Pursuant to a review of Exhibit C, the undersigned has determined that the amended reassessment amounts shown on said Exhibit A have been apportioned in accordance with the benefits the ,parcels will receive from the improvements financed by AD 86-2, based on current parcel zoning and .with proposed .uses.. Existing Reassessments 4073; 4074, and 4075 (hereafter "Reassessment 4073," "Reassessment 4074," and "Reassessment 4075", respectively) are described as Kern County Assessor's Tax Numbers (ATNs) 452-180-01-00-1, 452-180-02-00-4, and 452-180-03-00-7, respectively, and are located in the City of Bakersfield. Parcel Map No. 10984 ("PM 10984") subdivides Reassessments 4073, 4074, and 4075 creating 8 new commercial-use parcels. The 8 new parcels (identified as Parcels 1 through 8 in PM 10984) are assigned Amended Reassessment Numbers ("Amended Reassessments") 4834 through 4841, respectively. B. Reassessments 4073,. 4074, and 4075 were created by Reassessment and Diagram Amendment No. 82 for Assessment District No. 86-2 ("AD 86-2"). The entire Reassessments 4073, 4074, and 4075 are located within the Stage 1-A Benefit Zone and the Telephone Benefit Zone of AD 86-2. The improvement cost assessed to these Benefit Zones were funded by Series A, B, C, and D Bonds for AD 86-2, C. The total remaining Reassessment Principal Amounts for Reassessments 4073, 4074, and 4075 (effective January 1, 2005, at the beginning of the 2005/2006 Tax Year) are $31,041.23, $27,945.59, and $38,178.62, respectively. The total original AD 86-2 assessment amounts were $164,645.33, $147,781.27, and $201,242.64, respectively. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINALASSESSMENTAND TIC UNPAID REASSESSMENT PRINCIPAL AMOUNTS FROM REASSESSMENTS 4073, 4074, AND 4075 TO AMENDED REASSESSMENTS 4834 THROUGH 4841: A. Reassessments 4073, 4074, and 4075 are located in the Buena Vista Trunk Sewer (Series A Bonds} Benefit Zone and the Stage 1-A Benefit Zone for Street, Utility and Telephone improvements (Series B, C, and D Bonds). The total remaining AD 86-2 Reassessment Principal Amounts for Reassessments 4073, 4074, and 4075 are apportioned to the 8 new parcels created by PM 10984 as follows: 29658EXC 1 6/2/OS a. Buena Vista. Trunk Sewer (BVTS) Assessment (Series A Bonds): i. The BVTS Capacity for Reassessment 4073 is based on 8.14 gross acres at a rate of 6 Equivalent Dwelling Units (EDUs}/acre for Commercial land use. Reassessment 4073 was originally allocated 49 EDUs of BVTS Capacity at the original assessment unit charge rate of $245 , 60/EDU for a total BVTS Capacity charge of $12,034.40, The BVTS Capacity for Reassessment 4074 is based on 7.16 gross acres at a rate of 6 EDUslacre for Commercial land use. Reassessment 4074 was originally allocated 43 EDUs of BVTS Capacity at the original assessment unit charge rate of $245.601EDU for a total BVTS Capacity charge of $10,560.80. The BVTS Capacity for Reassessment 4075 is based on 9.55 gross acres at a rate of 6 EDUs/acre for .Commercial land use. Reassessment 4075 was originally allocated 57 EDUs of BVTS Capacity at the original assessment unit charge rate of $245.60/EDU for a total BVTS Capacity charge of $13,999.20. The total combined BVTS Capacity charge for Reassessments 4073, 4074, and 4075 is allocated to the 8 new parcels created by PM 10984 at the original rate of $245.601EDU as follows: Parcel / : 8 EDUs, Parcel 2; 4 EDUs, Parcel 3: 6 EDUs, Parcel 4: 5 EDUs, Parcel 5: 5 EDUs, Parcel 6: 9 EDUs, Parcel 7; 79 EDUs, and Parcel 8: 11 EDUs, based on their Commercial land use designation at a rate of 6 EDU/acre. The parcels' net areas (excluding off-site street right-of-way) for the 8 new parcels were provided to the Reassessment Engineer by the PM 10984 subdivision-engineer (Porter-Robertson Engineering & Surveying, Inc., Bakersfield, California). The total number of EDUs allocated to the 8 new parcels (127 EDUs) is by 22 lower than the total combined number of EDUs originally allocated to Reassessments 4073, 4074, and 4075 (atotal of 149 EDUs). The reduced BVTS Capacity is compensated for by increasing the total BVTS Oversizing by the same amount ($5,403.20), as described below. 