AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING SECTION 2..60.060 TO THE
BAKERSFIELD MUNICIPAL CODE RELATING TO THE
CREATION OF A CITIZENS' PARKS AND RECREATION
BOARD.'
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 2.60.060 is hereby added to Chapter 2.60 of
the Bakersfield Municipal Code to read as follows:
2.60.060 Citizens' Parks and Recreation Committee
Creation - Duties.
A. There is created a~ Citizens' Parks and Recreation
Committee consisting of seven members, each of whom shall be
nominated by a councilmember for his/her respective ward, who
shall be a resident of that ward, and shall be appointed by the
City Council. The term of office shall be four years, to run
concurrently with' the term of the councilmember from the same
ward; terms of the committee members first appointed may run less
than four years~and sha~l expire with the expiration of the term
of the councilmember from the same ward.
B. The Citizens' Parks and Recreation Committee shall
represent various community groups and interests for the purpose
of advising the City Council as to policies for opera%ions of city
parks and city recreation services. Except as provided in this
section, this committee has no administrative or other authority.
The Parks Superintendent and the Recreation Superintendent shall
be ~ex-officio members of this committee and may be present at any
meetings of this committee, but shall have no right to vote

This ordinance shall be posted in accordance with the
City ~charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

SUBJECT: NORTHEAST LITTLE LEAGUE ~/
In regard to the issue concerning Little League facilities, the
following information is offered:
Prior to the City Council meeting of November 28, 1990, I was
contacted by Mr, Kevin Keyes, representing the to-be-formed
Northeast Little League, inquiring as to the possibilty of using
the upper diamond at the Bakersfield Municipal Sports Complex
for little league play. He stated he was in the process of
acquiring a charter, and they would need a place to play. I
informed him that at that time, not knowing what our scheduling
needs would be, I could not commit a diamond at the Complex for
exclusive Little League use.
I suggested to Hr. Keyes that instead of seeking to move into
the Complex, he should investigate the possibility of utilizing
the Bakersfield College softball diamond. This diamond, by
agreement with the' Community College District, gives the City
exclusive use of the facility. I informed Mr. Keyes of this
fact and indicated to him that the Recreation Division had no
intention of using the diamond thereby freeing it up for public
use. I told him to contact the school (B.C.) to reserve the
diamond and that I would verify our intent not to use the
facility. There was no more contact at this time.
On November 29, 1990, I was informed by Charlie Graviss that an
issue had been referred to the Convention Center and Community
Services Committe regarding facilities for Little League. I
called Mr. Keyes and he stated he had talked to Pat Smith on
this matter. He said that he had a proposal written up, and he
would bring it to me after his sister put it on the computer.
That was the last I heard from Mr. Keyes until I called him on
February 6, 1991 and left a message and then called him again on
February 7, 1991, at which time he informed me that he had
changed his mind, and possibly, he would pursue the matter next
year.

12.56.050 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO PROHIBITED ACTS IN PARKS.
BE IT ORDAINED by the Counc{~ of the City of Bakersfield
as follows:
SECTION 1.
Subsection A. of Section 12.56,050 of the Bakersfield
~unicipal Code is hereby amended to read as follows:
12.56.050 Prohibited acts in parks.
Within the limits of any park, it is unlawful for any
person, other than a duly authorized City employee in the perform-
ance of his duty, to do any of the following:
A. Play or practice golf or archery, fly ~notor-driven
model aircraft, or throw a javelin, shotDut, hammer, boomerang or
other dangerous projectile, except in areas which may be ~pecifi-
cally designated and posted for such purposes, or to hit or bat ~
b~seball (hardball), except in areas designated ~ ~uch ~
activ~t~e~.~. ·
SECTION 2.
This ordinance shall be ~osted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

