PURSUANT to the requirements of Section 3114 of the Streets and
Highways Code, the undersigned, PAMELA A. McCARTHY, CMC, City Clerk of
the City of Bakersfield, hereby gives notice that an. Amended Diagram
and Amended Assessment Roll .(Assessment and Diagram Amendment No. 3)
for City of Bakersfield Assessment District No. 01-1 were filed and
recorded in the office of the Superintendent of Streets of the City of
Bakersfield, relating to the following described real property:
Reference is made to the map. entitled "Amended Assessment

Amendment No. 3), Amending Assessment 241, filed with the
Count Recorder of the County of Kern, on

description of the real property in said Assessment District.
and the exterior: boundaries thereof. Said Amended
Assessment Diagram .amends the map entitled ".Assessment
Diagram of City of Bakersfield Assessment District No.
01-1," recorded June 15, 2001, in Book 20 of Maps of
.Assessment and Community Facilities Districts, at Pages 32
through 39, in the Office of the County Recorder of the
County of Kern, California.
NOTICE IS FURTHER GIVEN that upon recording of this Notice in the
office. of the County Recorder, the several amended assessments on the
lots, pieces and parcels shown on the Amended Assessment Diagram
(Assessment and Diagram Amendment No. 3) of Assessment District No.
Ol-1 shall be-come a lien upon the lots or portions of lots assessed,
respectively.
This amendment evidences the completion of statutory proceedings to
divide the lien of special assessments previously levied on the
parcels of land shown on the amended diagram, to conform with the
divisions in the parcels themselves. Reference is made to said
Amended Assessment Diagram and Amended Assessment Roll recorded in the

off ice of the Superintendent of Streets of the City of Bakersfield.
Attached hereto pursuant to the requirements of Section 27288.1 of the
Government Code, marked Exhibit A, is a copy of the Amended Assessment
Roll identifying each new parcel by the amended assessment number
shown on the amended diagram, together with the amount of amended
assessment lien levied thereon and the name or names of the owners of
each parcel subject to such amended assessments as they appear on the
latest secured County Assessor's Roll, or as known to the undersigned.

NOTICE IS HEREBY GIVEN to you as the original purchaser of the bonds issued
by the CITY OF BAKERSFIELD, to represent the unpaid assessments relating to
the acquisition and construction of certain public improvements in an
assessment district known and designated as ASSESSMENT DISTRICT N0. 01-1.
Said bonds were issued pursuant to the terms and provisions of the
"Improvement Bond Act of 1915," being Division 10 of the Streets and
Highways Code of the State of California.
NOTICE IS HEREBY GIVEN that an apportionment has been requested by the
property owner(s) and prepared by the Superintendent of Streets of the
unpaid assessments relating to the assessments and parcels as shown on
EXHIBIT A, "AMENDED ASSESSMENT ROLL" for said district attached hereto and
incorporated herein by reference.
NOTICE IS HEREBY GIVEN that unless a request for a public hearing is
received from you within fourteen (14) days from the date of mailing of
this Notice, the above-referenced amended assessment shall be recorded in
the manner and form as required by law. If a request for hearing is
received, a report shall be filed and a hearing shall be scheduled, noticed
and held in accordance with Part 10 (commencing with Section 8730) of said

The undersigned is the owner and subdivider of existing Assessment 241 ("Assessment
241"}which was subdivided by Tract No. 6034 Unit Two ("TR 6034-2"), creating 48 single-
family residential lots and 1 landscape lot, and is the owner of all lots and parcels created
by said TR 6034-2. A description of said existing assessment, the total amount of the unpaid
assessment principal balance effective January 1, 2002, at the beginning of the 2002/2003
tax year, and a description of how said parcel has been subdivided are included in Engineer's
Report Exhibit B, Description of Existing Assessments in City of Bakersfield Assessment
District No. 01-1 (hereinafter "AD 01-1 "}, attached hereto and incorporated herein by
reference.
As the original owner and subdivider of the referenced existing assessment and the owner
of the aforesaid lots and parcels created by TR 6034-2, the undersigned hereby request the
Superintendent of Streets for the City of Bakersfield to apportion the amount remaining
unpaid on Assessment 241 in accordance with the provisions of the Improvement Bond Act
of 191 S. The unpaid principal amount for said existing assessment as shown on Exhibit B,
has been apportioned to each separate part of the original parcel of land comprising the
existing assessment in the amounts as shown on Exhibit A, Amended Assessment Roll
attached hereto and incorporated herein by reference. .

