Said Amended Assessment Diagram amends ,the -map entitled "Assessment Diagram of City of Bakersfield Assessment District No. 94-3," recorded September 29, 1995, in Book 12 of Maps of Assessment and Community Facilities Districts, at Pages 94 through 108, in the Office of the County Recorder, of the County of Kern, California. NOTICE IS FURTHER GIVEN that upon recording of this Notice in the office of the County Recorder, the several amended assessments on the lots, pieces and parcels shown on the Amended Assessment Diagram (Assessment and Diagram Amendment No. 84) of Assessment District No. 94-3 shall become a lien upon the lots or portions of lots assessed, respectively. This amendment evidences the completion of statutory proceedings to divide the lien of special assessments previously levied on the parcels of land shown on the amended diagram, to conform with the divisions in the parcels themselves. Reference is made to said Amended Assessment Diagram and Amended Assessment Roll recorded in the 1 office of the Superintendent of Streets of the City of Bakersfield. I have reviewed Exhibit C (Description of Assessment Apportionment Procedure) included in the attached Engineer's Report, describing the procedure used to apportion a share of the unpaid assessment principal amount for existing Assessment 2042 in AD 94-3 to the lots and parcels created by the recordation of said TR .5877-D. Pursuant to a review of Exhibit C, the undersigned has determined that the amended assessment amounts shown on said Exhibit A have been apportioned in accordance with the benefits the parcels will receive from the i~.provements financed by AD 94-3, based on current parcel zoning and with proposed uses. DESCRIPTION OF EXISTING ASSESSMENT 2042: A. Existing Assessment 2042 (hereafter "Assessment 2042") is located in the City of Bakersfield. Assessment 2042 is described as Kern County Assessor's Tax Number (ATN) 390-250-20-00-5. It was created by Assessment and Diagram Amendment No. 59 as Lot 20 in Tract No. 5877- Phase B. By Assessment and Diagram Amendment No, 22 .(Change and Modification No. 1) certain parcels in AD 94-3 were modified, as described below. The 11 R-1 lots (Lots 1 through 11 in TR 5877-D) are assigned Amended Assessment Numbers ("Amended Assessments") 26Q3 through 2613, respectively, the private street lot (Lot A in TR X877-D) is Amended Assessment 2b l4, the two landscape lots (Lots B and C in TR 5877-D are Ann~~ded Assessments 2b l 5 and 2b l 6, respectively, and the sewer lift station access lot is identified as Amended Assessment 2617, B. Assessment 2042 is located in the Seven Oaks Area (North) of AD 94-3, hereafter "Seven Oaks North. " Seven Oaks North is one of six community areas within AD 94-3 . AD 943 funded the cost to acquire certain improvements that are requited to be constructed, or are expected to be required, as conditions of final map or site plan approvals within the six AD 94-3 communit y areas, All. of the Seven Oaks North improvement acquisition costs funded by AD 94-3 were allocated only to the Seven Oaks North lots and parcels except the Buena Vista Road improvements which were allocated to both the Seven Oaks North and Seven Oaks South areas. The AD 94-3 Engineer's Report, approved September 27, 1995, describes the method of allocating the AD 94-3 costs to each assessed parcel. AD 94-3 also financed the cost to pay off the remaining principal balances of the existing AD 82- 1 assessments and of the existing AD 86-2 Reassessments for parcels within AD 943. The Seven Oaks North Community Area properties did not have an existing AD 86^2 reassessment balance, The cost to pay off those existing Assessments and Reassessments far each ATN is included in the total amount confirmed to assessment on each of the AD 94-3 parcels and within the total amount apportioned to the new lots and parcels created by the above-referenced TR 5877-D. D. The total original assessment principal, as based on the Amended Assessment Roll for the Second Amended Notice of Assessment as modified by Change and Modification No. 1, and the remaining assessment principal amount effective January 1,1998, at the beginning of the 1998199 Tax, dear, for Assessment 2Q42 are X55,620, 34 and $52,222.75, respectively. The total original assessment and the remaining principal balance for Assessment 2042 are segregated and apportioned to the lots and parcels in AD 94-3 created by the above-referenced TR 5877-D, as described below. 2. