AN ORDINANCE AMENDING TITLE 15 OF THE
BAKERSFIELD MUNICIPAL CODE BY ADDING C~PTER
15.84 IMPLEMENTING A T~NSPORTATION IMPACT
FEE ON ALL NEW DEVELOPMENT.
WHEREAS, in the Metropolitan Bakersfield 2010 General Plan
it has been established that land development shall not be
permitted unless adequate transportation facilities exist or are
assured; and
WHEREAS, in the Metropolitan Bakersfield 2010 General Plan
the policy has been established that land development shall bear
a proportionate share of the cost of the provision of the new or
expanded transportation facilities required by such development;
and
WHEREAS, in the Metropolitan Bakersfield 2010 General Plan
Circulation Element (Implementation Measure 33) it has been
established that a Transportation Impact Fee Ordinance is a
method of ensuring that land development is adequately supported
by a regional transportation system; and
WHEREAS, the Circulation Element designates the regional
transportation system required to support the adopted Land Use
Element; and
WHEREAS, a transportation impact fee is necessary to provide
a regional transportation system which is closely, systematically
and reciprocally related to the Land Use Element of the
Metropolitan Bakersfield 2010 General Plan; and
WHEREAS, a transportation impact fee is necessary to provide
a share of the funding which enables lOcal agencies to comply
with the adopted congestion management plan level of service
standards on our local state highway system, and
WHEREAS, the requirements of Section 54992 of the California
Government Code have been satisfied as they relate to revision of
planning, zoning, development and related processing fees; and
WHEREAS, the City CoUncil, at the regularly scheduled
meeting of , and the Kern County Board of
Supervisors, at the regularly scheduled meeting of ,
held public hearings to consider a fee for the purpose of
providing the necessary regional transportation facilities called
for in the Circulation Element of the Metropolitan Bakersfield
2010 Plan; and
WHEREAS, all required public notices h~ve been given; and
WHEREAS, the provisions of CEQA have been followed; and
WHEREAS, this ordinance is in the public interest, necessary
for public convenience, health, welfare and safety; and
WHEREAS, the Council of the City of. Bakersfield and the Kern
County Board of Supervisors have made the following findings in
accordance with the requirements of Section 66000 of the
California Government Code:
1. The fee established is for the sole purpose of
providing transportation facilities as established in the
Regional Transportation Facilities List, as depicted in Exhibit
"A", attached hereto and incorporated as though fully set forth
herein.
2. There is a reasonable nexus between the fee's use and
the type of development projects.on which the fee will be imposed
because the fee is calculated in relationship to the trip
generation potential of that development and that development's
impact on the regional transportation system.
3. There is a reasonable nexus between the need for a
regional transportation system and the types of development
projects on which the fee is imposed because all residential,
commercial and industrial projects do, to a measurable degree,
increase the need for a regional transportation system.
4. There is a reasonable nexus between the amount of the
fee and the cost necessary to provide a.regional transportation
system as depicted on the Metropolitan Bakersfield 2010 General
Plan.
WHEREAS, the Planning Commission has recommended approval of
a fee to provide a regional transportation system.

SECTION 1.
Chapter 15.84 is hereby'added to the Bakersfield Municipal
Code to read as follows:

15.84.010 Short title.
This ordinance shall be known and may be cited as the
"Transportation Impact Fee Ordinance".
15.84.020 Purpose.
A. This ordinance is intended to implement and be
consistent with the .Metropolitan Bakersfield 2010 General Plan.
B. The purpose 0f this ordinance is to regulate the use
and development of land so as to assure that new development
bears a proportionate share of the cost of capital expenditures
necessary to provide a regional transportation system consistent
with the Circulation Element of the Metropolitan Bakersfield 2010
General Plan.
C. This ordinance will be reviewed annually arab i~ No {~ta~ce

