ORDINANCE NO.
AN ORDINANCE AMENDING SUBSECTION L OF SECTION
12.56.050 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO PROHIBITED ACTS IN PARKS.
BE IT ORDAINED by the Council of the City of
Bakersfield as follows:
SECTION 1.
Subsection L of Section 12.56.050 is hereby amended to
read as follows:
12.56.050 Prohibited acts in parks.
Within the limits of any park, it is unlawful for any
person, other than a duly authorized city employee in the
performance of his or her duty, to do any of the following:
L. Except as allowed under permit issued pursuant to
Section 12.56.200, operate any radio, tape player, tape recorder,
record player or television on or in any park, or in any parking
area'or lot within any park, at such volume as permits the noise
therefrom to be audible to any person of normal hearing
sensitivity fifty feet from said radio, tape player, tape
recorder, record~player or television;
SECTION 2.
This Ordinance shall be posted in accordance with the
Bakersfield Municipal Code and shall become effective thirty (30).
days from and after the date of its passage.

SUBJECT BAKERSFIELD SYMPHONY REHEARSAL DATES
On the following .page I have listed performance and rehearsal dates the
_ Bakersfield Symphony has used in the past three fiscal years, along with booked
dates for the upcoming 1991-92 season. Also attached, for your information, is a
letter to John Farrer of the Bakersfield Symphony written in March, 1991, explain-
ing the Convention Center's position.
Currently, there are two Saturday rehearsal dates tentatively available for
the Symphony. Because of potential earnings derived from Saturday events, it is
important the Convention Center be given discretionary responsibilities over which
activities are booked. While we are acutely aware of the Symphony's needs, it is
the community as a whole that should be considered.

that event and the. possible revenue generated by your reheasal date. I have.
included a piano on all dates as they are occasionally used. If you should

Based on figures from 1989 and 1990, the Convention Center would have lost
$12,283 and $9,221, respectively, if only rehearsals were allowed. While I
can appreciate your concerns, it is important to keep Saturdays available
whenever possible. To block off the most important night of the week would
have a negative impact. ·
