DALE HAWLEY, CITY MANAGER DATE: JULY21, 1992 : FROM: JANET MCCREA, ACTING PERSONNEL MANAGER ~,r¥''~'* SUBJECT: HEALTH CARE CONSULTANT SELECTION ./ lhe Selection Committee for the Health Care Consultant met on day, duly 1 O, 1992 to interview the applicants for this position, lhe Selection Committee consisted of: ,Janet McCrea, Acting Personnel Manager; dohn Stinson, Assistant to the City Manager; Richard Watkins, Fire Captain; and Cathy Williams, Benefits Technician. Six (6) proposals were submitted as a response to the RFP that was sent out on Mag 29, 1992. Five of the six consulting firms were interviewed. Questions were asked to enable the committee members to evaluate the consultants on the following factors: *Health Care Consultant Experience/Problem Solving Ability *Experience in Alternative Approaches to Health Care *Experience in Development, Analysis, and Recommendation of Bid Proposals for Health and Dental Providers *Professional Training/Experience of Principal and/or Staff Following ;~, a listing of the consultants interviewed and their proposed contractual fee: Alliance Brokers, Bakersfield $84,000 Buck Consultants, San Francisco & LA $69,500 R.F. Causey & Associates, Brea $35,000 Miller Mason & Dickenson $35,000 Lee Insurance Services $24,000 During the interviews, all candidates indicated that they could tailor their proposal to fit within our budget. After careful consideration, Miller Mason & Dickenson was the unanimous choice of the Selection Committee. It was felt they would provide the City with the best value for the contract dollars involved. HCREPORT. Causey & Associates The deciding factors are highlighted as follows: *MM&D is a national consulting firm with 10 offices throughout the U.S. *MM&D has 22 employees in the LA office. Two staff members would be assigned exclusively to handle the City of Bakersfield account. Other resources available to us would be: staff attorney; actuarial, underwriting and dataprocessing services. *MM&D currently has several prominent Bakersfield employers as clients: ARB, Inc. Giumarra Vineyards which would give them a good working knowledge of the local insurance climate. *MM&D has experience working with municipalities; specifically, the City of Pasadena. The following rviM&D references were contacted and all input was wry positive: ARB,Inc. Giumarra Vineyards Los Angeles Unified School District City of Pasadena Herb Kaighan who is the Vice. President and Manager of the Los Angeles office of MM&D represented their firm at the interviews last Friday. He would be one of the principals working with us should we select MM&D as our Health Care Consultant. We found him to be very articulate and felt that he would interact very positively with employees, management, the Insurance Committee and City Council. For the above stated reasons, the Selection Committee recommends that Miller Mason & Dickenson be retained as the City of Bakersfield's Health Care Consultant. HCREPORT. DOC "REVISED JOB SPECIFICATION" CITY OF BAKERSFIELD CLASS SPECIFICATION: 808 UNIT: MANAGEMENT EEO4: OFFICIAL/ADMINISTRATORS CLASS TITLE: ASSISTANT CITY ATTORNEY CLASS SUMMARY: Under general direction, performs civil and criminal legal work in representing the City and providing advice and counsel to City staff, Boards and Commissions; conducts legal research and drafts legal documents; performs related work as required. REPRESENTATIVE DUTIES: The following typical tasks and responsibilities are representative of all positions inthe class. They are descriptive, not limiting. Essential Duties Acts as legal advisor to assigned City departments concerning their respective duties, powers, functions and obligations; researches legal issues and statutory and case law and drafts and reviews opinions, ordinances, resolutions, contracts, leases, permits and other legal documents; represents the City in court cases encompassing a variety of subject matter, including performing all phases of pretrial, trial and appellate work; represents the City in administrative hearings before City Boards and Commissions and state and federal agencies; prosecutes litigation where the City is plaintiff; assists other attorne;'-c in all phases of legal work; attends meetings of th,' City Council,. boards and commissions as requested by the City Attorney; recommends selection of consultants; monitors and prepares comments on proposed federal and state legislation and regulation; answers correspondence and public inquiries on legal matters related to City business; and may conduct minor criminal prosecutions; represents the City in court cases, including all .phases of pretrial, trial and appellate work; researches legal issues and statutory and case law and drafts ordinances, contracts, leases, permits and other legal documents. DISTINGUISHING CHARACTERISTICS: This position is typically