The AD 94-3 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance Bakersf~'eld Municipal Code Sect~'on 13.48. ~7~-Benefit Spread, Please see the AD 94-3 Engineer's Report for a detailed description of the AD 94-3 Assessment Spread Method. By Change and Modification No. 1 (Assessment and Diagram Amendment No, 22) certain park improvements originally planed for construction in the Seven Oaks Area (South) were transferred to Seven Oaks Area North, and several parcel assessments (including Assessment 2286) are affected by that change. Please see the AD 94-3 Modified Engineer's Report for a detailed description of Change and Modification No. 1 procedures. 29352EXC ~ 09/Q4198 C. AD 94M3 also financed the cost to pay off the remaining principal balances of the existing AD 82- 1 assessments and of the existing AD 86-2 Reassessments for parcels within AD 94-3 , The Seven oaks North Community Area properties did not have an existing AD 86-2 reassessment balance. The cost to pay off those existing Assessments and Reassessments for each ATN is included in the total amount confirmed to assessment on each of the AD 94-3 parcels and within the total amount apportioned to the new lots and parcels created by the above-referenced TR 5$76-G. D. The total original assessment principal, as based on the Amended Assessment Roll for the Second Amended Notice of Assessment as modified by Change and Modification No. 1, and the remaining assessment principal amount effective January 1,1998, at the beginning of the 1998/99 Tax Year, hor Assessment 2286 are $224,655,81 and $199,932.04, respectively. The total original assessment and the remaining principal balance for Assessment 2286 are segregated and apportioned to the lots and parcels in AD 94-3 created by the above-referenced TR 5876-G, as described below, 2, DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAL ASSESSMENT AMOUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 2286 TO AMENDED ASSESSMENTS 2501 THROUGH 2512: A. The total original AD 94-3 Assessment Principal for Assessment 2286 is apportioned to the 9 residential lots in TR 5876-G and the undivided remainder portion of Assessment 2286 in accordance with the Assessment Apportionment Method described on page D~ 19 of AD 94w3 l~,ngineer's Report Exhibit D, Description of Assessment Spread Method, The Exhibit D Assessment Apportionrrient Method is summarized below for reference; 1, when a parcel is subdivided into a tract phase and a remainder, as in the case of Assessment 2286, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total .,acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within the new tract. \ 3 , The remaining principal balance of the original assessment at the time .the apportionment is made will then be allocated to each lot and remainder parcel created by the subdivisio~i, in direct, proportion to the share of the original assessment principal amount allocated to each new lot as described above. B. As shown in AD 94-3 Engineer's Report Exhibit C tables, Seven Oaks North Area was planned for development into. several future Development Areas identified as follows: Windsor Park, Estates, Regency, and North PUD (all located east. of Kern River Canal), and future Commercial and Multi-family developments (located west of Kern River Canal). The portion of Seven Oaks North Area located west of Kern River Canal (future commercial and multi-family developments) was separated from the portion located east of Kern River Canal by Parcel Map No. 10299 (and, consequently, by Assessment and Diagram Amendment No. 33}, and is not affected by this apportionment. The design engineer (Martin-McIntosh Engineering) retained by Assessment 22$6 property owner has 29352EXC 2 09104198 provided the Public Works Department and Assessment Engineer for AD 94-3 with the revised plan for phased development of the area east of Kern River Canal. As described in Assessment and Diagram Amendment Nos. 11, 12, 14, 15,18, 27, 31, 32, 45, 51, 53, 54, 55, 59, 60, and 71 the Development Areas listed above (Windsor Park, Estates, Regency, and North PUD) are reconfigured into the following new Development Areas based on the typical future lot-sizes and lot product types (not corresponding to each other in order listed): Windsor Park III, Windsor Park 18~ II, Lexington I & II, and Re enc I g Y II. Four Vesting Tentative Tract Maps (No. 5425, No. 5426, No. 5427, and No. 5838) covering this portion of Seven Qaks North Area (and one of them covering Assessment 228b) are on file with the Public Works Department, Reference is made to the enclosed "Product Description" table which was prepared based on the information obtained from the Design Engineer, and which corresponds to the total number of future single-family residential lots shown on the above-referenced Vesting Tentative Tract Maps. A portion of Vesting Tentative Tract No, 5425 and a portion of Vesting Tentative Tract No: 5427 have been reconfigured by Vesting Tentative Tract No. 5876 (Ten TR 5876) and Vesting Tentative Tract No. 5877 (Ten