ROLL CALL Called to order at 4:20 p.m. Members present: Councilmember Jacquie Sullivan, Chair; Councilmember Irma Carson Member absent: Counciimember Patricia DeMond 2. APPROVAL OF FEBRUARY 19, 1998 MEETING MINUTES Approved as submitted. 3. PRESENTATIONS None Agenda Summary Report Legislative and Litigation Committee April 16, 1998 Page -2- 4. PUBLIC STATEMENTS None 5. DEFERRED BUSINESS A. MASSAGE PARLOR ORDINANCE Councilmember Carson made a motion that the issue of mobile neck massage be deferred because the person that this concerned was not in attendance and needed to be notified when the issue was being discussed. She further indicated that she felt the issue was of a serious nature and a better discussion would result when all members of the committee were available, especially Councilmember DeMond who was knowledgeable regarding and involved in the creation of the existing City ordinance. Councilmember Sullivan concurred in the motion. Staff indicated that they would contact Ms. Christi Doll regarding the next meeting and prepare staff reports which would be available prior to the meeting. 6. NEW BUSINESS None 7. Scott, Vice/Narcotics Detail Subject: Massage Parlor Ordinance Massage Therapist Christi Doll has requested the Committee review and change the city ordinance regarding massages to include and allow out-call massages. The City's current massage ordinance requires massages to be performed at a massage establishment for which a permit has been issued. Ms. Doll indicates she travels throughout the county and is allowed to perform "chair massages" at private and public facilities. The massage is performed by having the client sit in a chair fully dressed whereupon a fifteen minute on-sight express-massage to the neck, shoulders, arms, hands, and back muscles is conducted. The fee for this service is $10.00 for fifteen minutes. The Committee requested that the lBakersfield Police Depadment conduct a survey by contacting other agencies regarding their policy and procedure on this matter. The listed agencies were contacted and provided the following information: 1. Stockton Police Department A. Current ordinance allows for no out-call massage of any type, including chair massage. lB. Chair massages is currently being addressed and the City is in the process of drafting a new massage ordinance that would enforce and specify the number of hours of training for massage technicians. 2. San Joaquin County A. Current ordinance regulates chair massage. B. If a new ordinance is adopted, it will permit out-call massages for chair massage only. 3. Fresno Police Department A. Current ordinance doesn't address chair massage. However, currently, when requested by applicants after meeting stringent requirements, permits are issued. 4. Modesto Police Department A. Currently in the process of re-writing all ordinances requiring licenses and/or permits. B. Irvine Police Department A. Strong massage ordinance, which doesn't regulate out-call massage. B. Chair massages are allowed at businesses only. 6. Kern County Sheriff's Department A. No massage ordinance. B. Out-call massage allowed. 7. Visalia Police Department A. No massage ordinance. B. Currently in the process of writing an ordinance which would not allow out-call massages. 8. Delano Police Department A. No ordinance addressing massage establishments. B. No ordinance addressing out-call massage. The Bakersfield Police Department would oppose any change in the current ordinance that would favor out-call massages. It is this agency's strong opinion that out-call massages would contribute to prostitution and other illegal activity. Additionally, there is no way to effectively regulate client appointment dates, times, and locations as pagers would be the mode of contact with clients. Another challenge is the safety of the masseuse who could be subjected to harm when encountering unfamiliar clients. MS:bib
