SUBJECT: PROPOSED FEES FOR 1998 CALENDAR YEAR
UTILIZING COST RECOVERY STREAMLINING METHODOLOGY
Attached per the Budget and Finance Committee request, is a sample of cost recovery
fees proposed for calendar year 1998, utilizing the new methodology developed by the
Cost Recovery Streamlining Committee. Please note that in more than 98% of the fees
there are no significant increases or decreases proposed which will negatively impact
revenues. The Fire Department has proposed some new fees which are substantial and
Development Services have proposed some substantial increases to existing fees,
however, the increases are not due to the change in methodology.
The Budget and Finance Committee also requested a brief description of the new
methodology developed by the Cost Recovery Streamlining Committee. Basically, to
calculate the cost for each service center, the direct labor hours involved with providing the
service is multiplied by the hourly pay rate of the employees providing the service. Next the
fringe benefit rate is applied to the direct labor costs to calculate labor plus fringe benefit
costs. Add any direct operational costs for supplies or vehicle rental, etc. to that base
figure. Then a flat administrative overhead rate is applied to the new base figure to give
us a total cost of the service. If any cost of living or other adjustment for market conditions
is applicable, it is made at this point in the calculation to arrive at total adjusted cost of the
service. The total cost figure then is divided by the total number of units of services
anticipated to arrive at the proposed fee. A sample of the fee calculation for vehicle code
enforcement unlicensed towing is attached for your review.

Staff recommends City Council refer the matter to the Budget and Finance Committee for further
consideration.
CKGROUND:
On January 22, 1997, the City Council directed Economic and Community Development Department staff
to provide an economic trend analysis of two potential redevelopment areas. Staff subsequently
contracted with HdL Coren and Cone to develop an analysis of economic trends in assessed valuations
from 1988 to the present, and prospectively to the year 2006 in two areas of Bakersfield. The general
boundaries of the two areas are as follows:
Southeast Bakersfield - East California Avenue on the north, East Pacheco Road on the south,
Washington Street/Mt. Vernon on the east, and Union Avenue/"H" Street on the west; and
East Bakersfield - State Route 178 on the north, California Avenue on the south, Beale Avenue On
the east, and Union Avenue on the west.
The draft analysis has now been completed. Using data provided by the Kern County Assessor's Office,
the consultant's approach was to analyze historical property tax data from FY 88/89 through FY 96-97, a
nine-year period retroactively. Based on trends obtained from the historical data, the report then estimates
future growth in property tax revenue in the study areas from FY 97-98 through FY05/06, again a nine-year
period prospectively.
The report assumes that historical growth trends will continue at the same or similar rates in the future.
Furthermore, an assumption is made that no future projects will occur in either of the study areas. Thus,
the possibility that major project development, property demolition, or tax exempt acquisitions might occur
in the future'is not reflected in the report methodology. In calculating future property tax trends, the
consultant used three separate approaches. The first and most conservative is the limit of annual inflation
adjustment to property tax allowed by Proposition 13. The second approach uses the historical average
percentage increase in property tax. The third approach uses the compound percentage increase from

FY 88-89 through FY 96-97. Also, in estimating future property taxes for the study areas, the report
figures under the line "Available Tax Revenue" are net amounts after Housing Set-aside and AB 1290
Pass-through moneys are deducted.
In summary, the consultant has indicated the following economic trends for the two areas:
Southeast Bakersfield
A review of the historical data indicates considerable fluctuation in the annual percentage change in
assessed valuations, from a high of 10.87% in FY 94/95 to a Iow of .71% in FY 96/97. The report presents
the three scenarios mentioned previously to estimate future property tax growth over the next nine years.
The first scenario uses the annual inflation adjustment to property tax allowed by Proposition 13 of 2.00%.
The second scenario uses the historical average percentage increase in pr°perty tax of 2.67%. The third
scenario uses the compound percentage increase from FY 88-89 through FY 96-97, which is 2.45%.
The report indicates that by using the most conservative scenario-in this case the annual inflation
adjustment of 2.00%--the Southeast study area could expect $38,000 of annual property tax revenue in
FY 98/99, the first year property taxes could flow back to the Agency; $328,000 of annual property tax
revenue in FY 05/06, the end of the future study period; and $1,442,000 cumulatively over the entire future
study period. The most lofty scenario using the average percentage growth rate of 2.67% could expect
annual property tax revenue of $51,000 in FY 98-99, $452,000 in FY 05/06, and $1,970,000 cumulatively
over the future study period.
The report concludes that average historical growth experienced in the Southeast study area (2.67%) is
less than the County (4.02%) for the study period. Furthermore, the Southeast study area showed growth
over the period, and the area does not appear to be stagnant.
East Bakersfield
Again, the analysis of the East Bakersfield study area provides three scenarios that use assumed growth
rates to estimate future property tax growth: the annual inflation growth allowed by Proposition 13 of
2.00%, the historical compound growth of 2.16%, and the average percentage growth of 2.19%. Based
on these assumed growth rates, the report finds that estimated property taxes in FY 98-99 would be
approximately $13,000 in each scenario. By FY 05/06, the last year of the future study period, estimated
annual property tax revenue would reach $105,000 using the inflation growth scenario of 2.00%, and
$116,000 using average percentage growth scenario of 2.19%. Cumulative property tax revenue over the
future study period is estimated at $463,000 using the inflation growth scenario of 2.00%, and $509,000
using the average percentage growth scenario of 2.19%.
The report concludes that the East Bakersfield study area has had virtually no growth in assessed
valuations since FY 93/94, and the area's values are currently below what they were for FY 94-95. Also,
the area's secured property values are stagnant and have depreciated over the last two years. As is the
case in the Southeast study area, historical average growth experienced in the East Bakersfield study area
(2.19%) is less that the County (4.02%) for the study period.

