BACKGROUND: A coalition of community groups, city staff and Council members have been meeting to discuss options for developing a plan to preserve an area in the northeast commonly referred to as the Kern Bluffs. The citizens group met with the Urban Development Committee on February 12 at which time options that could lead to the development of a Kern Bluffs Corridor Open Space Plan were discussed. Representatives from the group informed the committee that grants may be available to assist with the development of the plan. The group further stated that most grants would want city support and/or matching funding in order to improve their potential for success. It was agreed that a resolution based on existing adopted general plan policies could be submitted with grant applications as an indication of city support. The attached resolution has been reviewed by members of the Urban Development Committee and staff and is recommended for adoption by the City Council. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD IN SUPPORT OF PURSUIT OF THE DEVELOPMENT OF A KERN BLUFFS CORRIDOR OPEN SPACE PLAN WHEREAS, northeast Bakersfield contains unique biological resoumes and topography in close proximity to the urban core of metropolitan Bakersfield commonly known as the "Kern Bluffs" (hereinafter the "Bluffs"); and WHEREAS, the Bluffs are in the beginning stages of experiencing pressure from pending development; and WHEREAS, a coalition of community groups desires to develop a plan to protect the Bluffs' existing open space, biological resources, and preserve existing wildlife habitat along with the development of public trails for hiking, equestrians, bicycling and other purposes; and WHEREAS, the City Council through adopted policies in the Metropolitan Bakersfield 2010 General Plan does support the preservation of open space, protection of biological resoumes and existing wildlife habitat. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The City Council hereby extends its support to the efforts of the Kern Bluffs Corridor Citizens Coalition to pursue public and private assistance in the development of the Kern Bluffs Corridor Open Space Plan. 2. The City Council hereby finds that such support is consistent with the following goals and policies of the general plan: A. Biological Resources: Goals (1) To conserve and enhance habitat areas for designated "Sensitive" animal and plant species. (2) Investigate the feasibility of including natural areas selected for the habitat conservation plan as a component of the regional park system. Policies (1) Capitalize on the Kern River, parks, steep hills, and canal as organizational elements for the Bakersfield area, creating activity corridors around which development and recreational uses can be focused. (2) Conserve and enhance Bakersfield's biological resources in a manner which facilitates orderly development and reflects the sensitivities and constraints of these resources. B. Open space: Policies (1) Conserve and enhance the unique aspects of open space within the planning area. (2) Create an integrated system of open space amenities in the planning area. (3) Locate and site development to minimize the disruption of open space areas. (1) Acquire new lands for open space. C. There is a group of residents on Sbellabarger Road that has interest in opening the West End of Shellabarger. We und~ there are many businesses on Shellabarger. The type of traffic generated by these businesses could be ora tYpe that is not conducive to our residential life. These could include truck and trailer rigs (18-wheelers), dump trucks and backhoes, welding trucks, horse and stock trailers, auto traffic in addition to the existing Shellabarger residents vehicles. We feel that this type of an increase in traffic will place our children and families in considerable increased jeopardy of their safety. Opening Shellabarger would also open our neighborhood to throu~ traffic, which could bring elements that we presently do not have - i.e. drugs, gangs, etc. We understand that this gate, although closed to through traffic, is (or will be) equipped with a locking system that is accessible to both County and City emergency equipment and personnel. Thus we support keeping the present gate, at the West End of Shellabarger, closed and hope you will support our wishes. I have been attending the Urban Development Committee meetings for more than a year in hopes to have a resolution to the Shellabarger / Pepita Way gate issue. The City of Bakersfield erected the gate on-the City'/County line, after a City resident sent an erroneous petition around the neighborhood. Varying members of the Urban Development 'Committee 'have voiced concerns regarding this dilemma, but still nothing is done to mitigate the "gate" problem. The following are observations regarding the Shellabarger Road / Pepita Way mess: ·Individuals living on Shellabarger have presented letters from both City and County personnel stating that the gate, the lock and the access do not meet code. ·Shellabarger.residents have presented pictures given written statements and verbal testimony depicting traffic hazards and various safety concerns. · Shellabarger residents present facts and Pepita residents relay fears. · Emergency Vehicles have no access via the west end of Shellabarger, beause they have no key to the gate. Worse yet if an accident or event were to close the east end of Shellabarger.there is no exit for .residents because of the locked gate. · If the City is so concerned about the number of Shellabarger residents that will be using Pepita why.not put up a flag person at the entrance to Pepita and limit.it to only Shellabarger residents until-the Calloway construction is complete. (A flag person standing in the middle of Calloway would present such a safety concern that no-one in the right mind would take the job) · The Urban Development Committee is willing to put the concerns of Brimhall/Allen residents on the fast track in order to satisfy a dust concern. Since when is it the Committee's ability to move heaven (wind) and earth (dust) to satisfy these residents and the Shellabarger / Pepita residents can continue to debate the gate issue for years to come. Is it a question of having an attorney present? Why is one individual, Mr. Koch dictating the timeline to the City of Bakersfield for a resolution to this problem. Mr. Koch has said ..that he won't reply to the City's proposal until after the separation of grade for Calloway is complete. . . ·If the residents of Pepita want a gated community then let them meet all the other legal requirements for a gated community. · Mr. Fanucchi has been more than patient in contending with traffic using his driveway not to mention his front yard for a turn around and yet nothing is done. I thank you for your attention to this matter and please, please resolve it. I respectfully request that this matter be brought before the full City Council before it evolves into an accident or an incident causing property damage or worse yet personal injury. