HomeMy WebLinkAboutRES NO 116-98RESOLUTION NO. j' JL 6 -- 9 8 A RESOLUTION DETERMINING THAT STRUCTURAL UNITS FOR ENCLOSING THE KERN ISLAND CANAL CANNOT BE REASONABLY OBTAINED TI!IROUGH USUAL BIDDING PROCEDURES AND AUTI'IORIZlNG THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFORE, NOT TO EXCEED $140,000. WHEREAS, City is obligated to construct the new Bakersfield AMTRAK Station as mandated by the agreement between the City and the State of California; and WHEREAS, the existing open-channel Kern Island Canal crosses the site selected for the new Bakersfield AMTRAK Station; and WHEREAS, a covering over the Kern Island Canal crossing the new Bakersfield AMTRAK Station site must be constructed in order to effectively utilize the property for its intended purpose; and WHEREAS, the installation of the covering over the canal requires that the operation of the canal be shut down during the construction of the covering; and WHEREAS, the owner of the Kern Island Canal, Kern Delta Water Storage District, has agreed to the installation of that covering of their canal and has approved a shut down of the kern Island Canal from November 20, 1998, to December 5, 1998, so that the City can construct the covering; and WHEREAS, this covering will provide structural support for a temporary crossing of the Burlington Northern Santa Fe Railroad tracks over the Kern Island Canal during construction of the Q Street Grade Separation Project and for a permanent crossing of the AMTRAK Railroad tracks over the Kern Island Canal after construction of the new Bakersfield AMTRAK Station; and WHEREAS, City desires to construct a covering that will be cost effective, can be installed within the time frame allowed by Kern Delta Water Storage District, will not impede Kern Delta Water Storage District's on-going operation of the Kern Island Canal, can be installed during this short shut down of the kern Island Canal, will conform to the requirements of both Burlington Norther Santa Fe Railroad and AMTRAK Railroad, and will be compatible with the Bakersfield AMTRAK Station project; and Page 1 of 4 .OR'~rNAL WHEREAS, construction of this covering within the. sixteen days allowed by Kern Delta Water Storage District can only be accomplished with a pre-cast product; and WHEREAS, City has determined that a pre-cast culvert manufactured by CSR Hydro Conduit in Fresno, California, is the only product that can be reasonably obtained which will satisfy all of the above stated requirements for this canal covering; and WHEREAS, the pre-cast culvert manufactured by CSR Hydro Conduit is the only product that has been approved by Kern Delta Water Storage District, Burlington Northern Santa Fe Railroad and AMTRAK Railroad; and WHEREAS, the manufacturing of these pre-cast culvert sections must be complete before the canal is shut down in order for the construction to be completed before the end of the scheduled shut down; and WHEREAS, the time frame for manufacturing the necessary pre-cast culvert sections is approximately six weeks; and WHEREAS, City desires to employ CSR Hydro Conduit to manufacture the pre-cast culvert sections which will be installed by a contractor under separate contract with the City; and WHEREAS, CSR Hydro Conduit represents that they are experienced and well qualified in the field of manufacturing pre--caet culverts and can manufacture the necessary pre-cast culvert sections within the time frame constraints stated above; and WHEREAS, the Public Works Director recommends the Council find that said materials cannot be reasonably obtained from more than one vendor because of the restricted availability of the pre-cast culvert sections and recommends this council authorize the Finance Director to dispense with bidding; and WHEREAS, the Finance Director recommends the Council find said pre-cast culvert materials cannot be reasonably obtained from more than one vendor as per the Public Works Director's recommendation and recommends the Council dispense with bidding under subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as follows: The above-recitals are true and correct and incorporated herein by reference. The materials cannot be reasonably obtained from more than one vendor because of restricted availability of the supplies and material necessary for the project. Page 2 of 4 ORI~AL 3. The Finance Director is authorized to dispense with bidding in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. The Mayor is authorized to execute a contract, as approved by City staff, with CSR Hydro Conduit. The expenditure of funds for said materials involved with said contract shall not exceed $140,000. .......... o0o ..........
