· 1. Review of Noise Ordinance (Rap Concert) (Allen Shaw)
Communications between the Cityand the University indicate progress in resolving
the problem Of noise going beyond campus area. Staff to follow up requesting that
we be kept informed of their new rules as they are developed.
Staff to review Sundale's permit to determine if there is a violation from amplified
music.
2. Status of Hotel Negotiations (Alan Tandy)
There are two interested parties who are trying to put together adequate and
appropriate funding packages.
3. Set Next Meeting Date
To be set after new councilmember is appointed.

Dear Mr. Tandy:
This is in response to your concerns and those of the City
Council that .you expressed to me about the noise level of the
outdoor concert .held on our campus on 13 November. Please
assure the City Council that I recognize and agree: the noise
level was too loud. Therefore, we are taking whatever steps we
can to avoid a similar problem in.the future.
As I indicated on the phone, the basic problem that led to the
complaints was-the extraordinary low-cloud ceiling condition
that prevailed that night'and amplified the sound far beyond
normal. Under normal conditions the sound would not have
carried much beyond the campus.
I should also note that our campus police worked closely with
your police department officials throughout the evening. The
Bakersfield City police officers were very helpful and handled
the coordination of security activities in a highly professional
manner. We thank and commend them for their efforts.
Thank you for bringing the concerns of'the City Council to my
attention, and rest assured that CSUB always stands ready to
work cooperatively with you and the Council on matters that
affect our community.

Dear Dr. Arciniega:
The City Council has asked me to express their concerns to you relative to an event
which occurred on Friday, November 13. The event involved, an outdoor music festival,
which resulted in multiple public complaints to our Police agency and City
Counciimembers concerning violation of noise regulations in the community.
The belief is, of course, that we should not have to take action with regard to the
enforcement of a City ordinance for an event being sanctioned at the University. In
addition to that, we have been made to understand that some University officials argued
that they were not under the authority of City ordinance relative to this matter - at least
at the outset of efforts being made to enforce our noise ordinance. While we understand
the University may be able to exercise certain discretions on its own property, in this
instance, the noise complaints were outside of the campus property, and our ordinances
are pertinent in that instance.
The City Council requested that I bring the concern to your attention in the hope that,
in the future, the University would avoid activities that could generate the rather high
number of complaints that occurred in this instance. Your cooperation would be greatly
appreciated.
