A. Discussion and Committee recommendation regarding request from Kern County
for the City of Bakersfield to provide sewer services to the Rexland Acres
neighborhood
City Manager Alan Tandy provided an update. The City had requested $300,000 in
financial assistance from the County to help with the rehabilitation of Jefferson pool,
which is surrounded on three sides by County residents. The County's CDBG
funding for that district was committed to sewer related costs for Rexland Acres.
The County indicated if the City would allow Rexland Acres sewage to flow to the
City plant, that would free up the money from the Rexland Acres sewer project and
they would be able to assist with $300,000 for Jefferson pool rehabilitation. It is
cheaper to flow the sewers to the City plant. However the City's annexation
ordinance does not allow sewer hookups without annexation, so it would require an
intergovernmental agreement between the City and County.

David Price, Kern County Resource Management Director, stated the County had
applied for a USDA grant for the Rexland Acres sewer project. However, they were
not successful in this funding cycle. There is another funding cycle coming up and it
will be March 2003 before they know if they will get the grant. The USDA Grant will
fund up to $2 million. The County does not have a financial plan to proceed with the
sewer project without the USDA grant or. other similar funding. It would make the
grant application look more favorable if the possible City hookup were included.
It was discussed, as the grant is not yet funded, if the County and City were to agree
in concept, it could be sent to the City Council and the Board of Supervisors with the
contingency that if the USDA Grant or other grant funding does not come through,
we will have agreed only in prinCiple.
If the County is not able to secure the USDA Grant for the Rexland Acres sewer
project, City staff recommended an expiration date of June 30, 2004 for the sewer
connection to the City system, so the City will not be reserving plant capacity for
something that may never come to fruition. City staff felt if the County is not able to
get any grants for the Rexland Acres Sewer project and it does'not go forward, that
wOuld, s~ill free up the CDBG funds for that~ Supervisorial District to be used for the
Jefferson ~pool rehabilitati-on.
As HUD precludes funding Community Development Block Grant projects after they
are under way, the City would need a commitment on the $300,000 for Jefferson
pool rehabilitation in advance. Without the $300,000 from the County-to help with
Jefferson pool rehabilitation, the City will have to come up with the money from
another source or reduce the scope of the project.
Committee Member Hanson made a motion to forward a recommendation to the
Council for the City to agree in concept with the County that the City will allow
Rexland Acres to hook up to the City's sewer system and the County will cOmmit
$300,000 to the Jefferson Park .pool rehabilitation with the following terms: (t) six
months (January 2003) for the County's commitment to the Jefferson pool project
and (2).the Rexland Acres sewer project must begin before or not later than June
30, 2004 or-the agreement will expire. The Committee unanimously approved the
motion'.
5. NEW BUSINESS
A. Discussion and Committee recommendation regarding Kern Economic
Development Corporation (Kern EDC) request
City Manager Alan Tandy explained that earlier in the year, Kern EDC (KEDC)
requested $150,000 from the City. The City's historic contribution has been about
$60,000 plus the incentive program of up to $40,000. Bakersfield was one of the
founding members and a leader in the formation of KEDC. For many years we were
the largest financial contributor. A few years ago KEDC started receiving a
substantial amount of Welfare to Work monies from the federal program. The
funding to KEDC from the Welfare to Work program has been discontinued.

The Committee reviewed the incentive .payments to KEDC from 1998-99 to .present,
which were paid for job creation. The significant statistic was that in 2001-02 there
was no incentive 'money earned for job creation.
The City Manager summarized Mayor Hall's July 1'5, 2002 memo to the Budget and
Finance 'Committee. (Due to the Brown Act, the Mayor cannot participate at the
Committee level.). Essentially, the Mayor recommended the City 'grant $60,000
(actually the budgeted amount is $50,000) and treat it as a one-time circumstance to
set up goals for-performance expectations with the understanding that next year, if it
is another year with no job-creation, there would be no further automatic renewals of
the agreement.
The Committee reviewed .data on economic developfflent achieved in the smaller
cities, which contribute much less than Bakersfield. The City Manager expressed

contribution. Bakersfield has 35 percent of the County population~ and deserves
more emphasis and a substantial number of job creations in our community. The
City contracts With KEDC essentially for a job creating entity for Bakersfield and it
should be incentive based on job creation. It was discussed it is necessary to
participate in KEDC at some level because of California Trade and Commerce
referrals. They will only provide relocation le.ads to a regional EDC.

