Section 1. WHEREAS:
(a) The City of Bakersfield intends to form a park
maintenance district (pursuant to Chapter 26 of Part 3 of Title 7
of the California Streets and Highways Code and Title 13 of the

Bakersfield Municipal Code) for the maintenance of a park and
related improvements to be located at the southeast corner of
Harris and Akers Roads, in the City of Bakersfield; and

RESOLUTION OF INTENTION N0. 986
A RESOLUTION OF INTENTION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD TO ESTABLISH MAINTENANCE
DISTRICT N0. 14 (AKERS AND HARRIS).

WHEREAS, Chapter 13.04 of Title 13 of the Municipal Code.
of the City of Bakersfield provides for an alternative procedure
by which the City council may provide for the payment of the
whole or any~part of the costs .and expenses of maintaining and
operating any public improvements which are local in~nature, from
annual benefit assessments apportioned among the several lots or
parcels of .property within the maintenance district established
therefor; and ~
WHEREAS, a written request has been transmitted to the
City Council to establish a maintenance district in accordance
with the procedures established therefor by~Chapter 13.04 of
Title 13 of the Municipal Code of the City of Bakersfield and the
Public Works Manager recommends such formation; and
WHEREAS, the City Council intends to establish such a
district to be designated Maintenance District No. 14, the exte-
. rior boundaries of which are hereinafter specified and described.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield, State of California, as follows:
1. The foregoing recitals are true and correct and the
City Council so finds arrd determines.
2. ,It, is the intention of the City Council of the City
of Bakersfield to order the establishment of a maintenance dis-
trict under the. provisions of said Chapter 13.04, which district
shall be designated Maintenance District No. 14, generally
. described in Exhibit "A" attached hereto, to maintain and operate
the local improvements also generally described in said Exhibit.

3. The City .Council hereby declares that the territory
within the boundaries sd specified and described is the district
benefiting from said local improvements; that the expense of

assessable upon said district; and that the exterior boundaries
of said dids.trict are hereby specified and described to be as
shown orr that certain map now on file in the office of the Clerk-
of the City of Bakersfield and in~ the office of the Public Works
Manager, entitled "Map and Assessment Diagram for Maintenance
District No. 14, Bakersfield, California, for Fiscal Year
lyaS-1y86," which map indicates by a boundary line the extent of
the territory included in said proposed district and shall govern
,~ for all details as to the extent of the maintenance district.
4. The City Council hereby reserves the right to per-
form the work of maintenance and operation of the public improve-
ments by City forces, such determination and election to be made
for each year at the time the budget and assessment 'is approved
~~ for the year in question.
5. The City Council hereby refers said proposed mainte-

said Public,Works Manager to make and file with the Clerk of the
City Council a report in writing containing a budget and the

other matters specified in Sections 13.U4.12U and 13.U4.13U of
Chapter 13.04 of Title 13 of the Municipal code of the City of
Bakersfield, which will apportion the assessment representing the
cost of maintenance and operation, if any, according to the for-
mula set forth in Exhibit "B" attached hereto, and hereby sets
September 11, 1985, at ~I:OO p.m., or as soon thereafter as the
matter may be heard, at the Council Chambers of the City Council,

' Section 1. WHEREAS:
{a) The City of Bakersfield intends to form a park
maintenance district {pursuant to Chapter 26 of Part 3 of Title 7
of the California Streets and Highways Code and Title 13 of the
Bakersfield Municipal Coded for the maintenance of a park and
related improvements to be located at the southeast corner of

.limits and within the unincorporated area of Rern County; and

must receive the consent of this Board of Supervisors; and
{d) The City of 8akerQfield~has submitted to-this Board,
for approval, its Resolution of Intention to form the subject
maintenance district, and has requested this Board consent to
certain property located outside the boundaries of the City of
Bakersfield and within the unincorporated territory of Rern
County being included within the boundaries of the proposed main-
tenance district; and

. Section 2. HOW, THEREFORE, BE IT HEREBY RESOLVED by the
Board of Supervisors of the County of Rern, State of California,
as follows:
1. That the Resolution of Intention to form a mainte-
nance district for City of Bakersfield Maintenance District
No. 14, presented to this Board by the City Council of the City
of Bakersfield, is hereby ,approved.
2. This Board hereby grants its consent:
A. To the formation of the maintenance district
referred to in said Resolution of Intention; and
` B. To the assumption of jurisdiction by the City
Council of the City of Bakersfield for all purposes in connection
therewith.
` 3. That the plats indicating by boundary lines the
extent of the territory included in the proposed maintenance dis-
trict, submitted by the City of ,Bakersfield and on file with the
Clerk of this Board, are hereby approved.
4. That the City of Bakersfield shall file with the
Clerk of this Board a copy of the map or maps showing the final
boundaries of the subject district immediately following the

A RESOLUTION OF INTENTION OF THE COUNCIL OF THE
CITY OF BARERSFIELD TO ESTABLISH MAINTENANCE
DISTRICT N0, 14 CARERS AND HARRIS.
WHEREAS, Chapter 13,04 of Title 13 of the Municipal Code
of the City of Bakersfield provides for an alternative procedure
by which the City council may provide for the payment of the.
whole or any part of the costs ,and expenses of maintaining and
operating any public improvements which are local in nature, from
annual benefit assessments apportioned among the several lots or
parcels of property within the maintenance district established
therefor; and r
WHEREAS, a written request has been transmitted to the
City Council to establish a maintenance district in accordance
with the procedures established therefor by~Chapter 13,04 of
Title 13 of the Municipal Code of the~City of Bakersfield and the
Public Works Manager recommends such formation; and
WHEREAS, the City Council intends to establish such a
district to be designated Maintenance District No, 14, the exte-
rior boundaries of which are hereinafter specified and described,
NOW,,THEREFORE, 8E IT RESOLVED by the Council of the
City of Bakersfield, State of California, as follows:
1. The foregoing recitals are true and correct and the
City Council so finds and determines,
2. It. is the intention of the City Council of the City
of 3akersfield to order the establishment of a maintenance dis-
trict under the provisions of said Chapter 13,04, which district
shall be designated Maintenance District No. 14, generall

matter may be heard, at the Council Chambers of the City Council,
1501 Truxtun Avenue, Bakersfield, California, as the time and