15.84.030 Definitions. .
Whenever used in this chapter, unless a different meaning
clearly appears from the context, the words set out in this
section shall have the following meanings:
A. "Administrator" means the City Public Works Director or
designee.
B. "Building permit" means an official document or
official certification which authorizes the construction,
alteration, enlargement, conversion, reconstruction, remodeling,
rehabilitation, erection, demolition, moving or. repair of a
building or structure. In the case of a change in use or
occupancy.of an existing building or structure, the term shall
specifically include Certificates of Occupancy, as those terms
are defined in Section 308 of the Uniform Building Code 1991.
C. "Capital improvements" means transportation planning,
preliminary engineering, engineering design studies, land
surveys, right-of-way acquisition, engineering, permitting and
construction of all the necessary features for any transportation
facility Projects including, but not limited to:
(a) Construction of new through lanes.
(b) Construction of new turn lanes.
(c) Construction of new frontage or access roads.
(d) Construction of new bridges and widening.
(e) Construction of new drainage facilities in
conjunction with. new roadway construction.
(f) Purchase and installation of traffic signalization
(including both new and upgrading signalization).
(g) Construction of curbs, medians, sidewalks, bicycle
paths and shoulders in conjunction with new roadway
construction.
(h) Relocating utilities to accommodate new roadway
construction.
(i) Other capacity increasing improvements, such as
transportation systems measures.
D. "Expansion" of the capacity of a road means all road
and intersection enhancements and includes, but is not limited
to-, extensions, widening intersection improvements, upgrading
signalization and improving pavement conditions.
E. "Fee payer" means a person commencing a land
development activity which generates or attracts traffic and who
is applying to the City of Bakersfield, for the issuance of a
building permit for a type of land development activity specified
in 15.'84.050 (A) of this ordinance, regardless if the~fee payer
owns the land which is to be developed.
F. "Land development activity generating traffic" means
any change in land use, or any construction or expansion of
buildings or structures, or any change in the use of any building
or structure that attracts or produces vehicular trips.

G. "Level of service" means a qualitative measure that
represents the collective factors of speed, travel time, traffic
interruption, freedom to maneuver, safety, driving comfort and
convenience and operating costs provided by a highway facility
under a particular volume condition as set forth in the 1985 (or
current edition) Highway Capacity Manual.
H. "Regional Transportation Facilities List" means those
projects in the Metropolitan Bakersfield 2010 Plan area which
constitute some of the regional facilities needed to maintain a
level of service "C" or not to permit the degradation of roads
which are currently below level of service "C" as shown in the
Metropolitan Bakersfield 2010 General'Plan - Circulation Element.
I.. "Site-related improvements" means capital improvements
and right-of-way dedications for direct access improvements to
the development in question. Direct access improvements include
but are not limited to the following:
(1) Site driVeways and roads.
(2) Median cuts made necessary by those driveways or roads.
(3) Right turn, left turn, and deceleration or acceleration
lanes leading to or from those driveways or roads.
(4) Traffic control measures for those driveways or roads.
(5) Access or frontage roads not.identified on Regional
Transportation Facilities List.
15.84.040 Imposition of transportation impact fee.
A. Except as provided in 15.84.090 of this ordinance, any.
person who applies to the city for the issuance of a building i
permit to make an improvement to land for one of the uses which
is specified in 15.84.050 of this ordinance, and which will
generate or attract additional traffic, shall be required to pay
a transportation impact fee in a manner and amount set forth in
this ordinance. ~
B. In the case of structures, mobile homes, or
recreational vehicles which are moved from one location to
another, a transportation impact fee shall be collected for the
new location if the structure, mobile home or recreational
vehicle is a ~ype of land development listed in 15.84.050 of this
ordinance, regardless of whether transportation impact fees had
been paid at the old location, unless the use at the new location
is a replacement of an equivalent use. If the structure or
mobile home so moved is replaced by an equivalent use, no
transportation impact fee shall be owed for the replacement use.
In every case, the burden of providing past payment of
transportation impact fees or equivalency of use rests with the
fee payer.
15.84.050 Computation of fee.
A. At the option of the fee payer, the amount of the fee
may be determined by the schedule set forth below or under
subsection B of this section. The reference in the schedule to
square feet refers to the gross square footage of each floor of a
building measured to the exterior walls, and not usable,
interior, rentable, non-common or other forms of net square
footage. Fee to be reduced by 25% for those housing projects
affordable to "iow income" families as defined by Department of
Housing and Urban Development. This fee will be waived entirely
for those projects able to demonstrate that the fee (alone) will
move the cost of the housing from iow to moderate.

