an ordinance re-zoning property or an emergency ordinance, be
referred by the Vice-Mayor to a committee to be chosen by the~

SUBJECT: An Ordinance of Council of the Ci of Bakersfield amending
Subsection F. of Section 16 2.030, Subsecti¢ B.2. of Section 16.20.060, and
Subsection B. of Section 16. 030 of the B rsfield Municipal Code relating t¢
Parcel and Tract Maps.
RECOMMENDATION: First readin¢
BACKGROUND: Section 16 2.030F. presently ibits parcel map waivers and lot
line adjustments whic would result in any lot~with a net area of less than 600
square feet. The amendment of this section wou~d prohibit such waivers and
adjustments resulting in substandard lots only w~th regard to residential lots.
It would also cre~e an exception for lots which ~ould thereby be increased in
size even though/~he lot would have a net area of ~ess than 6000 square feet.
The amendment of Section 16.30.060 B.2. world allow the signatures of
mineral rights 6wners on final tract maps to be waived if the owner's interest
is less than twenty percent and if the signatures or ~xpress waiver of sur.face
entry rights of one or more parties with a combined interest of more than fifty
percent has been obtained. ~
Section 16.22.060B., relating to signatures on ~arcel maps of parties
holding record title interest, is amended to correct an e~rant reference to
another code section. The present section refers t~o provi~ions of 16.22.060B.,
but was intended to refer to the provisions of Section 16.2~.060B.~

SECTION 2.
Subsection B.2. of Section 16.20.060 of the
Bakersfield Municipal Code is hereby amended to read as follows:
16.20.060 Certificate of parties having record title interest.
B. The signatures of each party owning a recorded interest
in, or right to, minerals, including but not limited to, oil,
gas, or other hydrocarbon substances, not including lessees of
such rights, shall be required unless his name and the nature of
his respective interest are stated on the final map and the
advisory agency determines, or on appeal the city council finds,
at least one of the following applies:

one or more parties having a combined interest of more than fifty
percent has been obtained;

Subsection B. Of Section 16.22.030 'of the Bakersfield
Municipal Code is hereby amended to read as follows:
16.22.030 Certificate on maR.
B. Subject to the provisions of Section 66436 of the Map
Act, unless otherwise determined by the advisory agency, a sepa-
rate certificate, signed and acknowledged by all parties having
any record title interest in the real property subdivided,
consenting to the preparation and recordation of the parcel map is
required; provided, however, that for good and sufficient cause
shown by the subdivider, the advisory agency may waive any or all
such signatures and/or names and nature of the respective inter-
ests otherwise required by Section 66436 of the Map Act at any
time after the tentative map is submitted for approval. Such
waiver shall be certified by .the city engineer. The provisions of
Section 16.20.060 B. shall apply to the waiver of signatures of
parties owning a recorded interest in, or right to, minerals,
including, but not limited to, oil, gas or other hydrocarbon
substances, if any parcel created by the final parcel map will
have a gross area of less than twenty acres.
SECTION 4.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

zoning into compliance with State .laws.
2. ORDER OF BUSINESS
Background: The City Clerk has requested that the
~Pproval of Council Meeting Minutes be placed on
the Consent Calendar to facilitate streamlining the~
Agenda. This ordinance, when adopted, will imple-
ment this change.
3. USE OF BICYCLES, SKATEBOARDS, ETC., IN BUSINESS DIST.
' Ba_~q~round: This ordinance makes it illegal to skate-~
board on the steps of City Hall.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 17.04.160 AND
SUBSECTION 18 OF SECTION 17.58.020; ADDING
SUBSECTION J. TO SECTION 17.10.020 AND
ADDING CHAPTER 17.67; AND REPEALING SUB-
SECTION B.9. OF SECTION 17.66.020 OF THE
BAKERSFIELD MUNICIPAL CODE RELATING TO
FAMILY DAY CARE HOMES.
BE IT ORDAINED by the.Council of the City of Bakersfield
as follows:
SECTION 1.
Section 17.04.160 of the Bakersfield Mun.~cipal Code is
hereby amended to read as follows:
17.04.160 Small family day care homes.
"Small family day care homes" are homes which regularly
provide family daY care, protection and supervision to six or
fewer children, including children who reside at the home, in the
provider's own home, for periods of less than 24 hours per day,
while the.parents or guardians, other than the provider, are away.
SECTION 2.
Subsection 18 of Section 17.58.020 of the Bakersfield
Municipal Code is hereby amended to read as follows:
17.58.020 Schedule of parking requirements.
Off-street parking facilities shall be provided and main-
tained for the following specific uses or facilities as follows:

for each staff member.
SECTION 3.
Subsection J. of Section 17.10.020 is hereby added to the
Bakersfield Municipal Code to read as follows:
17.10.020 Uses permitted.
The following uses are permitted in an R-1 zone:
J. Small family day.care homes, as defined in section
17.04.160, and which comply with the regulations set forth in the
California Child Day Care Facilities Act of the Health and Safety
Code (Section 1596.70 et seq.).
'SECTION 4.
Chapter 17.67 is hereby added to the Bakersfield
Municipal Code to read as follows:
Chapter 17.67
LARGE FAMILY DAY CARE HOMES
Sections:
17.67.010 Definition.
17.67.020 Permitted in residential ~zones subject to permit.
17.67.010 Definition.
"Large family day care home" means a home which provides
day care, protection, and supervision to 7 to 12 children, inclusive,
including children who reside at the home, in the provider's own
home, for periods of less than 24 hours per day, while the parents
or guardians, other than the provider, are away.
17.67.020 Permitted in residential zones subject to permit.
A. Large family day care homes shall be permitted in
residential zones by administrative permit issued by the City
Manager or his designee.
B. A permit for such home.shall be issued upon certifi-
cation to the City Manager or his designee that the proposed large
family day care home complies with State licensing requirements
and the following:

1. The day care home must be principle residence
of'the provider, and its use as a day care home must be clearly
incidental and secondary to the use of the property for
residential purposes.
2. A minimum of one off-street parking space per
employee must be provided. For purposes of this section, such
off-street parking may be provided in the driveway of the day.care
home, provided that such parking space will not conflict with the
required child drop-off/pick-up area and does not block a public
sidewalk or right-of-way.
3. No structural changes or signage are'proposed
which will alter the character of the single-family residence.
4. The operation of the facility will comply with
noise standards contained in the Noise Element of the Bakersfield
Metropolitan General Plan.
5. Residences located on major arterial streets
must provide a child drop-off/pick-up area designed to prevent
vehicles from backing onto the major arterial roadway.
6. The provider shall comply'With all applicable
regulations of the Bakersfield Fire Department and the State Fire
Marshal regarding health and safety requirements.
7. The facility will be operated in a manner which
will not adversely affect adjoining residences nor be detrimental
to the character of the residential neighborhood.
SECTION 5.
Subsection B. 9. of Section 17.66.020 of the Bakersfield
Municipal Code is hereby repealed.
SECTION 6.
This ordinance shall be posted in accordance with
the City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
