Shaw, Civil Engineer III DATE: April 11, 199b SUBJECT: Tract 5775 -Formation of Maintenance District Tract 5775 is a 35 lot subdivision developed by Probuilt Homes and located in the County of Kern. It is currently undergoing annexation to the City of Bakersfield; this process is expected to be complete in about four months. Early in the process, Parks indicated that they would not be maintaining the streetscaping associated- with this tract because it would be maintained by a homeowners association. Therefor, the formation of a maintenance district was not required. Since that time, Probuilt .Homes has. stated that they intend for the City to take over the maintenance of the streetscaping as soon as possible (See the attached letter from Mr. Fabbri to Probuilt Homes). Mr. Shuman has contacted me to start the district formation process and has told me that both Jack Hardisty and Kevin McDermott, assured him that he was not required to pay the formation fee since he is undergoing annexation. I have talked to Bob Sherfy regarding this,. and he feels that if the tract was approved without a condition to form a maintenance district that we may be on solid legal ground to not- require payment of the fee. Mr. Shuman will be sending the City a letter requesting the formation of the district, but Probuilt Homes is no longer the sole owner of the property -four lots have been sold. I requested that. Mr. Shuman try to get the other property owners to send a letter to the City requesting the district formation and waiving their right to a hearing. Unless we-have the acquiescence of 100 % of the property, owners to forgo a public hearing,. we must. follow the .provisions of the Brown Act and have two hearings following the approval of the Resolution of Intention. The testimony hearing would take place at least ten days. after the publication of the notice of hearings and the protest hearing would take place at least 45 days after the publication of the notice. In addition,. since the tract is located in the County, we must obtain authorization from the County to get jurisdiction in this matter. Since this tract has existing landscaping, we will be charging a maintenance assessment the first year. This is unusual -all of our interim districts so far have had no assessment the first year, since the landscaping was either not yet installed or not yet maintained by the City. The Parks Department will be sending me a memo giving me the amount the interim district is to be charged for the first year's maintenance, and also assigning. a tier for when the district is merged into the Consolidated Maintenance District. Under the best condition (no Brown Act proceedings), the schedule would be somewhat as follows: Resolution of Intention approved by CC May 22 Letter to County requesting jurisdiction May 24 Resolution by County consenting to district June 11 Request Fund numbers from Finance and the Tax Assessor June 12 Resolution Establishing Interim M.D. June 26 Tax Roll and Resolution to County July 12 If we have to use Brown Act proceedings, the district could not be established prior to the July 10, 1996 Council meeting, which is cutting it very close for the Tax Assessor deadline. Worst case, the City would have to bill the property owners. As there are only five property owners for the 30 R-1 lots, this might not be unworkable . Both schedules hinge upon getting the Resolution of Intention to the City Council for their May 22, 1996 meeting. I will attempt to have the Resolution of Intention prepared for the May 22, 1996 meeting. If we have letters waiving the hearing by all the property owners by the time the Admin Report is filed, we will proceed with the shortened schedule. If we do not have the letters by that date, then the Resolution of Intention will set hearings for June 12 and July 10 and we will attempt to make the Tax Assessor's deadline. In either case, I am not requiring that Probuilt Homes pay the City's Maintenance District formation fee. If this meets with your approval, please sign below. Approved Ja~ R. In order for the City to assume maintenance responsibilities, it will be necessary to establish a District. I understand you definitely intend to have the City maintain the street landscaping. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield, State of California, as follows 1. The foregoing recitals are true and correct and are incorporated herein. 2. The City Council hereby preliminarily adopts and approves the Public Works Director's Report and declares that the territor-y within the boundaries so specified and described is the district benefiting from said local improvements; that the expense of maintaining and operating said improvements is hereby made assessable upon said district; and that the exterior boundaries of said district are hereby specified and described to be as shown on that certain map now on file in the Office of the City Clerk of the City of Bakersfield and in the Office of the Public Works Director, marked Exhibit "B", attached hereto and incorporated in this resolution as though fully set forth herein, entitled "Map .and Assessment Diagram for Maintenance District No. 1-12 (Interim), Bakersfield, California, for Fiscal Year 1996-97," which map indicates by a boundary line the extent of the territory included in said proposed district and shall govern for all details as to the extent of the maintenance district. 3. Once this Resolution has been approved by the City Council, it is a necessity that prior to including unincorporated territory within such a district, the City of Bakersfield must receive the consent of the -Board of Supervisors.