Land Use type will be determined by the administrator.
Average Daily Traffic (ADT) for the various type traffic
generators will be determined using the report Trip Generation:
An Informational Report, Institute of Transportation Enqineers
(latest edition).
1. If a building permit is requested for a building with
mixed uses, then the fee shall be determined according to the
above schedule by apportioning the sPace committed to uses
specified on the schedule.
2. If the type of development activity for which a
building permit is applied is not clearly specified on the above
fee schedule, the administrator shall use the fee applicable to
the most nearly comparable type of land use on the above fee
schedule. The administrator shall be guided in the selection of
a comparable type by the reports titled Trip Generation: An
Informational Report, Institute of Transportation Enqineers
(latest edition). If the administrator determines that there is
no comparable type of land use on the above fee schedule, then
the adminiStrator shall determine the fee by:
(a) Using traffic generation statistics from the above
named sources; and
(b) Applying the formula set forth in paragraph B of this
section.
3. When change of use, redevelopment, or modification of
an existing use requires the issuance of a building permit, the
impact fee shall be based upon the net increase in the impact fee
for the new use as compared to the previous use. However, should
the change of use, redevelopment or modification result in a net
decrease, no refunds or credits for past transportation impact
fees paid shall be made or credited. The administrator shall be
guided in this determination by the above referenced sources.
B. If a fee payer decides not to have the transportation
impact fee determined according to paragraph A of this section,
then the fee payer shall prepare and submit to the administrator
an independent fee calculation study for the land development
activity for which a building permit is sought. The independent
fee calculation study shall measure the impact of the development
in question on the road system by following the prescribed
methodologies and formats for the study established by the
administrator. Such study shall be subject to the approval of the
administrator. Any decision of the administrator pursuant to
this section may be appealed as set forth in section 15.84.100.
15.84.060 Payment of fee.
A. The fee payer shall pay the transportation impact fees
required by this ordinance to the administrator prior to the
issuance of a building permit for which the fee is imposed. For
structures other than residential structures, the fee payer shall
pay the transportation impact fees prior to issuance of the
building permit. No building permit may be issued for any non-
residential development listed in 15.84.050(A) of this ordinance
until such fee has been paid.
B. In lieu of cash, the transportation impact fee may be
paid by the use of credits which are created in accordance with
the provisions of 15.84.090 of this ordinance.
C. All funds collected pursuant to this ordinance shall be
deposited into.the appropriate Transportation Impact Fee Trust
Fund and used solely for the purposes specified in this
ordinance.
15.84.070 Use of funds.
A. Funds collected from transportation impact fees shall
be used for the purpose of capital improvements to transportation
facilities associated with the "Regional Transportation
Facilities List". Such improvements shall be of the type as are
made necessary by the new development. No funds shall be used
for periodic or routine maintenance. Funds collected may also be
used to reimburse city's street capital improvement budget for
funds previously expended to acquire segments of the Kern River
Freeway right-of-way. Funds shall be used exclusively for
capital improvements within the city or for projects outside this
area which are a direct benefit to the city.
B. In the event that bonds or similar debt instruments are
issued for advanced provision of road capital improvements for
which transportation impact fee may be expended, impact fees may
be used to pay debt service on such bonds or similar debt
instruments to the extent that the facilities provided are of the
type described in paragraph A above.
C. Each fiscal year, the administrator shall present to
the City Council a proposed capital improvement plan for road
construction projects as set forth in Section 15.84.030(C). Such
Plan shall indicate the approximate location, size, time of
availability and estimates of cost for all improvements to be
financed with transportation impact fees. Such plan shall be
adopted by the City Council following a noticed public hearing as
set forth in Government Code Section 66002.
15.84.080 Refund of fee paid.
A. If a building permit expires, is revoked or is
voluntarily surrendered and is therefore voided, and no
construction or improvement of land has been commenced, then the
fee payer shall be entitled to a refund, with interest at five
percent (5%) per annum, of the transportation impact fee paid as
a condition for its issuance.
B. Any funds not expended or encumbered by the end of the
calendar quarter immediately following five (5) years from the
date the transportation impact fee was paid shall be returned to
the then current owner or owners of lots or units of the
development project or projects on a prorated basis, with
interest at the rate of five percent (5%) per annum.

