HomeMy WebLinkAboutROI NO 1238RESOLUTION OF INTENTION NO. 12 ~ 8 A RESOLUTION DECLARING INTENTION TO INCREASE ASSESSMENTS FOR A PORTION OF AREA 2-01 (VINEYARDS) WITHIN THE CONSOLIDATED MAINTENANCE DISTRICT, PRELIMINARILY ADOPTING, CONFIRMING AND APPROVING THE PUBLIC WORKS DIRECTOR'S REPORT, THE ZONE OF BENEFIT INCLUDING TIER LEVEL AND THE AMOUNT OF ASSESSMENT TO BE LEVIED AGAINST EACH PARCEL; AND SETTING TIME AND PLACE FOR HEARING PROTESTS TO THE PROPOSED INCREASE IN ASSESSMENTS. WHEREAS, On July 7, 1993, the City of Bakersfield ("City") and Vineyards Community Association, Inc., ("Association") entered into Agreement No. 93-132, delegating maintenance responsibilities for certain landscape areas to the Association in exchange for reduced maintenance district assessments; and, WHEREAS, City has received a letter from Association requesting that this agreement be terminated; and, WHEREAS, termination of the agreement would require an increase in assessments to the parcels within the Association; and, WHEREAS, Proposition 218 requires that any increase in assessments requires a vote of the owners of the affected parcels; and, WHEREAS, upon approval of the property owners it is the intention of the City Council of the City of Bakersfield to increase assessments to the parcels within the above described property; and, WHEREAS, the Public Works Director has on this date filed with the City Clerk his Report, attached hereto and incorporated herein by reference as Exhibit "1" containing the following: (a) a description of the boundary of the affected area, attached hereto as Exhibit "A"; and (b) a map and assessment diagram of the affected area, attached hereto as Exhibit "B"; and (c) the benefit formula set forth as Exhibit "C"; and (d) a budget, Exhibit "D," containing the matters specified in Section 13.04.120 of the Bakersfield Municipal Code; and (e) the amount of assessment to be levied against each parcel, attached hereto as Exhibit "E". NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield, State of California, as follows: herein. The foregoing recitals are true and correct and are incorporated 2. Subject to voter approval pursuant to Proposition 218, the City Council hereby preliminarily adopts and approves the Public Works Director's Report and declares that the territory within the boundaries so specified and described is the area, (that portion of Area 2-01, Parkside Village known as Vineyards), benefitting from said local improvements; that it is the intent of this Council to determine that the expense of maintaining and operating said improvements be made assessable upon said area as set forth in the Public Works Director's Report; and that the exterior boundaries thereof are hereby specified and described to be as shown on that certain map marked Exhibit "B", entitled "Map and Assessment Diagram for increased assessments, Area 2-01 (Vineyards), within the Consolidated Maintenance District, Bakersfield, California," which map indicates by a boundary line the extent of the territory in question and shall govern for all details as to the extent of the increased assessments. 3. Subject to voter approval pursuant to Proposition 218, each parcel identified in Exhibit"E" shall be included in the Street Tier 2.5 zone of benefit and assessed an amount not to exceed $57.14 per equivalent dwelling unit (as that term is defined in Exhibit "C") per year. 4. The City Council hereby fixes Wednesday, May 16, 2001, at 7:00 PM, or as soon as thereafter as may be heard, at the Council Chambers of the City Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for hearing protests on the following matters: ZONE OF BENEFIT, INCLUDING TIER LEVEL; THE AMOUNT OF THE ASSESSMENT ON ANY PARCEL OF PROPERTY TO BE ASSESSED; -2- Any interested person may object to any of the above listed matters by filing a written protest with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California, at or before said time set for the protest hearing; and said City Clerk shall endorse on each protest the date and hour of its receipt, and at said hearing shall present to the Council all such ~rotests filed with said Clerk. 