(Assessment and Diagram Amendment No. 2), Amending Assessment 873, filed with the

a description of the real property in said Assessment District and the exterior boundaries
thereof. Said Amended Assessment Diagram amends the map entitled "Assessment
Diagram of City of Bakersfield- Assessment District No. 03-3," recorded May 4, 2004, in
Book 22 of Maps of Assessment and Community Facilities Districts, at Pages 163 through
176, in the Office of the County Recorder of the County of Kern, State of California.
NOTICE IS FURTHER GIVEN that upon recordation of this Notice in the Office of the County
Recorder, the several amended assessments on the lots, pieces, and parcels shown on the Amended
Assessment Diagram (Assessment and Diagram Amendment No. 2) of Assessment District No. 03-3
shall become a lien upon the lots or portions of lots assessed, respectively.
This amendment evidences the completion of statutory proceedings to divide the lien of special
assessments previously levied on the parcels of land shown on the Amended Assessment Diagram, to
conform with the divisions in the parcels themselves. Reference is made to said Amended Assessment
Dia ram. and Amended Assessment Roll recorded in the office of the Superintendent of Streets of the

Attached hereto pursuant to the requirements of Section 27288.1 of the Government Code, marked
"Exhibit A," is a copy. of the Amended Assessment Roll, identifying each new parcel by the .amended
assessment number shown on the Amended Assessment Diagram, together with the amount of amended
assessment lien levied thereon. and the name or names of the owners of each parcel subject to such
amended assessments as they appear on the latest secured County Assessor's Roll, or as known to the
.undersigned.

1. An application has been filed with the Superintendent of Streets of the City of Bakersfield by
the owners or interested parties in the referenced existing assessment within City of Bakersfield
. Assessment District No. 03-3, requesting apportionment of the amount remaining unpaid on
said assessment in accordance with the provisions of the Improvement Bond Act of 1915.
In accordance with said application, the undersigned hereby apportions to each separate part
of the original parcel of land as shown on the Amended Assessment Roll, City of Bakersfield
Assessment District No. 03-3, Assessment and Diagram Amendment No. 2, attached hereto as
Exhibit A and incorporated herein by reference, the proportionate part of the remaining
assessment in the same manner as if the land -had been so divided at the time the original

PURSUANT TO RECORDATION OF
TRACT N0.6079 UNIT THREE
1. An application has been filed with the Superintendent of Streets of the City of
Bakersfield requesting a segregation and apportionment of an existing assessment within
Assessment District No. 03-3, pursuant to the division of the parcel.
2. In accordance with said application, the undersigned hereby apportions to each separate
part of the original parcel of land the proportionate part of its respective unpaid
assessment that would have been levied thereon if the parcel had been so divided at the
time the .original assessment was made. The undersigned has assigned .anew assessment
number to each new parcel, as shown on the Amended Assessment Diagram attached
hereto.
3. The existing assessment number, new assessment numbers, and apportioned assessment
amounts (based in each case on the unpaid principal amount of assessment effective
January 1, 2005, at the beginning of the 2005/2006 tax year) are as shown on Exhibit A,
"Amended Assessment Roll," attached hereto and incorporated herein by reference:. A
description of the referenced existing assessment and of how it has been subdivided is
included in Exhibit B, attached hereto. A description of the procedure used to apportion
the unpaid principal for the referenced existing assessment, to the new assessments is
included in Exhibit C, attached hereto, and a listing of the apportioned share of .the
original. assessment for each new. assessment is shown on Exhibit D, attached hereto.
Existing Assessment 873 is deleted from the assessment roll for Assessment District No.
03 -3 .

1. DESCRIPTION OF EXISTING ASSESSMENT 873:
A. Existing Assessment 873 (hereafter "Assessment 873") is located in the City of
Bakersfield. It was created by Assessment and Diagram Amendment. ("Apportionment")
No. 1 for Assessment District No. 03-3 ("AD 03-3"). Assessment 873 is described as
Kern County Assessor's Tax Number ("ATN") 497-320-03, Tract No. 6079 Unit. Three
("TR 6079-3") subdivides Assessment 873 creating 60 single-family residential. ("R-1")
lots. The 60 residential lots (Lots 1 through 60 in TR 6079-3) are assigned Amended
Assessment Numbers ("Amended Assessments") 876 through 93 5, respectively.
B. Assessment 873 is located in the Fairway Oaks South Area of AD 03-3 .(hereafter
"Fairway. Oaks. South"). Fairway Oaks South is one of three community areas within AD
03 -3 , AD 03 -3 funded the costs to acquire certain improvements that are required, or are
expected to be required, to be constructed as conditions of final map or site plan approvals
within the three AD 03-3 community areas. All of the Fairway Oaks. South improvement
acquisition costs funded by AD 03-3 were allocated only to the Fairway Oaks South lots
and parcels. The AD 03-3 Engineer's Report, approved April 28, 2004, describes the
method of allocating the AD 03-3 costs to each assessed parcel. The AD 03-3
Assessment .Spread Method described in Exhibit D of the Engineer's- Report is in
conformance with Bakersfield 1V~unicipal Code Section 13.08.070-Benefit Spread.
Please see the AD 03-3 Engineer's Report for a detailed description of the AD 03-3
Assessment Spread Method.
C. The total original assessment principal amount, per Apportionment No.1,for Assessment
873 is $352,496.90. The remaining assessment principal for Assessment 873 (effective
January 1, 2005, at the beginning of the 2005/2006 Tax Year} is $341,302.19. The total
original assessment amount and its remaining principal balance for Assessment 873 are
segregated and apportioned to the lots and parcels created by the above-referenced TR
6079-3, as described below.