15.84.090 ExemDtions and credits.
A. The following'shall be exempted from payment of the
transportation impact fee:
1. Alterations or expansion of an existing building or use
of land where no additional living units will be produced over
and above those in the existing use of the property, the Use is
not changed, and where no additional vehicular 'trips will be
produced over and above 'those produced by the existing use.
2. Construction of accessory buildings or structures which
will not produce additional vehicular trips over and above those
produced by the principal building or use of the land.
3. The replacement of a lawfully permitted building,.
mobile home or structure, the building permit for which Was
issued on or before the effective date of this ordinance or the
replacement of a building, mobile home, or structure that was
constructed subsequent thereto and for which the correct'
transportation impact fee, which was owed at the time the
building permit was applied for, was paid or otherwise.provided
for, with a new building, mobile home, or structure of the same
use and at the same location, proVided that no additional
vehicular trips will be produced over and above those produced by
the original use of the land.
4. A building permit for Which the transportation impact
fee thereof has been or will be paid or otherwise provided for
pursuant to a written agreement, zoning approval or development
agreement which, by the written terms thereof, clearly and
unequivocally was intended to provide for the full mitigation of
such impact by enforcement of the agreement, zoning approval or
development order, and not by the application of this ordinance.
5. A building permit which does not result in any
'additional generation, or attraction of traffic as determined by
the administrator.
B. Credits:
1. No credit shall be given for site-related improvements,
local'roads or payments to special assessment or taxing
districts.
2. All other capital 'improvements for approved projects on
the Regional Transportation Facilities List except for those
improvements deemed site-related shall be credited against
transportation impact fees in the amounts to be established
pursuant to paragraph B.3. of this section. However,
determination of whether a capital improvement will be approved
for credit purposes lies exclusively with the administrator,
unless the improvement is not site-related.and is required under
a state or city development approval, in which case credits shall
be given to the extent required by law.
3. When a fee payer requests that a credit be created for
construction of any item on the "Project list".including
dedication of right-of-way for an approved road permitted by
paragraph B.2. of this section, he shall submit a project
description in sufficient detail and with complete cost estimates
consistent with the unit costs.established via the Regional
· Transportation Facilities List support data to permit the.
administrator to evaluate the request. Credit requests for land
dedication of roads listed in the Regional Transportation
Facilities List require:'
(a) Deed to convey title to the appropriate governmental
body;
(b) Title report prepared within sixty (60) days of
submission thereof;
(c) Value based upon one or more.current appraisals
prepared by fully qualified independent real property
appraisers. Selection of appraisers shall be subject
to approval by the administrator.
(d) Credits for land dedication shall be created when the
title to said land has been accepted by the city.
4. 'Credits for construction shall be created when the
construction is completed and accepted by the appropriate
governmental body for maintenance.
5. Fee payers claiming credits for constrUction shall
submit documentation sufficient to permit the determination of
whether such credits claimed are due and, if so, the amount of
such credits. The amount of credit shall be actual documented
costs, not to exceed the. facility,s Regional Transportation
Facilities List Total Cost.
C. Exemptions or credits must be claimed by the fee payer
at the time of the application for a building permit.
15.84.100 Appeal.
Any decision made by the administrator in the course of
administering this ordinance may be appealed to the City Council
by filing a written notice of appeal within ten days after the
decision with the City Clerk, setting forth the grounds for
appeal. The cost to file a notice of ~appeal is two hundred ·
seventy five dollars $275.00. The City Council shall hear such
appeal at a regular meeting no later than 3 weeks following the
filing of the appeal with the City Clerk. The appellant shall be
given notice of the appeal hearing no less than 3 days prior, to
said hearing. The Council may, upon said hearing, sustain or
overrule the decision of the administrator, which decision shall
be final and conclusive.

