A. BID APPEAL PROCESS
Staff presented the Committee a draft of the revised ordinance relating to the
determination of responsible bidders and bid protest. The Committee had
concerns regarding some of the definitions, content and language in the
revised ordinance. The Committee instructed staff to further research and

refine the draft ordinance and bring back to the next Budget and Finance
Committee meeting.
6. NEW BUSINESS
A. COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) ACTION PLAN
FY 1998-99
Staff provided an overview of the Community Development Block Grant
(CDBG) fiscal year 1998-99 action plan. The Action Plan will require a
30-day public notice and comment period. Staff would like to submit the
CDBG application to the Housing and Urban Development Department
(HUD) by May 16, 1998.
Public comments were made by a representative of Kern County Economic
Opportunity Corporation (KCEOC) requesting consideration for funding for
rehabilitation of a kitchen to be used by the Headstart Program. A
representative of the Bakersfield Homeless Center requested consideration
for Emergency Shelter Grant (ESG) funding to assist with operations at the
Homeless Center. Also, a representative of the Kenya Community Center
requested consideration for assistance to acquire property for development
of a training center in Southeast Bakersfield Lakeview area. In addition,
Committee member Carson requested staff to consider using CDBG funds
for emergency roof repairs at the Bakersfield Senior Center.
Committee member McDermott directed staff to continue discussions with
Kern County relative to annexing the area surrounding the Kern County
Health Department as a condition of the City providing financial assistance
to the County to construct a new health facility.
The Committee authorized staff to initiate the 30-day public review process,
publish the public notice and move forward with the CDBG application
process for fiscal year 1998-99.
B. KERN COUNTY MUSEUM AUTHORITY BOARD CONTRIBUTION
REQUEST
A representative of the Kern County Museum Authority requested the City
of Bakersfield share in the cost of consultant services for master planning the
Metropolitan Recreation Center. This master plan will ultimately lead to the
expansion and development of the Kern County Museum area and integrate
it into the surrounding community. The Committee determined that they
could support a contribution to the master plan project as long as the entire
City Council received an opportunity to review and approve the full master

plan. The Committee requested a letter from the Kern County Museum
Authority giving the City Council authorization to review the master plan. The
Committee directed staff to examine the use of CDBG and or Council
Contingency funds for the City's contribution to this project.
C. BUDGET AMENDMENTS FOR THE PERIOD JUNE 30, 1997 THROUGH
JANUARY 1, 1998
The Committee briefly reviewed the budget amendments for the period of
June 30, 1997 through January 1, 1998. The Committee deferred action on
this item until staff provides additional research on the appropriation of funds
for the traffic signal design located at 24th and Beech Streets.
D. MEADOWS FIELD AIRPORT TERMINAL FUNDING
The Committee discussed the use of one-time funds from the sale of Elk
Hills as a possible City contribution to assist with the construction of a new
Kern County Airport Terminal. The Committee discussed challenging the
County to keep Meadows Field Airport as a high priority project. The
Committee directed staff to prepare a resolution in support of the project and
place the City's contribution into the City's long-term capital improvement
program. Also, staff was directed to contact the Kern County Airport Chief
Mr. Ray Bishop and request a workshop or presentation to the City Council
on the project.

SUBJECT: Signal - Beech Street at 24t~ Street
Staff was instructed by the Budget and Finance Committee to provide additional
background information regarding the approval of the above project. The design phase of
the project was included as part of the Public Works Department budget modifications to
the fiscal year 1997-98 capital improvement program. Staff research indicates the design
for the signal at Beech Street at 24"~ Street was approved at the Council meeting of August
6, 1997. The project is proposed to be constructed in fiscal .year 1.998-99.
Attached for the Committee's review is the Administrative Report of August 6, 1998,
the Council minutes from the meeting of August 6, 1998 and the minutes from the Urban
Development Committee meeting on September 17, 1998.

RECOMMENDATION: Staff recommends approvaj of the Fiscal Year 1997-98 Capital Improvement
Program Budget as modified.
,-,ACKGROUND: Late in the budget process for the Fiscal Year 1997-98 Capital Improvement Program. several
developments occurred that would require modifications to the 1997-98 Capital Improvement Program. Among these
developments was the State approval of the Q Street Separation or` Grade Project. and t'he resulting desire to accelerate the
development of this project to enhance circulation in the area. .Another maior development was staff being recently
irLformed by Kern Council of Governments (Kern COG) that the City of Bakersfield is scheduled to receive approximately
5500.000 additional ISTEA/STP Federal funds for eligible street projects. Substituting these additional funds for gas tax
funds on several proposed CIP projects allows the l~cal share portion Ibr the construction of the Q Street Separation or'
Grade to be budgeted in Fiscal Year 1997-98 without the loss of any currently proposed CIP projects. Based on these and
other recent developments, the Public Works Department recommends the followin* chan,~es to the proposed Fiscal Year

completion of the Convention Center Expansion.