Present' Don Anderson, Terry Gosney, Barbara Lomas, Geri Spencer,
Joyce Tanner, Mary Sawyer
Staff Present' Charles Graviss, Lee Andersen, Frank Fabbri, Jim Ledoux
The meeting was called to order at 5:36 pm by Chairperson Don Anderson.
1. Geri Spencer moved, seconded by Jack Goldsmith, to approve the
agenda. Motion carried.
2. Jack Goldsmith moved, seconded by Geri Spencer, to approve the
minutes of the meeting of April 26, 1990. Motion carried.
3. Recreation Superintendent, Jim Ledoux, introduced Charles Graviss
and Lee Andersen, Convention Center Manager and Assistant Manager,
respectively, who will take over the reins of the Community Services
Department. Ledoux explained that as of July 2, 1990, Community
Services had been reorganized by deleting the Water Resources and
Sanitation Divisions and including the Convention Center, along with
the Parks and Recreation Divisions.
4. Public Statements - none
5. Parks Superintendent Frank Fabbri and Jim Ledoux commented on the roller
hockey situation. Both stated that to the best of their knowledge,
no complaints had been received during the summer months. Ledoux
suggested that since hockey is a seasonal sport, hockey players would
probably return when it is less hot during the fall. Committee
member Lomas commented she has passed by Jast.ro and the tennis courts
have not been full.
6. Superintendent Ledoux reported on the Recreation Division's summer
programming. There was much comment from committee members regarding
the programming. Member Sawyer felt that the programs were not
adequately publicized. She suggested talking to Jerry Stanners at
the Bakersfield Californian. Ledoux explained how information is
disseminated through schools, churches, etc. He also stated that a
news release is prepared for most upcoming events and mailed to the
Californian. Committee member Sawyer suggested that bulletin boards
be placed in each park so that the Recreation program information
is readily available for park users.
Mrs. Sawyer, moved, seconded by Jack Goldsmith, to have staff
investigate the cost of placing bulletin boards in parks to display
schedules of upcoming events and report findings back to the
committee. Motion carried.
More discussion took place on Recreation programmin9. Attendance
figures were examined. Committee member Spencer Suggested that
possibly year-round school might cause drop off in attendance.
Committee member Tanner suggested the Bakersfield Ad Club be
contacted, as well as the C.S.U.B. marketing class for help in
promoting the program.

Park Superintendent Fabbri explained the issue of amending the ---.
ordinance was a staff referral and not. a council referral Chair-
person Anderson asked that the minutes'reflect the correction.
Fabbri then explained about the amendment to the City ordinance
regarding hardball in City parks; He'stated the City Attorney has
added a'clause relating to size of parks where hardball would be allowed.
Committee member Sawyer asked which parks are presently designated'
as hardball: parks. Fabbri.r~sponded none..He then suggeste'd'that

Chairperson Don Anderson recommended that a list of parks be provided
to the City Council along with.the committee's recommendation.
Fabbri suggested that the-recommendation be back to staff through the
Community Services and Convention Center Council Committee and then
that would go to the full co'uncil.
Committee member Gosney felt this issue had been discussed before.
He felt statement'should be added to ordinance'relating to
specifically designated area and should not have anything to do with
acreage.
Other'Committee members concurred with Gosney and also felt the issue
had been discussed before. Chairperson Anderson moved that the dis-
cussion be tabled until the next meeting. The motion was seconded.
Motion carried.
8. Council Referral - Park and Recreation Plan - Jack Hardisty, Planning
Director, was unable to attend. It'em tabled until next meeting.
9. Committee Statements - Committee member Sawyer questioned the
authority under which previous meetings had been cancelled.
Chairperson Anderson stated he would check with City Attorney's
office.
The rescheduling of the parkway tour was also discussed.
10. It was determined by the committee to set their regular meeting date
on the second Wednesday of each month at 5-30 pm.
11. The agenda was set for the next meeting for Septemebr 12, 1990.
12. The meeting was adjourned at 6-57 pm.

