At the August 14 Central District Development Agency meeting Mark Brodeur, .Urban Design
Studio resented the final draft design for the Chester Avenue Urban Design Concept -Plan. Project

boundaries extend from the south side of Truxtun Avenue to the south side of 24th Street and both
sides of Chester- Avenue.-
Not Navin received an ne ative comments on the design .plan we have asked the consultant to

roceed with completion of the final report This report is scheduled for "receive and file" action

by the agency at their September 11 meeting.
Once the final report is completed it is the .city's intent to move the plan into its -next. phase which
focuses on obtainin fundin for the ro'ect. We envision funding to come primarily from grants

monies su plemented by local and .federal funding sources. We will need your active support in

.preparing any. grant application.
Maintenance of the im rovements on .Chester Avenue will be an important component of project

implementation. The adoption of a maintenance district .will probably be proposed to .downtown
ro ert owners. while the Cit could maintain the street lights ~~and street signs, as they do now,

Assuming total build out please provide me a probable ,opinion of annual. maintenance costs for this

SUBJECT: Chester Avenue Maintenance District
The following calculations were made to determine if the proposed Chester Avenue
Maintenance District would. collect enough money to pay the estimated annual maintenance
cost of the district. Approximate Iot and building areas. were calculated using assessor's
office maps and aerial photos. The Parks Department estimated the annual maintenance
cost at $12,000. Four scenarios were examined:
1. Cost to be spread by lot area of parcels fronting on Chester Avenue from 24th
Street to Truxtun Avenue. This is the method used in .most other .districts. Using 6
Equivalent Dwelling Units ~EDU's) per acre this method would put this area in tier, 7.2.
2. Cost to be s read b building area of parcels fronting on Chester. Avenue. Using

b EDU's per acre of building area this method resulted in the area being in tier 5.0.
3. Cost to be spread by lot area of parcels fronting on Chester Avenue and the side
streets between E e and K Streets. This method resulted in the area being in tier 4.b.

4. Cost to be spread by building area of parcels fronting on Chester Avenue and the
.side streets between E e and K Streets. This method resulted in the area being in tier 3.6.

Preliminary landscape plans show median and street landscaping. Compared to other areas
this district should be in tier 2.
The following is a comparison of assessments of various parcels at the 4 scenarios listed
above.

All parcel and building areas are approximate only. Parcel areas were calculated from
assessor's maps. Building areas were calculated from visual inspection and aerial photos.
Basements were not included in the building areas. Upper floors were- included based on
visual inspection from the street or alley. All upper floors were included even though many
appeared :not to be used..
Spreading the assessments by parcel area only can be inequitable since parcel use varies
from parking lots to 5 story buildings. Spreading. assessments bybuilding area only may
cause problems since some buildings have upper floors that are not in use. Perhaps a
combination of: parcel area .and building area might be more equitable.

Dr. Kelly Blanton has requested that the Board of Education building be included in the proposed Chester Ave.
MD -the building does not fronton Chester and so was not included in the district.boundary, If Dr. Blanton
wishes the- opportunity to help .pay for the annual maintenance of the proposed streetscaping, we are happy to
oblige. The attached memo has been written at the request of Jake Wager and Raul to ,show what the annual
maintenance assessment would be for the Board of Education building. Since Mr. Tandy. designated the
streetscape as Tier 4, all assessments in the proposed district have been calculated. on .that basis. However, Tier
4 does not bring in sufficient funds to pay for the actual cost to maintain the streetscaping. Fran Fabbri has given
us an annual maintenance cost of $12,000 and Tier 4 collects only $5,900. For some. reason, it is a bad thing to
say that the balance of the cost for this particular area is distributed to all of the other parcels in the Consolidated
Maintenance District, so the balance has been called a "subsidy". This memo is trying to get away from that.
Since the assessment are based on Tier 4 rates, adding the Board of Education building. has not affected the other
assessments in the proposed district. This may not go down well. Lauren and I have been trying to stick to our.
guns and keep this district on the same basis as all the :others - we don't want to have to keep a separate
accounting method for this one. and start down the separate district road again. However, Pat Demond has been
talking about-that $1000 subsidyand we-have gotten conflicting signals from Mr. Tandy, so we may end up with
a separate, non-consolidated district that is called consolidated. Confused?
Please feel free to get the lowdown from Lauren - he has all the information you could .possibly want on this
project. _

Truxtun Avenue Drop Inlet (see attache drawings}
I had Harry research our books about the inlet west of Mohawk. All Harry could find was that there is a low spot
in the road plans with no provision for drainage. We have nothing in our storm drain books showing anything
at that location. Streets is checking it out.

Several departments are. involved in forming the assessment district for Chester Avenue.
.Because EDCD is doing the grants for funding the improvement, ~ and ,because they are the
historic lead for communications with downtown business interests, I want them to be the primary
spokesperson for issues surrounding the streetscape and for them to -handle inquiries, public
meetings, etc.
All other involved departments will continue in their historic maintenance district roles relative to
calculations, mailings, etc.. This one is a hybrid, due to the interface. with other downtown issues,
so I want to keep external communications centralized.

