District Mike Maggard wanted to place an item on the October 18 agenda authorizing the City to send. out a ballot to property owners in the Panorama. area to form a maintenance district fore-median landscaping. Formation of a maintenance district- must be initiated by the property owners. We suggest that members of the neighborhood .committee write a letter to he City requesting formation of a district. They would also need to write a letter to all the property owners; within the proposed district explaining he purpose of the district and-the formation procedure. The ~, letter would include a map of the district and a ballot o be returned to this office. VVe could provide the map and the ballotC When the letter of request is received we would then send a Resolution of Intention to the Council setting a hearing date. At the hearing a final count of the ballots would be. made to determine if the district would be formed. There are no impediments to developing this piece at its current zoning, R-1. City policy for the assessment charge for undivided residential property is 4 units per acre, and this was used for the Owens property. We could reduce the assessment to 3 units. per acre, which would be more in line with what we expect to develop there. That would put the assessment at about $274 annualy. All undivided residential property within our maintenance district is currently charged at 3 to 4 units per acre. Charging the Owens property as one parcel would create a different standard then that which is used throughout the Consolidated Maintenance District, and would be very difficult to defend. legally. Also, upping the assessment later would be difficult, since under Prop 218 they would have to agree to . the. increased assessment. If they do not agree, what would we do -not allow them to subdivide? Pave over the median landscaping? Also, when the Owens property does finally develop (assuming that he is removed from the maintenance district), they would be required by our local ordinances to pay for and form a maintenance district. This would cost him $1545. We are doing it for free now. In short, the property has value and derives a benefit from the installation of the median landscaping which is similar to the benefit accrued to other similar parcels citywide.
