NOTICE IS FURTHER GIVEN that upon recording of this Notice in the office of the County Recorder, the several amended reassessments on the lots, pieces and parcels shown on the Amended Reassessment Diagram (Reassessment and Diagram Amendment No. 99) of Assessment District No. 86-2 shall become a lien upon the lots or portions of lots assessed, respectively. This amendment evidences the completion of statutory proceedings to divide the lien of special reassessments previously levied on the parcels of land shown on the amended reassessment diagram, to conform with the divisions in the parcels themselves. Reference is made to 1 said Amended Reassessment Diagram and Amended Reassessment Roll recorded in the office of the Superintendent of Streets of the City of Bakersfield. DESCRIPTION OF EXISTING REASSESSMENT 4478: A. Existing Reassessment 4478 (hereafter "Reassessment 4478"} is located in the City of Bakersfield. Reassessment 4478 is described as Lot 103 in Tract No. 6107 "Phase 1'' ("TR 6107-1 "), and it was created by Reassessment and Diagram Amendment No. 93 fob Assessment District No. 86-2 ("AD 86-2"). Reassessment 4478 is also identified as Kern County Assessor's Tax Number ("ATN"} 494-670-07-00-1. Tract No. 6017 "Phase 2'' ("TR 6107-2") subdivides Reassessment 4478 creating 40 single-family residential ("R~- 1 "} lots, 1 private street lot, and 1 common area landscape lot. The 40 R 1 lots (Lots 1 through 40 in TR 6107-2) are assigned Amended Reassessment Numbers ("Amendet~ Reassessments"} 4668 through 4707; respectively. The private street lot (Lot B in TR 6107-2) is Amended Reassessment 4708, and the common area landscape lot (Lot CA# in TR 6107-2) is Amended Reassessment 4709. B. Reassessment 4478 is within an area which was included in Assessment and Diagram Amendment No. 19 ("Amendment No. 19"}. Amendment No. 19 was a Change and Modification that respread the original and unpaid assessment amounts for all of the A.D 86-2 parcels owned by Riverlakes Ranch, to bring those parcel assessments into conformance with their amended land uses approved by General Plan Amendment 1-90 Segment III ("GPA 1-90-III"}. Reassessment 4478 is located in the Buena Vista Trunk Sewer and Telephone Benefit Zones (Series A Bonds). At the time it was created by Reassessment and Diagram Amendment No. 93 for AD 86-2 (pursuant to recordation of TR 6107-1) Reassessment 4478 was allocated its share of BVTS Sewer Capacity and BVTS Sewer Oversizing base on the Riverlakes Ranch Specific Plan Amendment, ZC P97-0892, GPAP97-0892, and Vestin Tentative Tract No. 6107 "Ten TR 6107" . BVTS Sewer Capacity: By Reassessment and Diagram Amendment No. 93 Reassessment 4478 was allocated its share of EDUs of BVTS Sewer Capacity eased on the estimated number of dwelling units~when developed to its maximum permitted density in accordance with the Riverlakes Ranch Specific Plan Amendment and Ten TR ~ 6'107, as described above. Each EDU was allocated one unit of BVTS Sewer Capacity at the original assessment unit charge rate of $245.60/EDU. The entire Reassessment 4478 (as a part of former Reassessment 3 849 from which it was created pursuant tc Reassessment and Diagram Amendment No. 93} is covered by Ten TR 6107. Thy owner of former Reassessment 3 849 has requested, and the Public Works Department of the City of Bakersfield has approved that request, that all residential lots in Ten TR 6107, covering the entire former Reassessment 3 849, be apportioned an equal per lot share of the total original assessment and the remaining reassessment principal amounts for former Reassessment 3 849. As described in the Engineer's Report for Reassessment and Diagram Amendment No. 93, it was the finding of the apportionment analysis that each and every residential lot approved for subdivision from former Reassessment 3849 as a part of Ten TR 6107 wild receive the same level of benefit from the improvements funded by AD 86-2. Accordingly, the total original BUTS Capacity assessment amount for former Reassessment 3 849 was apportioned to the remainder parcel, the lot planned for future subdivision into residential lots, and TR 6107-1 residential lots as an equal assessment share per existing or planned residential lot, as those lots are shown ors the TR 6107-1 map and the Ten TR 6107 map. Lot 103 in TR 6107-1. (Reassessment 4478) was allocated 40 shares (of the total of 201 shares in Ten TR 6107} for Phase 2 of Ten TR 6107. TR 6107-Z follows the general lot layout of Ten TR 6107 and it has the same number of R-11ots (40) as the number of BVTS Sewer Capacity shares allocated to Reassessment 4478. The total Reassessment 4478 BVTS Sewer Capacity share i spread among the 40 residential lots in TR 6107-2 as an equal per lot assessment share. The private street lot (Amended Reassessment 4708} and the common area landscape lot (Amended Reassessment 4709} are not assessed. 