A. Staff report and Committee recommendation regarding FY 2005-06 Cost
Recovery Development Related Fees
Brian Todd, Building Industry Association of Kern County, had contacted the
Committee just before meeting time and indicated he was not able to attend
today's meeting and requested the Committee to defer this item to the next
meeting.
Committee Chair Maggard made a motion to defer the Cost Recovery Fees to
the next Committee agenda, but indicated action must be taken soon because
the fee increases for these remaining fees cannot be collected until approved
by the Council. The Committee unanimously approved the motion.
The next Budget and Finance Committee meeting is scheduled for October
31st. Due to scheduling conflicts, the Committee requested staff to cancel the
October 31 st meeting and work with Committee members to try and set another
Committee meeting date.

B. Discussion and Committee recommendation on potential sale of the City
Airport
City Manager Tandy gave a brief report on a form (outline) of the required
information from the Federal Aviation Administration (FAA) Request for
Release (closure) document. Public Works Operations Manager Brad
Underwood and Public Works staff are working on compiling the required
information assuming it will return to the Committee for authorization to submit
it to the FAA. Also at Committee Member Carson's request, Economic
Development Director Donna Kunz and staff are working on an economic
development analysis proposal that would include the desired uses for the
airport property.
City Manager Tandy provided an overview of report information from 1984 and
1985 when the City Council was considering acquisition of the airpark using
FAA grant funding. The information provided a summary of the history
regarding the purchase of the airpark. The actual grant agreement was not
included, as the document is very thick and lengthy.
The City of Bakersfield holds title to the airport. However, when accepting
grant funding from the FAA, there were conditions in the agreement. If a sale
were approved, the conditions in the grant agreement require repayment of the
grant monies; however, the FAA has the right to waive or moderate repayment.
Public Works Director Rojas explained because the airpark was actually
purchased with FAA grant monies, it is somewhat different from getting grants
to fix up a property the City already owned. The language in the grant
agreement contained standard federal grant conditions and the FAA has
decision-making power over the sale of the airport, repayment of the grants and
the disposition of any profits that might be realized from a sale.
The Committee requested a summary of the federal grant agreement,
particularly pertaining to sale conditions.
Tony Smith, a tenant at the airport, spoke regarding other options or vacant
properties .to revitalize the area and promote economic opportunity around the
airport rather than closing and selling the airport.
Joe Campen, an airport tenant, spoke in agreement with Mr. Smith's
suggestions and in support of keeping the airport open.
Committee Member Carson explained the airport flight path limits growth, and
the citizens in the area would like to see economic development, new job
creation, schools and affordable housing.

Committee Member Hanson expressed there are two basic questions, which
need to be answered: 1) Will the FAA approve the sale of the airport? and 2) Is
there a well-qualified buyer, with the financial capability to purchase the airport
at an acceptable price? If a sale is approved by the FAA, and the City has a
buyer, there are other expense issues to resolve, such as runway removal,
environmental issues and relocation of tenants.
Committee Chair Maggard asked staff about whether the FAA has approved
the sale of any municipal airports in the Western Region.
Public Works Director Rojas reported the one approved airport sale was a
privately-owned airport with no FAA funding attached to it: There have been no
closures of airports that have been sponsored with FAA grant funding.
Committee Chair Maggard asked staff to report on the steps staff would need to
take to request a closure of the airport.
City Manager Tandy responded staff is working on the two initial items to bring
to the Committee for review: Public Works staff is compiling the required
information for the FAA Request for Release (closure) document and in concert
with that Economic Development staff is working on an economic development
analysis proposal.
Committee Chair Maggard recommended staff complete the package of
information and bring it back to the next Committee meeting. The Committee
unanimously agreed.

Most of the units identified in the study reside in predominately low income
neighborhood. The neighborhoods adjacent to the Airport are plagued with
examples of this need. The neighborhood also suffers from lack of medical
and educational facilities. In 1999, the City formed the Southeast
Redevelopment Project Area with the goal of stimulating economic
development, encouraging new private and public investment, facilitating
improvements to deteriorating infrastructure and creating new affordable
housing opportunities. The blighted housing conditions and absence of
medical and educational facilities would be addressed adequately if the area
was provided the opportunity of a new large scale development and its
generation of various school and other associated f~tk~ersfield College

airport are classic brownfields and redevelopment. You can find several auto

underground fuel tanks. The area also has many underutilized lots and
incompatible land uses. The poor economic conditions and demographics of
the area are demonstrated by the area being within a'designated
Redevelopment Project Area. A housing market study of the Bakersfield area
estimated 10,324 housing units are in need of some type of rehabilitation.

