SUBJECT: Adding Territory to a Maintenance District
Developers are required by Subdivisions as a condition of the final
map to either form a maintenance district or be included in an
existing maintenance district. This is to provide for the cost of
maintaining median, parkway and/or park landscaping. Maintenance
District 4, Division 5, was established June 5, 1989 for
maintaining street landscaping in the area northeast of Brundage
and Oswell. Tract 5602 is being developed adjacent to this area
and is being added to Maintenance District 4, Division 5. The
addition of tract 5602 to Maintenance District 4, Division 5 must
take place prior to the adoption of the Consolidated Maintenance
District to eliminate having to notice all 18,000 parcel owners..

SUBJECT: Public hearing as required by Resolution of Intention No. 1118, to hear public testunony
regarding the assessments for adding territory to Maintenance District No. 4, Divlslon 5
(Orwell), Ward 1)
RECOMMENDATION: Staff recommends First Hearing to hear public testimony.
BACKGROUND: State legislation enacted in 1992 requires two hearings on any new or increased
assessments. The first hearing is to hear public testunony regarding the assessments, the second hearing
is the protest hearing.
A written request has been transmitted to the City Engineer from the developer of Tract No. X602 as
outlined in the subdivision requirements to form a maintenance district for Tract 5602 or to be included
into an existing maintenance district. This district will provide for the maintenance of public street
landscaping. Staff recommends the addition of Tract 5602 to the existing Maintenance District No. 4,
Division 5. The proposed district is generally bounded by Virginia Avenue on the north, Sterling Road
on the east, Brundage Lane on the south and Orwell Street on the west.
The resolution sets the date for protest hearing for the Council meeting of June 29, 1994. Since there
are very f ew property owners involved, no protests are anticipated.
The result of adding Tract 5602 will decrease the overall assessment f or the district.