TR 5877). Tract No. 5876-Phase A was the first phase of any of said two reconfigured tentative tract maps that was recorded (on December 31, 1997}. Before Tract No. 5876-Phase A was recorded, all recorded tracts (Nos. 5425- Phases A, B, C, and D, 5426-Phases A and B, and 5838-Phases A, B, and C) have followed the established lot layout for respective vesting tentative tract maps, and accordingly, have followed the assessment allocation for the four Develo ment Areas p shown on the Product Description table. With the two new vesting tentative tracts (Nos. 5876 and 5877), the following has changed in comparison to the original subdivision la out y per Vesting Tentative Tract Nos, 5425 and 5427: 1. The remaining, unsubdivided portion of Regency I & II Development Area has 2 lots less than the same area per Ten TR 5425 and Ten TR 5427 (58 vs. 60}; 2. The remaining unsubdivided portion of Lexington I & II Develo ment Area has 1 p rot more than the same area per Ten TR 5427 (147 vs, 146}; 3. The sump originally located at the southern ends of Ten TR 5425 and Ten TR 5427 (just north of Ming Avenue) has been eliminated; and, 4, Two new sumps have been created within Ten TR 5877, adjacent to Buena Vista Canal. Based on the above-listed four changes, the originally established assessment allocation was adjusted per directions from the Public Works Department, as follows: The assessment amounts for the remainders of Regency I ~ II and Lexington I & IZ Development Areas that were unpaid at the time of preparing apportionment documents for Assessment and Diagram Amendment No. 51(pursuant to TR 5876- Phase A) were combined and respread to the same development areas based on new net areas, taking into consideration locations of new sumps. This resulted in an increase of original assessments for residential lots in Regency ~ & II area (from $4,171,24 to $5,056.40), and a decrease of assessments for residential lots in Lexington I & II area (from $3,877.84 to $3,558.96). Also, it needs to be noted 29352>aXC 3 09104/98 that 16 original lots in Tract No. 5425-Phase D (within, Regency I & II area) have been reconfigured into 14 lots per Parcel Map Waiver No. P97-0444 (as described in Apportionment No. 36), and the new original assessment amount for the 141ots is $4,767.13/lot. After the above-referenced Apportionment No, 36 was completed, a subdivision map for Tract No. 5877-Phase A was recorded, bringing all unmodified lots in Tract No, 5425-Phase D and all lots in Parcel Map Waiver No. P97-0444 into one private, gated community (per Apportionment No. 56}, which conforms to the layout of Ten TR 5877. With this assessment reallocation between Lexington I & II and Regency I & II Development Areas, assessment amounts for Windsor Park I & II and Windsor Park III Development Areas are not changed. The Windsor Park areas are excluded from the assessment reallocation because: i} the sump relocation is entirel . , ,. , y within the Regency I & II and Lexington I ~i II areas; and, ~z) based on the finding that the. decrease in the total sump area of approximately 2.6 acres would not significantly change the assessment amounts for the Windsor Park areas, but rather would create uneven assessments between neighboring lots in the existing tract phases that abut lots in future phases. As calculated in Apportionment No, 71, the remainder parcel created by Tract No. 5877- Phase ~ (Assessment 228b) consists only of a portion of Lexington I & II Develo ment p Area, Therefore, in accordance with .the above described AD 94-3 Assessment Apportionment Method, and the revised phased development of Assessment 2286, the Assessment 2286 total`original assessment principal amount has been apportipned anion the g four new Development Areas as follows: 1. As described above, originally allocated assessment shares for Windsor Park I & II and Windsor Park III Development Areas have not been changed, and are no lon er g apart of the unsubdivided remainder parcel e 2, The remainders of Lexington I & II and Regency I & II Development Areas were reconfigured based on Vesting Tentative Tract Nos. 5876 and 5877, and the data for the reconfigured areas is shown on the enclosed "Revised Product Description" table, 3, As phases of future Tract Nos. 5426 and 5876 are recorded, each lot within certain Development Area will be allocated equal-per-lot share of the total share for that Development Area, based on the number of proposed single~family residential lots for that Development Area, as shown on the enclosed Revised Product Descri tion p table and the above-referenced Vesting Tentative Tract Maps. The Tract No, 5876-Phase G 9single-family residential lots are a part of Lexington I & II Development Area. Each of the 9single-family residential lots in TR 5876-G is allocated one 147-th share of the total revised original assessment share allocated to the Lexington I ~. II Development Area (based on the enclosed Revised Product Description table), The remainder parcel created by the recordation of TR 5876-G (Amended Assessment 