This traffic signal would allow safer access from the portion of Westchester north of 24'~ Street to the portion of

in a safer manner. The FY 97-98 portion of the project would be only for the design of the project, with construction
~nding proposed for FY 98-99. The funding for FY 97-98 is recommended bv staff to be budgeted from existin~ Gas
Tax Fund balance. - -

construct the project in one phase.
Project No. EbK035 Storm Improvements Terrace Way
Budgeted Amount: Current- $206,000.00 Proposed - 50
This project was proposed by the Engineering Division last November as a CDBG project. In April, the Community
Development and Economic Development Department concluded that other projects had hither priority for the use o'f
CDBG funds. As a resuit, Public Works understood that the project would be dropped from~the 1997-9~ CIP pro,am.
But instead of deleting the project, funding of the project was evidently transferred to the Sewer Enterprise Fund. This
project was originally recommended primarily because the service area qualified for CDBG funding, not because of a
priority, based upon storm drainage problems. There are other areas throughout the City that have more serious draina~oe
problems than this area. and the Public Works Department recommends these areas should have priority for the limited
amount of Sewer Enterprise funds available for storm drainage installation each year.
Project No. T8K048 Street Construction Ashe/Panama -
Budgeted Amount: Current- S265,600.00 Proposed - 50
This project was to construct two lanes of .Ashe Road between Harris Road and Panama Lane. This project was funded
;th Traffic Development Fees. ,A Tentative Subdivision Tract ITract 5386) was recently approved in this area, and the

Public safety in and around apartment complexes be referred to

workshop and draft any necessary ordinances/resolutions
addressing issues from design to operation and management of
apartment complexes (Crime-Free Multi-Family Program); and
Police, Fire, City Attorney and Development Services review the
efforts at the Urban Development Committee meeting of August 13,
1997.
Rowles thanked Development Services Department for outstanding
service for a code enforcement issue in Kern City regarding

A. UTILITY STREET CUT PERMITS
Staff gave a report on the proposal for issuing street cut permits to reduce the frequent
cutting of City streets by various utilities. The proposal includes requiring a warranty
of work from franchise holders or charging a performance fee equal to the cost of
repaying the patch area if the street patch fails. The City will institute a street cut
moratorium after streets have been repaved. An infrastructure planning committee has

been formed between representatives of the city and utilities, to plan and coordinate
projects requiring street cuts and repaving projects. Finally, the length of street that
can be opened at one time is limited to 1,200 feet which is the minimum necessary for
effective work by utilities. Representatives of the utilities were in attendance and
supported the proposal. The Committee voted unanimously to recommend the item
to the Council for adoption, with Councilmember Pat Smith absent
B. PARK DEVELOPMENT FEES
Staff presented the final draft of the proposed Park Development Fee which changes
the standard park on which the fee is calculated from a 6 acre park to a 10 acre park.
The fee calculation method is also changed from a graduated scale based on the
average number of residents for different types of dwelling units to a fiat fee based on
a single weighted average of residents per dwelling unit. The new method takes the
park costs per person and multiplies it times the weighted average persons per
dwelling unit to come up with a single flat fee. This resulted in a decrease in the fee
for single family units and an increase in the fee for multi-family and mobile home
units.
The BIA indicated that it did not support the flat fee because it penalized multi-family
developers by increasing the cost to build this type of housing. The Committee asked
if we could give a higher fee credit as greater incentive to developers to address the
~ recreation and park needs of their development on site, in order to offset the increased
i fee. Staff indicated that the City currently gives 7/10 of an acre credit for land used
within the multi-family development to address recreation needs. The Committee
asked staff to look at increasing the credit. This will be discussed at the next Urban
Development meeting. The Park Development Fee proposal was unanimously
recommended by the Committee to the City Council for approval, with Councilmember
Pat Smith absent.
6. NEW BUSINESS
A. METROPOLITAN TRANSPORTATION INVESTMENT STRATEGY (MTIS)
A representative of Barton-Aschman Associates, the consulting firm hired to develop
the MTIS, gave a presentation on the draft action plan. The plan prioritizes both
funded and unfunded surface transportation projects in the metropolitan area. The
highest priority unfunded project is the Crosstown Freeway. The consultant indicated
that a comprehensive study like the MTIS may help in procuring federal funding for this
and other identified projects. The plan will be updated on an annual basis to reflect
changes in funding and priority. The Committee felt that air transportation should be
addressed in future updates. Staff expressed ongoing concern that the County has

refused to contribute to the funding of the grade separation for the Kern River Freeway
project, which could jeopardize the state funding. Staff will continue to update the
Committee on the ongoing development of the Kern River Freeway funding. The MTIS
will be discussed at an upcoming Council Workshop.
B. 24TM AND BEECH TRAFFIC SIGNAL
The City's Traffic Engineer has studied this intersection at the request of residents in
the area. Staff does not recommend closure of Beech onto 24th as requested by
residents, due to the anticipated increase of traffic onto neighboring streets that would
result. In addition, staff has concerns about the traffic circulation impacts that would
result from a traffic signal. Design of a traffic signal at that location 'is budgeted in the
FY 97-98 CIP. Staffwill continue to study this issue and bring other possible solutions
back to the Committee for discussion at a later date.