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD REGARDING SITING OF DAIRIES WHEREAS, the City of Bakersfield is pro-business, pro-agriculture and supports the attraction of business and industry to Kern County; and WHEREAS, in attracting business and industry to-Kern County, all pertinent regulations should be clearly set forth; and WHEREAS, such regulations should detail the approval processes, siting criteria and land .use relationships for such businesses and industries; and WHEREAS, the City of Bakersfield and County-of Kern have a joint interest in the type, quality and location of development within the Metropolitan Bakersfield 2010 General Plan ("2010-General Plan")area; and WHEREAS, the City of Bakersfield and County of Kern are committed to a cooperative approach to providing government services, including development review; and WHEREAS, there needs to be a balancing of compatibility between the growing economy of the urbanized area and the growing industrial/agricultural economic base in the areas adjacent thereto; and WHEREAS, projects such as dairies and other significant agricultural and industrial projects affect the City of Bakersfield and its residents, as such projects occur within and adjacent to the 2010 General Plan boundaries; and · WHEREAS, the City of Bakersfield and County of Kern should develop a coordinated, consistent protocol for jointly reviewing extraordinary and significant projects at and/or near. the incorporated/unincorporated boundaries of the metropolitan area; and WHEREAS, the City Council believes certain specific recommendations of the Dairy Technical Advisory Committee do not adequately protect the citizens of the City of Bakersfield by allowing dairies within the 2010 General Plan area via the Conditional Use Permit process. The City Council is hereby opposed to the establishment or enlargement of any dairy: (1) within the boundaries of the 2010 General Plan "By-Right," by issuance of a permit or by any other means; (2) within three (3) miles of any existing or planned residential development outside of the boundaries of the 2010 General Plan; and (3) within two (2) miles, of any property used for water recharge or recovery purposes; and 3. Senate Bill 1533 (Poochigian, R- Fresno) made it through the legislative process until it was blocked in the Assembly Appropriations Committee after passing the Senate and Assembly policy committees with a strong bi-partisan majority. Working together on the final day of the legislative session, Senator Poochigian and Assemblyman Dave Cogdill (R-Modesto) were able to amend and quickly move AB 2630 (Cogdill) (containing the provisions of SB 1533) through the Legislature and to the Governor's desk. "I am pleased to see that we are a step closer to tightening security in California's small airports. Domestic security should be among our highest priorities," said Poochigian. "We must make every effort to fill security gaps and ensure that we minimize the vulnerability of small airports to criminal and terrorist activity." "We cannot overlook these airports simply because they are general aviation airports," Cogdill said. "Without this grant funding, many of these airports will be unable to afford needed security upgrades." Currently, general aviation airports can receive up to $150,000 per year for three years from the federal government, provided they supply a ten-percent match. Half of the ten-percent match comes from the state and half comes from local communities. AB 2630 will allow the state to provide the entire ten-percent matching requirement. More than $19 million is available in federal funds this fiscal year with more than $9 million unused and carried over from last year's funds. The Caltrans Aeronautics Fund derives its revenue from an airplane fuel tax, separate from the state's General Fund. Last year's budget had reserves in this fund; however, the recently signed budget diverts a portion of the revenue to non-security, non transportation-related purposes. Airport officials are advised to act quickly to secure the matching grants before funds are depleted. =more- There are more than 100 eligible general aviation airports throughout California. Counties with eligible airports include, among others: El Dorado, Fresno, Humboldt, Kern, Los Angeles, Madera, Mariposa, Merced, Monterey, Riverside, Sacramento, San Bernardino, San Diego, San Joaquin, Santa Barbara, Shasta, Stanislaus, Siskiyou, Sonoma, Tulare and Trinity. Last year, sixty-three of those eligible airports did not receive grant funds. Airport security grants typically furnish or augment fencing around the airport's perimeter, lighting, and security equipment such as electronic surveillance. Todd Section 17.61.030(K) A definition is needed in this section for what are "neighboring residential areas" that are "developed". Section 17.61.030(L) Placed on center, a 5 x 5 foot tree well in a parking lot reduces a 20-foot parking space to 17 feet, which is too small to accommodate large SUV's and vans. We believe adjusting this to a 4 x 4 foot tree well would allow adequate parking space size, while still achieving the proposal's stated goal. Section 17.61.040(C) The Planning Commission committee has recommended that the city require all tree pruning to comply with the International Society of Arboculture pruning guidelines. An exemption is needed for broken tree limbs, if not already exempted under these guidelines. Also, are these requirements common knowledge for most Bakersfield area tree- trimming contractors? Who would be liable for violations of these proposed regulations - the offending tree-trimming contractor, or the property owner? · ~' Section 17.61.050(A) Mandates have been proposed requiring tree replacement and specifying minimum required sizes for replacement trees, up to a 48" box, estimated to cost $2,500 per tree (our inquiries revealed that insurance policies generally cover only $500 per tree maximum, · minus the policy holder's deductible). We request an exemption for trees destroyed due to acts of God, including but not limited to storm damage and disease. Also, an exemption is needed for property owners who must permanently remove trees that are damaging or threatening damage to buildings, sidewalks, parking areas, or other real property. Further, under 17.61.050(A), what civil or criminal, penalties will be imposed onproperty owners ,. who are not in compliance?