SUBJECT: Curbside Recycling Rates - Council Referral #1313 to the
Budget and Finance Committee
In preparation for the Budget and Finance Committee meeting on November 7th,
here are some things to consider in addressing the recurring interest in improving
curbside recycling participation. There are two types of "extra" refuse carts -
those that are charged as additional to the basic service, and those that are free
in exchange for unused green carts:
A. Additional char,qed carts vs. rec¥clin.q carts
1. Additional refuse carts cost the City $76.08 per year, but residents pay
only $51.52 per year. In 1995 the Budget and Finance committee chose
to subsidize the rate in order to help large families get by when the new
refuse cart program started. The subsidy is $24.56 per year.
2. Only 2,844 out of 70,000 homes in the City pay for additional carts.
The subsidy amounts to about $70,000 (2,844 homes x $24.56), or abOut
$1 per year for all the homes to subsidize the oneS with extra trash. Many
of these customers frequently run delinquent on the bill, causing extra
costs of bill collection.
3. Recycling carts cost $80 per year, and residents pay the entire amount.
There is no subsidy. The option of additional refuse carts could be
eliminated, replacing them with recycling carts. Then, one of three
approaches could be used to deal with the rate difference:
a. The rates could remain the same, which would cause the existing
blue cart customers to complain about paying $80 while the others
pay only $51.52 for the same service.
b. The homes which now pay $51.52 could be made to pay the full
$80. They would protest that as well as the fact that their new blue

cart only gets picked up every other week, versus their old extra
refuse cart getting picked up every week. But since they are the
ones with the most trash, it may be desirable to induce them to
recycle and pay their fair share. If the size of the household
prevents them from affording the $80 recycling service, they can
simply use the free drop off recycling centers and not use the extra
cart.
c. The current $70,000 subsidy for extra refuse carts could be spread
over the 6,144 customers (2,844 with extra trash + 3,300 with blue).
This would result in a new rate of $69 per year for recycling, instead
of the current $80 rate. The option of paying for an extra trash cart
would then be taken away. The $69 rate would essentially cover
the cost of operation and billing for the blue cart service. Only the
cost of the container pumhase would be subsidized. To avoid
conflict with Proposition 218 law, the current $70,000 subsidy from
refuse rates for extra carts would be redirected to the drop off
centers, and grant funds from the drop off centers would in turn be
redirected to the curbside program. Drop off centers are for use by
all residents, which is a requirement for services funded by fees
under Proposition 218.
B. Exchanqed carts vs. recyclin.cl carts
1. Exchange carts may be issued where a resident states they have a
gardener removing their greenwaste. The resident then has two refuse
carts only. About 4,482 out of 70,000 homes use this option. There is no
change in billing for the resident or the hauling contractor with green carts
exchanged for refuse carts
2. In order to provide blue carts in lieu of those green carts exchanged for
extra refuse carts, there would be extra costs to cover. The "exchange"
refuse carts do not require extra truck driving distance, while the blue carts
often do. Negotiations and amendments may be needed in both of the
separate refuse and curbside recycling hauler contracts to consider
exchanges of green carts for blue ones.
Aside from the topic of extra carts, some other possibilities for helping the
curbside program exist or have been tried:
1. Several promotional efforts for curbside recycling have been made,
including discounts for new signups and giving away gift certificates
through various organizations. These efforts have resulted in very few
new signups. The most common feedback is that the price of recycling
should be lower, and/or that it should be included in the refuse rate.

2. The City gets a routine grant every year (based on beverage bottle
deposits) that partially offsets the cost of the drop off recycling center
program. This grant funding could be either partly or wholly diverted to the
curbside program, with minor impact on refuse rates to keep the drop off
program intact.
3. Staff applied for two other one-time state grants this year to offset the cost
of curbside recycling. Unfortunately, the grants were not awarded.
4. As a long shot, the landfill closure fund may have significant savings after
the project is completed. Perhaps this could boost the curbside program if
and when the savings result.
5. Another long shot would be to get the County to level the playing field and
rebate part of the annual residential landfill fee for the homes that use
curbside (arguing that they put less trash in the landfill but pay the same
fee as all the other homes).
In the future, the City may need to implement mandatory curbside recycling for
either of two reasons. First, the development surge is making it hard to stay at
the required 50% goal. Second, new legislation is pending to increase the goal.
Mandatory curbside has the potential to yield about 4 to 5% recycling.