2501) is allocated the remainder of Lexington I & II area assessment share (as calculated by Assessment and Diagram Amendment No. 51, Assessment and Diagram Amendment No. 29352EXC 4 09/04/98 53, Assessment and Diagram Amendment No. 60, and this Assessment and Diagram Amendment No. 79, as described above}. Each parcel's total original amended assessment amount shown on Exhibit D, attached to the. Engineer's Report for this AD 94-3 Assessment and Dia ram Amendment No. 79 is the g new parcel's original assessment share, and is the amount that should be used to calculate the Bond Reserve credit the new parcel would receive if the parcel owner elects to re a .. p pY the total remaxning balance for Amended Assessments 2501 through 2512. The apportioned assessment share also includes each new parcel's share of the cast to pay off and refinance the existing AD 82-1 Assessment total amount included in the total original amount for Assessment 2286. Apportionment of the Remaining Assessment Princi al for Assessment 2286 to Amended p Assessments 2501 through 2512; The total unpaid assessment principal amount for Assessment 2286 is apportioned to the new lots and parcels created by the recordation of TR 5876-G indirect proportion to the original Assessment 2286 share apportioned to each new .lot and parcel, as shown on Exhibit A, Amended Assessment Roll, attached to the Engineer's Re ort for this AD 94-3 p Apportionment No. 79. DESCRIPTION OF EXISTING ASSESSMENT 2286; A, Existing Assessment 2286 (hereafter "Assessment 2286"} is located in the City of Bakersfield. Assessment 2286 consists of an undivided portion of Section 6, Township 30 South, Range 27 East, Mount Diablo Base and Meridian (T 30 S, R 27 E, MDB&M), It was created by Assessment and Diagram Amendment No. 71 as a remainder parcel created by Tract No. 5877- Phase C. By Assessment and Diagram Amendment No, 22 (Change and Modification No. 1) certain parcels in AD 94-3 were modified, as described below. Assessment and Diagram Amendment No. 22 only modified parcel assessment amounts and it did not change parcel configuration, Tract No, 5876-Phase G (TR 587d-G) subdivides a portion of Assessment 2286 identified as a remainder of I{ern County Assessor's Tax Number (ATN) 390-010-77-00-1 into 9 single-family residential lots (Lots 1 through 9 in TR 5876-G), one storm drainage basin lot, one canal lot, and one remainder parcel. The remainder parcel is identified as Amended Assessment Number ("Amended Assessment") 2501, the 9 R-1 lots (Lots 1 through 9 in TR 5876-G) are identified as Amended. Assessments 2502 through 2510, respectively, the storm drainage basin lot (Lat A in TR 5876-G) is Amended Assessment 2511, and the canal lot (Lot B in TR 5876-G) is Amended Assessment 2512, B, Assessment 2286 is located in the Seven Oaks Area .(North) of AD 94-3, hereafter "Seven Oaks North." Seven Oaks North is one of six community .areas within AD 94-3, AD 94-3 funded the cost to acquire certain improvements that are required to be constructed, or are expected to be required, as conditions of final map or site plan approvals within the six AD 94-3 community areas, A11 of the Seven Oaks North improvement acquisition costs funded by AD 94-3 were allocated only to the Seven Oaks North lots and parcels except the Buena Vista Road improvements ~vhich were allocated to both the Seven Oaks North and Seven Oaks South areas. The AD 94-3 Engineer's Report, approved September 27, 1995, describes the method of allocating the AD 94-3 costs to each assessed parcel, The AD 94-3 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance Bakersfield Municipal Code Sect~'on 13~ 08.470-Benefit Spread. Please see the AD 94-3 Engineer's Report for a detailed description of the AD 94-3 Assessment Spread Method, By Change and Modification No. 1 (Assessment and Diagram Amendment No, 22) certain park improvements originally planed for construction in the Seven Oaks Area (South) were transferred to Seven Oaks Area North, and several parcel assessments (including Assessment 22$6) are affected by that change. Please see the AD 94-3 Modred Engineer's Report for a detailed description of Change and ModiEcation No, 1 procedures, 29352EXC 1 09/04/98 C. AD 94-~ also financed the cost to pay off the remaining principal balances of the existing AD 82- 1 assessments and of the existing AD 86-2 Reassessments for parcels within. AD 94-3. The Seven Qaks North Community Area properties did not have an existing AD 86-2 reassessment balance. The cost to pay off those existing Assessments and Reassessments for each ATN is included in the total amount confirmed to assessment on each of the AD 94-3 parcels and within the total amount apportioned to the new lots and parcels created by the above-referenced TR 5876-G. D. The total original assessment principal, as based on the Amended Assessment Roll for the Second Amended Notice of Assessment as modified by Change and Modification No. 1, and the remaining assessment principal amount effective January 1,1998, at the beginning of the 1998199 