2 . BVTS Sewer Oversizing \ The BVTS Oversizing charge originally allocated to Reassessment 4478 is apportioned to the lots and parcels created by TR 6107-2 in the same manner as the BVTS Capacity: equal per residential lot in TR 6107-2. Apportionment of the Unpaid Reassessment Principal Amount for Reassessment 4478 to Amended Reassessments 4668 through 4709: The three original AD 86-2 Series of Tax Exempt Bonds (Series A, B, and D) were refunded in January of 1994 by a Single Series of Tax Exempt Bonds. The single origin~.l AD 86-2 Series of Taxable Bonds (Series C) were also refunded at the same time by a Single Series of Taxable Bonds. The amount required to refund each original series of bonds was prorated t~o each parcel based on that parcel's remaining principal for that original bond series. The total remaining principal amount for each AD 86-2 Bond Series for Reassessment 4478 is apportioned to each new lot and parcel created by TR 6107- in direct proportion to the original assessment share that is apportioned to each new lot and parcel by each AD 86-2 Bond Series. More detailed information on the land uses, zoning and dwelling unit densities used to apportion Reassessment 4478 is on file in the office of the Public Works Director and the office of the Planning Director for the City of Bakersfield. The 40 R-1 lots (Lots 1 through 40 in TR 6107-2) are assigned Amended Reassessment Numbers ("Amended Reassessments") 4668 through 4707, respectively. The private street lot (Lot B in TR 6107-2) is Amended Reassessment 4708, and the common area landscape lot (Lot CA# in TR 6107-2) is Amended Reassessment 4709. B. Reassessment 4478 is within an area which was included in Assessment and Diagram Amendment No. 19 ("Amendment No. 19"}. Amendment No. 19 was a Change and Modification that respread the original and unpaid assessment amounts for all of the AD 86-2 parcels owned by Riverlakes Ranch, to bring those parcel assessments into conformance with their amended land uses approved by General Plan Amendment 1-90 Segment III ("GPA 1-90-III"). See Amendment No. 19 for details on the amended land uses and the impact on the AD 86-2 Assessments in this area. Reassessment 4478 is also within an area included in the Riverlakes Ranch Specific Plan Amendment which way approved by the City Council of the City of Bakersfield on August 12, 1998, irk accordance with Zone Change No. P97-0892 ("ZC P97-0892"} and General Plan Amendment No. P97-0892 ("GPA P97-0892"), as presented in Reassessment and Diagram Amendment No. 51. Reassessment 4478 is located in the Buena Vista Trunk Sewer Benefit and the Telephone Benefit Zones of AD 86-2. The improvement cosh assessed to these Benefit Zones were funded by the AD 86-2 Series A Bonds. C. The total remaining reassessment principal amount for Reassessment 4478 (effective January 1, 2003, at the beginning of the 2003/2004 Tax Year) is $9,21 S .71. Reassessment 4478 is located in the Buena Vista Trunk Sewer and Telephone Benefit Zones (Series A Bonds). At the time it was created by Reassessment and Diagram; Amendment No. 93 for AD 86-2 (pursuant to recordation of TR 6107-1) Reassessment 4478 was allocated its share of BUTS Sewer Capacity and BVTS Sewer Oversizing based; on the Riverlakes Ranch Specific Plan Amendment, ZC P97-0892, GPA P97-0892, and; Vesting Tentative Tract No. 6107 ("Ten TR 6107"), A copy of the map showing they revised land use plan per GPA P97-0892 is attached to this Engineer's Report for reference. Each benefitted parcel was allocated its share of the BVTS Capacity charge indirect proportion to the number of Equivalent Dwelling t.Jni~s (EDUs) allocated to each of them, The number of EDUs allocated to each parcel is calculated based on the; maximum permitted number of Dwelling Units (DUs) for each parcel when developed: according to the land uses approved in GPAP97-0892 and in accordance to Bakersfield 2010 General Plan ("2010 Plan") and in proportion to each parcel's net areas within each. land use presented in said GPAP97-0892. The parcels' net areas were obtained from The DeWalt Corporation (an engineer retained by the Riverlakes Ranch