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAL ASSESSMENT AMOUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 2042 TO AMENDED ASSESSMENTS 2603 TI~ROUGH 2617: A. The total original AD 94-3 Assessment Principal for Assessment 2042 is apportioned to the 11 residential lots in TR 5877-D in accordance with the Assessment Apportionment Method described on page D-19 of AD 94-3 Engineer's Report Exhibit D, Description of Assessment Spread Method. The Exhibit D Assessment Apportionment Method is summarized below for reference; 1. When a parcel is subdivided into a tract phase and a remainder the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel indirect proportion to their total acreage, 2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within the new tract, 3. The remaining principal balance of the original assessment at the .tune the apportionment is made will then be allocated to each lot and remainder parcel created by the subdivision, in direct proportion to the share of the original assessment principal amount allocated to each new lot as described above. B. As shown in AD 94-3 Engineer's Report Exhibit C tables, Seven Oaks North Area was planned- for development into several future Development Areas identified as follows; Windsor Park, Estates, Regency, and North PUD (all located east of Fern River Canal), and future Commercial and Multi-family developments (.located west of Kern River Canal), The portion of Seven Oaks North Area located west of Kern River Canal (future commercial and multi~farrlily developments) was separated from the portion located east of Kern River Canal by Parcel Map No. 10299 (and, consequently, by Assessment and Diagram Amendment No. 33), and is not affected by this apportionment. The design engineer (Martin-McIntosh Engineering) retained by Assessment 2042 prope owner has ~y provided the Public Works Department and Assessment Engineer far AD 94-3 with the 29361~XC 2 11/28198 revised plan for phased development of the area east of Kern River Canal. As described in Assessment and Diagrarr~ Arrlendrnent Nos. 11, 12, 14, 1S, 18, 27, 31, 32, 45, 51, S3, 54, SS, SS, 59, f 0, 71, 79, 80, 81, and 82, the Development Areas listed above (Windsor Park, Estates, Regency, and North PUD) are reconfigured into the following new Development Areas based on the typical future lot-sizes and lot product types (not corresponding to each other in order listed): Windsor Park III, Windsor Park I & II, Lexington I & II, and Regency I ~. II. Pour Vesting Tentative Tract Maps (No. 5425, No. 5426, No. 5427, and No, 5838} covering this area east of Kern River Canal (and one of them covering Assessment 2042} are on ale with the Public Works Department. Reference is made to the enclosed "Product Description" table which was prepared based on the information obtained from the Design Engineer, and which corresponds to the total number of future single-family residential lots shown on the above-referenced Vesting Tentative Tract Maps. A portion of Vesting Tentative Tract No. 5425 and a portion of Vesting Tentative Tract No, 5427 have been reconfigured by Vesting Tentative Tract No. 5876 (Ten TR 5876) and Vesting Tentative Tract No. 5877 (Ten TR 5877), Tract No. 5876-Phase A was the first phase of any of said two reconfigured tentative tract maps that was recorded (on December 31, 1997). Before Tract No. 5876~Phase A was recorded, all recorded tracts (Nos. 5425- ~'hases A, B, C, and D, 5426~Phases A and B, and 5838-Phases A, B, and C} have followed the established lot layout for respective vesting tentative tract maps, and accordingly, have followed the assessment allocation for the four Development Areas shown on the Product Description table. With the two new vesting tentative tracts (Nos. 5876 and 5877), the following has changed, in comparison to the original subdivision layout per Vesting Tentative Tract Nos. 5425 and 5427; 1. The remaining, unsubdivided portion of Regency 18~ II Development Area has Z lots less than the same area per Ten TR 5425 and Ten TR 5427 (S8'vs, 60); 2. The remaining unsubdivided portion of Lexington I & lI Development Area has l lot more than the same area per Ten TR 5427 (147 vs. 146); ~, The sump originally located at the southern ends of Ten TR 5425 and Ten TR 5427 (just north of Ming Avenue) has been eliminated; and, 4. Two new sumps have been created within Ten TR 5877, adjacent to Buena Vista Canal. Based on the above-listed four changes, the originally established assessment allocation was adjusted per directions from the Public Works Department, as follows: The assessment amounts for the remainders of Regency I & II and Lexington I & II Development Areas that were unpaid at the time of preparing apportionment documents for Assessment and Diagram Amendment No. 51 (pursuant to TR 5876- Phase A) were combined and respread to the same development areas based on new net areas, taping into consideration locations of new sumps. This resulted in an increase of original assessments for residential lots in Regency I & II area (from $4,171.24 to $5,056.40), and a decrease of assessments far residential lots in 293b1EXC 3 11128!98 Lexington I & II area (from $3,$77.84 to $3,558.96}. Also, it needs to be noted that 16 original lots in Tract No. 5425-Phase D (within Regency I & II area) have been reconfigured into 14 lots per Parcel Map Waiver No. P97-0444 (as described in Apportionment No. 36), and the new original assessment