SECTION 2.
This Ordinance shall be posted in accordance with the
Bakersfield Municipal Code and. shall become effective ~thcsam¢
date as the equivalent county ordinance, not less than sixty (60) days ~rn
adop~on of this ordinance by thc City coun~l.

TRANSPORTATION IMPACT FEE
The total cost to construct the neCessary improvements was
determined by first making a list of roadway needs based on the
2010 plan and then applying a unit cost for each need. The
individual costs of all required improvements were then added to
generate an overall cost of the entire program. Once this was
completed, a cost per lane mile was determined using the roadway
network mileage.
In order to equitably distribute the cost of the total program to
the individual land uses approved in the 2010 General Plan, an
equation** was used containing several factors which are unique to
each development type. These factors are:
1. Average Daily Trip rate.. The average number of daily
trips produced by each
development type.
2. Peak Hour Trip rate ..... The average number of trips
produced by each development
type during a peak period.
3. Average trip length ..... The average length of a trip
produce by each development
type.
4. Percent New Trips ....... A measure of trips that are
produced solely by and for the
development type verses trips
that are combined such as
stopping at the market on the
way home from work.
These factors are.combined to determine the proportionate share of
the total cost for each land use. All of these costs are based on
average daily trip rates. Since average daily trip rates for
residential developments are constant, the 'fees for residential
units were based on a per unit cost rather than a cost per trip.
Credits were applied to all fees based on the estimated gas tax
revenues using the same factors as outlined above.

SUBJECT: PUSHCART FOOD VENDORS
Several months ago a pushcart food vendor complained that a permit
had been incorrectly issued for a location in front of the County
Administration Building at 1415 Truxtun. It was alleged that the
location was less than one hundred feet walking distance from a
restaurant or other establishment selling prepared food to the
public (cafeteria in basement) which would violate Municipal Code
Section 12.44.035(D)(7). It was determined the permit was issued
in accordance with the code as written. However, code language is
different from what was intended. The matter was referred to the
Urban Development Committee for review.
In order to correct the distance language and other shortcomings
identified in the review, staff has prepared an ordinance as a
separate Municipal Code chapter relating to pushcart food vendors.
The new chapter clarifies the criteria for measuring distance from
restaurants, requires vendors to have commercial liability
insurance naming the City as an additional insured, indemnifies the
City from claims, increases the distances between vendors from 100
to 150 feet, requires pushcarts to be self contained and prohibits
adjacent crates, coolers, tables and chairs. While this appears to
be a comprehensive chapter, issues remain. The above changes were
discussed with many of the vendors. Generally, they feel they are
being regulated out of business. The following issues have been
identified:
1. The dictionary defines a pushcart as a cart pushed by
hand, especially one used by street vendors. None of the
carts currently dispensing hot dogs meet this definition.
Pushcarts are not currently operated as self contained
units and would not be allowed to operate under the new
ordinance.
2. According to the Community Services Manager, outdoor food
vendors in the vicinity of the Convention Center pose a
potential conflict with the concessionaire that has
contracted with the City to provide food service at the
facility. Litter is also a potential problem with ticket
lines that form for concerts, trade shows, conventions
and with the anticipated crowds for basketball games.
The Traffic Division advises that the right-of-way on the
east side of N Street is wide enough to accommodate as
many as four vendors. Prohibition of pushcarts in the

area of the Convention Center, as has been suggested,
would be discriminatory and is not a viable solution.
3. Outdoor food vendors have complained that their business
is being hurt by other vendors in the vicinity. These
vendors were well over 150 feet apart which raises the
question whether the distance between vendors should be
greater than 150 feet.
4. The owner of Westchester Liquors complained that a vendor
across F Street by Pep Boys was hurting his sandwich
business. The vendor claims the Pep Boys manager was
hostile toward him for having his pushcart on the
sidewalk along the side of their building. The location
meets code requirements.
5. Regulation of this activity takes considerable staff time
Vendors have looked to staff to act as mediators in
dispUtes. Currently, permits cost $25.00. In order to
recover costs, the fee should be increased.
6. A survey of five vendors revealed that two had no
liability insurance. One had $1 million and the other
two had $100,000 and $300,000. The potential liability
to the City is $1 million.

