RESOLUTION ESTABLISHING UNDERGROUND UTILITY
DISTRICT NO. 2, DIVISION 27 (STOCKDALE)
WHEREAS, by Resolution of Intention No. 1234, adopted on February 28,
2001, a public hearing was called for March 14, 2001, at the hour of 7:00 p.m. in the
Council Chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, to
ascertain whether the public necessity, health, safety or general welfare requires the
removal of poles, overhead wires and associated overhead structures, and the
underground installation of wires and facilities for supplying electric, communication, cable
television or similar and associated services, within that certain area, more particularly
described as follows:
UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 27
PHASE I:
Those portions of Section 35, T. 29 S., R. 27 E., and Section 2, T 30 S., R.
27 E., M.D.B.&M., in the City of Bakersfield, County of Kern, State of
California, being more particularly described as follows:
Beginning at a point on the north right of way line of Stockdale Highway (110'
wide), said point being 300 east of the centerline of Montclair Street;
Thence (1) Easterly, along said north right of waytine of Stockdale Highway,
a distance of 3900 feet, more or less, to intersect the southerly prolongation
of the west right Of way line of Oakdale Drive (60' wide);
Thence (2) Southerly, at right angles to said north right of way line, a
distance of 110 feet, to intersect the south right of way line of Stockdale
Highway;
Thence (3) Westerly, along said south right of way line, a distance of 3900
feet, more or less, to a point 300 feet east of the centedine of Monclair
Street;
Thence (4) Northerly, at right angles to said south of way line, a distance of
110 feet to intersect the north right of way line of Stockdale Highway and the
TRUE POINT OF BEGINNING.
PHASE I1:
Those portions of Section 34, T. 29 S., R. 27 E., and Section 3, T 30 S., R.
27 S., M.D.B.&M. being more particularly described as follows:
ORIGINAL
Beginning at the point of intersection of the North right of way line of
Stockdale Highway and frontage road (150 feet wide) and the West line of
said Section 34, also being the west end of the frontage road;
Thence (1) Easterly, along said North right of way line, a distance of 2640
feet, more or less, to the mid section line of said Section 34, also being the
east end of the frontage road;
Thence (2) Southerly, along said mid section line, a distance of 40 feet to the
north line of Stockdale Highway (110 feet wide);
Thence (3) Easterly, along said north right of way line, a distance of 300.00
feet;
Thence (4) Southerly, at right angles to said north right of way line, a
distance of 110 feet, to intersect the south line of Stockdale Highway (110
feet wide);
Thence (5) Westerly, along said south right of way line, a distance of 3260
feet, more or less, to intersect the west line of said Section 3;
Thence (6) Northerly, along said west line of Section 3 and west line of
Section 34, a distance of 150.00 feet to intersect the north right of way line
of Stockdale Highway and frontage road (150 feet wide) and the TRUE
POINT OF BEGINNING.
Phase III
Those portions of Section 33, T. 29 S., R. 27 E., and Section 4, T 30 S., R.
27 S., M.D.B.&M. being more particularly described as follows:
Beginning at the point of intersection of the North right of way line of
Stockdale Highway (110 feet wide) and the east right of way line of Coffee
Road (110 feet wide);
Thence (1) Easterly, along said north right of way line of Stockdale Highway,
a distance of 600 feet, more or less, to the west end of the frontage road;
Thence (2) Northerly, along the west end of the frontage road, a distance of
40.00 feet to the north right of way line of Stockdale Highway and the
frontage road (150 feet wide);
Thence (3) Easterly, along the north right of way line of Stockdale Highway

and the frontage road, a distance of 1800 feet, more or less, to the east end
of the frontage road;
Thence (4) Southerly, along the east end of the frontage road, a distance of
40.00 feet to the north right of way line Stockdale Highway (110 feet wide);
Thence ($) Easterly, along said north right of way line, a distance of 1475
feet, more or less, to the City Limit Line at the Fire Station;
Thence (6) Southerly, at right angles to said north right of way line, a
distance of 110 feet, to intersect the south right of way line of Stockdale
Highway;
Thence (7) Westerly, along the south right of way line Stockdale Highway,
a distance of 3875 feet, more or less, to intersect the southerly prolongation
of the east property line of Coffee Road;
Thence (8) Northerly, along said east right of way line and southerly
prolongation thereof, a distance of 110 feet, to intersect the north property
line of Stockdale Highway and the TRUE POINT OF BEGINNING; and,
WHEREAS, notice of such hearing has been given to all affected property
owners as such are shown on the last equalized assessment roll and to all utilities
concerned in the. manner and within the time required by law; and,
WHEREAS, such hearing has been duly and regularly held, and all persons
interested have been given an opportunity to appear and be heard.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that, pursuant to Chapter 12.32 of Title 12 of the Municipal Code of the City of
Bakersfield, the above described area is hereby declared an underground utility district and
is designated as Underground Utility District No. 2, Division 27, of the City of Bakersfield.
Attached hereto, marked Exhibit "A", and hereby incorporated as a part of the Resolution,
is a map or diagram entitled as follows: UNDERGROUND UTILITY DISTRICT NO. 2,
DIVISION 27", delineating the boundaries of said District.
BE IT FURTHER RESOLVED that the electric utility which undertakes
underground installation of its facilities shall use the underground conversion allocation
computed pursuant to decisions of the Public Utilities Commission of the State of California
for the purpose of providing to each of the premises in Underground Utility District No. 2,
Division 27, requiring a maximum of one hundred feet of individual electric service
trenching and conductor, as well as backfill, paving and conduit.
BE IT FURTHER RESOLVED that the Council does hereby fix September30,
2002 as the date on which all affected utilities must have all facilities installed, and have

completed removal of all poles, overhead wires and facilities for supplying electric,
communication, cable television or similarorassociated services within Underground Utility
District No. 2, Division 27.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to notify
all affected utilities and all persons owning real property within Underground Utility District
No. 2, Division 27, of the adoption of this Resolution within ten (10) days after the date of
such adoption.
Such notification shall be made by mailing a copy of this Resolution to all
affected property owners as such are shown on the last equalized assessment roll and to
the affected utilities,
as follows:
BE IT FURTHER RESOLVED that the Council hereby finds and determines
1. That the public necessity, health, safety or general welfare requires the
removal and undergrounding of poles, overhead wires and associated overhead structures
within Underground Utility District No. 2, Division 27.
2. The underground Utility District herein created is in the general public
interest for the reason that the streets, roads or rights-of-way in the District are extensively
used by the general public and carry a heavy volume of pedestrian and vehicular traffic.
3. The Underground Utility District herein created is to avoid or eliminate an
unusually heavy concentration of overhead utility facilities.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by Council..o_f the ~;ity of Bakersfield at a regular meeting thereof held on