Tax Year, far Assessment 2286 are $220,655.81 and $199,932.04, respectively. The total original assessment and the .remaining principal balance for Assessment 2286 are segregated and apportioned to the lots and parcels in AD 94-3 created by the above-referenced TR 5876-G, as described below, 2. DESCRIPTIt~N QF THE PRQCEDURE USED TQ SEGREGATE AND APPORTION THE ORIGINAL ASSESSMENT AMQUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 2286 TO AMENDED ASSESSMENTS 2501 THROUGH 2512: A. The total original AD 943 Assessment Principal for Assessment 2286 is apportioned to the 9 residential lots in TR 5876-G and the undivided remainder portion of Assessment 2286 in accordance with the Assessment Apportionment Method described on page D-19 of AD 943 Engineer's Report Exhibit D, Description of Assessment Spread Method. The Exhibit D Assessment Apportionment Method is summarized below for reference: 1, when a parcel is subdivided into a tract phase and a remainder, as in the case of Assessment 2286, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2, The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within.the new tract. 3. The remaining principal balance of the original assessment at the time the apportionment is made will then be allocated to each lot and remainder parcel created by the subdivision, in direct proportion to the share of the original assessment principal amount allocated to each new lot as described above. B. As shown in AD 94-3 Engineer's Report Exhibit C tables, Seven Qaks North Area was planned for development into several future Development Areas identified as follows: Windsor Park, Estates, Regency, and North PUD (all located east of Kern River Canal), and future Commercial and Multi-family developments (located west of Kern River Canal). The portion of Seven Qaks North Area located west of Kern River Canal (future commercial and multi-family developments) was separated from the portion located east of Kern River Canal by Parcel Map No. 10299 (and, consequently, by Assessment and Diagram Amendment No. 33), and is not affected by this apportionment. The design engineer (MartiniMclntosh Engineering) retained by Assessment 2286 property owner has 293S2EXC 2 09/04/98 provided the Public Works Department and Assessment Engineer for AD 94-3 with the revised plan for phased development of the area east of Fern River Canal. As described in Assessment and Diagram Amendment Nos, 11, 12,14, 15, 18, 27, 31, 32, 45, 51, 53, 54, 55, 59, 60, and 71 the Development Areas listed above (Windsor Park, Estates, Regency, and North PUD) are reconfigured into the following new Development Areas based on the typical future lot-sizes and lot product types (not corresponding to each other in order listed); Windsor Park III, Windsor Park I & II, Lexington I & II, and Regency I II. Four Vesting Tentative Tract Maps (No. 5425, No, 5426, No. 5427, and No, 5838) covering this portion of Seven oaks North Area (and one of them covering Assessment 22$6) are on file with the Public Works Department. Reference is made to the enclosed "Product Description" table which was prepared based on the information obtained from the Design Engineer, and. which corresponds to the total number of future single-family residential lots shown on the above-referenced Vesting Tentative Tract Maps. A portion of Vesting Tentative Tract No, 5425 and a portion of Vesting Tentative Tract No, 5427 have been reconfigured by Vesting Tentative Tract No, 5876 (Ten TR 5876) and Vesting Tentative Tract No. 5877 (Ten TR 5877), Tract No, 5876-Phase A was the first phase of any of said two reconfigured tentative tract maps that was recorded (on December 31, 1997), Before Tract No, 5876-Phase A was recorded, all recorded tracts (Nos. 5425- Phases A, B, C, and D, 5426-Phases A and B, and 5.838-Phases A, B, and C) have followed the established lot layout for respective vesting tentative tract maps, and accordingly, have followed the assessment .allocation for the four Development Areas shown on the product Description table. With the two new vesting tentative tracts (Nos. 5876 and 5877), the following has changed in comparison to the original subdivision layout per Vesting Tentative Tract Nos. 5425 and 5427; 1, The remaining, unsubdivided portion of Regency I & II Development Area has 2 lots less than the same area per Ten TR 5425 and Ten TR 5427 (58 vs. 60); 2. The remaining unsubdivided portion of Lexington I & II Development Area has 1 lot more than the same area per Ten TR 5427 (147 vs, 146); 3. The sump originally located at the southern ends of Ten TR 5425 and Ten TR 5427 (just north of Ming Avenue) has been eliminated; and, 4. Two new sumps have been created within Ten TR 5877, adjacent. to Buena Vista banal. Based on the above-listed four changes, the originally established assessment allocation was adjusted per directions from the Public works Department, as follows; The assessment amounts for the~re~iainders of Regency I ~i II and Lexin ton I & g r~ Development Areas that were unpaid at the time of preparing