5. The City Clerk is hereby further directed to cause notice of said protest hearing to be published, posted and mailed in the manner prescribed by Sections 13.04.140 through 13.04.160 of the Bakersfield Municipal Code, and to mail to each property owner a notice of proposed increased assessment, notice of public hearing and ballot procedure and assessment ballot in compliance with Proposition 218. Your proposed yearly assessment is $57.14. Duration of payments: ongoing on a yearly basis. Reason for increased assessment: to maintain additional street and median landscaping that benefits your property. This additional landscape maintenance has been provided through the Vineyards CommunityAssociation. The Association now wishes the City to maintain this additional area. Assessments are based on an equivalent dwelling unit basis per Exhibit "C" to the Public Works Director's Report (on file with the City Clerk). -4- 2. NOTICE OF PUBLIC HEARING AND BALLOT PROCEDURE: NOTICE IS HEREBY GIVEN that the Public Works Director of the City of Bakersfield has caused to be prepared and filed with the City Clerk a report which provides the basis for the increase in assessments for maintaining additional street and median landscaping to be borne by all parcels of property within a portion of Area 2-01, (Vineyards) which includes your property. The additional street and median landscaping is located on the south side of Kroll Way, west side of Gosford Road and north side of Camino Media, adjacent to the Vineyards. Said report sets forth the amounts to be provided in the budget for maintenance and operation, a description of each lot or parcel of property in Area 2-01, (Vineyards) by a description sufficient to identify the same, and the amount of the increased assessments to be levied for fiscal year 2001-2002, against each lot or parcel of property. Said report is open to public inspection at the City Clerk's Office, 1501 Truxtun Avenue, Bakersfield, California. A PROTEST HEARING WILL BE HELD REGARDING INCREASED ASSESSMENTS IN A PORTION OF AREA 2-01, (VINEYARDS) WITHIN THE CONSOLIDATED MAINTENANCE DISTRICT ON WEDNESDAY, MAY 16, 2001, AT 7:00 P.M. or as soon thereafter as the matter may be heard in the Council Chambers at 1501 Truxtun Avenue, Bakersfield, California. At such time, the Council will consider the above- referenced report and hear protests. At the protest hearing, protests will be heard regarding the following: the fairness of the benefit formula, the zone of benefit including tier level; the amount of the assessment on any lot or parcel of property. Any interested owner objecting to any of the items listed herein may file a written protest, signed by him/her, describing the parcel of property so that it may be identified, and stating the grounds of his/her protest. Any written protest shall be filed with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California at or before the protest hearing. Individuals may also appear and be heard at the hearing. Any person challenging in court the decision made at the conclusion of such public hearing may be limited to raising only those issues raised at such hearing or in correspondence delivered to the City Clerk prior to the close of such hearing. Pursuant to Government Code § 53753, the following procedure will be followed by the City Council to determine whether a "majority protest" exists at the close of the public hearing of protests. An "Official Property Owner Assessment Ballot" (the "Assessment Ballot") has been enclosed with this Notice. -5- NOTE: THE ENCLOSED PROPERTY OWNER ASSESSMENT BALLOT IS THE OFFICIAL ASSESSMENT BALLOT. IT IS NOT A SAMPLE BALLOT. YOU WILL NOT RECEIVE ANY OTHER OR ADDITIONAL ASSESSMENT BALLOT. IN ORDER TO MAKE THIS ASSESSMENT BALLOT COUNT IN DETERMINING WHETHER A "MAJORITY PROTEST" EXISTS, YOU MUST MARK IT "YES" OR "NO," DATE IT, SIGN IT, AND SUBMIT IT TO THE CLERK NO LATER THAN THE CLOSE OF THE PUBLIC HEARING OF PROTESTS. This Assessment Ballot may be used by the owner or owners of any parcel to express either support for or opposition to the proposed increased assessment. Please see the Assessment Ballot for instructions respecting the alternative methods for submitting the Assessment Ballot either by mail (which may be done using the enclosed envelope but requires the user to provide the required postage) or by personal delivery, either prior to or at the time of the public hearing of protests. Immediately following the close of the public hearing of protests, whether on May 16, 2001 or on such date as the hearing may be continued to, the returned Assessment Ballots will be tabulated, both in support of and in opposition to the increased assessments, with the ballots being weighed in accordance with the amount of the proposed assessment, and results will be announced; provided that, in the event the Clerk requires opportunity to determine whether any Assessment Ballot has been properly signed by an owner or authorized representative of an owner, the City Council reserves entitlement to continue the matter of announcing results to provide the Clerk with such an opportunity. In the event that Assessment Ballots in opposition exceed those in support, there will be a "majority protest," and the City Council will be precluded from proceeding with the proposed increased assessments. In that case, the assessments would remain