The undersigned is the owner and subdivider of existing Assessment 242 ("Assessment 242") which was subdivided by Tract No. 6032 Unit One ("TR 6032-1"), creating 57 single- family residential lots, 3 landscape lots, and 1 remainder parcel, and is the owner of all lots and parcels created by said TR 6032-1. A description of said existing assessment, the total amount of the unpaid assessment principal balance effective January 1, 2003, at the beginning of the 2003/2004 tax year, and a description ~f how said parcel has beers subdivided are included in Engineer's Report Exhibit B, Description of Existing Assessments in City of Bakersfield Assessment District No. 01-1 (hereinafter "AD 01-1 "), attached hereto and incorporated herein by reference. As the original owner and subdivider of the referenced existing assessment and the owner of the aforesaid lots and parcels created by TR 6032-1, the undersigned hereby request the Superintendent of Streets for the City of Bakersfield to apportion the amount remaining unpaid on Assessment 242 in accordance with the provisions of the Improvement Bond Act of 1915. The unpaid principal amount for said existing assessment as shown on Exhibit B, has been apportioned to each separate part of the original parcel of land comprising the existing assessment in the amounts as shown on Exhibit ~~., Amended Assessment Roll attached hereto and incorporated herein by reference. 29594COL.APP -1- 6/15/03 II. ACCEPTANCE OF ASSESSMENT APPORTIONMENTPROCEDUREANDREQUEST TO RECORD AMENDED ASSESSMENTS. I have reviewed Exhibit C (Description of Assessment Apportionment Procedure) included in the attached Engineer's Report, describing the procedure used to apportion shares of the unpaid assessment principal amount for Assessment 242 in AD Ol-1 to the lots and parcels created by the recordation of said TR 6032-1. Pursuant to a review of Exhibit C, the undersigned has determined that the amended assessment amounts shown on said Exhibit A have been apportioned in accordance with the benefits the parcels will receive from the improvements financed by AD O l -1, based on current parcel zoning and with proposed uses. Therefore, the undersigned waives notice and hearing before the City Council on this .assessment apportionment, accepts the procedure used for the requested apportionment ofd the principal balance for said existing assessment, and requests and consents to the recordation of the apportioned assessments on the properties for which the undersigned is listed as owner on the accompanying Exhibit A, and to the amended assessment amounts shown thereon. DESCRIPTION OF EXISTING ASSESSMENT 242: A. Existing Assessment 242 (hereafter "Assessment 242") is located in the City of Bakersfield. It was created by Assessment and Diagram Aanendment ("Apportionment"} No. 2 for Assessment District No. 01-1("AD 01-1"). Assessment 242 is identified as Kern CountyAssessor's Tax Number ("ATN") 522- 010-71. Tract No. 6032 Unit One ("TR 6032-1"} subdivides Assessment 242 creating 57single-family residential ("R-1"} lots, 3 landscape lots, and 1 remainder parcel. The remainder parcel is assigned Amended Assessment Number ("Amended Assessment") 386. The 57 residential lots (Lots 1 through 57 in TR 6032-1) are Amended Assessments 387 through 443, respectively, and the 3 landscape lobs (Lots A, B, and C in TR 6032-1) are Amended Assessments 444 through 446, respectively. B. Assessment 242 is located in the Ming at Allen Area of AD 01-1 (hereafter "Ming at Allen"). Ming ~~t Allen is one of three conununity areas within AD O 1-1. AD 01-1 funded the cost to acquire certain improvements that are required, or are expected to be required, to be constructed as conditions of fin~.l map or site plan approvals ~vithin the three AD O l -1 conununity areas . All of the Ming at Allen improvement acquisition costs funded by AD 01-1 were allocated only to the Ming at Allen lots and parcels. The AD 01-1 Engineer's Report, approved June 13, 2001, describes the method of allocating the AD 01-1 costs to each assessed parcel. The AD Ol-1 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance with Bakersfield Municipal Code Section 13.08.070-benefit Spreacl. Please see the AD 01-1 Engineer's Report for a detailed description of the AD 01-1 Assessment Spread Method. C. The total original assessment principal amount, based on Apportionment No. 2 and as originally reduced for the lower than anticipated bond issuance costs, for Assessment 242 is $399,624.02. The remaining assessment principal for Assessment 242 (effective January 1, 2003, at the beginning of the 2003/2004 Tax Year} is $375,256.71. The total original assessment amouunt and its remaining principal balance for Assessment 242 are segregated and apportioned to the lots and parcels created by the above-referenced TR 6032-1, as described below. 2. DES CRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAL ASSESSMENT AMOUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENrT 242 TO AMENDED ASSESSMENTS 386 THROUGH 446: A. As described in the AD Ol-1 Apportionment No. 2 Engineer's Report, Assessment 242 was plalnned for subdivision into a combined total of 108 R-1 lots pursuant to Vesting Tentative Tract No. 6032 ("Ten TR 6032"). Tlne area of Ten TR 6032 was identified as the "Celebration" Product Type Area, TR 6032- 1 generally follows tlne lot layout shown on Ten TR 6032. In accordance with the Assessment Apportionment Method described on page D-16 of AD 01-1 Engineer's Report Exhibit D, Description 29594E~C " 6/15/(13 of Assessment Spread Method, the Assessment 242 principal amount is apportioned to the 57 R-1 lots and the remainder parcel created by TR 6032-1 as an equal assessment per R-1 lot for that Product Type Area (Celebration), as described below. The E~ibit D Assessment Apportionment Method is summarized below for reference: 1, when a parcel is subdivided into a tract phase and a remainder, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision loth as an equal share per lot, excluding landscape and well site lots, parks, or drainage siunp Lots within the new tract. 