II. ACCEPTANCE OF ASSESSMENT APPORTIONIV~NT PROCEDUREAND REQUEST
TO RECORD AMENDED ASSESSMENTS.
I have reviewed Exhibit C (Description of Assessment Apportionment Procedure) included
in the attached Engineer's Report, describing the procedure used to apportion shares of the
unpaid assessment principal amount for Assessment 241 in AD 01-1 to the lots and parcels
created by the recordation of said TR 6034-2. Pursuant to a review of Exhibit C, the
undersigned has determined that the amended assessment amounts shown on said Exhibit
A have been apportioned in accordance with the benefits the parcels will receive from the
improvements financed by AD 01- 1, .based on current parcel zoning and with proposed uses.
Therefore, the undersigned waives notice and hearing before the City Council on this
assessment apportionment, accepts the procedure used for the requested apportionment of
the principal balance for said existing assessment, and requests and consents to the
recordation of the apportioned assessments on the properties for which the undersigned is
listed as owner on the accompanying Exhibit A, and to the amended assessment amounts
shown thereon.

1. An application has been filed with the Superintendent of Streets of
the City of Bakersfield requesting a segregation and apportionment
of existing assessment within Assessment District No. 01-1,
pursuant to the division of the parcel.
2. In accordance with said application, the undersigned hereby
apportions to each separate part of the original parcel of land,
the proportionate part of its respective unpaid assessment that
would have been levied thereon if the parcel had been so divided at
the time the original assessment was made. The undersigned has
assigned a new assessment number to each new parcel, as shown on
the Amended Assessment Diagram attached hereto.
3. The existing assessment number, new assessment numbers and
apportioned assessment amounts (based in each case on the unpaid
principal amount of assessment effective Januray 1, 2002 at the
beginning of the 2002/2003 Tax Year), are as shown on Exhibit A
"Amended Assessment Roll" attached hereto and incorporated herein
by reference. A description of the referenced existing assessment
and of how it has been subdivided is included in Exhibit B,
attached hereto. A description of the procedure used to apportion
the unpaid principal for the referenced existing assessment to the
new assessments is included in Exhibit C, attached hereto, and a
listing of the apportioned share of the original assessment for
each new assessment is shown on Exhibit D, attached hereto.
Existing Assessment 241 is deleted from the assessment roll for
Assessment District No. Ol-1.

1. DESCRIPTION OF EXISTING ASSESSMENT 241:
A. Existing Assessment 241 (hereafter "Assessment 241 ") is located in the City of Bakersfield. It was
created by Assessment and Diagram Amendment ("Apportionment") No. 2 far Assessment District No.
01-1("AD 01-1"}, Assessment 241 is identified as a remainder of Kern County Assessor's Tax Number
("ATN") 522-010-48-00-8 created by the recordation of Tract No. 6034 Unit One ("TR 6034-1").
Assessment 241 is also identified as Remainder Parcel 1 created by TR 6034-1. Tract No. 6034 Unit
Two ("TR 6034-2") subdivides Assessment 241 creating 48 single-family residential ("R-1") lots and
1 landscape lot. The 48 residential lots (Lots 1 through 48 in TR 6034-2) are assigned Amended
Assessment Numbers ("Amended Assessments") 307 through 354, respectively, and the landscape lot
(Lot A In TR 6034-2) is Amended Assessment 355,
B . Assessment 241 is located in the Ming at Allen Area of AD 01-1 (hereafter "Ming at Allen") , Ming at
Allen is one of three community areas within AD 01- l . AD 01-1 funded the cost to acquire certain
improvements that are required, or are expected to be required, to be constructed as conditions of final
map or site plan approvals within the three AD 01-1 community areas . All of the Ming at Allen
improvement acquisition costs funded by AD 01-1 were allocated only to the Ming at Allen lots and
parcels. The AD Ol-1 Engineer's Report, approved June 13, 2001, describes the method of allocating
the AD Ol-1 costs to each assessed parcel. The AD Ol-1 Assessment Spread Method described in
Exhibit D of the Engineer's Report is 111 conformance with Bakersfield Municipal Code Section
13.08.070-Benefit Spread. Please see the AD 01-1 Engineer's Report for a detailed description of the
AD 01-1 Assessment Spread Method.
C, The total original assessment principal amount, based on Apportionment No. 2, for Assessment 241 is
$243,929, 80, The remaining assessment principal for Assessment 241(effective January 1, 2002, at the
beginning of the 2002/2003 Tax Year) is $236,492,92. The total original assessment amount and its
remaining principal balance for Assessment 241 are segregated and apportioned to the lots created by

