BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 10.32.140 is hereby added to Chapter 10.32 of the Bakersfield Municipal Code to read as follows: 10.32.140 Parking of commercial vehicles prohibited in residential districts. A. It shall be unlawful, except as provided in subsec- tion B. of this Section, for any person to park or to leave stand- ing on any street in a residential district any commercial vehicle having a manufacturer's gross vehicle weight rating of 10,000 pounds or more. B. The prohibition set forth in subsection A. of this Section shall not apply to any commercial vehicle making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on a restricted street or delivering materials to be used in the actual and bona fide repair, altera- tion, remodeling or construction of any building or structure for which a building permit has been obtained prior to such delivery. C. For purposes of this Section, "residential district" means any property located in any R-1 (One Family Dwelling) Zone, any R.S. (Residential Suburban) Zone, any R-2 (Limited Multiple- Family Dwelling) Zone, any R-3 (Limited Multiple-Family Dwelling) Zone, any R-4 (Multiple-Family Dwelling) Zone, any R.H. (Residential Holding) Zone, and any P.U.D. (Planned Unit Develop- ment) Zone, in accordance with Title 17 of this Code. The prohi- bition set forth in subsection A. of this Section shall apply to commercial vehicles of the specified weight or greater parking on streets adjacent to and on the same side of the street as such residential district. D. Any person violating the provisions of this Section shall be guilty of an infraction and upon conviction thereof shall be punishable by: 1. A fine not exceeding $50.00 for a first violation; 2. A fine not exceeding $100.00 for a second violation within one year; and 3. A fine not exceeding $300.00 for each additional violation within one year. SECTION 2.