4. Recreation Superintendent Jim Ledoux introduced Assistant Planning
Director Stan Grady, who reported on the "park' ordinance" that is
currently being proposed by the City. He stated that it is a "Quimby"
type ordinance. He also spoke about a comprehensive parks and recrea-
tion plan that will be prepared. This plan is due in two years, and
work has not begun on it yet. He stated there is a lot of preliminary
Work to be done prior to starting this project.
Community Services Manager Charles Graviss stated he felt the Council'
was looking for from the Citizens' Committee was input on whether to go
with either neighborhood or regional parks. He explained what each type
of park is and said he felt the council wants a recommendation from the
committee as to what way to go.
Assistant Parks Superintendent Marguerite Smith described what typifies
the different types of parks and cited various city parks as examples.
Chairperson Don Anderson requested that copies of the park element of the
2010 Plan be sent to all of the committee members.
Mary Sawyer suggested that a park tour is a necessity to identify where
the parks are and what exists or does not exist in the par~s.
Further discussion followed in regard to establishing a special district
and what it would requiCe. Mary Sawyer requested that the committee be
brought up to date on progress and the newly completed.report be placed
on the next meeting agenda for discussion.
Assistant Convention Center Manager Leland Andersen provided an update.

next agenda.
5. Staff Referral - Hard'~all use at City Parks.

6. Cancellation of meetings.
Jim Ledoux reported that he had spoken with Deputy City Attorney Laura
Marino regarding cancellation of meetings. She stated since the
committee falls under the Brown Act without a quorum, there can be no
meeting.
Both Charles Graviss' and Leland Andersen stated that if a quorum were not
available, a notice should be posted at the location of the meeting place
and that will suffice.
7. Park Bulletin Boards
Marguerite Smith reported on the cost of bulletin boards ($128 for
materials only). There are 33 pa~ks. Additional cost figures will be
supplied at the next meeting.
8. Committee statements - none.
9. The agenda was set for the meeting of October 10, 1990.

The meeting was called to order at .5:40 pm by Chairperson Don Anderson.
1. Don Anderson moved, se'conded by Geri Spencer, to approve the agenda.
Motion carried.
2. Don Anderson moved, seconded by Jack Goldsmith, to approve the minutes
of the meeting of September 12, 1990, as amended. Motion carried.
3. Public Statements - Gerald Patterson and Bill Carroll, representing the
Bakersfield Shoe Crew, made a presentation to the committee in regard
to the possibility of constructing more horseshoe courts (15) at Beach
Park, which would be privately funded. The funds to be solicited by
the Show Crew· They stated the initial plan is to start, off with 11
courts and install the others at a later date.
4. Council Referral - horseshoe court proposal
Park Superintendent Frank Fabbri provided background on the proposal
before the committee. He also stated that he doesn't know if the City
wants to give' up the required acreage for the sole use of the horseshoe
courts· After considerable discussion, committee member Jack Goldsmith
made a motion, seconded by Geri Spencer, to support the Show Crew pro-
poSal to construct 15 additional courts, at their expense. This motion
failed by a vote of 5 noes, 1 yes.
Jack Goldsmith then re-stated his motion with the condition that all
monies be turned in by July 1, 1991 and that it be 15 additional courts
and. that the City be able to file a notice of non-responsibility
(mechanic's lien). Mary Sawyer seconded the motion. Motion carried.

The issue of hardball use in City parks was discussed ChairpersOn
Anderson passed out copies of some proposed verbiage to be recommended
to the City Manager for inclusion in an amended City ordinance.
Discussion followed pertaining to the defini.tion of "hardball", and
what should and should not be allowed, the City's liability and the
ability to enforce, the ordinance. Don Anderson moved, seconded by .Geri
Spencer, to refer this issue back to the City Manager's office, with a
statement that the committee disagrees with the portion of the proposed
amendment to the ordinance stating "in any park of less than 3.5 net
'. acres"; however, they do agree with the intent to restrict baseball
~ (hardba'll) to designated areas only, and they are'asking that the City
',~,, Manager ask the City Attorney to prepare some language to that end to be.,
brought back to the Citizens' Committee for further consideration.
Motion carried on 5-1 vote.
6. Council Referral - Park and Recreation Plan
This was a carryover item from a previous meeting meriting only brief
discussion. Don Anderson brought up issue of neighborhood parks as
.opposed to community parks.
Lee Andersen gave his views on the issue of neighborhood versus
community parks. He stated that it is part of the issue'of the City-
Wide Parks and Recreation District.
7. Lee Andersen discussed the existing inequities in reCreation and parks
programming and facilities. He also spoke of the park deficient areas
and the' maintenance districts. Lee provided insight into the study
now being done to consider the formation of a special district
including the 2010 Plan boundaries, with the exception of the North
Bakersfield and Bear Mountain Park and Recreation Districts.
8. Park Bulletin Boards - On a motion by Barbara Lomas, motion carried by
Geri Spencer, this item was tabled until the next meeting.
9. Park Maintenance District Update - This item was covered in items #6
and ~7.
10. The agenda was determined for the meeting of Novemebr 14, 1990.
11. On a motion by Don Anderson, seconded by Barbara Lomas, the meeting
was adjourned at 7:15 pm.