Ten TR 6034 were identified as, respectively, the "Celebration" and the "Palisades" Product Type Areas.
However, after the confirmation of the AD Ol-1 assessment, the development area of Ten TR 6034 was
revised by Revised Vesting Tentative Tract No. 6034 ("Rev Ten TR 6034") in the following manner:
Unit One of Rev Ten TR 6034 was converted into the Celebration Product Type Area with a total of 61
R-1 lots, and Unit Two of Rev Ten TR 6034 remained as the Palisades Product Type Area with a total
of 48 R-1 lots. with this revision, ll1 all of Ming at Allen the total number of the Celebration Product
Type Area lots is increased to 169, and the total number of the Palisades Product Type Area lots is
reduced to 48. In accordance with the Assessment Apportionment Method described on page D-16 of
AD 01-1 Engineer's Report Exhibit D, Description of Assessment Spread Method, in Apportionment
No. 1 the original Assessment 1 principal amount was apportioned as an equal assessment per R-1 lot
for each revised Product Type Area, as described below. The Exhibit D Assessment Apportionment
Method is summarized below for reference:
1. when a parcel is subdivided into a tract phase and a remainder, the total original assessment
principal amolu~t will be apportioned to the tract phase and to the remainder parcel in direct
proportion to their total acreage.
2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as
an equal share per lot, excluding landscape and well site lots, parks, or drainage suunp lots within
the new tract.
3. Specifically, for the Ming at Allen Area, Exhibit D states: "...the original Assessment No. 1 total
confirmed assessment amount will be apportioned first on a net area basis between the two Product
Type Areas (Ten. TR 6032 and Ten. TR 6034) within the Ming at Allen Area and then each area's
assessment share will be apportioned as an equal per lot assessment. Accordingly, the first tract
phase recorded ... will be allocated a total assessment share equal to the number of R-1 lots in the
phase multiplied by the calculated equal per R-1 lot cost share factor for the Product Type Area
of Assessment No. 1 in which the first tract phase is located. The xemaining balance will be
apportioned to the unsubdivided remainder fox apportionments to future subdivision phases in
accordance with the process described above. However, if the development plan for Assessment
No. 1 is revised, then the plan for segregation of the original assessment will be revised to
apportion a cost share to the first subdivision or subdivision phase and its remainder parcel in
direct proportion to their total acreages. The total assessment share apportioned to the recorded
subdivision or subdivision phase would then be reapportioned to its lots as an equal assessment
share per R-1 lot. Storm water retention sumps, water well sites, parks, and school parcels will be
excluded from the tract acreage and the calculated net acreages used to apportion the original
assessment. Landscape lots and in tract street areas will not be excluded from the tract acreage
totals."
B. As described above, based on the revised development plan of the Ming at Allen, and in accordance with
Apportionment No. 2, there is a total of 48 R-1 lots in the Palisades Product Type Area (in Unit Two of
Rev Ten TR 6034), Based on the above-described Assessment Apportionment Method the total
assessment amount for Assessment 241 is apportioned as follows:
Each of the 48 R-1 lots in TR 6034-2 is allocated 1/48 share of the total original assessment
amount for Assessment 241. The landscape lot is not assessed. There are no remauider parcels
created by TR 6034-2. TR 6034-2 is the last (and only) subdivision phase in the Palisades Product
Type Area of AD O1-l.

Ech parcel's total amended assessment amount sho~m on Exhibit D, attached to the Engineer's Report
for this AD 01-1 Assessment and Diagram Amendment No. 3 is the new parcel's original assessment
share, and is the amount that should be used to calculate the Bond Reserve credit the new lot and parcel
would receive if the parcel owner elects to prepay the total remaining balance for Amended Assessments
307 through 355.
D. Apportionment of the Unpaid Assessment Principal for Assessment 241 to Amended Assessments 307
through 355:
The total unpaid assessment principal amount for Assessment 241 is apportioned to the new lots and
parcels created by the recordation of said TR 6034-2 in direct proportion to the original Assessment 241
shares apportioned to each new lot and parcel, as shown on Exhibit A, Amended Assessment Roll,
attached to the Engineer's Report for this ADO 1-1 Apportiolunent No. 3.

existing assessment within City of Bakersfield Assessment District No.
01-1, requesting apportionment of the amount remaining unpaid on said
assessment in accordance with the provisions of the Improvement Bond Act
of 1915 .
In accordance with said application, the undersigned hereby apportions to
each separate part of the original parcel of land as shown on the Amended
Assessment Roll, City of Bakersfield Assessment District No. 01-1,
Assessment and Diagram Amendment No. 3, attached hereto as Exhibit A and
incorporated herein by reference, the proportionate part of the remaining
assessment in the same manner as if the land had been so divided at the
time the original assessment was made.