Regarding Purchasing Limits and Formal Bidding Process Requirements
The Main Issue:
The Bakersfield Municipal Code (BMC) requires the use of a formal bid process and
City Council approval of agreements over $25,-000. These processes have the affect
of slowing down the purchase process to ensure a fair and equitable procedure is
followed and that the City is getting the best price possible for materials and supplies.
We have run into a couple of situations recently where the slower process has
become a practical problem from an operational viewpoint.
Example #1: Fuel costs have risen to the point where sometimes it costs more than
$25,000 to fill up one of our larger storage tanks. Normally, City staff would obtain
three telephone quotes (or e-mail) for a fuel delivery, pick the Iow cost quote, and the
fuel is delivered the next day. If we were required to do a formal bid process (3 to 6
weeks) and take a contract to Council for approval (another two weeks) tanks would
run dry and operations would shut down, which is obviously unacceptable.
Example # 2: We recently had to follow the formal bid and council approval process
to purchase a large circuit breaker for one of our wastewater generators. The item
was about $28,000. Since this was a backup piece of equipment it was not
considered an "emergency" purchase, so we followed the formal process, which took
about six weeks to complete.
Example # 3: We recently had both an asphalt vendor and a concrete vendor cancel
their annual contract because they could no longer hold to the contracted prices due
to rising construction costs. Under the current rules we would immediately begin the
formal process of getting new bids and a new contract in place, but during the six to
eight week lag time we would be limited to small quantity purchases of $25,000 or
less to try and handle existing projects.

Recommendations.
We are recommending that the dollar threshold for both the "formal bidding" and the
"formal contract" procedures be raised from $25,000 to $75,000. This action would
require a change to the Municipal Code sections and, as a practical matter, would
mean that only bids and contracts over $75,000 would come before the City Council
for approval.
There would still be a structure in place for making purchases and departments
would still be held accountable to continue with a written bid process, obtaining three
quotes whenever possible, and selecting the lowest responsive bidder; all in
accordance with our open market procedures currently in the Municipal Code.
Our hope is that by making this change City staff can respond faster to fairly routine
operational issues while still maintaining adequate internal controls to ensure public
funds are being spent wisely and costs are kept as Iow as possible.
A survey of other cities formal bid limits is attached for your review and comparison.
One County and three Cities have limits of $100,000; two Cities are at $50,000 and
the remainder of the agencies surveyed are at $25,000 or less. We also reviewed
the construction cost index figures from 1997, when the $25,000 level was
established, to 2005. The index shows construction costs have risen about 28%
during that time. If you were to apply that index to the current $25,000 level, it would
imply the limit should be raised to about $32,000.

On September 7, 2005 the City Council approved a Resolution (# 204-05) authorizing
the Finance Director to dispense with formal bidding procedures for items such as
"oil, gas, asphalt, cement and other oil or construction related materials" needed for
normal operations of the City for the remainder of the 2005-06 fiscal year.
This action was a "stop gap" measure to allow City operations to continue without
undue delays, until such time as we could formally address some of the issues
associated with formal bidding requirements.
The Bakersfield Municipal Code (BMC) Section 3.20 provides a structural outline
regarding the purchase of supplies, equipment and materials. This outline includes
discussion regarding dollar thresholds related to "formal bidding requirements" and
"formal contract procedures". The current rule is that any item with an estimated cost
of over $25,000 must go through a formal bidding process and be approved by the
City Council via a formal contract procedure.

The formal bidding process is a relatively slow process, which generally takes three
to six weeks to complete. There are also additional costs involved regarding staff
time, document preparation, and public noticing requirements. Additionally, the
Council agenda process creates additional timing issues that slow down the
acquisition of equipment and materials.
We fully support the formal bidding process and believe it protects the City and the
public funds we administer, but do not believe it should negatively impact routine
.operational matters.