A. As described in the Engineer's Report for. Apportionment No. 1, Assessment 873 was
planned for subdivision into a total of 60 R-1 lots pursuant to a portion of Vesting
Tentative Tract No. 6079 ("Ten TR 6079"). TR 6079-3 follows the general lot
confi uration shown on Ten TR 6079.. In accordance with the Assessment

Apportionment Method described onpages D-17 and D-18 of AD 03-3 Engineer's Report
Exhibit D, .Description of Assessment Spread Method, the original Assessment 873
rinci al amount is apportioned to the 60 R-1 lots created by TR 6079-3 as an equal

assessment per R-1 lot, as described below. The Exhibit D Assessment Apportionment
Method is summarized below for reference:
1. when a arcel is subdivided into a tract phase and a remainder, the total

original assessment principal amount will be apportioned to the tract phase and
to the remainder parcel in direct proportion to their total acreage.
2. The amount so allocated to the new subdivision will be reallocated among the
subdivision.lots, as an equal share per lot, excluding landscape and well site
lots, parks, or drainage sump lots within the new tract.
3. Specifically, for the Fairway Oaks South Area, Exhibit D states: "This portion
of AD 03-3 has been approved for development into a total of 59 R-1 lots, 1

assessment apportionments of those lots of record, unless record lots are
merged or reconfigured by some form of future subdivision. However, .the

as an equal per R-1 lot assessment in accordance with the above-described
roposed development and if the ,development proceeds as proposed.

Accordingly, the first tract phase recorded ... to subdivide all or a portion of
Assessment No. 809 will be allocated a total assessment share equal to the
.number of R-1 lots in the recorded phase multiplied by the calculated equal per
R-1 lot cost share factor for Assessment No. 809. The remaining balance will
be a ortioned to the unsubdivided remainder of Assessment No. 809, if any,

.for apportionments to future subdivision phases in accordance with the process
described above. However, if the development plan for Assessment No. 809
is revised, then the plan for segregation of the original assessment will be
revised to apportion a cost share to the first subdivision or subdivision phase

and its remainder parcel in direct proportion to their total acreages. The total
assessment share apportioned to the recorded subdivision or subdivision phase
would then be reapportioned to its lots as an equal assessment share per R-1
lot. Storm water retention sumps, water well sites, and parks will be excluded
from the tract acreage and the calculated net acreages used to ,apportion the
original total assessment. Landscape lots and in-tract street areas will not be
excluded from the tract acreage totals."
B. As described above, there is a total of 60 R-1 lots planned for subdivision of Assessment
873 pursuant to Ten TR 6079. Based on the above-described Assessment Apportionment
Method, the total assessment amount for Assessment 873 is apportioned as follows:
The total Assessment 873 assessment amount is apportioned to the 60 R-1 lots as
an equal-per-lot assessment (each of the 60 R-1 lots in TR 6079-3 is allocated 1160
share of the total original assessment amount for Assessment 873). TR 6079-3 is
the last phase of Ten TR 6079. located in AD 03-3 (there are no remainder parcels
created by TR 6079-3}.
C. Each parcel's total amended assessment amount shown on Exhibit D, .attached to the
Engineer's Report for this AD 03-3 Assessment and Diagram Amendment No. 2 is the
new parcel's original assessment share, and is the amount that should be used, to calculate
the Bond Reserve credit the new parcel would receive ifthe parcel owner elects to prepay
the total remaining balance for Amended Assessments 876 through 93 5 .
D. Apportionment of the Unpaid Assessment Principal for Assessment 873 to Amended
Assessments 876 through 93 5 :
The total unpaid assessment principal amount for Assessment 873 is apportioned to the
new lots created by the recordation of said TR 6079-3 indirect proportion to .the original
Assessment 873 shares apportioned to each new lot, as shov~n on Exhibit A, Amended
Assessment Roll, attached to the Engineer's Report for this AD 03-3 Apportionment
No. 2.

