NOTICE IS FURTHER GIVEN that upon recording of this Notice in the office of the County Recorder, the several amended assessments on the lots, pieces and parcels shown on the Amended Assessment Diagram (Assessment and Diagram Amendment No. 6) of Assessment District No. 01-1 shall become a lien upon the lots or portions of lots assessed, respectively. This amendment. evidences the completion of statutory proceedings to divide the lien of special assessments previously levied on the parcels of land shown on the amended diagram, to conform .with the divisions in the parcels themselves. The area of Ten TR 6032 was identified as the "Celebration" Product Type Area. TR 6032-2 generally follows the lot layout shown on Ten TR 6032. In accordance with the Assessment Apportionment Method described on page D-16 of AD 01-1 Engineer's Report Exhibit D, Description of Assessment 29597E~C 1 7124103 Spread Method, the Assessment 386 principal amount is apportioned to the 51 R-1 lots created by TR 6032-2 as an equal assessment per R-1 lot for that Product Type Area (Celebration), as described below. The E~ibit D Assessment Apportionment Method is sununarized below for reference: 1. when a parcel is subdivided into a tract phase and a remainder, the total original assessment principal alnot~nt will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage s~unp lots ~itlain the new tract. 3. Specifically, for the Ming at Allen Area, Exhibit D states: "...the original Assessment No. l total confirmed assessment amount will be apportioned first on a net area basis between the two Product Type Areas (Ten. Based on the above-described Assessment Apportionment Method the total assessment amolu~t .for Assessment 3 86 is apportioned as follows; The total Assessment 3 86 assessment amount is apportioned to the entire TR 6032-2 in direct proportion to the number of existing and proposed R-1 lots. TR 6032-2 is allocated 51151 shares ofthe Celebration Product Type Area. The total original assessment principal amount, based on Apportionment No. 5 and as originally reduced for the lower than anticipated bond issuance costs, for Assessment 386 is $188,711.34. The remaining assessment principal for Assessment 386 (effective January 1, 2003, at the beginning of the 2003/2004 Tax Year) is $177,204.55. The total original assessment amount and its remaining principal balance for Assessment 386 are segregated and apportioned to the lots and parcels created by the above-referenced TR 6032-2, as described below. 2. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAL ASSESSNI[ENT AMOUNT AND ITS REMAINING PRINCIPAL BALANCE FROM ASSESSMENT 386 TO AMENDED ASSESSMENTS 447 THROUGH 499: A. As described in the AD Ol-1 Apportionment No. 5 Engineer's Report, Assessment 386 was planned for subdivision i11to a total of 51 R-1 lots pl~rsuant to Vesting Tentative Tract No. 6032 ("Ten TR 6032"}. The area of Ten TR 6032 vas identified as the "Celebration" Product Type Area. TR 6032-2 generally follows the lot layout shown on Ten TR 6032. In accordance with the Assessment Apportionment Method described on page D-16 of AD Ol-1 Engineer's Report Exhibit D, Description of Assessment 29597E~C 1 712/03 Spread Method, the Assessment 386 principal amount is apportioned to the 51 R-1 lots created by TR 6032-2 as an equal assessment per R-1 lot for that Product Type Area (Celebration), as described below. The Exhibit D Assessment Apportionment Method is stunmarized below for reference: 1. when a parcel is subdivided into a tract phase alld a remainder, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2. The amount. so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within the new tract. 3. Specifically, for the Ming at Allen Area, Exhibit D states: "...the original Assessment No. 1 total confirmed assessment amount will be apportioned first on a net area basis between the two Product Type Areas (Ten. TR 6032 and Ten. TR 6034) within the Ming at Allen .Area alld then each are4i's assessment share will be apportioned as an equal per lot assessment. Accordingly, the first tract phase recorded ... will be allocated a total assessment share equal to the number of R-1 lots in the phase multiplied by the calculated equal per R-11ot cost share factor for the Product Type Area of Assessment No. 1 in whicli the first tract phase is located. The remaining balance will be apportioned to the lulsubdivided remainder for apportionments to future subdivision phases in accordance with the process described above. However, if the development plan for Assessment No. 1 is revised, then the plan for segregation of the original assessment will be revised to apportion a cost share to the first subdivision or subdivision phase and its remainder parcel in direct proportion to their total acreages. The total assessment share apportioned to the recorded subdivision or subdivision phase would then be reapportioned to its Lots as an equal assessment share per R-1 lot. Storm water retention siunps, water well sites, parks, and school parcels will be excluded from the tract acreage and the. calculated net acreages used to apportion the original assessment. Landscape lots and in-tract street areas will not be excluded from the tract acreage totals." B. As described above, there is a total of 51 R-1 lots of the Celebration Product Type Area in Ten TR 60 32 covering the area of Assessment 3 86. Based on the above-described Assessment Apportionment Method the total assessment amount for Assessment 386 is apportioned as follows: ~~The total Assessment 386 assessment amount is apportioned to the entire TR 6032-2 in direct proportion to the number of existing and proposed R-1 lots. TR 6032-2 is allocated 51/51 shares of the Celebration Product Type Area. Each of the 51 R-11ots in TR 6032-2 is allocated 1151 share of the total original assessment amount allocated to this portion of Assessment 386. The landsca~~e lot is not assessed. The remainder parcel (Amended Assessment 447} is also not assessed: the portion of the Original Assessment No. 1 (from which Assessment 386 was created through Assessment and Diagram Amendments Nos. 2 and 5} now identified as the remainder parcel was originally planned fir subdivision as a future school site parcel and a future storm drain sump parcel, and their areas wexe excluded from the "net assessable area" of the Original Assessment No. 1. The current development plan for the remainder parcel follows the above-described plan for its subdivision into a school site and a storm drawl sump, and, therefore, it is not allocated a share of the total assessment amount for Assessment 386. 29597ExC 2 7/24103 Ech parcel's total amended assessment amount shown on Exhibit D, attached to the Engineer's Report for this AD 01-1 Assessment and Diagram Amendment No, 6 is the new parcel's original assessment share, and is the amount that should be used to calculate the Bond Reserve credit the new lot and parcel would receive if the parcel owner elects to prepay the total remaining balance for Amended Assessme~.ts 447 through 499.
