Dear Marion Shaw,
I am requesting a waiver for the consolidation into the maintenance district
requirements per City Ordinance 3714. I am requesting this waiver to expedite the
issuance of a Certificate of Compliance. I met with John Stinson for clarification and he
informed me that this ordinance is in place to maintain road islands, flower beds, and
other areas that are not maintained by the land owner. The area in which my property,
located at 3400 Hale Street, has no city improvements as mentioned above. My property
is not being divided for a multiple housing development. I axn simply splitting the
property in half for two single family houses. It was made known to me that if no such
maintenance is currently conducted in this area, then I could request this waiver. I
believe the property is already within the boundaries of the Consolidated Mai~.tenance

We, the undersigned, as owners of the property included within Parcel Map Waiver #46-
41 S4, hereby request that the property be included within the Consolidated Maintenance
District. This request is pursuant to the requirements of Municipal Code Section
13.04.021.
Enclosed is a check in the amount of $1,631.34 to cover the costs mentioned above.
Further, our engineer will supply You with a disk copy of the Parcel NCap Waiver #06-
4184for yauruse.
We also waive our right to any and all hearings (whether pursuant to the Brown Act,
Proposition 21$, its enabling legislation, the Bakersfield Municipal Code, or ,any other
law) concerning the formation of or inclusion in a maintenance district.
We f~krther waive all rights under Proposition 218 to formally vote for these assessments
any by signing this letter, indicate our consent to the assessments.