amount for the 14 lots is $4,767.13/1ot, After the above-referenced Apportionment No. 36 was completed, ~. subdivision map for Tract No. 5877-Phase A was recorded, bringing all unmodified lass in Tract No, 5425-Phase D and all lots in Parcel Map Waiver No. P97-0444 into one private, gated community (per Apportionment No. 56}, which conforms to the layout of Ten TR 5877. With this assessment reallocation between Lexington I & II and Regency I & II Development Areas, assessment amounts for Wuadsor Park I & II and Wl~dsor Park ~ZI Development Areas are not ganged. The Windsor Park areas are excluded from the assessment reallocation because; i) the sump relocation is entirely within the Regency I & II and Lexington I & II areas; and, ii) based on the finding that the decrease in the total sump area of approximately 2.6 acres would not significantly change the assessment amounts for the Windsor Park areas, but rather would create uneven assessments between neighboring lots in the existing tract phases that abut lots in future phases. As calculated in Apportionment No. 59, Lot 20 in Tract No, 5877-Phase B (Assessment 2042) consists only of a portion of Regency I & II Development Area. Therefore, in accordance with the above described AD 94-3 Assessment Apportionment Method, and the revised phased development of Assessment 2042, the Assessment 2042 total original assessment principal amount has been apportioned among the four :new Development Areas as follows; 1, As described above, originally allocated assessment shares for Windsor Park I & II and Windsor Park III Development Areas have not been changed, and are no longer apart of the unsubdivided remainder parcel. 2. The rerr~ainders of Lexington I & II and Regency I & II Development Areas were reconfigured based on Vesting Tentative Tract Nos. 5876 and 5877, and-the data for the reconfigured areas is shown on the enclosed "Revised Product, Description" table. As phases of future Tracts 5426, 5838, 5876, and 5877 are recorded, each. lot within certain Development Area .will be allocated equal-per-lot share of the total share for that Development Area, based on the number of proposed single-family residential lots for that Development Area, as shown on the enclosed Revised Product Description table and the above-referenced Vesting Tentative Tract Maps. ~~ The Tract No. 5877-Phase ~ 11 single-family residential lots are a part of Regency I & II Development Area. Each of the 11single-family residential lots in TR 5877~D is allocated one 58-th share of the total revised original assessment share allocated to the Regency I & II Development Area (based on the enclosed Revised Product Description table). It was created by Assessment and Diagram Amendment No. S9 as Lot 20 in Tract No. 5877- Phase B, By Assessment and Diagram Amendment No. 22 (Change and Modification No, 1). certain parcels in AD 94-3 were modified, as described below. Assessment and Diagram Amendment No ~ 22 only modified parcel assessment amounts and it did not change parcel configuration. Tract No, 5877-Phase D (TR 5877-D) subdivides Assessment 2042 into 11 ~single- family residential lots (Lots 1 through 11 in TR 5877-D}, one private street lot (Lot A in TR 5877-D), two landscape lots (Lots B and C in TR 5877-D), and a sewer lift station access lot. The 11 R-1 lots (Lots 1 through 11 in TR 5877-D) are assigned Amended Assessment Numbers "Amended Assessments") 2603 through 2613, respectively, the private street lot (Lot A in TR 5877-D) is Amended Assessment 2614, the two landscape lots (Lots B and C in TR 5$77-D) are Amended Assessments 2b 15 and 261 b, respectively, and the sewer lift station access lot is identified as Amended Assessment 2617. B. Assessment 2042 is located in the Seven Oaks Area (North} of AD 94-3, hereafter "Seven Oaks North, " ~ Sevin Oaks North is one of six community areas- within AD 94-3 . AD 94-3 funded the cost to acquire certain improvements that are required to be constructed, or are expected to be required, as eond~tions of final map or site plan approvals within the six AD 94-3,community areas. All of the -Seven oaks North improvement acquisition costs funded by AD 94-3 were allocated only to the Seven Oaks North lots and parcels except the Buena Vista Road improvements which were allocated to both the Seven Oaks North and Seven oaks South areas. The AD ~4~3 Engineer's Report, approved September 27, 1995, describes the method of allocating the AD 94.3 costs to each assessed parcel. The AD 94-3 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance ~al~ersfield Municipal Code ~S~ction 23.08, ~7~-Benefit Spread: Please see. the AD 94-3 Engineer's Report for a detailed description of the AD 94-~ Assessment Spread Method. By Change and Modification No. 1 (Assessment and Diagram Amendment No. 22) certain park improvements originally planed for construction in the Seven Oaks Area (South) were transferred to Seven Oaks Area North, and several parcel assessnnents (including Assessment 2042) are ai"fected by that change.. Please see the AD 94-3 Modified Engineer's Report for a detailed description of Change and Modification No. 1 procedures, ~ ~~ 29361EXC ~ 11128198 C. AD 94-3 also financed the cost to pay off the remaining principal balances of the existing AD 82- ~ assessments and of the existing AD 86-2 Reassessments for parcels within AD 94-3. The Seven Oaks North Community Area properties did not have an existing AD 8b-2 reassessment balance. The cost to pay off those existing Assessments and Reassessments for each ATN is included in the total amount confirmed to assessment on each of the AD 94N3 parcels and within the total amount apportioned to the new lots and parcels created by the above-referenced TR 5877-D. D. The total original assessment principal, as based on the Amended Assessment Roll for the Second Amended Notice of Assessment as modified by Change and Modification No. 1, and the remaining assessment principal amount effective January 1,199$, at the beginning of the 1998/99 Tax. Year,. for Assessment 2042 are $55,~20.3~ and $52,222,75, respectively. The total original assessment and the remaining principal balance for Assessment 2042 are segregated and apportioned to the lots and parcels in AD 94-3 created by the above-referenced TR 5877-D, as described below. 2. DESCRIPTION OF T1~E PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAI.~BSESSMENT AMOUNT ANA ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 2Q42 TO AMENDED ASSESSMENTS 2603 THROUGH 2~ 17: A. The total original AD 94-3 Assessment Principal for Assessment 2042 is apportioned to the 11 residential lots in TR 5877-D in accordance with the Assessment Ap ortionment Method p described on page D-19 of AD 94-3 Engineer's Report Exhibit D, Description of Assessment Spread Method. The Exhibit D Assessment Apportionment Method is summarized below for reference: 1, when a parcel is subdivided into a tract phase and a remainder the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel indirect proportion to their total acreage. 2. The amount so allocated to the new subdivision wi11 be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots,. parks, or drainage sump lots within the 'new tract, 3. The remaining principal balance of the original assessment at the time the apportionment is made will then be allocated to each lot and remainder parcel created by the subdivision, in direct proportion to the share of the original assessment principal amount allocated to each new lot as described above. B. As shown in AD 94-3 Engineer's Report Exhibit C tables, Seven Oaks North Area was planned for development into several future Development Areas identified as follows; Windsor Park, Estates, Regency, and North PUD (all located east of Kern River Canal), and future Commerdial and Multi-family developments (located west of Kern River Canal). The pardon of Seven Oaks North Area located west of Kern River Canal {future commercial and multifamily developments) was separated from the portion located east of Fern River Canal by Parcel Map No. 10299 (and, consequently, by Assessment and Diagram Amendment No, 33), and is not. affected by this apportionment. The design engineer (Martin-McIntosh Engineering.) retained by Assessment 2042 property owner has provided the Public Narks Department and Assessment Engineer for AD 94-3 with the 29361EXC ~ 11128/98 revised plan for phased development of the .area east of Fern River Canal. As described in Assessment and Diagram Amendment Nos. 11, 12, 14, 1S, 18, 27, 31, 32, 4S, 51, 53, S4, 55, 55, 59, 60, 71, 79, 80, 81, and 82, the Development Areas listed above (Windsor Park, Estates, Regency, and North PUD) are reconfigured into the following new Development Areas based on the typical future lot-sizes and lot product types (not corresponding to each other in order listed): Windsor Park III, Windsor Park I & II, Lexington I x.11, and regency I & II. Four Vesting Tentative Tract Maps (No. 5425, No. 5426, No. 5427, and No. 5838) covering this area east of Kern River Canal (and one of them covering Assessment 2042) are on file with the Public works Department. Reference is made to the enclosed "Product Description" table which was prepared based on the information obtained from the Design Engineer, and which corresponds to the total number of future single-family residential lots shown on the above~referenced Vesting Tentative Tract Maps. A portion of Vesting Tentative Tract No. 5425 and a portion of Vesting Tentative Tract No. 5427 have been reconfigured by Vesting Tentative Tract No. 5876 (Ten TR 587d) and Vesting Tentative Tract No. 5877 (Ten TR 5877). Tract No. 5876-Phase A was the first phase of any of -said two reconfigured tentative tract maps- that was recorded (on December 31, 1997), Before Tract No. 5876-Phase A was recorded, all recorded tracts (Nos. 5425- Phases ~, B, C, and D, 5426-Phases A and B, and 5838-Phases A, B, and C) have