r:esponsible for the more complex cases having greater risk and consequences for the City and for providing counsel to larger and more complex City · departmental operations. They are also expected to carry out their responsibilities with greater independence and discretion than a Deputy City Attorney and to assign and oversee the completion of legal work by other attorneys. CLASS TITLE: ASSISTANT CITY ATTORNEY QUALIFICATIONS GUIDE: Knowled.qe of: Principles and procedures of civil, criminal and adminiStrative law, especially as they relate to municipal governments; pleading and practices and effective techniques in the presentation of court cases; judicial procedures and rules of evidence; principles, methods and techniques of legal research and investigation; responsibilities and obligations of public officials and administrative agencies; municipal government organization, structure and functional responsibilities; the Brown Act, the Fair Political Practices Act and other state laws and court cases applicable to municipalities and public bodies. Ability to: Define issues, perform legal research, analyze problems, evaluate alternatives and make sound conclusions and recommendations; present statements of fact, law and argument clearly and logically; exercise sound, independent judgment within general policy guidelines and legal parameters; interpret state and federal laws, regulations, legislation and constitutional provisions affecting municipal operations; establish and maintain effective working relationships with those contacted in the course of work; represent the City effectively in hearings, courts of law and meetings; prepare clear, concise and competent resolutions, ordinances, contracts, leases, permits, reports, correspondence and other written materials. Training and Experience: A typical way of obtaining the knowledge, skills, and abilities outlined above is: A minimum of four years experience in the practice of civil and criminal laW and litigation defense, preferably in a municipal setting. EXAMPLES OF DUTIES: Prepares drafts of resolutions, ordinances, leases, contracts, or other documents to be presented for action to the Council; gives legal advice to officers of City departments; carries out research on departmental legal problems; conducts hearings; acts as legal advisor to a variety of City boards and commissions; attends meetings and hearings as necessary; answers correspondence and public inquiries on legal matters relating to City business. DESIRABLE MINIMUM QUALIFICATIONS: Training and Experience: Membership in the California Bar Association, and four years of law practice experience, including three years of'municipal law experience. Knowledge, Abilities and Skills: Comprehensive knowledge of gen- eral civil law, including that of municipal corporations; .consid- erable knowledge of the structure and operations of municipal government and all facets of municipal law. EXAMPLES OF DUTIES: Prepares contracts or other documents to be presented for action by the City Water Board and for the City Council; gives legal advice to officers of City Water Department; carries out research on water departmental legal problems; defends, water litigation suits against the City brought by other litigants; conducts water litigatiOn trials and. hearings; attends meetings and hearings as necessary; answers correspondence and public inquiries on legal matters relating to City business. ~ DESIRABLE MINIMUM QUALIFICATIONS: Training and Experience: Membership in the California Bar Association, and four years of law practice experience, including three years of water law experience. Knowledge, Abilities and Skills: Comprehensive knowledge of water law, including that of municipal corporations owning water rights; comprehensive knowledge of methods of litigation and court representation; considerable knowledge of the structure and operations of a municipal water department. EXAMPLES OF DUTIES: De~ends suits against the City brought by other litigants; con- ducts trials and hearings; attends meetings and hearings as neces- sary; answers correspondence and public inquiries on legal matters relating to City business. Prosecutes cases where the City is the plaintiff. Handles 1-itigation discovery and motions. Coordinates civil litigation investigation and trial preparation. DESIRABLE MINIMUM QUALIFICATIONS: Training and Experience: Membership in the California Bar Association, and four years of law practice experience, including three years of experience in civil litigation defense, with sub- stantial experience in handling jury trials in Superior Court. Knowledge, Abilities and Skills: Comprehensive knowledge of civil law and of rules governing litigation, both evidentiary and procedural. REPRESENTATIVE DUTIES:~ The following typical tasks and responsibilities are representative of