Your proposed assessment for 1996-1997 is $ 00.00 .
NOTICE IS HEREBY GIVEN that the Public Works Director of the City of Bakersfield has
prepared and filed with the City Clerk a Report which provides the basis for the benefit assessment
for maintaining street landscaping and other local public improvements to be borne by all parcels
of property within "Maintenance District 4-11 (Interim)" which includes your property.
The estimated revenue to be raised for this fiscal year for Maintenance District 4-11 (Interim) is
$ 00.00 .
Two hearings will be held regarding Maintenance District 4-11(Interirn). The first will be a public
testimony hearing at which time any comments regarding the fallowing will be heard: the boundaries
of the district; the fairness of the benefit formula; the zones of benefit; the. reservation of right by
the City to utilize either City forces or to contract with private industry for the operation and
maintenance of the improvements; or the amount of the .assessment on any parcel of property to be
assessed. This hearing will be held on Wednesday, October 9, 1996, at 7:00 P.M., or as soon
thereafter as the matter may be heard in the Council Chambers at 1501 Truxtun Ave.
The second hearing will be a protest hearing at which time only protests will be heard. The Public
Works Director's report will be heard at this hearing. Any interested owner objecting, to any of the
items listed in the preceding paragraph may file a written protest, signed byhim/her, describing the
parcel of property so that it may bezidenti~ied and stating the grounds ofhis/her protest. Anywritten
protest shall be bled with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California, 93301 at
or before the protest hearing. Individuals may also appear and be heard at the hearing. This hearing
will be held on Wednesday, October 23,1996, at 7:00 P.M. or as soon thereafter as the matter may

PROPOSED CHESTER AVENUE MAINTENANCE DISTRICT
Mr. Ruggenberg stated that the City will be asking all property owners on Chester Avenue between
Truxtun Avenue and 24th Street to participate in a maintenance district. Such a district will provide
the funds necessary to maintain improvements. The annual assessment for the District is expected
to be a proximately $201.00. Staffhas reviewed the information and recommends .the Board .approve

~~he ~ formation of a. M~.intenance District fir the main'c~riance of landscaping on Chester- Avenue
between Truxtun Avenue and 24th Street. After discussion, Director Michel moved and Director
Silver seconded to approve the formation of a Maintenance District for the maintenance of
landscaping on Chester Avenue between Truxtun Avenue and 24th Street and authorize the General
Manager to sign the necessary agreement. The motion carried.
CONTROLLER' S REPORT
Mr. Woods reviewed the June and July financial statements and responded to questions from the
Board. This was an informational item only.
TRANSIT PLANNER'S REPORT
Mr. Moland reviewed the June and July ridership reports with the Board. Mr Moland also advised
the Board on the progress of the Centennial and Ridgeview High Schools limited service buses which
were initiated on August 26. Mr. Moland stated that both have proven to be very successful. This
was an informational item only.
FIXTURE AGENDA ITEMS:
Director Mattox distributed a copy of the BoardlStaff Report prepared by facilitator Mary Davis to
each Board member. Director Mattox requested that each Board member review the information
which would be discussed in detail at the next Board meeting.
EXECUTIVE SESSION
The Board moved into executive session at 6:19 p.m. to discuss: Conference with Legal Counsel -

On September 9,1996, your Board referred to the County Administrative Office for review and
recommendation a proposal by the City of Bakersfield to establish a new maintenance district f or
properties bordering Chester Avenue between 24th Street and Chester Avenue.
The purpose of the proposed maintenance district is to rovide fundin for the on- oin

NOTICE IS I-IEREBY GIVEN that the Public Works Director of the City of Bakersfield has
prepared and filed with the City Clerk a Report which provides the basis for the benefit assessment
for maintaining street landscaping and other local public improvements to be borne by all parcels
of property within "Maintenance District 4-11 (Interim)" which includes your property.
The estimated revenue to be raised for this fiscal ,year for Maintenance District 4-11 (Interim) is
$ 00.00 .
Two hearings will be held regarding Maintenance District 4-11 (Interim). The first will be a public
testimony hearing at which time any comments regarding the following will be heard: the boundaries
of the district; the fairness of the benefit formula; the zones of benefit; the reservation of right by
the City to utilize either City forces or to contract with private industry for the operation and
maintenance. of the improvements; or the amount of the assessment on any parcel of property to be
assessed. This hearing will be held on Wednesday, October 9, 1996, at 7:00 P.M., or as soon
thereafter as the matter may be heard in the Council Chambers at 1501 Truxtun Ave.
The second hearing will be a .protest hearing at which time only .protests will be heard. The Public
Works Director's report will be heard' at this hearing. Any interested owner objecting to any of the
items listed in the preceding paragraph may file a written protest, signed byhim/her, describing the
parcel of property so that it may be identified and stating the grounds ofhis/her protest. Any written
protest shall be filed with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California, 93301 at
or before the protest hearing. Individuals may also appear and be heard at the hearing. This hearin

will be held on Wednesday, October 23,1996, at 7:00 P.M. or as soon thereafter as the matter may
be heard, in -the Council Chambers at 1501 Truxtun Avenue.
Any person challenging in court the decision made at the conclusion of such public hearing maybe
