NOTICE IS FURTHER GIVEN that upon recordation of this Notice in the Office of the County Recorder, the several amended assessments on the lots, pieces, and parcels shown on the Amended Assessment Diagram (Assessment and Diagram Amendment No. 1) of Assessment District No. 03-3 shall become a lien upon the lots or portions of lots assessed, respectively. This amendment evidences the completion of statutory proceedings to divide the lien of s ecial p assessments previously levied ~ on the parcels of land shown on the Amended Assessment Diagram, to conform with the divisions in the parcels themselves. However, after the AD 03-3 assessments were confirmed, the property located south of Fairway Oaks South Was a roved for pp development .into a private (gated) subdivision, and the City of Bakersfield placed a requirement on the TR 6079 developer to "close" Gillingham Way, located at the south end of TR 6079 (which provided access to the property south of it, the newly-approved private subdivision}, thereby providing space for an additional residential lot in Amended TR 6079. In accordance with the Assessment Apportionment Method described on pages D-17 and D-18 of AD 03 -3 Engineer's. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAL ASSESSMENT AMOUNTS AND THEIR REMAIr1ING PRINCIl'AL BALANCES FROM AS SES SMENTS 749 THROUGH 811 TO AMENDED AS SES SMENTS 812 THROUGH 875 A. As described in the final AD 03-3 Engineer's .Report, Fairway Oaks South was planned for subdivision into a combined total of 119 R-11ots pursuant to a portion of Vesting Tentative Tract No. 6079 ("Ten TR 6079"). The original Tract No. 6079 ("TR 6079"}, recorded prior to confirmation of the AD 03-3 assessment, followed the general lot configuration shown on Ten TR 6079. However, after the AD 03-3 assessments were confirmed, the property located south of Fairway Oaks South was approved for development into a private (gated} subdivision, and the City of Bakersfield placed a :requirement on the TR 6079 developer to "close" Gillingham Way, located at the south .end of TR 6079 (which provided access to the property south of it, the newly-approved private subdivision}, thereby providing space for an additional residential lot in Amended TR 6079. In accordance with the Assessment Apportionment Method described on pages D-17 and D-18 of AD 03-3 Engineer's Report Exhibit D, Description of Assessment Spread Method, and the above-described City of Bakersfield requirement, -the original Assessments 749 through 811 total combined principal amount is apportioned to the 60 R-1 lots and the lot planned for future subdivision into R-11ots, created by Amended TR 6079-1, as an equal assessment per existing orproposed R-11ot, as described below. The Exhibit D Assessment Apportionment Method is summarized below for reference: 1. When a parcel is subdivided into a tract phase and a remainder, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2. :The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within the new tract. 3 . However, the original Assessment No. 809 total. confirmed assessment amount will be apportioned. as an equal per R-1 lot assessment in accordance with the above- describedproposed development and if the development proceeds as proposed. Accordingly, the first tract phase recorded ... to subdivide all or a portion of Assessment No. 809 will be allocated a total assessment share equal to the number of R-1 lots in the recorded phase multiplied by the calculated equal per R-11ot cost share factor for Assessment No. 809. The remaining balance will be apportioned to the unsubdivided remainder of Assessment No. 809, if ~,ny, for apportiorllnents to future subdivision phases in accordance with the process described above. However, if the development plan for Assessment No. 809 is revised, then the plan for segregation of the original assessment will be revised to apportion a cost share to the first subdivision or subdivision phase and its remainder parcel in direct proportion to their total acreages. The total assessment share apportioned to the recorded subdivision or subdivision phase would then be reapportioned to its lots as an equal assessment share per R-1 lot. Storm water retention sumps, water well sites, and parks will be excluded from the tract acreage and the calculated net acreages used to apportion the original total assessment. Landscape lots and in-tract street areas will not be excluded from the tract acreage totals." B . Pursuant to Ten TR 6079 and Amended TR 6079-1, there is a total of 120 R-1 lots planned for subdivision of Assessments 749 through 811. Based on the above-described Assessment .Apportionment Method, the total .combined assessment amount for Assessments 749 through 811 is apportioned as follows: The total combined Assessments 749 through 811 assessment amount is first apportioned to the 60 R-1 lots and the lot planned for future subdivision into R-1 lots in direct proportion to the number of existing or planned R-1 lots in each of them: the 60 R-1 lots in Amended TR 6079 are allocated 60/120 shares of the Assessments 749 through 811 total combined original assessment amount, and the lot planned for future subdivision into R-1 lots (Amended Assessment 873) is allocated 601120 shares of the Assessments 749 through 811 total combined original assessment amount.