The- issue of . amending the Ordinance
relating to Prohibited Acts in Parks was
referred to the Auditorium and Community
Services Committee. On August 24, 1989,
this Committee met with staff to discuss
this issue.
Complaints have been received from users ~~,~
and residents of neighboring parks that
baseballs and other potentially harmful
projectiles were being thrown in the parks.
This Committee feels these objects should
not be allowed and that the Ordinance
should be amended to prohibit those
objects.
Based on the above, this Committee
recommends the Prohibited Acts in Parks
Ordinance be amended as directed by the
attached Ordinance and considered as first
reading.
First Reading of an Ordinance of the
Council of the City of Bakersfield amending
Subsection A of Section 12.56.050 of the
Bakersfield Municipal Code relating to
Prohibited Acts in Parks.
Upon a motion by Councilmember Smith, Auditorium and
Community Services Committee Report No. 11-89 was accepted, and
First Reading given to an Ordinance of the Council of the City
of Bakersfield amending Subsection A of Section 12.56.050 of
the Bakersfield Municipal Code relating to Prohibited Acts in
Parks as amended to include "allow throwing of baseballs but
prohibiting the hitting of baseballs."

Adoption of Ordinance No. 3250 of the
Council of the City of Bakersfield amending
Subsection A. of Section 12.56.050 of the
Bakersfield Municipal Code relating to
Prohibited Acts in Parks.
This Ordinance was given first reading at the Council
meeting of August 30, 1989,.following receipt and acceptance of
Auditorium and Community Services Committee Report No. 11-89.
Communication has been received from ~lr. ~nd Mrs. 'D.
Scheidle, 4305 Bonaire, dated September 7, 1989, opposing the
ordinance restricting the use of a baseball in parks.
Councilmember McDermott made a motion to amend the
Ordinance to delete "or to hit or bat a baseball (hardball),"
Commiand refer proper use of parkSttee, to the Parks and Recreation
Councilmember Peterson made a substitute motion to
refer this issue to the Parks and Recreation Commission with a
report back to the Council. The motion failed by the following
roll call vote:

Municipal Code by changing the Land Use
Zoning of those certain properties in the
City of Bakersfield located on the
northeast corner of Buena Vista Road and '
Ming Avenue from a C-2 (Commercial), C-0
(Commercial and Professional Office), R-3
(Limited Multiple Family Residential) and
R-2 (Limited Multiple Family Residential)
Zones to an R-1 (One Family Dwelling) Zone.
This Ordinance was given first reading at the meeting
of August 30, 1989.
Upon a motion by Councilmember Ratty, Ordinance
No. 3251 of the Council of the City of Bakersfield was adopted

AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SUBSECTION A. OF SECTION
12.56.050 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO PROHIBITED ACTS IN PARKS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Subsection A. of Section 12.56.050 of the Bakersfield
Municipal Code is hereby amended to read as follows:
12.56.050 Prohibited acts in Dar]cs.
Within the limits of any park, it is unlawful for any
person, other than a duly authorized City employee in the perform-
ance of his duty, to do any of the following:
A. Play or practice golf or archery, fly motor-driven
/~i~odel aircraft, or throw a javelin, shotput, hammer, boomerang or
:~other dangerous projectile, except in areas which may be specifi .... ·
~ly designated and posted for such purposes.

SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
