SUBJECT: Proposed Ordinances
On 12/14/88 the Council approved City Managers' Report No.
3(b)-88, providing that each proposed ordinance, other than an
ordinance re-zoning property or an emergency ordinance, be
referred by the Vice-Mayor to a committee to be chosen by the
Vice-Mayor prior to Council action.
Please refer the following proposed ordinances to whichever com-
mittee you deem appropriate:
1. Adult Bookstores U~ ~.~

3. Uniform Fire Code ~~

SUBJECT: An Ordinance of the Council of the City of Bakersfield
adding Section 12.20.035 to the Bakersfield Municipal Code
relating to encroachments.
RECOMMENDATION:
First Reading.
BACKGROUND:
This ordinance adds a section to the Bakersfield Municipal
Code requiring the City Engineer to obtain Council approval
before granting an encroachment permit for any at or above
grade portion of any building.

ORDINANCE NO. NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING SECTION 12.20.035 TO
THE BAKERSFIELD MUNICIPAL CODE RELATING TO
ENCROACHMENTS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 12.20.035 is hereby added to the Bakersfield
Municipal Code to read as follows:
12.20.035 City council approval.
Notwithstanding any other provision of this Chapter,
the City Engineer shall not grant an encroachment permit for any
at or above grade portion of any building unless he has first
referred the application to and obtained Council approval of the
application.
SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
