Based on my conversation with Don Hoggatt yesterday, the cast now appears to have escalated above $100,000. You will also note in the two memos that the square footage of area to be landscaped changes. Based on these discrepancies I am now concerned over the validity of the estimate for maintenance cost. It is estimated that there is ,35,800 sq. ft. of area to be landscaped within the medians along Union Avenue. -The .estimated annual cosh to maintain this. area is $16,!000.00 .which works out to ~~ $ 2.2 3 per sq . f t . cost . RECEIVED NO~I 14 1991 MEMORANDUM ECONOMIGREDEVELGFMENT DEVELOPMENT TO: CHARLES WEBS - ECONOMIC DEVELOPMENT FROM: DEWAYNE STARVES - PUBLIC WORKS DEPARTMENT DATE: NOVEMBER 13, 1991 SUBJECT: PROPOSED UNION AVENUE MAINTENANCE DISTRICT The Parks Department has indicated that the ,area to be landscaped along Union Avenue has been modified to an estimated 19,560 square feet. The revised estimated annual cost to maintain this area is approximately X8,000. The total cost of improvements or landscaping will be approximately X45,000. The average cast to install landscaping is ~2.Z3 per sq. ft. The average cost to maintain landscaping is Z8 to 36 cents per square foot. The Parks Department indicates that the actual cost of maintenance maybe a little higher, due to the relatively small size of the district. As part of the project, Caltrans desires to eliminate the current landscaping. They are willing to provide planters and red brick-like stamped concrete medians.- This beautification will be done by Caltrans at State expense provided the County andlor the City of Bakersfield accepts responsibility for planting and then maintaining the landscaping. Those owning property along Union Avenue have been contacted in regards to forming a district to maintain the landscape improvements, since the upgrading of the median landscaping will enhance the area. The County normally requires a majority written support prior to approving a district of this nature. At the time of writing this letter, the majority of those responding to the questionnaire have indicated, in writing, that they are in favor of forming the district, but repeated attempts to obtain a written commitment from non-responsive property owners have failed. Since the majority of the affected parcels are in the City of Bakersfield, the City has requested approval to act as the lead agency in the formation and operation of the proposed district. Vllhile the County generally requires majority written consent before forming this type of district, in this instance it appearsthat obtaining said consent will not be possible. The City of Bakersfield has, however, conducted a noticed protest hearing on the formation and has found, in accordance with both the Bakersfield Municipal Code and the Government Code, a majority protest of the property owners has not occurred. . Board of Supervisors March 24, 1992 Page 2 On January 14, 1992 with Resolution #92-030, your Board granted consent to the formation of this district on the condition that the City receive written support of a majority of the property owners. Due to the unusual nature of this project and the significant benefit to the area, this department recommends that your Board adopt the attached Resolution of Consent allowing the City of Bakersfield the authority to determine support for the Union Avenue Maintenance District in accordance with the Government Code and their Municipal Code regulations. This resolution will supersede Resolution #92-030 and has been approved by County Counsel. IT LS RECOMMENDED that your Board approve and adopt the Resolution of Consent. WHEREAS, .Chapter 13.04 of Title 13 of the Municipal Code of the City of Bakersfield provides for an alternative procedure or by which the City Council may provide for the payment of the whole or any part of the costs and expenses of maintaining and operating any public improvements which are local in nature, .from annual benefit assessments apportioned among the several lots .or parcels of property within the maintenance district established .therefor; and WHEREAS, some of the property owners along Union Avenue ' have supported th® City Council ~in establishing a maintenance district in accordance with the procedures established therefor by Chapter 13.04 of Title 13 of the Municipal Code of the City of Bakersfield and the Director of Public Works recommends such formation; and WHEREAS, the City Council intends to establish such a district to be designated Union Avenue Maintenance- District, the exterior boundaries of which are hereinafter specified and described. The foregoing recitals are true and correct and the City Council so finds and detenaines. 2. It is. the intention of the City Council of the City. of Bakersfield to order the establishment of a maintenance district under the provisions of said Chapter 13.04, which district shall be designated Union~Avenue Maintenance District generally described in Exhibit "A" attached hereto, to maintain and operate the local .improvements also generally described in said Exhibit. 3. The City Council hereby declares that the territory within the boundaries so specified and described is the district benefiting from said local improvements; that the expense of maintaining and operating said improvements is hereby made asaeaaable upon said district; and that the exterior, boundaries of said district are hereby specified and described to be as shown on that certain map now on .file in the Office of the City Clerk of the City of Bakersfield and in the Office of the Director of Public Works, marked. The district was necessary to secure approximately $500,000 in median improvements from Caltrans (red stamped concrete ,and planters). The Cit and Count would share the casts of the approximately Y Y $45,000 in planting and irrigation costs. .The cost. to each parcel for .maintenance is estimated to be $7.50 ~ er .month or $90 annually. p To date the survey results have been: 93 total parcels = 100_% 69 respondents = 74 32 in favor = 34 % 32 against = 34 ~o 5 undetermined(*) = 5% 24 didn't respond = 26% * -signed survey form in favor and a petition against The split in responses was mainly due to, a single property owner, Mr. John Baxter Smith of John's Potluck, who hand carried a petition against the proposal. He was able to get 24 property owners ar their re resentatives to a ree with .his viewpoint (see attached petition}. p g In addition, another property owner had five parcels, four of which were vacant with boarded up buildings. In general, those properties that were oorl maintained responded negatively to the survey. p y December 26, 1991 Page Z After review and consideration, it is staffs .recommendation to proceed with a public protest hearing. The protest hearing is the initial step in beginning the district formation. If So% plus one of the total number of property owners respond in writing or show up to object to the formatian, the formation cannot proceed unless the Council overrules the protest. It is anticipated that a "Resolution of Intention" can go before the City Council on January 15th to set the public protest hearing date. Allowing for the proper notification of property owners and the publication of the hearing date, the protest hearing and "Resolution to Establish" should be set for Janu 29th, The Count will need to ~'y y adopt a "Resolution of Consent" allowing for the inclusion of county parcels within the. City maintenance district, prior to Janua 15th. County staff .has indicated they should be able to put such a resolution before the Poard at their January 14th meeting.