Specific Plan:. Amendment proponent and original owner of the land area covered by Reassessment 4478), A copy of the table showing said net areas for each affected parcel is enclosed for reference. The approved maximum permitted DU densities and corresponding number of EDUs for each land use designation are as follows: - Suburban Residential(SR): 4.00 DU / 4.00 EDU per acre - Low Density Residential (LR): 7.26 DU / 7.26 EDU per acre -Low Medium Density Residential(LMK): 10.00 DU / 10.00 EDU per acre -High Medium Density Residential(HNIR): 17.42 DU / 13.40 EDU per acre - General Commercial(GC): 6.00 DU / 6.00 EDU per acre By Reassessment and Diagram Amendment No. 51 the BVTS Oversizing charge for each. of the three Benefit Zones (Stage 1-A, Telephone, and Severer only} was allocated only to Amended Reassessments, or portions of Amended Reassessments, located within each, Benefit Zone. Within each Benefit Zone the total BVTS Oversizing amount was first adjusted (reduced) based on the total BVTS Capacity charge allocated to parcels within each zone (to keep 'the total Original Assessment unchanged), and such adjusted BVTS. BUTS Sewer Capacity: By Reassessment and Diagram Amendment No. 93 Reassessment 4478 wad allocated its share of EDUs of BVTS Sewer Capacity based on the estimated number of dwelling units~when developed to its maximum permitted density in accordance with the Riverlakes Ranch Specific Plan Amendment and Ten TR ~ 6'107; a described above. Each EDU was allocated one unit of BVTS Sewer Capacity. at the original assessment unit charge rate of $245.60/EDU. The entire Reassessment 4478 (as a part of former Reassessment 3 849 from which it was created pursuant tc Reassessment and Diagram Amendment No. 93} is covered by Ten TR 6107. Thy owner of former Reassessment 3 849 has requested, and the Public Works Department of the City of Bakersfield has approved that request, that all residential lots in Ten TR 6107, covering the entire former Reassessment 3 849, be apportioned an equal per lot share of the total original assessment and the remaining reassessment principal amounts for former Reassessment 3 849. As described in the Engineer's Report for Reassessment and Diagram Amendment No. 93, it was the finding of the apportionment analysis that each and every residential lot approved for subdivision from former Reassessment 3849 as a part of Ten TR 6107 will receive the same level of benefit from the improvements funded by AD 86-2, Accordingly, the total original BVTS Capacity assessment amount for formex Reassessment 3 849 was apportioned to the remainder parcel, the lot planned for future subdivision into residential lots, and TR 6107-1 residential lots as an equal assessment share per existing or planned residential lot, as those lots are shown ors the TR 6107-1 map and the Ten TR 6107 map. Lot 103 in TR 6107-1 (Reassessment 4478) was allocated 40 shares (of the total of 201 shares in Ten TR 6107) for Phase 2 of Ten TR 6107. TR 6107-2 follows the general lot layout of Ten TR 6107 and it has the same; number of R-11ots (40) as the number of BVTS Sewer Capacity shares allocated to Reassessment 4478. The total Reassessment 4478 BVTS Sewer Capacity share is spread among the 40 residential lots in TR 6107-2 as an equal per lot assessment share. The private street lot (Amended Reassessment 4708) -and the common area landscape lot (Amended Reassessment 4709) are not assessed. 2. BVTS Sewer Oversizing: The BUTS Qversizing charge originally allocated to Reassessment 4478 is apportioned to the lots and parcels created by TR 6107-2 in the same manner as the BVTS Capacity: equal per residential lot in TR 6107-2. Apportionment of the Unpaid Reassessment Principal Amount for Reassessment 4478 to Amended Reassessments 4668 through 4709: The three original AD 86-2 Series of Tax Exempt Bonds (Series A, B, and D) were refunded in January of 1994 by a Single Series of Tax Exempt Bonds. The single origin~.l AD 86-2 Series of Taxable Bonds (Series C) were also refunded at the same time by Single Series of Taxable Bonds. The amount required to refund each original series of bonds was prorated to each parcel based on that parcel's remaining principal for that original bond series. The total remaining principal amount for each AD 86-2 Bond Series for Reassessment 4478 is apportioned to each new lot and parcel created by TR 6107-? in direct proportion to the original assessment share that is apportioned to each new lost and parcel by each AD 86-2 Bond Series.
