The total original assessment amounts and their remaining principal balances for Assessments 128,129, and 537 are segregated and apportioned to the lots created by the above-referenced TR 6033, as described below. 29636EXC ~` 9/8/04 2. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION TIC ORIGINAL ASSESSMENT AMOUNTS AND THEIR REN[AINING PRINCIPAL BALANCES FROM ASSESSMENTS 128,129, AND 537 TO AMENDED ASSESSMENTS 539 THROUGH 578: A. As described inthe final AD 01-1 Engineer's Report, Assessments 128 and 129 were planned for subdivision into 12 R-1 lots each pursuant to Vesting Tentative Tract No. 6033 ("Ten TR 6033"). As described in the AD 01-1 Apportionment No. 7 Engineer's Report, Assessment 537 was planned fox subdivision into 14 R-1 lots pursuant to Ten TR 6033. In accordance with the Assessment Apportionment Method described on page D-17 of the AD 01-1 Engineer's Report Exhibit D, Description of Assessment Spread Method, the total combined original Assessments 12 8, 12 9, and 5 3 7 princip al amount is apportioned to the 3 8 R-11ots in TR 6 03 3 as an equal assessment per existing R-1 lot. The Exhibit D Assessment Apportionment Method is summarized below for reference: 1. When a parcel is subdivided into a tract phase and a remainder, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2. The amount so allocated to the new subdivision will be reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks, or drainage sump lots within the new tract. 3 . Specifically, for the Hampton Place Area, Exhibit D states: ``...the next tract phase recorded ... will be allocated a total assessment share equal to the number of R-1 lots in the phase multiplied by the calculated equal per R-1 lot cost share factor for the Hampton Place Area. The remaining balance will be apportioned to the unsubdivided remainders for apportionments to future subdivision phases in accordance with the process described above. However, if the development plan for Assessment Nos.128, 129,183, and 184 is revised, then the plan for segregation of the original assessment will be revised to apportion a cost share to the first subdivision or subdivision phase and its remainder parcel in direct proportion to their total acreages.. The total assessment share apportioned to the recorded subdivision or subdivision phase would then be .reapportioned to its lots as an equal assessment share per R 1 lot. Stone water retention sumps, water well sites, and parks will be .excluded from the tract acreage and the calculated net acreages used to apportion the original, assessment. Landscape lots a11d in-tract street areas will not be excluded from the tract acreage totals ." B. As described above, based on the original development plan of the Hampton Place and -based on the above-described Assessment Apportionillent Method, the total combined assessment amount for Assessments 128,129, and 537 is apportioned as follows: Each of the 38 R-1 lots in TR 6033 is allocated 1138 share of the total combined original assessment amount for Assessments 128, 129, and 537. The private street lots are not assessed. There are no remainder parcels created by TR 6033. Each parcel's total amended assessment amount shown on Exhibit D, attached to the Engineer's Report for this AD 01-1 Assessment and Diagram Amendment No. 8, is the new parcel's original assessment share, and is the amount that should be used to calculate the Bond Reserve credit the new lot and parcel would. receive if the parcel owner elects to prepay the total remaining balance for Amended Assessments 539 through X78. . 29636ExC ~ 9/8/04 C. Apportionment of the Unpaid Assessment Principals for Assessments 128, 129, and 537 to Amended Assessments 539 through 578: The total combined unpaid assessment principal amount for Assessments 128,129, and 537 is apportioned to the new lots created by-the recordation of said TR 6033 in direct proportion to the original Assessments 128,129, and 537 assessment shares apportioned to each new lot, as shown on Exhibit A, Amended Assessment Roll, attached to the, Engineer's Report for this AD 01-1 Apportionment No . 8 . For more detailed information on the Assessment Spread Method used to calculate the Assessments 128, 129, and 537 original assessment amounts, reference is made to the AD 01-1 Engineer's Report on file in the office of the Public Works Director for the City of Bakersfield. DESCRIPTION OF EXISTING ASSESSMENTS 128,129, AND 537: A. ,Existing Assessments 128, ,129, and 537 (hereafter "Assessment 128," "Assessment 129," and "Assessment 537," respectively) are located inthe City of Bakersfield. Assessments 128 and 129 were created by Original Assessment and Diagram. for Assessment District No. 01-1("AD Ol- 1"). Assessment 537 was created by Assessment and Diagram Amendment ("Apportionment") No. 7 for AD 01-1. Assessments 128;129, and 537 are identified, respectively, as the following three Kern CountyAssessor's TaxNumbers ("ATNs"):495-010-24-00-1, 495-010-25-00-4, 495- 360-08-00-7. Tract No. 6033 ("TR 6033") subdivides Assessments 128,129, and 537 creating 3 8single-family residential ("R-1 ")lots and 2 private street .lots . The 3 8 R-1 lots (Lots 1 through 38 in TR 6033) are assigned Amended Assessment Numbers ("Amended Assessments") 539 through 576, respectively. The 2 private street lots (Lots A and B in TR 6033) are Amended Assessments 577 and 578, respectively. B. Assessments 128, 129, and 537 are located in the Hampton Place Area of AD 01-1 (hereafter "Hampton Place"} . Hampton Place is one of three community areas within AD 01- l . AD ~01-1 funded the cost to acquire certain improvements that are required, or are expected to be required, to be constructed as