ACCEPTANCE OF ASSESSMENT APPORTIONMENT PROCEDURE AND RE VEST Q TO RECORD AMENDED ASSESSMENTS, have reviewed Exhibit C (Description of Assessment Apportionment Procedure) included in the attached Engineer's Report, describing the procedure used to apportion a share of the unpaid assessment principal amount for existing Assessment 2138 in AD 94-3 to the lots and parcels created by the recordation of said TR 5844,A. Pursuant to a review of Exhibit C, the undersigned has determined that the amended assessment amounts shown on said Exhibit A have been apportioned in accordance with the benefits the parcels will xeceive from the improvements financed by AD 94-3, based on current parcel coning and with proposed uses. Therefore, the undersigned waives notice and hearing before the City Council on this assessment apportionment, accepts the procedure used for the requested apportionment of the principal balance for existing Assessment 2138, and requests and consents to the recordation of the. apportioned assessments on the properties for which the undersi ned is listed as the g owner on the accompanying Exhibit A, and to the amended assessment amounts shown thereon. On June 18,1998, we mailed to all interested parties (the property owner, bond counsel, underwriter, and you) all relevant documents related to the assessment segregations of properties in AD 94-3 associated with the park property exchange between the City of Bakersfield and Castle & Cooke in Sections 6 and 7, T 30 S, R 27 E, MDB&M. This apportionment was labeled "Assessment and Diagram Amendment No. 74," and the modified parcels were assigned Amended Assessment Nos. 2374 through 2377. Since then we were informed that the park property exchange process has been delayed. This was a circumstance not known to us at the time we prepared this apportionment. Therefore, in order to avoid a possible gap that would affect future apportionment and amended assessment numbering, we proposed to John to use "Assessment and Diagram Amendment No. 74" and Amended Assessment Numbers starting with 2374 for the next pending subdivision in AD 94-3 (Tract No. 5844-Phase A) and continue with sequential numbering as new subdivisions are approved. When the park property exchange deed is recorded, we will assign new apportionment and amended assessment numbers in sequence at that time (and change the documents and maps originally labeled "Assessment and Diagram Amendment No. 74") if the exchange is finalized in the configuration presented on those documents. However, if the phase of Ten. Parcel Map 10522 that includes the existing parcel from which the new park will be created (or anything else) records prior to recording the property exchange deed, we will need to do a new apportionment under a new agreement and fee. The remainder parcel created by TR 5844- A is assigned Amended Assessment Number (hereafter "Amended Assessment") 2374, the 21 R-1 lots (Lots 1 through 21 in TR 5844-A) are Amended Assessments 2375 through 2395, respectively, and the two landscape lots (Lots A and B in TR 5844-A) are identified as Amended Assessments 239b and 2397, respectively, B. Assessment 2138 is located in the. Silver Creek Area of AD 94-3, hereafter "Silver Creek". Silver Creek is one of six community areas within AD 94-3. AD 94-3 funded the cost to acquire certain improvements that are required to be constructed, or are expected to be required, as conditions of final neap or site plan approvals within the six AD 94-3 community areas. All of the Silver Creek improvement acquisition costs funded by AD 94-3 were allocated only to tie Silver Creek lots and parcels, The AD ~94~3 Engineer's Report, approved Se~tennber 27, 1995, describes the rraethod of allocating the AD 94-3 costs to each assessed parcel. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ~RIGINAI~, ASSESSMENT AMOUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 2138 TO AMENDED ASSESSMENTS 2374 THROUGH 2397: A. The total original AD 94-3 Assessment Principal for Assessment 2138 is apportioned to the 21 R•1 lots in TR 5844-A and the undivided remainder portion of ATN 498-010-56-00-5 in accordance with the Assessment Apportionment Method described on page D-19 of AD 94-3 Engineer's Report Exhibit D, Description of Assessment Spread Method. The Exhibit D Assessment Apportionment Method is summarized below for reference: 1. When a parcel is subdivided into a tract phase and a remainder, as in the case of Assessment 2138, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel indirect proportion to their total acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share pear lot, excluding landscape and well site lots, parks, or drama e g sump lots within the new tract. 3. Reference is made to the enclosed "Product Description" table which was prepared based on the information obtained from the Design Engineer, and which corresponds to the total number of future single-family residential lots shown on the above-referenced Vesting Tentative Tract Maps Nos. 5446, 564, 5844, 5845, and 5846. Therefore, in accordance with the above described AD 94- 3 Assessment Apportionment Method, and the revised phased development of Assessment 2138, the Assessment 2138 total original assessment principal amount has been apportioned among the four new Development Areas (still being a part of Assessment 213$) in proportion to their acreage as shown in the abavewreferenced Product Description.