as they are currently set and Vineyards Community Association would continue to be responsible for certain landscape maintenance as provided in City of Bakersfield Agreement No. 93- 132. -6- 3. IMPORTANT - OFFICIAL PROPERTY OWNER ASSESSMENT BALLOT This Ballot is for the use of the property owner of the parcel identified below, which parcel is located within a portion of Area 2-01, (Vineyards) for the proposed increased assessments for maintenance of street and median landscaping. This Ballot may be used to express either support for or opposition to the proposed increase in assessments. In order to be counted, this Ballot must be signed below by an owner or, if the owner is not an individual, by an authorized representative of the owner. The Ballot must then be delivered to the City Clerk, either by mail or in person as follows: Mail Delivery: If by mail, place in the return envelope provided, provide stamps for first class postage, and place in the mail not later than one (1) calendar week prior to May 16, 2001. Mailing later than this deadline creates the risk that the Ballot may not be received in time to be counted. Personal Delivery: If in person, to the City Clerk at any time up to 12:00 noon on May 16, 2001, atthe City Clerk's Office at 1501 Truxtun Avenue, Bakersfield, California, or at the protest hearing itself at 7:00 p.m. on that date at the City Council Chambers at the same address. However delivered, the Ballot must be received by the City Clerk prior to the close of the public hearing (whether on May 16 or a later continuation date) to be counted. THILTGEN City Attorney S:\PROJ ECTS\MAINDIST\ROI\VineyardRoi01 .wpd Attachments: Exhibit "1" Exhibit "A" Exhibit "B" Exhibit "C" Exhibit "D" Exhibit "E" -8- City of Bakersfield PUBLIC WORKS DIRECTOR'S REPORT INCREASE ASSESSMENTS Portion of Area 2-01 (Vineyards) Fiscal Year 2001-2002 That portion of Area 2~01 (Parkside Village), known as Vineyards is a part of the Consolidated Maintenance District, and is generally described as an area bounded by Kroll Way on the north, Gosford Road on the east, Camino Media on the south, and a line 1040 feet west of Gosford Road on the west, and as specifically shown on Map and Assessment Diagram marked Exhibit "B," attached hereto and incorporated herein by reference as though fully set forth, as an area within the City of Bakersfield. Pursuant to the provisions of Chapter 13.04 of Title 13 of the Municipal Code of the City of Bakersfield, referred to as the Maintenance District Procedure, the Public Works Director makes and files this Report and proposed increased assessments of and upon all parcels of property within the area described above for the cost of maintaining street and median landscaping improvements. The improvements generally include, but are not limited to, plant forms, irrigation system pipes, conduits, water mains and/or sprinkler systems therefore, planting, including turf, shrubs, ground covers and trees now existing or hereafter to be installed or planted in and for said area and are of a public nature. The assessment includes the cost of necessary repairs, replacement, water, electricity, care, supervision and any and all other items necessary for the proper maintenance and operation thereof, and all additions and improvements thereto which may hereafter be made. On July 7, 1993 the City of Bakersfield and Vineyards Community Association, Inc., entered into Agreement No. 93-132 delegating a portion of maintenance responsibilities for street landscape areas. Those areas are along the south side of Kroll Way, west side of Gosford Road and north side of Camino Media, adjacent to the Vineyards, to the Association in exchange for reduced maintenance district assessments. On August 24, 2000, the Association requested that this agreement be terminated and the previously delegated maintenance responsibilities be returned to the City. In order for the City to terminate the agreement and assume maintenance responsibilities, assessments must be increased. Proposition 218 requires a vote of the affected property owners before assessments can be increased. Assessments within this area will increase from the current $11.54 (tier 0.5 for median landscaping only) to $57.14 (tier 2.5 for median and extra wide street landscaping) per single family residence. Increased assessments will be assessed beginning with the 2001-2002 fiscal year as set forth in Exhibit "E". Public street and median landscaping will benefit all the lots or parcels and will be EXHIBIT "1" assessed on an Equivalent Dwelling Unit basis throughout the area. The Benefit Formula is set forth herein as Exhibit "C" and attached hereto and incorporated in this resolution as though fully set forth herein. NOW THEREFORE, I, JACQUES R.
