DESCRIPTION OF EXISTING ASSESSMENT 127: A. Existing Assessment 127 (hereafter "Assessment 127") is located in the City of Bakersfield. It was created by Original Assessment and Diagram for Assessment District No. O l -1("AD 01-1 "). Assessment 127 is identified as Lot 69 in Tract No. 6008 "Phase 1" ("TR 6008-1 "). Tract No. 6008 "Phase 2" ("T'R 6008-2") subdivides Assessment 127 creating 55 single-family residential ("R-1") lots. The 55 residential lots (Lots 1 through 55 in TR 6008-2) are assigned Ame11ded Assessment Numbers ("Amended Assessments"} 186 through 240, respectively. B. Assessment 127 is located in the Mountain Vista Drive Area of AD 01-1 (hereafter "Mountain Vista Drive") . Mountai~l Vista Drive is one of three communty areas within AD 01-1. AD 01-1 funded the cost to acquire certain improvements that are required, or are expected to be required, to be constructed as conditions of final map or site plan approvals within the three AD 01-1 community areas . All of the Molu~tain Vista Drive improvement acquisition costs funded by AD 01-1 were allocated only to the Mountain Vista Drive lots and parcels. The AD Ol-1 Engineer's Report, approved June 13, 2001, describes the method of allocating the AD 01-1 costs to each assessed parcel. The AD Ol-1 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance with Bake~sfiehl Municipal Cone Section 13.08.070-Benefit Spread. Please seethe AD Ol-1 Engineer's Report fox a detailed description of the AD 01-1 Assessment Spread Method. C. The total original assessment principal amount, as reduced for the lower tha11 anticipated bond issuance costs, for Assessment 127 is $181,534.46. The remaining assessment principal for Assessment 127 (at the beghuling of the 2001/2002 Tax Year) is same as the original assessment amount; $181,534.46. The total original assessment amount and its remaining principal balance for Assessment 127 are segregated aild apportioned to the lots created by the above-referenced TR 6008-2, as described below. 2. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATEAND APPORTION THE ORIGINAL ASSESSMENT AMOUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 127 TO AMENDED ASSESSMENTS 186 THROUGH 240; A. As described in the final AD Ol-1 Engineer's Report, Assessment 127 was planned for subdivision into 55 R-I lots pursuantto Vesting Tentative TractNo. 6008 ("Ten TR 6008"). As requested byAssessment 127 property owner (Campus Park, LLC), and as approved by the City of Bakersfield Public 'Works Department, and in accordance with the Assessment Apportionment Method described on page D-16 of AD 01-1 Engineer's Report Exhibit D, Description of Assessment Spread Method, the original Assessment 127 principal amount is apportioned to t11e 55 R 1 lots in TR 6008-2 as an equal assessment per lot. The Exhibit D Assessment Apportionment Method is sununarized below for reference: 29517EXC 1 9124/01 1. When a parcel is subdivided into a tract phase and a remainder, the total original assessment principal amolult will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within the new tract. 3. Specifically, for the Mountain Vista Drive Area, Exhibit D states: "...the next tract phase recorded... will be allocated a total assessment share equal to the number of R-1 lots in the phase multiplied by the calculated equal per R-1 lot cost share factor for the Mountain Vista Drive Area. The remaining balance will be apportioned to the unsubdivided remainder for apportiolunents to future subdivision phases in accordance with the process described above..." 4. The remaining principal balance of the original assessment at the time the apportionment is made will then be allocated to each lot and remainder parcel created by the subdivision, in direct proportion to the share of the original assessment principal amount allocated to each new lot as described above. B. As described above, there is a total of 55 R-1 lots in the portion of Ten TR 6008 covering Assessment 127. Based on the above-described Assessment Apportionment Method and the finding that all residential Lots In this tract will receive the same level of b enefit from the AD 01-1 improvements, and therefore, be assessed the same amount, the new lots created pursuant to the recordation of TR 6008-2 are allocated their share of the AD 01-1 assessment amount as follows: Each of the 55 R-1 lots in TR 6008-2 is allocated 1155 share of the original assessment amount allocated to Assessment 127. There are no remainder parcels created from Assessment 127 since this is the last phase of Tract No. 6008. D. At the time this- apportionment was prepared, the original assessment principal amount for Assessment 127 had not been reduced by partial cash payments or any assessment debt service installments for the 2001/2002 tax year. Therefore, the unpaid principal amount for Assessment 127 is the assessment total for the parcel as based on the above-described original principal amount. Accordingly, each parcel's total amended assessment amount shovcnl on Exhibit A, Amended Assessment Roll attached to the Engineer's Report for this AD Ol-1 Assessment and Diagram Amendment No. 1 is the new parcel's original assessment share, and is the alnolu~t that shol~ld be used to calculate the Bond Reserve credit the new parcel would receive if the parcel owner elects to prepay the total remaining balance for Amended Assessments 186 through 240. As requested by Assessment 127 property owner (Campus Park, LLC}, and as approved by the City of Bakersfield Public Works Department, and in accordance with the Assessment Apportionment Method described on page D-16 of AD Ol-1 Engineer's Report Exhibit D, Description of Assessment Spread Method, the original Assessment 127 principal amount is apportioned to the 55 R-11ots in TR 6008-2 as an equal assessment per lot.
