The 1913 Act further requires that the cost of the assessment be apportioned to the individual parcels in proportion to the estimated benefit that each parcel can be expected to receive from the work and improvements covered by the assessment. The City of Bakersfield has adopted the ordinance adding Sections 13.08.060 and 13.08.070 to Chapter 13.08 of the Bakersfield Municipal code authorizing the reallocation of special assessments from benefited parcels to other parcels with the express written consent of the owners of the parcels assessed. ASSESSMENT SPREAD METHOD The 2003 Assessment District will be formed for the purpose of financing the acquisition of public improvements within the District Boundary. Improvements included within the District were chosen such that a community benefit is derived by parcels within the District both developed and undeveloped. Therefore, the apportioning of the cost of the community improvements is to be shared equally on a per gross acre basis. It is further anticipated that the resulting assessments would be reapportioned to subsequent land divisions on an equal per lot basis when final subdivision occurs. The description of improvements to be acquired by the district and their apportionment to the benefited communities is included in the following study.