the position's essential duties. They are descriptive, not limiting. Essential Duties Develops and participates' in the analysis and design of computer systems and enhancements to meet City information systems needs; analyzes and codes computer programs for the more complex applications and for existing programs to meet new or special requirements; reviews, tests and approves all completed projects; analyzes and responds to users' complaints; supervises the work of data processing staff; provides training and technical assistance to data processing personnel; identifies and diagnoses systems problems and complaints and develops solutions and systems recovery processes; coordinates systems installations and the solution of operating problems with operations personnel; and provides technical assistance and training to systems users; assists the information systems manager in data processing planning and keeps up-to- date on technology trends. DISTINGUISHING CHARACTERISTICS: This position directs the work of Programmer/Analysts and other data processing staff and performs systems design and development services. The systems design and development responsibilities of this class are distinguished from those of the Programmer/Analyst class by their higher degree of technical complexity, typically involving difficult data transfer issues and the use of new technologies. CLASS TITLE: DATA PROCESSING SUPERVISOR QUALIFICATIONS GUIDE: Knowledge of: Programming principles, techniques and procedures for business and administrative applications, including design principles to ensure efficient systems operations and maintenance; standard programming languages and utilities; systems troubleshooting principles and practices; forms and design documentation techniques; operating principles and characteristics of standard computer hardware and software used by the City; systems analysis methods and techniques; project planning, prioritize and scheduling techniques; basic accounting, statistical, business administration and office procedures commonly involved in administrative applications; the nature and interrelated uses of various types of data processing equipment in a business environment; principles and practices of supervision and human resource management. Ability to: Analyze information systems needs and problems and develop new and modified computer programs to meet City needs; analyze complex problems, evaluating alternatives'and making creative recommendations; assess user department needs, translate them into system designs and set appropriate priorities; prepare clear and concise program documentation, user procedures, reports of work performed and other written materials; troubleshoot hardware and software problems and make. modifications; train user staff in the operation of new and revised computer applications; make sound independent decisions within established guidelines; establish and maintain effective working relationships with City officials, department staff and others encountered in the course of work; effectively supervise staff. Training and Experience: A typical way of obtaining the knowledge, skills, and abilities outlined above is: Graduation from an accredited four year college or university with a Bachelor's Degree in computer sciences, mathematics, business or public administration or a related field and at least five years experience in designing and developing computer applications .which included some leadworker or supervisory experience. Approved by the Miscellaneous Civil Service Board: Approved by the City Council: JOBSPECS\FINANC~713 "OLD JOB SPECIFICATION" CLASS TITLE: SENIOR PROGRAMMER/ANALYST 713 CLASS CHARACTERISTICS: Under general supervision, is responsible for performing duties of considerable difficulty in developing computer programs for new and special applications; provides direction to.other progrmmmer/ analysts and performs other work as required° EXAMPLES OF DUTIES: Designs and codes computer programs for new and special applications; codes changes to existing programs and applications as indicated by changes or additions to policies and procedures; assists in applying new or special procedures or applications; assists in the development of system design and analysis of new applications and modifications of existing applications° Provides limited direction to programmer/ analyst° Pro~ides training when required to programmer/analyst° DESIRABLE MINIMUM QUALIFICATIONS: Trainin~ and Experience: Completion of four years of college, in- eluding or supplemented by course work in electronic data processing supplemented by three years experience in programming and operating a computer console unit and other data processing equipment; or an equivalent combination of training and experience which-provides the capabilities to perform the described duties.