ORDINANCE NO.
AN ORDINANCE REPEALING SECTION
12.44. 035 AND ADDING. CHAPTER 5.'45 OF
THE BAKERSFIELD MUNICIPAL CODE
RELATING TO PUSHCART FOOD VENDORS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 12.44.035 of the Bakersfield Municipal Code is
'hereby repealed.
SECTION 2.
Chapter 5.45 is hereby added to the Bakersfield
Municipal. Code to read as follows:
Chapter 5.45.
PUSHCART FOOD VENDORS
Sections:
5.45.010 Definitions.
'5.45.020 Permit required.
5.45.030 ApPlication - Issuance - Fee.
5.45.040 Regulations.
5.45.050 Revocation.
5.45.060 Appeal.
5.45. 010 Definitions.
Whenever used in this chapter, unless a different
meaning clearly appears from the context, the words set out in
this section shall have the following meanings:
A. "Person" means any individual, partnership,
corporation or association of any nature whatsoever.
B. "Pushcart food vendor" means any Person who engages
in a business of selling food and/or drinks on any city sidewalk
within the city, and does not include any business occupying a
structure upon a permanent foundation constructed in accordance
with the requirements of Chapter 15.12 of this code.
5.45.020 Permit required..
It is unlawful for any person to operate as a pushcart
food vendor in the city in violation of this chapter, or without
having first procured and maintained a valid permit from the city
manager or his designee.
5.45.030 Application - Issuance - Fee.
· A. Applications for permits under this section shall be
made on forms to be furnished by the city manager or his designee,
shall be submitted no less than fourteen days prior to
commencement of business, shall be signed under penalty of perjury
by the applicant and shall require the following information:
1. The name, address and' telephone number of the
applicant;
2. The name, address and telephone number of the
business;
3. Prior permits held and whether such permits
were ever revoked or suspended and the reasons therefor;
4. If the pushcart is to be stationary, the exact
location where the pushcart will be situated;
5. If the pushcart is to be mobile, the proposed
areas within which the pushcart will be operated;
6. The business tax certificate number of the
business;
7. Whether a health department permit for this
business has been issued.
B. The application may be accompanied by a written
approval'from the owner of any retail business located within
fifty feet in either direction and on the same side of the street
as the proposed fixed location (if any).
C. The application shall be accompanied by evidence,
satisfactory to the city manager or his designee, of general
liability insurance providing coverage on an occurrence basis for
bodily injury, including death of one or more persons, property
damage and personal injury, with limits as required by the city.
Insurance required of the applicant hereunder shall be primary
insurance as to the city, its mayor, council, officers, agents,
employees and volunteers and any insurance or self-insurance'
maintained by the city, its mayor, council, officers, agents,
employees and volunteers shall be considered excess insurance,

