Saalfield, City Attorney SUBJECT: Proposed Ordinances On 12/14/88 the Council approved City Managers' Report No. 3(b)-88, providing that each proposed ordinance, other than an ordinance re-zoning property or an emergency ordinance, be referred by the Vice-Mayor to a committee to be chosen by the Vice-Mayor prior to Council action. Please refer the following proposed ordinances to whichever com- mittee you deem appropriate: 1. Public Hearings 2. Parcel and Tract Maps--this ordinance was sent ~.~ to you on 1/3/89 but was missing the first page. Also, corrections were made to the Admin. Report. Thank you for your help. RECOMMENDATION: First reading. BACKGROUND: This proposed ordinance would revise Council hearing procedures to: 1) reduce initial presentations by. proponents and opponents to 20, rather than 30, minutes, and summation by each side to 5, rather than 10 minutes; 2) specify that, except on appeals, opponents make their presentations first; and 3) provide that a hearing not commenced prior to Midnight shall be opened and continued to the next regular meeting of the Council and considered before other hearings at such meeting. AJS/meg NB.38 DRAFT ORDINANCE NO'. NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 2.04.110 D. OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO PUBLIC HEARINGS. BE IT O~DAINED by the Council of the City of Bakersfield as follows: SECTION 1. Subsection D. of Section 2.04.110 of the Bakersfield Municipal Code is hereby amended to read as follows:. 2.04.110 Other public statements. D. Hearings. Scheduled hearings on .zoning matters, annexations, public improvement districts, appeals, and other hearings are to be conducted in the following manner: 1. Presentation by opponents, limited to twenty minutes unless permission is granted for additional time; 2. Presentation by proponents, with the time limits specified in subdivision 1 of this subsection; 3. Where a hearing is the result of an appeal, the order of presentation shall be reversed and the appellant shall proceed first; the time limits specified in subdivision 1 of this subsection shall apply; 4. Summation by both sides limited to five minutes each; 5. Council closes public discussion, at which time no member of the public shall address the council unless specifically asked to by a member through the presid- ing officer; 6. Council discussion, council decision or submission for deliberation; 7. Whenever a scheduled hearing does not commence prior to midnight, the Council shall open such hearing and continue the matter to the next regular meeting of the council. Each hearing so continued shall be placed on the agenda for such next regular meeting above any other hearing scheduled for such meeting.