11. The .total combined BVTS Oversizing amount for Reassessments 4073, 4074, and 4075 (increased for the reduced BVTS Capacity, as described above} is allocated to the 8 new parcels in PM 10984 in direct proportion to parcels' net areas described above. The total combined original BVTS Oversizing amount- for Reassessments 4073, 4074, and 4075 was $52,320.67. b. Stage 1-A Arterial Street and Utility Assessment (Series B, C, and D Bonds): The Stage 1-A Arterial Street and Utility improvement assessment consists of several components including a basic street area charge, a major street trip generation charge, and a sewer frontage charge. The total combined Stage 1-A Arterial Street and Utility assessment for Reassessments 4073, 4074, and 4075 is allocated to the 8 new parcels in PM 10984 in direct proportion to parcels' net areas described above, in the same manner the BVTS assessment is allocated. The total original assessment shares for the 8 new parcels in PM 10984 have been allocated as original series B, C, and D Bonds shares in proportion to the Reassessments 4073, 4074, and 4075 Series B, C, and D Bonds shares allocated to each of them. Apportionment of the Total Remaining Reassessment Balance from Reassessments 4073, 4074, and 4075 to Amended Reassessments 4834 through 4841: The three original AD 86-2 Series of Tax Exempt Bonds (Series A, B, and D) have been refunded by a Single Series of Tax Exempt Bonds. The single original AD 86-2 Series of Taxable Bonds 29658EXC 2 612/05 (Series C}has also been refunded by a Single Series of Taxable Bonds. The amount required to refund each original series. of bonds was prorated to each parcel based on that parcel's remaining principal for that original bond series.. The BVTS Capacity for Reassessment 4073 is based on 8.14 gross acres at a rate of 6 Equivalent Dwelling Units (EDUs}/acre fox Commercial land use. Reassessment 4073 was originally allocated 49 EDUs of BVTS Capacity at the original assessment unit charge rate of $245 , 60/EDU for a total BVTS Capacity charge of $12,034.40. The BVTS Capacity for Reassessment 4074 is based on 7.16 gross acres at a rate of 6 EDUs/acre for Commercial land use. Reassessment 4074 was originally allocated 43 EDUs of BVTS Capacity at the original assessment unit charge rate of $245 , 601EDU for a total BVTS Capacity charge of $10,560, 80. The BVTS Capacity for Reassessment 4075 is based on 9,55 gross acres at a rate of 6 EDUslacre for Commercial land use. Reassessment 4075 was originally allocated 57 EDUs of BVTS Capacity at the original assessment unit charge rate of $245.601EDU for a total BVTS Capacity charge of $13,999,20. The total combined BVTS Capacity charge for Reassessments 4073, 4074, and 4075 is allocated to the 8 new parcels created by. PM 10984 at the original rate of $245,60/EDU as follows: Parcel 1: 8 EDUs, Parcel 2: 4 EDUs, Parcel 3: 6 EDUs, Parcel 4: 5 EDUs, Parcel 5: 5 EDUs, Parcel 6: 9 EDUs, Parcel 7: 79 EDUs, and Parcel 8: 11 EDUs, based on their Commercial land use designation at a rate of 6 EDUlacre. The parcels' net areas (excluding off-site street right-of-way) for the 8 new parcels were provided to the Reassessment Engineer by the PM 10984 subdivision engineer (Porter-Robertson Engineering & Surveying, Inc., Bakersfield, California). The total number of EDUs allocated to the 8 new parcels (127 EDUs) is by 22 lower than the total combined number of EDUs. originally allocated to Reassessments 4073, 4074, and 4075 (a total of 149 EDUs). The reduced BVTS Capacity is compensated for by increasing the total BVTS Oversizing by the same amount ($5,403.20), as described below. 11, .The total combined BVTS Oversizing amount for Reassessments 4073, 4074, and 4075 (increased for the reduced BVTS Capacity, as described above) is allocated to the 8 new parcels in PM 10984 in direct proportion to parcels' net areas described above. The total combined original BVTS Oversizing amount for Reassessments 4073, 4074, and 4075 was $52,320.67. b. Stage 1-A Arterial Street and Utility Assessment (Series B, C, and D Bonds): The Stage 1-A Arterial Street and Utility improvement assessment consists of several components including a basic street area charge, a major street trip generation charge, and a sewer frontage charge. The total combined Stage 1-A Arterial Street and Utility assessment for Reassessments 4073, 4074, and 4075 is allocated to the 8 new parcels in PM 10984 in direct proportion to parcels' net areas described above, in the same manner the BVTS assessment is allocated. The total original assessment shares for the 8 new parcels in PM 10984 have been allocated as original series B, C, and D Bonds shares in proportion to the Reassessments 4073,. 4Q74, and 4075 Series B, C, and D -Bonds shares allocated to each of them. Apportionment of the Total Remaining Reassessment Balance from Reassessments 4073, 4074, and 4075 to Amended Reassessments 4834 through 4841: The three original AD 8b-2 Series of Tax Exempt Bonds (Series A, B, and D) have been refunded by a Single Series of Tax Exempt Bonds. The single original AD 86-2 Series -of Taxable Bonds 29658EXC 2 612!05 Series C} has also been refunded by a Single Series of Taxable Bonds. The amount required to refund each original series of bonds was prorated to each parcel based on that parcel's remaining principal for that original bond series. Reassessment 4073 was originally allocated 49 EDUs of BVTS Capacity at the original assessment unit charge rate of $245.60/EDU for a total BVTS Capacity charge of $12,034.40.