followed the established lot layout for respective vesting tentative tract maps, and accordingly, have followed the assessment allocation for the four Development Areas shown an the Product Description'table. With .the two new vesting tentative tracts (Nos. 5876 and 5877), the following has changed in comparison to the original subdivision layout per Vesting. Tentative Tract Nos. 5425 and 5427: 1, The remaining, urlsubdivided portion of Regency I & II Development Area has 2 lots less than the same area per Ten TR 5425 and Ten TR 5427 (58 vs. 60); 2. The remaining unsubdivided portion of Lexington I & II Development Area has 1 lot more than the same area per Ten TR 5427 (147 vs. 146); 3. The sump originally located at the southern ends of Ten TR 5425 and Ten TR 5427 (just north of Ming Avenue) has been eliminated; and, 4. Two new sumps have been created within Ten TR 5877, adjacent to Buena Vista Canal. Based on the above-listed four changes, the originally established assessment allocation was adjusted per directions from the Public Works Department, as follows: The assessment amounts for the remainders of Regency I & II and Lexington I & II Development Areas that were unpaid at the time of preparing apportionment documents for Assessment and Diagram Amendment No. 51 (pursuant to TR 5876- Phase A} were combined and respread to the same development areas based on new raet areas, taking into consideration locations of new sumps. This resulted in an increase of original assessments for residential lots in Regency I & II area (from $4,171.24 to $5,056.40), and a decrease of assessments for residential lots in 29361EXC 3 11/28!98 Lexington I & II area (from $3,877.84 to $3,558.96}. Also, it needs to be noted that 16 original lots in Tract No. 5425-Phase D (within Regency I & II area) have been reconfigured into 141ots per Parcel Map Waiver No. P97-0444 (as described in .Apportionment No. 36), and the new original assessment amount for the 141ots is $4,767.13I1ot. After the above-referenced Apportionment No. 36 was completed, a subdivision map for Tract No. 5877-Phase A was recorded, bringing all unmodified lots in Tract No. 5425-Phase D and all lots in Parcel Map Waiver No. P97-o444 into one private, gated community (per Apportionment No. 56), which conforms to the layout of Ten TR 5877. With this assessment reallocation between Lexington I & II and Regency I & II Development Areas, assessment amounts for Windsor Park I & II and Windsor Park III Development Areas are not changed. The Windsor Park areas are excluded from the assessment reallocation because: i) the sump relocation is entirely within the Regency I & II and Lexington I & II areas; and, ii) based on the finding that the decrease in the total sump area of .approximately 2. d acres would not significantly change the assessment amounts for the Windsor Park areas, but rather would create uneven assessments between neighboring lots in the existing tract phases that abut lots in future phases. As calculated in Apportionment No. 59, Lot 20 in Tract No. 5877-Phase ~ {Assessment 204} consists only of a portion of Regency I & II Development Area. Therefore, in accordance with the above described AD 94-3 Assessment Apportionment Method., and the revised phased. d~veloprnent of Assessment 2042, the Assessment 2042 total original assessment principal amount has been apportioned among the four new Development Areas as follows: 1. As described above, originally allocated assessment shares for Windsor Park I & II and Windsor Park iI~ Development Areas have not been changed, and are no longer a pant of the unsubdivided remainder parcel, 2. The remainders of Lexington I & II and Regency I & II Development Areas were reconfigured based on Vesting Tentative Tract Nos, 5876 and 5877, and the data for the reconfigured areas is shown on the enclosed "Revised Product Description" table. 3. As phases of future Tracts 5426, 5838, 5876,.. and 5877 are recorded, each lot within certain Development Area will be ahocated equal-per-lot share of the total share for that Development Area, based on the number of proposed single-family residential lots for that Development Area, as shown on the enclosed Revised Product Description table and the above-referenced Vesting Tentative Tract Maps. The Tract No. 5877MPhase D 11single-family residential lots are a part of Regency I & II Development Area, P~ach of the 11 single-family residential lots in TR 5877-D is allocated one 58-th share of the~total revised original assessment share allocated to the Regency I & II Development Area (based on the enclosed Revised Product Description table). With the recordation of Tract No. 5877-Phase D Regency I & II Development Area is fully developed, 29361 EXC 4 11128/98 The private street lot (Amended Assessment 2614), the two landscape lots (Amended Assessments 2b 15 and 2616), and the sewer lift station access lot (Amended Assessment 2610 are non~benefited and non~assessed parcels.
