NOTICE IS FURTHER GIVEN that upon recording of this Notice in the office of .the County Recorder, the several amended assessments on the lots, pieces and parcels shown on the Amended Assessment Diagram (Assessment and Diagram Amendment No. 4) of Assessment District No. 01-1 shall become a lien upon the lots or portions of lots assessed, respectively. This amendment evidences the completion of statutory proceedings to divide the lien of special assessments previously levied on the parcels of land shown on the amended diagram, to conform with the divisions in the parcels themselves. Reference is made to said Amended Assessment Diagram and Amended Assessment Roll recorded in the 1 off ice of the Superintendent of Streets of the City of Bakersfield. Pursuant to a review of Exhibit C, the undersigned has determined that the amended assessment amounts shown on said Exhibit A have been apportioned in accordance with the benefits the parcels will receive from the improvements financed by AD 01-1, based on current parcel zoning and with proposed uses. DESCRIPTION OF EXISTING ASSESSMENT 183: A. Existing Assessment 183 (hereafter "Assessment 183") is located in the City of Bakersfield. It vas created by Original Assessment and Diagram for Assessment District No. 01-1("AD 01-1 "). Assessment 183 is identified as Kern County Assessor's Tax Nlunber ("ATN"} 495-290-04-00-5. Tract No. 6007 Unit Two ("TR 6007-2"} subdivides Assessment 183 creating 28 single-falnily residential ("R-1 ") lots, l private street lot, and 1 landscape lot. The 28 R-1 lots (Lots 1 tlarou~h 28 in TR 6007-2} are assigned Amended Assessment Numbers ("Amended Assessments") 356 through 383, respectively. The private street lot (Lot A in TR b007-2) is Amended Assessment 384, and Landscape lot (Lot B in TR 6007-2} is Amended Assessment 385. B. Assessment 183 is located in the Hampton Place Area of AD 01-1 (hereafter "Hampton Place"). Hampton Place is one of three community areas within AD 01-1. AD 01-1 fielded the cost to acquire certain improvements that are required, or are expected to be required, to be constructed as conditions of final leap or site plan approvals within the three AD 01-1 commulty areas . AlI of the Hampton Place improvement acquisition costs filnded by AD 01-1 were allocated only to the Hampton Place lots aid parcels. The AD O1-1 Engineer's Report, approved June 13, 2001, describes the method of allocating the AD 01-1 costs to each assessed parcel. The AD 01-1 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance with Bakersf field Municipal Code Section 13.08.070-Benefit Spread. Please see the AD O1-1 Engineer's Report for a detailed description of the AD 01-I Assessment Spread Method. C. The total original assessment principal amount, as reduced for the lower than anticipated bond issuance costs, for Assessment 183 is $165,669.01. The remaining assessment principal for Assessment 183 (effective January 1, 2002, at the beginning of the 2002/2003 Tax Year) is $160,618.13. The total original assessment amount and its remainng principal balance for Assessment 183 are segregated and apportioned to the lots created by the above-referenced TR 6007-2, as described below. 2. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAL ASSESSMENT AMOUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 183 TO AMENDED ASSESSMENTS 356 THROUGH 385; A. As described in the final AD 01-1 Engineer's Report, Assessment 183 was plaluled for subdivision into 28 R-1 lots pursuant to Vesting Tentative Tract No. 6007 ("Ten TR 6007"). In accordance with the Assessment Apportionment Method described on page D-17 of AD 01-1 29583ExC 1 ~ 12/10/U2 Engineer's Report Exhibit D, Description of Assessment Spread Method, the original Assessment 183 principal amount is apportioned to the 28 R-1 lots in TR 6007-2 as an equal assessment per R-1 lot. The Exhibit D Assessment Apportioillnent Method is summarized below for reference: 1, w11en a parcel is subdivided into a tract phase and a remalllder, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel i11 direct proportion to their total acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, exch~ding landscape and well site lots, parks, or drainage sump lots witlli~~ t11e new tract. 3 . Specifically, for the Hampton Place Area, Exhibit D states: "...t11e next tract phase recorded ... will be allocated a total assessment share equal to file lnunber of R-1 lots in the phase multiplied by the calcl~lated equal per R-1 lot cost share factor for the Hampton Place Area. The remaining balance will be apportioned to the lulsubdivided remainders far apportionments to future subdivision phases in accordance with the process described above. However, if the development p1a11 for Assessment Nos. 128, 129, 183, and 184 is revised, then the plan far segregation of the. original assessment will be revised to apportion a cost share to tlae first subdivision or subdivision phase and its remalllder parcel in direct proportion to their total acreages.