ASSESSMENT PURSUANT TO PART 10.5 OF DIVISION 10, STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA, THE IlVIl'ROVEMENT BOND

AMOUNT FROM EXISTING ASSESSMENT 873 1N THE CITY OF BAKERSFIELD
Wi~RE SAID PARCEL HAS BEEN SUBDIVIDED BY TRACT NO.6079 iJNIT THREE.
The undersigned is the owner and subdivider of existing Assessment 873 ("Assessment
873") which was. subdivided by Tract No. 6079 Unit Three ("TR 6079-3"), creating 60
single-family residential lots, and is the owner of all lots and parcels created by said TR
6079-3. A description of said existing assessment, the total amount of the unpaid assessment
principal balance effective January 1, 2005, at the beginning of the 2005/2006 tax year, and
a description of how, said parcel has .been subdivided are included in .Engineer's Report
Exhibit B, Description of Existing Assessment in City of Bakersfield Assessment District
No. 03-3 (hereinafter "AD 03-3"), attached hereto and incorporated herein by reference.
As the original owner and subdivider of the referenced existing .assessment and the owner
of the aforesaid lots created by TR 6079-3, the undersigned hereby request the
Superintendent of Streets for the City of Bakersfield to apportion the. amount remaining
unpaid on Assessment 873 in accordance with the provisions of the Improvement Bond Act
of 1915. The unpaid principal amount for said existing assessment as shown on Exhibit B,
has been apportioned to each separate part of the original parcel of land comprising the
existing assessment in the amounts as shown on Exhibit A, Amended Assessment Roll
attached hereto and incorporated herein by reference.

II. ACCEPTANCE OF AS SES SMENT APPORTIONMENT PROCEDURE AND REQUEST
TO RECORD AMENDED ASSESSMENTS.
I have reviewed Exhibit C (Description of Assessment Apportionment Procedure} included
in the attached Engineer's Report, describing the procedure used to apportion a share of the
unpaid assessment principal amount for Assessment 873 in AD 03-3 to the lots and parcels
created by the recordation of said TR 6079-3. Pursuant. to a review of Exhibit C, the
undersigned has. determined that the amended assessment amounts shown on said Exhibit
A .have been apportioned in accordance with the benefits the parcels will receive from the
improvements financed by AD 03-3, based on current parcel zoning and with proposed uses.
Therefore, the undersigned waives notice and hearing before the City Council on this
assessment apportionment, accepts the procedure used for the requested apportionment of
the principal balance for said existing assessment, and requests and consents to the
recordation of the apportioned assessments on the properties for which the undersigned is
listed as owner on the accompanying Exhibit A, and to the amended assessment amounts
shown thereon.

PURSUANT TO RECORDATION OF
TRACT N0.6079 UNIT THREE
1. An application .has. been filed with the Superintendent of Streets of the City of
.Bakersfield requesting a segregation and apportionment of an existing assessment within
Assessment District No, 03-3, pursuant to the division of the parcel.
2. In accordance with said application, the undersigned hereby apportions to each separate
part of the .original parcel of land the proportionate part of its respective unpaid
assessment that would have been levied thereon if the parcel had been so divided at the
;time the original assessment was made. The undersigned has assigned a new assessme~it
number to each. new .parcel, as shown on the Amended Assessment Diagram attached
hereto.

A. Existing. Assessment 873 (hereafter "Assessment 873") is located in the City of
Bakersfield. It was created by Assessment and Diagram Amendment ("Apportionment")
No. 1 for Assessment District No. 03-3 ("AD 03-3"}, Assessment 873 is described as
Kern County Assessor's Tax Number ("ATN") 497-320-03. Tract No. 6079 Unit Three
"TR 6079-3 ") subdivides Assessment 873 ,creating 60 single-family residential ("R-1 "}
(
lots. The 60 residential lots (Lots 1 through 60 in TR 6079-3) are assigned Amended
;Assessment Numbers ("Amended Assessments") 876 through 93 5, respectively.
B. Assessment 873 is located in the Fairway Oaks South Area of AD 03-3 (hereafter
"Fairway Oaks South"). Fairway Oaks South is one of three community areas within AD
03 -3 , AD 03 -3 funded the costs to acquire certain improvements that are required, or are
ex ected to be required, to be constructed as conditions of final map or site plan approvals

within the three AD 03-3 community areas. All of the Fairway Oaks South improvement
acquisition costsfunded by AD 03-3 were allocated only to the Fairway Oaks South lots
and parcels. The AD 03-3 Engineer's Report, approved April 28, 2004, describes the
.method of allocating -the AD 03-3 costs to each assessed parcel. The AD 03-3
Assessment Spread Method described in Exhibit D of the Engineer's Report is in
conformance ,with Bakersfield Municipal Code Section 13.08.070-Benefit Spread.