over and above the applicant's insurance and shall not contribute
with it. The applicant shall.save, hold harmless and indemnify
the city, its officers, agents, employees and volunteers from all
claims, demands, damages, judgments, costs or expenses in law or
equity that may at any time arise from, or are in any way related
to, any activity addressed by this chapter.
D. If the application is not accompanied by the signed
approvals described in subsection B., above, the city manager or
his designee shall, within ten days of receipt of the application,
set. a hearing upon the application. The city manager or his
designee shall by mail notify the applicant and each business
operator whose approval was not obtained, of the time and place of
such hearing, which shall be not less than five days after the
date~such notices are mailed. At such hearing, any owner of any
such business may respond as to the criteria set forth in
subsections E.4, through E.6. of this chapter. Within five
business days of the conclusion of the hearing, a written decision
shall be mailed to the applicant.
E. The city manager or his designee shall, in his
discretion, issue a permit if he finds:
1. That the application is complete and truthful;
2. That the location of the pushcart is no less
than one hundred feet from a hypothetical line extending out to
the public sidewalk from the outer edges of the main entrance of
any establishment within which food prepared on the premises is
sold to the public. For any establishment having more than one
entrance, the city manager or his designee shall determine which
entrance is the main entrance to the establishment.
3. That the location of the pushcart is no less
than one hundred fifty (150) feet, measured radially, from a
location specified in a permit issued another vendor pursuant to
the provisions of this chapter.
4. The business for which the application is made
will .be maintained and conducted in accordance with all laws of
the city and the state.
5. That operation of such business at such
location will not present any substantial hazard to vehicular or
pedestrian traffic.
6. That operation of such business will not create
an unreasonable hardship for any adjacent or neighboring business.
7. That the applicant has obtained insurance as
required under subsection C of this section.

8. That a valid business tax certificate has been
issued for this business.
9. That a health department permit has been issued
for this business.
10. That the applicant has not had a permit,
issued under this section, revoked, unless the city manager finds
that the reasons for such revocation are unrelated to this
application.
F. Ail permits issued under this chapter shall remain
in effect until the following June 30, unless earlier suspended or
revoked.
G.' The applicant shall pay a fee not to exceed the cost
of processing any such application and inspecting such business as
set forth in Section 3.70.040.
H. Permits may be issued with conditions to ensure that
the pushcar{ will be operated in a safe and legal manner, will not
disturb the peace and quiet of the neighborhood and will not
constitute an undue burden on city resources.
5.45.040 Regulations.
A. No permitholder shall shout, make any outcry, blow
a horn, ring a bell or use any other sound device including any
loudspeaker, radio or amplifying system where sound of sufficient
volume is emitted or produced therefrom capable of being plainly
heard upon the streets, alleys, parks or other public places.
B. Ail pushcarts shall be self-contained, and no
tables, chairs, boxes or objects other than the permitted pushcart
shall be permitted on the public sidewalk.
C. Any permit issued pursuant to this chapter shall be
non-transferrable, and shall be valid only'as to the applicant and
location provided .on the application for such permit.
D. Except as expressly permitted by and in accordance
with the provisions of.Chapter 12.44 of this code, the sale, offer
to sell, advertising or display of merchandise on any street or
sidewalk in the city is prohibited.
E. The permitholder shall maintain the required
insurance throughout the term of the permit.

5.45.050 Revocation.
Any permit' issued pursuant tO this chapter .shall be
immediately revoked by the city manager whenever he finds:
A. That misrepresentations were made on the
application; or
B. That the applicant has been convicted of a crime
substantially related to the qualifications, functions or duties
of the business for' which application is made, unless he has
obtained a certificate of rehabilitation; or
C. That the applicant has done any act involving
dishonesty, fraud or deceit with the intent to substantially
benefit himself or another, or substantially injure another; or
D. That any of the terms or conditions of said permit
have been violated, or that the business has been operated in
violation of local, state or federal law.
5.45.060 Appeal.
A. Should any applicant be dissatisfied with the
decision of the city manager or his designee not to grant a permit
or for the revocation of a permit, then said applicant may, no
later than ten days after notice of such decision is deposited in
the United States mail, addressed to the applicant or permittee at
the address provided on the application,, make written objection to
the city council setting forth the grounds for dissatisfaction,
whereupon the council shall hear said objections at a regular
meeting no later than three weeks following the filing of the
objection with the city clerk. The applicant shall be given
written notice no less than three days prior to said hearing. The
council may, upon said hearing, sustain, suspend or overrule the
decision of the city manager, which decision shall be final and
conclusive.
B. Pending the hearing before the council, the
decision of the city manager shall remain in full force and effect
and any reversal thereof, by the .city council shall not be
retroactive but shall take effect as of the date of the council's
decision.
SECTION 2.
This Ordinance shall be posted in accordance with the
Bakersfield Municipal Code and shall become effective thirty (30)
days from and after the date of its passage.