conditions of final map or site plan approvals within the three AD 01-1 community areas . All of the Hampton Place improvement acquisition costs funded by AD 01-1 were allocated only to the Hampton Place lots and parcels. The AD 01-1 Engineer's Report, approved June 13, 2001, describes the method of allocating the AD 01-1 costs to each assessed parcel. The AD 01-1 Assessment Spread Method described in Exhibit D of the Engineer's Report is in conformance with Bakersfield 1Vlunicipal Code Section 13.08.070-Benefit Spread. Please see the AD 01-1 Engineer's Report for a detailed description of the AD 01-1 Assessment Spread Method. C. The total original assessment principal amounts, as reduced for the lower than anticipated bond issuance costs, for Assessments 128 and 129 are $71,000.99 and $71,000.99, respectively. The total original. assessment principal amount, based on Apportionment No. 7, for Assessment 537 is $82,834.52. The remaining assessment principal amounts for Assessments 128,129, and, 537 (effective January 1, 2004, at the beginning of the 2004/2005 Tax Year) are $64,362.10, $64,362.69, and $75,089.88, respectively. The total original assessment amounts and their remaining principal balances for Assessments 128,129, and 537 are segregated and apportioned to the lots created by the above-referenced TR 6033, as described below. 29636ExC 1 918104 2. DESCRIPTION OF THE PROCEDURE USED TO SEGREGATE AND APPORTION THE ORIGINAL ASSESSMENT AMOUNTS AND THEIR REN[AINING .PRINCIPAL BALANCES FROM ASSESSMENTS 128,129, AND 537 TO AMENDED ASSESSMENTS 539 THROUGH 578: A. As described in the final AD 01-1 Engineer's Report, Assessments 128 and 129 were planned for subdivision into 12 R-1 lots each pursuant to Vesting Tentative Tract No. 603 3 ("Ten TR 603 3 ") . As described in the AD 01-1 Apportionment No. 7 Engineer's Report, Assessment 537 was planned for subdivision into 14 R-1 lots pursuant to Ten TR 6033. In accordance with the Assessment Apportioiunent Method described on page D-17 of the AD 01-1 Engineer's Report Exhibit D, Description of Assessment Spread Method, the total combined original Assessments 128, 129, and 537 principal amount is apportioned to the 38 R-1 lots in TR 6033 as an equal assessment per exist111g R-1 lot. The Exhibit D Assessment Apportionment Method is summarized below for reference: 1. When a parcel is subdivided into a tract phase and a~ remainder, the total original assessment principal amount will be apportioned to the tract phase and to the remainder parcel in direct proportion to their total acreage. 2. The amount so allocated to the new subdivision -will be .reallocated among the subdivision lots as an equal share per lot, excluding landscape and well site lots, parks; or drainage sump lots within the new tract. 3 . Specifically, for the Hampton Place Area, Exhibit D states: ".. ahe next tract phase recorded ... will be allocated a total. assessment share equal to the number of R-l lots in the phase multiplied by the calculated equal per R-1 lot cost share factor for the Hampton Place Area. The .remaining balance will be apportioned to the unsubdivided remainders for apportionments to future subdivision phases in accordance with the process, described above. However, if the development plan for Assessment Nos. 128,129,1.83, and 184 is revised, then the plan for segregation of the original assessment will be revised to apportion a cost share to the first subdivision or subdivision phase and its remainder. parcel in direct proportion to their total acreages. The total assessment share apportionedto the recorded subdivision or subdivision phase would then be reapportioned to its lots as an equal assessment share per R 1 lot. Storm water retention. sumps, water well sites, and parks .will be excluded from the tract acreage and the calculated net acreages used to apportion the original assessment. Landscape lots and in tract street areas will not be excluded from the tract acreage totals ." B. As described above, based on the original development plan of the Hampton Place and based on the above-described Assessment Apportiolunent Method, the total combined assessment amount for Assessments 128,129, and 537 is apportioned as follows: Each of the 3 8 R-11ots in TR 603 3 is allocated 1 /3 8 share of the total combined original assessment amount for Assessments 128, 129, and .537. The private street lots are not assessed. There are no remainder parcels created by TR 6033. Each parcel's total amended assessment amount shown on Exhibit D, attached to the Engineer's Report for this.AD 01-1 Assessment and DiagramAmendment No. 8, is the new parcel's original assessment share, and is the amount. that should be used to calculate the Bond Reserve credit the new lot and parcel would xeceive if the parcel owner elects to prepay the total remaining balance for Amended Assessments 539 through 578. . ~9636ExC ~ 918!04 C. Apportionment of the Unpaid Assessment Principals for Assessments 128, 129, and 537 to Amended Assessments 539 through 578: The total combined unpaid assessment principal amount for Assessments 128,129, and 537 is apportioned to the new lots created by the recordation of said TR 6033 in direct proportion to the original Assessments 128,129, and 537 assessment shares apportioned to each new lot, as shown on Exhibit A, Amended Assessment Roll, attached to the Engineer's Report for this AD 01-1 Apportionment No . 8 . For more detailed information on the Assessment Spread Method used to calculate the Assessments 128, 129, and 537 original assessment amounts, reference is made to the AD 01-1 Engineer's Report on file in the office of the Public Works Director for the City of Bakersfield.