1. An application has been filed with the Superintendent of Streets of
the City of Bakersfield requesting a segregation and apportionment
of existing assessment within Assessment District No. O1-l,
pursuant to the division of the parcel.
2. In accordance with said application, the undersigned hereby
apportions to each separate part of the original parcel of land,
the .proportionate part of its respective unpaid assessment that
would have been levied thereon if the parcel had been so divided at
the time the original assessment was made. The undersigned has
assigned a new assessment number to each new parcel, as shown on
the Amended Assessment Diagram attached hereto.
3. The existing assessment number, new assessment numbers and
apportioned assessment amounts (based in each case on the unpaid
principal amount of assessment effective Januray 1, 2002 at the
beginning of the 2002/2003 Tax Year), are as shown on Exhibit A
"Amended Assessment Roll" attached hereto and incorporated herein
by reference. A description of the referenced existing assessment
and of how it has been subdivided is included in Exhibit B,
attached hereto. A description of the procedure used to apportion
the unpaid principal for the referenced existing assessment to the
new assessments is included in Exhibit C, attached hereto, and a
listing of the apportioned share of the original assessment for
each new assessment is shown on Exhibit D, attached hereto.
Existing Assessment 241 is deleted from the assessment roll for
Assessment District No. 01-1.

ASSESSMENT AND DIAGRAM AMENDMENT NO. 3
1. DESCRIPTION OF EXISTING ASSESSMENT 241:
A. Existing Assessment 241. (hereafter "Assessment 241 ") is located in the City of Bakersfield. It was
created by Assessment and Diagram Amendment ("Apportionment"} No. 2 for Assessment District No.
Ol-1("AD 01-1"). Assessment 241 is identified as a remainder of Kern County Assessor's Tax Number
("ATN") 522-010-48-00-8 created by the recordation of Tract No. 6034 Unit One ("TR 6034-1").
Assessment 241 is also identified as Remainder Parcel 1 created by TR 6034-1. Tract No, 6034 Unit
Two ("TR 6034-2") subdivides Assessment 241 creating 48 single-family residential ("R-1 ") lots and
1 landscape lot. The 48 residential lots (Lots 1 through 48 in TR 6034-2) are assigned Amended
Assessment Ntunbers ("Amended Assessments") 307 through 354, respectively, and the landscape lot
(Lot A in TR 6034-2) is Amended Assessment 355.
B. Assessment 241 is located in the Ming at Allen Area of AD 01-1 (hereafter "Ming at Allen"). Ming at
Allen is one of three community areas within AD 01- l . AD 01-1 funded the cost to acquire certain
improvements that are required, or are expected to be required, to be constructed as conditions of final
map or site plan approvals within the three AD 01-1 community areas. All of the Ming at Allen
improvement acquisition costs funded by AD O l -1 were allocated only to the Ming at Allen lots and
parcels. The AD 01-1 Engineer's Report, approved Jtu~e 13, 2001, describes. the method of allocating
the AD 01-1 costs to each assessed parcel. The AD 01-1 Assessment Spread Method described in
Exhibit D of the Engineer's Report is i~1 conformance with Bakersfield Municipal Code Section
13.08.070-Benefit Spread. Please see the AD 01-1 Engineer's Report for a detailed description of the
AD 01-1 Assessment Spread Method.
C. The total original assessment principal amount, based on Apportionment No. 2, for Assessment 241 is
$243,929.80. The remaining assessment principal for Assessment 241 (effective January 1, 2002, at the
beginning of the 2002/2003 Tax Year) is $236,492.92. The total original assessment amount and its
remaining principal balance for Assessment 241 are segregated and apportioned to the lots created by
the above-referenced TR 6034-2, as described below.
2. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATEAND APPORTION TIC ORIGINAL
ASSESSMENT AMOUNT AND ITS REN[AINING PRINCIPAL BALANCE FROM ASSESSMENT
241 TO AMENDED ASSESSMENTS 307 THROUGH 355:
A. As described in the Ptnal AD 01-1 Engineer's Report, former Assessment 1(from which Assessment 241
was created by Apportionment No. 2) was planned for subdivision into a combined total of 202 R-1 lots
as follows : (1)10 8 R-1 lots pursuant to Vesting Tentative Tract No . 603 2 ("Ten TR 6 03 2 ") and (ii} 94
R-1 lots pursuant to Vesting Tentative Tract No. 6034 ("Ten TR 6034"). The areas of Ten TR 6032 and