C. The total original assessment principal amount, per, Apportionment No.1,for Assessment
873 is $35.2,496.90. The remaining assessment principal for Assessment 873 (effective

original assessment amount and its remaining principal balance for Assessment 873 are

A. As described in the Engineer's Report for Apportionment No. 1, Assessment 873 was
planned for subdivision into a total of 60 R-1 lots pursuant to a portion of Vesting
Tentative Tract No. 6079 ("Ten TR 6079"). TR 6079-3 follows the general lot
configuration shown on Ten TR 6079.. In accordance with the Assessment
A ortionment Method described onpages D-17 and D-18 of AD 03-3 Engineer's Report

Exhibit D, Description of Assessment Spread Method; the original Assessment 873
rincipal amount is apportioned to the 60 R-1 lots created by TR 6079-3 as an equal

assessment ,per R-1 lot, as described below. The Exhibit D Assessment Apportionment
Method is summarized below fof reference:
1. When a parcel is subdivided into a tract phase and a remainder, the total
original assessment principal amount will be apportioned to the tract phase and
to the remainder parcel in direct proportion to their total acreage.
2. The amount so allocated to the new subdivision will bereallocated-among the
subdivision lots as an equal share per lot, excluding landscape and well site
lots, parks, or drainage sump lots within the new tract.
3. Specifically, for the Fairway Oaks South Area, Exhibit D states: "This portion
of AD 03 -3 has been approved for development into a total of 5 9 R-1 lots,.1

number of R-1 lots in the recorded phase multiplied by the calculated equal per
R-1 lot cost share factor for Assessment No. 809. The remaining balance will
be a portioned to the unsubdivided remainder of Assessment No. 809, if any,

described above. However, if the development plan for Assessment No. 809
is revised, then the plan for segregation of the original assessment. will be
revised to apportion a cost share to the first subdivision or subdivision phase

assessment share apportioned to the recorded subdivision or subdivision phase
would then be reapportioned to its lots as an equal assessment share per R-1
.lot. Storm water retention sumps, water well sites, and parks will be excluded
from the tract acreage and the calculated net acreages used. to apportion the
original .total assessment. Landscape lots. and in-tract street areas will not be
excluded from the tract acreage totals."
B. As described above, there is a total of 60 R-1 lots planned for subdivision of Assessment
873 pursuant to Ten TR 6079. Based on the above-described Assessment Apportionment
Method, the total assessment amount for Assessment 873 is apportioned as follows:
The total Assessment 873 assessment amount is apportioned to the 60 R-1 lots as
anequal-per-lot assessment (each of the 60 R-1 lots in TR 6079-3 is allocated 1/60
share of the total original assessment amount for Assessment 873}. TR 6079-3 is
. the last. phase of Ten TR 6079 located in AD 03-3 (there are no remainder parcels
created by TR 6079-3).
C. Each parcel's total amended assessment amount shown on Exhibit D, attached to the
Engineer's Report for this AD 03-3 Assessment and Diagram Amendment No. 2 is the
new parcel's original assessment share, and. is the amount that should be used to calculate
_ the Bond Reserve credit the new parcel would receive if the parcel owner elects to prepay
the otal remaining balance for Amended Assessments 876 through 93 5.

Transmitted herewith is a "Notice to Bondholder" form giving your firm notice that assessment
apportionments have been requested by district property owners. The Amended Assessment-Roll and
Amended Assessment Diagram for this apportionment have been prepared by the Superintendent of
Streets for the City of Bakersfield. A copy of the Amended Assessment Roll is attached as Exhibit A
to the Notice to Bondholder. A copy of the Engineer's Report on this Apportionment No. 2 is also
enclosed, providing a description of how- the referenced assessment has been subdivided. A reduced
and not to scale copy of the Amended Assessment Diagram for Apportionment No. 2 is attached to the
Engineer's Report.
We would like to record this apportionment as soon as possible. Accordingly, enclosed for your review
is a draft letter that waives RBC Dain Rauscher's 14-day period to request a hearing on this
apportionment. If this apportionment is acceptable, would you please place the enclosed letter on RBC
Dain Rauscher letterhead and send the signed letter to John Stinson at City of Bakersfield Public works
Department for processing.

being Division 10 of the Streets and Highways Code of the State of California.

prepared by the Superintendent of Streets of the unpaid assessments relating to the assessments and

NOTICE IS HEREBY GIVEN that unless a request for a public hearing is received. from you within
fourteen (14) days from the date of mailing of this Notice, the above-referenced amended assessments
shall be recorded in the manner and form as required by law. If a request for hearing is received, a
report shall be filed and a hearing shall be scheduled, noticed, and held in accordance with .Part 10
(commencing with Section 8730) of said Division 10.