is KEDC's r~equirement and role to be a single point contact and basically to find the
requirementS' of the company.and possible locations. They start with a list of cities
for the region and then get all the opportUnities on the table. However, KEDC does
not have any control over where prospective businesses decide to locate. He stated
he is not opposed to an incentive based performance contract, but does not want to
become a broker.
Committee Member Maggard stated the reality is if companies look at the whole
region and .KEDC cannot influence the location, there is nothing there that should
make us pay more that anyone else pays. It is a level .playing field if it is not affected
by our geographic area or our population. It seems if $10,000 is the going fare,
Bakersfield should pay $10,000. An incentive .program, which would create jobs, is
a good concept. If we do not spend the dollars at KEDC, then should we spend the
money through ED/CD attending tradeshows to try for results?
Economic Development Director Kunz explained ED/CD focuses on redevelopment
projects and development support packages. Staff does not attend tradeshows and
our materials are outdated. She spoke about KEDC and explained most economic
efforts are regional. However, other regions offer different tiers of services and you
pay accordingly for the tier of service you want. She recommended a flat rate and
the City should have the option of choosing the services. This would allow KEDC to
know exactly what level of service is expected. Most developers use the Internet
and all the Cities are listed with what they have to offer and the type of industries
that are coming there. With the tier system, all cities are equally represented and
not working against each other.

Committee Member Hanson stated he is somewhat sympathetic as he has served
on the KEDC board. He likes the idea of incentives. He was not comfortable with
reducing the City's 'contribution to KEDC to $10,000 and thought the City should go
with $50,000 for this year and have the City Manager look at some incentive
program over the next 12 months to use next year. With an incentive program in
place if there is no job creation, We could reduce the City's contribution to $10,000 or
$20,000 for next year.
Committee Chair Maggard requested the City Manager to come back at the next
meeting with funding options other than a reduCtion from $60,000 plus the incentive
to a City contribution of $10,000 for this year.

SUBJECT: KEDC Contract
At the last Committee meeting, the issue of the contract with KEDC was-discussed. In
short form, the.City has a longstanding history of support for the organization and the
goal of job creation. Nonetheless, incentives have not been eamed for job creation
within the City, at an acceptable level, for the last two years.
' David Lyman and I met with Pat. Collins and a KE~)C Board member since the last
Budget and Finance meeting. Viewpoints were openly shared. It is fair to. say that my
office' has a fundamentally different view of the roles and responsibilities of KEDC than
those of Mr. Collins.
We have done some preliminary research into how other cities structure their contracts.
Summary
Staff is not yet prepa_red to make a recommendation on this matter, other than to
request another month to think over-options and alternatives.

Tejon Ranch. We wanted to take this opportunity to update you on some of our activities
over the past year, as well as the future goals of the Kern EDC.
To give you a snapshot of our successes in the past year and our plan for the future, we
have produced an annual report, which is enclosed with this letter. The report recognizes
our 2001-2002 Board of Directors and introduces our 2002-2003 Board members. It also
includes a current investor list and a general overview of our accomplishments for the
past year, as well as an outline of our strategy for tackling our new challenges. In
addition to the Annual Report, you will find our 2002 Business Directory enclosed for
· your reference. This directory includes valuable contact information for our investors,
partners and board members as of July 2002. We hope that you will take a moment to
review these publications and accept our thanks for your support in growing the local
economy.
As many of you are already aware, the Kern County Department of Human Services
contract ended as of June 31, 2002. The Department of Human Services is facing
significant funding changes and therefore is no longer able to continue their contract with
the Kern EDC. ·With the loss of this revenue, we will need to intensify our focus on
private business investment. Despite these financial challenges, the Kern EDC is looking
forward to another successful year, attracting more businesses to Kern County and
continuing to support existing businesses in the industry clusters.

SUBJECT: Economic Development loan Policy Guidelines
In response to a request from the Budget and Finance Committee for loan guidelines, the
following proposal is submitted. These proposed guidelines provide a frame work to evaluate
requests for financial assistance, qualifications for prospective borrowers, criteria for protecting
the taxpayers' investment, and justification for conducting a cost-benefit analysis. By making
funding decisions based upon these guidelines, loans made by the City of Bakersfield should
reap greater results and a higher return on the community's investment.
PROPOSED LOAN POLICY GUIDELINES
1) Basic tenets
a) The City of Bakersfield is a funder of last resort.
b) The City of Bakersfield will only provide gap financing.
c) Repayment begins immediately (nothing less than annual payments). No balloon
payments.
d) Projects must meet the "but for" test: the applicant must demonstrate the
proposed project cannot succeed but for City assistance.
2) Qualifications
a) A completed loan application with all required attachments must be submitted.
Our clock begins ticking only when a completed package has been submitted.
b) 'Determination of sound credit position of borrower(s).
c) A proven ability of borrower(s) to repay.