apportionment documents for Assessment and Diagram Amendment No. 51 (pursuant to TR 5876- Phase A) were combined and respread to the same development areas based on new net areas, taking into consideration locations of new sumps, This resulted in an increase of original assessments for residential lots in Regency I & II area (from $4,171,24 to $S,o56,40}, and a decrease of assessments for residential lots in Lexington I & II area (from $3,877,84 to $3,558.96), Also, it needs to be noted 29352EXC 3 U9104198 that 16 original lots in Tract No. 5425-Phase D (within Regency I & II area) have been reconfigured into 14 lots per Parcel Map Waiver No. P97-0444 (as described in Apportionment No. 36), and the new original assessment amount for the 141ots is $4,767,13/1ot. After the above-referenced Apportionment No. 36 was com leted, P a subdivision map for Tract No. 5877-Phase A was recorded, bringing all unmodified lots in Tract No, 5425-Phase D and all lots in Parcel Map Waiver No. P97-4444 into one private, gated community (per Apportionment No. 56}, which conforms to the layout of Ten TR 5877. With this assessment reallocation between Lexington I & II and Regency I & II Development Areas, asseV-snnent amounts for Windsor Fark I & II and Windsor Park III Development Areas are not changed. The Windsor Park areas are excluded from the assessment reallocation because; i) the sump relocation is entirely within the Regency I & II and Lexington I & II areas; and, ii) based on the finding that the decrease in the total sump area of approximately 2.6 acres would not significantly change the assessment amounts for the Windsor Park areas, but rather would create uneven assessments between neighboring lots in the existing tract phases that abut lots in future phases. As calculated in Apportionment No. 71, the remainder parcel created by Tract No. 5877- Phase ~ (Assessment 2286) consists only of a portion of Lexington I & II Develo ment p Area. Therefore, in accordance with the above described AD 94-3 Assessment Apportionment Method, and the revised phased development of Assessment 2286, the Assessment 228b total original assessment principal amount has been apportioned among the four: new Development Areas as follows: 1, As described above, originally allocated assessment shares for Windsor Park I & II and Windsor Park III Development Areas have not been changed, and are no longer a part of the unsubdivided remainder parcel. 2, The remainders of Lexington I ~i II and Regency I & II Development Areas were reconfigured based on Vesting Tentative Tract Nos, 5876 and 5$77, and the data for the reconfigured areas is shown on the enclosed "Revised Product Description" table. 3, As phases of future Tract Nos. 5426 and 5876 are recorded, each lot within certain Development Area will be allocated equal-per-lot share of the total share for that Development Area, based on the number of proposed single-family residential lots for that Development Area, as shown on the. enclosed Revised Product Description table and the above=referenced Vesting Tentative Tract Maps, The Tract No. 5876-Phase G 9single-family residential lots are a part of Lexington I & II Development Area. Each of the 9single-family residential lots in TR 5876-G is allocated one 147-th share of the total revised original assessment share allocated to the Lexington I II Ievelopment Area (based on the enclosed Revised Product Description table), The re~naind~r parcel created by the recordation of TR 5876-~ (Amended Assessment 2501) is allocated the remainder of Lexington I & II area assessment share (as calculated by Assessment and Diagram Amendment No. 51, Assessment and Diagram Amendment No. 29352EXC 4 09/04/98 53, Assessment and Diagram Amendment No. 60, and this Assessment and Diagram Amendment No, 79, as described above). Each parcel's total original amended assessment amount shown on Exhibit D, attached to the Engineer's Report for this AD 94-3 Assessment and Diagram Amendment No. 79, is the new parcel's original assessment share, and is the amount that should be used to calculate the Bond Reserve credit the new parcel would receive if the parcel owner elects to prepay the total remaining balance for Amended Assessments 2501 through 2512, The apportioned assessment share also includes each new parcel's share of the cost to pay off and refinance the existing AD 82.1 Assessment total amount included in the total on final amount for g Assessment 2284. For a detailed description of the Assessment Apportionment Method see AD 94-3 Engineer's Report Exhibit D. C. Apportionment of the Remaining Assessment Principal for Assessment 2286 to Amended Assessments 2501 through 2512: The total unpaid assessment principal amount for Assessment 2286 is apportioned to the new lots and parcels created by the recordation of TR 5876-G indirect ro onion to the on final pp g Assessment 2286 share apportioned to each new lot and parcel, as shown on Exhibit A, Amended Assessment Roll, attached to: the Engineer's Report for this AD 94-3 Apportionment No. 79.