3. Specifically, for the Ming at Allen Area, Exhibit D states: "...the original Assessment No. 1 total confirmed assessment amount will be apportioned first on a net area basis between the two Product Type Areas (Ten. TR 6032 and Ten. TR 6034) within the Ming at Allen Area and then each area's assessment share will be apportioned as an equal per lot assessment. Accordingly, the first tract phase recorded ... will be allocated a total assessment share equal to the number of R-1 lots in the phase multiplied by the calculated equal per R-1 lot cost share factor for the Product Type Area of Assessment No. 1 in which the first tract phase is located. The remaining balance will, be apportioned to the unsubdivided remainder for apportionments to future subdivision phases in accordance with the process described above. However, if the development plan for Assessment No. 1 is revised, then the plan for segregation of the original assessment will be revised to apportion a cost share to the first subdivision or subdivision phase and its remainder parcel in direct proportion to their total acreages. The total assessment share apportioned to the recorded subdivision or subdivision phase would then be reapportioned to its lots as an equal assessment share per R-1 lot. Storm water retention sumps, water well sites, parks, and school parcels will be excluded from the tract acreage and the calculated net acreages used to apportion the original assessment. Landscape lots and in tract street areas will not be excluded from the tract acre~.ge totals." B. As described above, there is a total of 108 R-1 lots of the Celebration Product Type Area in Ten TR 6032, Based on the above-described Assessment Apportiolunent Method the total assessment amount for Assessment 242 is apportioned as follows: The total Assessment 242 assessment amount is apportioned to the remainder parcel and the entire TR 6032-1 ni direct proportion to the number of existing and proposed R-1 lots. The remainder parcel (Amended Assessment 386) is allocated 51/108 shares ofthe Celebration Product Type Area (for the future phases of Ten TR 6032), and TR 6032-1 is allocated 57/108 shares of the Celebration Product Type Area. Each of the 57 R-1 lots in TR 6032-1 is allocated 1/57 share of the total original assessment amount allocated to this portion of Assessment 242. The 3 landscape lots are not assessed. The AD 01-1 Engineer's Report, approved June 13, 2001, describes the method of allocating the AD 01-1 costs to each assessed parcel. The AD Ol-1 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance with Bakersfield Municipal Code Sectioa~ x'3.08.070-Benefit Spread. As described in the AD 01-1 Apportionment No. 2 Engineer's Report, Assessment 242 was planned far subdivision into a combined total of 108 R-1 lots pursuant to Vesting Tentative Tract No. 6032 ("Ten TR 6032"). The area of Ten TR 6032 was identified as t11e "Celebration" Product Type Area. TR 6032- 1 generally follows the lot layout shown on Ten TR 6032. In accordance with the Assessment Apportionment Method described on page D-16 of AD Ol-1 Engineer's Report Exhibit D, Description 29594E~C 1 6115143 of Assessment Spread Method, the Assessment 242 principal amount is apportioned to the 57 R-1 lots and the remainder parcel created by TR 6032-1 as an equal assessment per R-1 lot for that Product Type Area (Celebration), as described below. 'The E~ibit D Assessment Apportionment Method is sunuilarized below for reference: 1. when a parcel is subdivided into a tract phase and a remainder, the total original assessrr~ent principal amount will be apportioned to t11e tract phase and to the remainder parcel in direct proportion to their total acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision 1ot~ as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within the new tract. 3. Specifically, for the Ming at Allen Area, Exhibit D states: "...the original Assessment No. 1 total confirmed assessment amount will be apportioned first on a net area basis between the two Product Type Areas (Ten. TR 6032 and Ten. TR 6034) within the Ming at Allen Area and then each area's assessment share will be apportioned as an equal per lot assessment. Accordingly, the first tract phase recorded ... will be allocated a total assessment share equal to the number of R-1 lots iii the phase multiplied by the calculated equal per R-1 lot cost share factor for the Product Type Area of Assessment No. 1 in wlucli the first tract phase is located. The remaining balance will be apportioned to the unsubdivided remainder for apportionments to future subdivision phases in accordance with the process described above. However, if the development plan for Assessment No. 1 is revised, then the plan for segregation of the original assessment will be revised to apportion a cost share to the first subdivision or subdivision phase and its remainder parcel in direct proportion to their total acreages. The total assessment share apportioned to the recorded subdivision or subdivision phase would then be reapportioned to its lots as an equal assessment share per R-1 lot. Storm water retention sumps, water well sites, parks, and school parcels will be excluded from the tract acreage gild the calculated net acreages used to apportion the original assessment. Landscape lots and in tract street areas will not be excluded from the tract acreage totals." B. As described above, there is a total of 10$ R-I lots of the Celebration Product Type Area in Ten `TR 6032. Based on the above-described Assessment Apportionment Method the total assessment amount for Assessment 242 is apportioned as follows: The total Assessment 242 assessment amount is apporCioned to the remainder parcel and the entire TR 6032-1 in direct proportion to the ntunber of existing and proposed R-1 lots. The remainder parcel (Amended Assessment 386) is allocated 51/108 shares ofthe Celebration Product Type Area (for the future phases of Ten TR 6032), and TR 6032-1 is allocated 57/108 shares of the Celebration Product Type Area. Each of the 57 R-1 lots in TR 6032-1 is allocated 1/57 share of the total original assessment amount allocated to this portion of Assessment 242. The 3 landscape lots are not assessed.
