1. Hardball Use in City Parks

SUBJECT: HARDBALL ORDINANCE
As per your direction, I had staff contact several Recreation
and Park Departments or Special Districts asking if they have an
ordinance in place relating to ~ardball use in parks. The
question asked was, "Do you have an ordinance in effect
restricting hardball use in parks? The responses are as
follows:
1. City of Fresno

They have no ordinance or regulations; However, their parks have
Recreation Leaders year round who handle problems if any should
arise. They also have several official sized baseball diamonds.
2. City of Sacramento
Contact Person: Ron Kashiwagi, Recreation Supervisor

They have no ordinance. They have many baseball diamonds and
conduct leagues year round for both adults and youths. They
have security personnel to handle problems.
3. City of Stockton

They have no ordinance. They have several baseball diamonds on
which they conduct leagues.
4. City of Seaside

They have no ordinance and they have had no problems.
5. North Bakersfield Recreation & Park District

They nave no ordinance. They nave nad complaints about adults
playing on little league f'~elds and ndtt]ng balls over the
fence. They also have security personnel to handle problems.
6. Greater Vallejo Recreation District

They have no ordinance and have had no complaints. They do have
some baseball diamonds.
7. City of Santa Barbara

They have no ordinance. Both baseball and softball playing
require permits. Recreation staff monitors the various
locations for violations.
8. City of Modesto

They have a long list of ordinances governing use of parks.
Section 12-4. 201. (x) Reads "To play or engage in any game or
contest in any park except in such places, as are specially
I provided or designated for that purpose." They post signs
prohibited areas.
When discussing this issue with the various agencies, the
genera] feeling expressed was that we mi9ht have better control
of ball playing if we were to specify and post signs in those
particular portions of a park where hardball is not allowed,
such as in picnqc or children's play areas, and not designate
certain parks where hardball is allowed.

XXX. City Of Mo~esto Ordinances
The following City of Modesto Ordinances pertain under Article
~. ~2, General Regulations Governing Use of Parks and Recreation
-- Areas and Facilities, Section 12-~.~01'.
A. To enter or ~respass in any area, building, or facility
~hich is fenced and locked or enclosed and locked.
B. To ride or bring any horse or other similar animal or to
propel a vehicle in Dr upon any area of a park, except
those areas speci'fically provided and designated for such
purposes, unless prior written permission is~obtained from
the Director.
C. To drive or operate any motor vehicle in any park in excess
of fifteen (15) miles'per hour.
D. To park any automobile or other vehicle in any park at any
place other than designated parking .areas. Places where
parking is permitted shall be designated by appropriate
'signs.
E. To operate gasoline powered go carts, model airplanes,
boats or midget cars in any park except on designated
ar~as.
F. To clean, wash, polish, or make other than emergency
repair,s upon any automobile, motorcycle, or self driven
vehicle in any park.
G. To.carry or bring .any firearms, air guns, slingshot,
firecrackers or fireworks into any park.
H. To make a fire in any park other than in stoves, pits, or
braziers provided by the City, unless prior written
permission is obtained from the Director.
~ I. To bring into anY'Park ,any material Which .will, if spilled
or spread, be injurious to ~the turf or plant growth.
J. TD cut Dr remove any.wood, turf, rock, tree, flower, shrub,
sand or gravel from any p'~rk unless prior, written
permission is obtained from the Director.
K. To throw or dispose of in any park any bottles, tin cans,
broken glass, paper, clothes, cast iron, rubbish, soil,
tree trimmings, garbage,'ashes, or other debris of any kind
except in approved containers provided by the City.
L. To 'remove, damage, or destroy any athletic equipment
provided by the City, normal wear and tear excepted.
M. To move or remove from one location to another any part of
parts of field equipment.
N. To move or remove from one location to ano.ther any
equipment used for park maintenance.
' O. To open or close .any valve pertaining to the ~ater 'mains or
sprinkler systemOr ~to expose or interfere with any gas.

P. To cu't, break or deface in any way buildings, equipment,
grounds or other facilities of any park.

meeting, concert, or e~hibition in any park.
S. To operate a public address system without prior written
permission of the Director. This prohibition shall not
include the use of small portable radios when operated at
such a volume as not to disturb Other persons present in
the parks.
· T. To disturb or interfere with any employee of the City of
Modesto acting within the scope of his employment, o? to
disturb~or interfere with any spectator or participant in
any event or activity conducted in any park, or to enter
any park for the purpose of committing any such disturbance~
or interference.
U. To camp or lodge in or upon any park unless prior written
permission is obtained from the Director.
V. To sell refreshments, food stuffs, or novelties in any park
or on any street immediately adjacent there to without the
prior written permission of the Director or the City
Council.
W. To practice, carry on, conduct or solicit for trade,
occupation, business or profession in any park without the
prior written permission of the City Council.

that 'purpose.
Y. To play upon any tennis courts wearing shoes other than
those having vulcanized soles and heels, commonly known as
tennis shoes.
Z. To refuse to open any tennis court being used for Singles
play. to doubles play at the end of the set being played
~- when other persons are waiting, unless prior written
permission is obtained from the Director.
AA. To refuse to relinquish any tennis court being used for
doubles play at the end of the set being played when other
persons are waiting, unless prior written permission is
obtained from the Director.
BB. To use any. tennis courts for tennis tournaments, team
practices, or other special events of any kind without the
prior written permission from the Director or the City
Council.
CC. To play or engage in hitting of golf balls in any park,
except on driving ranges and golf courses.
DD. To use any park facility or equipment which 'has been.
reserved or which is indicated by an authorized or official
sign to have been reserved without first having received
the written permission of the Director.
EE. To ride bicycles through any children's playground area.
FF. To ~ade or swim in any pool in any park except when
supervised.
GG. ~To use any park facility for which a charge is now or
hereafter made without first having.paid the fee requeSted
and having received the required permit.
HH. To enter any park facility for which a charge is made
without first paying the full legal charge made4 for such
entrance unless such entrance is by the consent or.
permission of the person or persons in charge.
'~----- II. To discard lighted or unlighted cigars or cigarettes in
children's playground areas.

JJ. To use any park facility or equipment which has been reserved
or which is indicated by an authorized or official sign to
have been reserved without first having received the written
permission of the Director.
KK. To remove any authorized or Official sign indicating that any
park facility or equipment is reserved.
LL. For any male person to resort to any toilet set apart for
women, and 'for any female person to resort to .any toilet set
apart from men, provided that this prohibition shall not apply
to children accompanied by their father, mother or guardian.
MM. To loiter or remain in any park at any time between midnight
and daylight of the following morning, unless prior written
permission is obtained from 'the Director or the City Council.