Ten TR 6034 were identified as, respectively, the "Celebration" and the "Palisades" Product Type .Areas.
However, after the confirmation of the AD 01-1 assessment, the development area of Ten TR 6034 was
revised by Revised Vesting Tentative Tract No. 6034 ~"Rev Ten TR 6034") in the following manner:
Unit One of Rev Ten TR 6034 was converted into the Celebration Product Type Area with a total of 61
R-1 lots, and Unit Two of Rev Ten TR 6034 remained as the Palisades Product Type Area with a total
of 48 R-11ots. with this revision, in all of Ming at Allen the total number of the Celebration Product
Type Area lots is increased to 169, and the total nlunber of the Palisades Product Type Area lots is
reduced to 48. In accordance with the Assessment Apportionment Method described on page D-16 of
AD 01-1 Engineer's Report Exhibit D, Description of Assessment Spread Method, in Apportionment
No. 1 the original Assessment 1 principal amount was apportioned as an equal assessment per R-1 lot
for each revised Product Type Area, as described below. The Exhibit D Assessment Apportionment
Method is summarized belo~v for reference:
1. when a parcel is subdivided into a tract phase and a remainder, the total original assessment
principal amount will be apportioned to the tract phase and to the remainder parcel in direct
proportion to their total acreage.
2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as
an equal share per lot, excluding landscape alld well site lots, parks, or drainage sump Lots within
the new tract.
3. Specifically, for the Ming at Allen Area, Exhibit D states: "...the original Assessment No. 1 total
confirmed assessment amount will be apportioned first on a net area basis between the two Product
Type Areas (Ten. TR 6032 and Ten. TR 6034} within the Ming at Allen Area and then each area's
assessment share will be apportioned as an equal per lot assessment. Accordingly, the first tract
phase recorded ... will be allocated a total assessment share equal to the number of R-1 lots in the
phase multiplied by the calculated equal per R-1 lot cost share factor for the Product Type Area
of Assessment No. 1 in which the first tract phase is located. The remaining balance will be
apportioned to the unsubdivided remainder far apportionments to future subdivision phases in
accordance with the process described above. However, if the development plan for Assessment
No. 1 is revised, then the plan for segregation of the original assessment will be revised to
apportion a cost share to the first subdivision or subdivision phase and its remainder parcel in
direct proportion to their total acreages. The total assessment share apportioned to the recorded
subdivision or subdivision phase would then be reapportioned to its lots as an equal assessment
sliare per R-1 lot. Stone water retention sumps, water well sites, parks, and school parcels will be
excluded from the tract acreage and the calculated net acreages used to apportion the original
assessment. Landscape lots and in-tract street areas will not be excluded from the tract acreage
totals ."
B. As described above, based on the revised development plan of the Ming at Allen, and in accordance with
Apportionment No. 2, there is a total of 48 R-1 lots in the Palisades Product Type Area din Unit Two of
Rev Ten TR 6034). Based on the above-described Assessment Apportionment Method the total
assessment amount for Assessment 241 is apportioned as follows:
Each of the 48 R-1 lots in TR 6034-2 is allocated 1/48 share of the total original assessment
amount for Assessment 241. The landscape lot is not assessed. There are no remainder parcels
created by TR 6034-2. TR 6034-2 is the last (and only) subdivision phase in the Palisades Product
Type Area of AD O l -1.

Ech parcel's total amended assessment amotu~t shown on Exhibit D, attached to the Engineer's Report
for this AD 01-1 Assessment and Diagram Amendment No. 3 is the new parcel's original assessment
share, and is the amount that should be used to calculate the Bond Reserve credit the new lot and parcel
would receive if the parcel owner elects to prepay the total remaining balance for Amended Assessments
3 07 through 3 5 5 .
D. Apportionment of the Unpaid Assessment Principal for Assessment 241 to Amended Assessments 307
through 355 ;
The total ltnpaid assessment principal amount for Assessment 241 is apportioned to the new lots and
parcels created by the recordation of said TR 6034-2 i11 direct proportion to the original Assessment 241
shares apportioned to each new lot and parcel, as shown on Exhibit A, Amended Assessment Roll,
attached to the Engineer's Report for this AD 01-1 Apportionment No. 3.

assessment amount, reference is made to the AD 01-1 Engineer's Report on file in the office of the Public Works
