ROLL CALL 1. BOARD MEMBERS: Present: DONNA KUNZ, Chairperson PHIL BURNS BRAD UNDERWOOD STAFF MEMBERS: Present: PAUL HELLMAN, Principal Planner JIM EGGERT, Assistant Planning Director MICHAEL RICHARDS, Attorney GEORGE GILLBURG, Engineer II DELORES OLDHAM, Recording Secretary 2.PUBLIC STATEMENTS No speaker cards were presented. 3.CONSENT CALENDAR A.Non-Public Hearing Items: 1. Approval of the Minutes of the regular meeting held December 11, 2007. Member Burns moved to approve the Minutes of December 11, 2007. Motion carried by the following roll call vote: AYES: Members: Kunz, Burns, Underwood NAYS: None ABSENT: None B.Public Hearing Items: 1.File No. 07-2287 - Approval of a Conditional Use Permit to allow a 2,100 square foot drive-through restaurant in a C-1 (Neighborhood Commercial) zone district located at 11102 Brimhall Road. 2.File No. 07-2229 - Approval of a Conditional Use Permit to replace a 986 square foot second dwelling unit with a 2,102 square foot dwelling unit in an Minutes, BZA, 01/17/08 Page 2 R-S-1A (Residential Suburban 1-Acre Minimum Lot Size) zone district located at 2600 Berrendo Avenue. 3.File No. 07-2290 - Approval of a Conditional Use Permit to develop a 3.4- acre private recreation center, including a 15,000 square foot clubhouse, pool with 900 square foot pool house, 1,800-square foot bus barn/maintenance building, two tennis courts, shuffleboard area, and 57 off-street parking spaces, within a gated senior community in an R-1 (One-Family Dwelling) zone district located at 10308 White Butte Drive. 4.File No. 07-2306 - Approval of a Zoning Modification to reduce the required front yard setback for a duplex from 15 feet to 7 feet in an R-2 (Limited Multiple-Family Dwelling) zone district located at 117 Northrup Street. 5.File No. 07-2317 - Approval of a Conditional Use Permit to operate an 11,000 square foot school for persons with developmental disabilities in C-O (Professional and Administrative Office) and C-1 (Neighborhood Commercial) zone districts located at 1300 Stine Road. 6.File No. 07-2350 - Approval of a Conditional Use Permit to operate a 4,501 square foot retail bicycle shop in a C-O (Professional and Administrative Office) zone districted located at 8850 Stockdale Highway. The public hearing was opened. No one from the Board or the audience requested the removal of any items from the consent calendar. The public hearing was closed. Motion made by Member Underwood to approve public hearing consent agenda items. Motion carried by the following roll call vote: AYES: Members: Kunz, Burns, Underwood NAYS: None ABSENT: None 4.PUBLIC HEARINGS: 1.File No. 07-2183 - A Conditional Use Permit to operate a 5,485 square foot retail jewelry store in a C-O/P.C.D. (Professional and Administrative Office/Planned Commercial Development) zone district located at 9700 Brimhall Road. The public hearing was closed on December 11, 2007. Staff summarized its January 11, 2008 memorandum to the Board, including conditions of approval recommended by staff and agreed to by the applicant. Motion carried by the following roll call vote: AYES: Members: Kunz, Burns, Underwood NAYS: None ABSENT: None 2.File No. 07-2352: Zoning Modification to construct a 9-foot tall masonry wall along the side and rear yard property lines and to construct a 12-foot tall, 200 square foot pool equipment enclosure within the side yard setback in an R-1 (One Family Dwelling) zone district located at 13307 Nantucket Place. The public hearing was opened. Staff stated that the applicant requested a continuance which staff concurs with. The public hearing remained open. No one from the audience provided any comments in opposition or in favor of this item or request. Motion made, and unanimously agreed, to continue File No. 07-2352 to February 12, 2008. 5.COMMUNICATIONS None. 6. BOARD COMMENTS: A.Election of Chair for 2008 Member Kunz nominated Brad Underwood. Motion made, and unanimously agreed, to elect Brad Underwood to be the Chair . for 2008 7. ADJOURNMENT: There being no further business the meeting was concluded at 1:16 p.m. The next Board of Zoning Adjustment meeting is scheduled for February 12, 2008.