On June 25, 1997, the City Council adopted Resolutions No.110-97 and 111-97 which approved the Operating,_
Capital Improvement Program, and Central District Development Agency Budgets. Between June 30, 1997 and
January 1, 1998, Council has taken action to transfer and/or appropriate funds for specific services and as a
result, the respective budgets must be amended to reflect these changes for the last six months of the fiscal year.
The fiscal year 1997-98 Amended Budget is $267,044,690, with the Operating and Debt Service (which includes
the Community Development Block Grant) Budget totaling $185,171,062, the Capital Improvement Program
totaling $76,090,533, and the Central district Development Agency Budget totaling $5,783,095. A detailed
listing of the items approved by Council action, which amends the 1997-98 budgets, is attached.

WHEREAS, in accordance with the Charter of the City of Bakersfield and

I have two issues related to the Taxicab Industry in the City of Bakersfield which I feel need the
attention of the City Council for resolution.
A. Independent Contractor Status.
In 1977, the City of Bakersfield amended the existing City Ordinance to allow taxicab
companies to operate utilizing independent contractors as drivers.
Subsequent to this amendment, the State of California in 1993 notified all taxicab
companies that operation utilizing independent contractors was illegal based on a Santa
Cruz Appellate Court Decision. Verification may be obtained by contacting Mr. Paul
Wagner of the Employment Development Department Audit Section at #916-464-2500
ext. 353.
I am requesting the City Council amend the existing ordinance to conform to existing State Law
regarding independent taxicab drivers.
B. Issuance of Taxicab Company Licenses.
It has become apparent that the number and quality of taxicabs operating in the City of
Bakersfield needs some scrutiny.
In the past few years more and more companies with one to three taxis have been licensed
to operate in the City. According to the Police Department the oversight of these
companies has become increasingly difficult, thus allowing substandard equipment and
drivers to move about in our community. "
I am requesting that the Legislative and Litigation Committee make inquiries into this problem
to determine if there should be a limit to the number of companies and taxis operating within our
City.
In many cases visitors to our City form their first impression when they enter a taxicab at
Meadows Field or take a cab from their Hotel to our Convention Center / Sports Arena. Let us
give these visitors the best possible impression of Bakersfield.
In closing, I again respectfully request that these matters be referred for study and
recommendation to the Council Legislative and Litigation Committee.

ACCOUNTANT has completed one year of a five year commitment and has submitted a proposal
concerning an annual audit for the fourth year; and
2. Paragraph 3 of the Agreement is hereby amended in its entirety to read as follows:
3. COMPENSATION
Compensation for services under paragraph one shall consist of a total
payment not to exceed FORTY FIVE THOUSAND SIX HUNDRED DOLLARS
($45,600) paid in such increments, and upon completion to the satisfaction of the
CITY, of those items contained in ACCOUNTANT's Proposal.
At the completion of each of the items, all documents shall have been
completed by ACCOUNTANT, and shall be submitted to CITY by
ACCOUNTANT. Three copies of each document shall be included in the
compensation set forth herein. Upon the review and approval of CITY staff of the
ACCOUNTANT's work and submission of an invoice as set forth herein, the sum
stated above shall be paid.
The compensation set forth in this paragraph shall be the total
compensation for the services provided by ACCOUNTANT including all out-of-
pocket cost incurred by the ACCOUNTANT. CITY shall pay no fee other than
the compensation listed int his paragraph unless otherwise agreed to in writing by
the CITY and ACCOUNTANT.
3. Except as amended herein, all other provisions of Agreement 95-135(2)shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be
executed, the day and year first-above written.

Dear Mr. Tandy,
The Bakersfield S.P.C.A. is in need of a new animal control truck to be able
to adequately cover the. City's increasing animal control needs. The five
existing trucks are being stretched to the limit with the City's continuing
expansion, and especially so in new annexation areas with heavy animal
populations. Thus, we are asking the City to fund this one-time animal
control truck purchase which will be dedicated solely to the City's animal
control needs. A new animal control truck will cost approximately
$34,511.20.
When one of the existing trucks is being repaired, our officers must
double-up in the remaining vehicles which severely limits the area the
S.P.C.A. can cover while the vehicle is out of service, hinders our ability
to provide appropriate service to Bakersfield residents, and limits the
numbers of animals taken off the street. A new truck will greatly enhance
the S.P.C.A.'s ability to respond to service calls in a timely manner.
The S.P.C.A. will, as part of its on-going contract with the City, absorb the
cost of maintenance and replacement of the vehicle.
