DeMond Lynn Edwards AGENDA SUMMARY REPORT LEGISLATIVE AND LITIGATION COMMITrEE Wednesday, February 17, 1993 12:00 noon City Manager's Conference Room 1. Retaining Local Control in Government Committee members are supportive of retaining local control over land use decisions. Staff will draft a resolution based on the guiding principles and action plan of the Kern Citizens for Effective Local Government advocating local government as the avenue which best serves the people of the community. 2. Smoking The Committee feels that a citywide smoking ordinance will place undue burdens upon already overburdened local businesses as well as be a problem with enforcement. The Committee is in unanimous agreement that further review should be made of an ordinance to limit tobacco access to minors through a vending machine ordinance. Staff will contact local vending machine owners to discuss this issue with them and provide input to the committee. 3. Graffiti Staff reported on steps being taken to reduce and eradicate graffiti. The Police Department is tracking arrested minors to see if they become repeat problems after diversion efforts have been made. Community meetings are also being held to educate-the public on the problems of graffiti citywide. Graffiti has extended beyond gang-related activities into malicious mischief ("tagging"). Discussions included stiff penalties, better control of spray paint cans and felt markers at the point of sale, educational efforts, and parents' responsibilities for their children's actions. 4. Council Procedures (Alan Tandy) Committee supports the proposed amendment to Section 2.04.070 of the Municipal Code which will allow the Council to change the Agenda format at a noticed council meeting with a two-thirds affirmative vote of the Council at that meeting. Thus, Council can respond quickly to immediate needs generated a that Council meeting without changing the established order of business in the existing City ordinance. The only change in the proposed ordinance from the existing one is in the introductory paragraph, deleting "unless otherwise changed by the Council" and adding "Changes in the order of business at the noticed meeting can be accomplished by a two-third's affirmative vote of the Council." 5.