Cost Considerations
Three major cost elements are involved in implementing the proposed redevelopment projects areas: 1)
establishment costs, 2) operating costs, and 3) personnel costs. If it is decided that the new project areas
are to be formed, $100,000 of CDBG funds have been budgeted to pay for establishment costs. We have
expended $10,000 thus far to complete the feasibility study, leaving $90,000 remaining for establishment
of one area. Staff estimates that the cost of establishing each new project area is $100,000, which means
that an additional $110,000 would be required if two areas were to be established. All establishment,
operating, and personnel costs can be constituted as debts of the Agency, and future tax increment
revenue may be used to repay those costs if new project areas are formed.
Staff estimates that increased operating costs in the first year of the new project areas would be $22,969,
which 'includes auditing services, consulting services, insurance, advertising, printing, telephone, training,
office expenses, and appraisals. This total includes expenses for compliance and financial reports
associated with two proposed project areas. Although we do not anticipate large operating increases in
future years, increases would be determined by the level of activity in the proposed project areas.
Increased project or development activity in the new areas would also produce additional offsetting tax
increment revenue to'cover increased operating expenses.
In the area of personnel costs, a number of city staff would need to be committed to the establishment
process. During establishment of the new project areas, no additional staff would need to be hired.
However, the following existing staff members would need to commit a percentage of their time to
establishment activities in FY 97-98: Department Director, 30%; Development Associate, 50%; Principal
Planner, 20%; and Business Manager, 15%. The total of these proportional staff costs is $91,599, which
would be incurred only in the first year in which the proposed areas are established. These costs would
be paid for from the existing department budget, but could be repaid from future tax inCrement revenue
generated from the new areas.
Upon formation of the proposed areas, any additional staffing that may be required by the Agency is
difficult to quantify until a measurable level of activity has been established in the project areas. We
estimate that no additional staff would need to be hired in FY 98-99, the first full year of the proposed new
areas. However, as project activity increases we estimate that.two additional positions would be needed
in year two and three of the new project areas' existence: one (1) new Principal Planner in year two (FY
99/00), and one (1) new Development Associate in year three (FY 00/01). The estimated cost of the
Principal Planner is $69,590 beginning in FY 99-00, and the Development Associate is $48,004 beginning
in FY 00/01. If no project activity were to occur in the new areas, there would be no need to hire the two
positions.
In an effort to determine what effect the proposed areas might have on the Agency's budget, staff has
brought together resources and costs associated with formation of the proposed areas. The following is
a table outlining the estimated operating revenues and expenses of both the new areas through FY 05-06:

crime; if a plowdown date of May 1s~ should be set; and if the property
owners do not meet the date, how they can be heavily fined; and
suggestions for providing a safer community against fire hazards.
Carson and Sullivan congratulated Gail Waiters and wished her good luck in
her new employment.
Carson requested staff inform Roy Malahowski and Barbara Harris of the

As you are aware, occasionally a member of the public requests that the City install curb and gutter for them
and that the cost of this improvement be place on their tax roll. With the exertion of a City-sponsored project,
we have received no more than two of these requests per year. For a typical residence, the installation of curb
and gutter costs approximately $1600.00. Assuming a maximum of 3 of these events per year, the total
administrative charge to be collected annually would be as follows:
3 events x $1600.00/event x 8% administrative cost = $384.00/annually
If the City allowed the improvement cost to be paid over a period of two or three years, the administrative cost
would decrease accordingly.

AN ORDINANCE ADDING SECTION TO
SECTION OF THE BAKERSFIELD
MUNICIPAL CODE RELATING TO CURB AND GUTTER
ASSESSMENTS.
WHEREAS, the City of Bakersfield awards annual contracts for curb and gutter
construction; and
WHEREAS, property owners from time to time request the City construct curb and
gutters and allow for repayment from same from property taxes; and
WHEREAS, the City is willing to construct the curbs and gutters and receive
payment for same from property taxes provided that City's administrative costs, principle
and interest on the funds advanced are timely paid, and the City's legal interest properly
protected.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
BAKERSFIELD AS FOLLOWS:
SECTION 1.
Section of Section of the Bakersfield Municipal Code
relating to curb and gutter assessments is hereby added.
SECTION 2.
Curb and Gutter Assessments.
The Superintendent of Streets may, under the following conditions, execute an
agreement with a property owner to cause the City to construct curb and gutters on the
property owner's land and repay the cost of same through the property owner's property
tax assessments over a period of two (2) years. The agreement shall require the full cost
of construction be repaid, including but not limited to administrative costs of eight percent
(8%); interest at the legal rate; the full repayment of the contract price within two (2) years
from the date the agreement is signed; an indemnity from the property owner to protect the

City; a lien for the full contract amount shall be required on the property upon which the
improvement was constructed; and any other provision deemed necessary by the City
Attorney or Street Superintendent for the protection of the City.
SECTION 3,
This Ordinance shall be posted in accordance with the provisions of the Bakersfield
Municipal Code and shall become effective thirty (30) days from and after the passage.