3) Criteria
a) Security (collateral) must be,
i) equal to or greater than the amount of the loan.
ii) in a form acceptable to the City of Bakersfield (preferably real estate).
b) The proposed project must demonstrate the ability to (at least one),
i) create jobs.
ii) retain jobs (defined as those that would be lost "but for" this assistance).
iii) reduce blight.
iv) spur revitalization.
v) increase tax revenue.
c) The borrower(s) will accept the City's efforts to protect the community's investment
in the proposed project through one or all of the following:
i) clawback (recovery of all or part of the subsidy costs if the project fails to
meet performance criteria).
ii) penalty (fines or charges for non-performance or relocation).
iii) recalibration (adjustments to the amount of the subsidy to reflect changing
business conditions).
d) The responsibility for maintaining the property rests with the property owner and
will run with the property.
4) Cost-benefit analysis
a) Identify all costs:
i) cost of the loan amount.
ii) cost of interest that the City could be earning on funds if the funds were not
used as loan proceeds.
iii) time value of money - the cost to the City of Bakersfield of not having the
use of the funds.
iv) loss of tax revenue, if any.
v) any negative impacts (direct or indirect) to our area's existing businesses.

vi) assistance will not diversify our local economy, if applicable.
b) Identify all benefits
i) monetary
(1) increase in property tax revenue, if any
(2) increase in sales tax revenue, if any
(3) increase in business license revenue, if any
(4) increase in other tax r~eyenue, if any
ii) non-monetary
(1) assistance will positively directly impact our area's existing businesses.
(2) assistance will diversify our local economic base.
(3) assistance will play a pivotal role in strengthening existing clusters or
forming new clusters in our area.
c) Evaluate the following to determine whether the proposed use will result in a cost
or a benefit:
i) the business will produce a product for export outside our area.
ii) the quality of the jobs to be created.
(1) benefits.
(a) the percent of jobs to be created that will provide benefits.
(b) how the benefits provided by the new jobs compare to those
provided-by others in local industry.
(2) wage rate.
(a) the wage rate of jobs compared to others in local industry.
iii) whether the business will target iow- and moderate-income individuals for
employment.
d) are other types of government assistance received by the borrower(s)?

SUBJECT: Charter/Code Requirements for Street Maintenance/Repair
QUESTION
Does the Charter or the Bakersfield Municipal Code ("Code") require all street
maintenance/repair projects be awarded by contract pursuant to bidding requirements,
even when being performed by City forces?
ANSWER
No. The Charter contains an exception for street maintenance and repair and
the Code provides the process authorizing such work to be performed by the City.
ANALYSIS
Initially, resurfacing, maintenance and repair of streets legally is included in the
definition of "public works." Section 136 of the Charter (Public Work-to be Done By
Contract) provides, in pertinent part: "... The City Council shall establish, by ordinance,
· . . requiring biddi_ng and award of a contract, if awarde, d, to the lowest responsible
bidder submitting a reSponSive bid." The section continues, in pertinent part: "Projects
for the resurfacing, maintenance or repair of'streets, drains o-r sewers are exempted
from the-requireme_n_ts of this paragraph, if the city council determines that such work
can be performed more economically by a city department than by contracting for the
doing of such work."-
Pursuant to the above charter limitation, the City Council adopted Section
3.20.060 of the Code, which provides the process for bidding associated with public
works projects. In accordance with the attendant charter authorization, the City Council
adopted Subsection D, which contains multiple exceptions to this bidding process. The
pertinent provisions of this subsection are as follows:

the procedures prescribed in this section and Section 136 of the city
charter..

1 .... projects for the improvement, repair or maintenance of all public
buildings and works, and for furnishing any supplies and materials for the
same if provided for in the council adopted budget, may be performed by a
city department.., as determined by the city manager to best serve the
needs of the city.
Thus, the City Council complied with the Charter by enacting the appropriate
ordinance allowing for an exception to the bidding process for maintenance/repair of
streets when performed by City forces. Further, the City Council placed a limitation on
such activity by requiring such work must have been approved in the council adopted
budget. The argument has been raised that the Council must approve each project
individually. However, this contention has no merit as the action of the Council in
adopting the ordinance, combined with the ordinance requirement for the approval via
the council adopted budget, results in a lawful delegation of such individual project
approval responsibility to the city manager.
