I assume that this matter has been generally discussed with either the Planning Commission or Public Works, since appar- entiy, as you will see from the enclosures, this entity has already been denominated as Maintenance District No. 17. I have reviewed Chapter 13.04 of the Municipal Code (as it was sent to Nancy Ha11 in early 1985) as well as the documentation for Maintenance District No. 12, which was created in 1985. On the assumption that there have been no material changes, I am 'taking the liberty of enclosing a revised Resolution of Intention for i~ai ntenance District No. 11, together with the required map and description. '~ The resolution is essentially identical to that used in Mainten- ance District No. 12. It contains blanks, both because of the need to fi I I i n the number of the Resolution of Intention and the date of passage of this resolution, as wel I as the date for hearing. Those matters are self-evident when you review this resolution. I am also encl osi ng a revi sed Improvement Description and Payment Formula. I i nadvertentl y did not realize that this maintenance district, unlike Maintenance District 12, contains parks and multi -fami I y properties , and accordingly, the previously provided Improvement Description and Payment Formula is incorrect, The Improvement Description and Payment Formula enclosed i s borrowed from Maintenance District No. 3, which includes both parks and multi -family properties. Z7 (SILVER CREEK} City of Bakersfield Fiscal Year I989-90 ~~ City of Bakersfield, Maintenance District No. 17, is generally described as a district within the City of Bakersfield, generally bounded by Southern Pacific Railroad on the North, Gosford Road on the West, Panama Lane on the South and Arvin-Edison Canal on the East. Pursuant to the provisions of Chapter 13.04 of Title 13 of the Municipal Code cf the City of Bakersfield, ref erred to as the Bakersfield Maintenance District Procedure, the Public Works Director makes and files this report and proposed assessment of an upon all parcels of property within the districtto be assessed for the cost of maintaining and operating local public .improvements, which are now contemplated or are in various planning stages, and some of which may be .constructed or installed within and would then be maintained and operated by the district. All such improvements will be constructed only after plans therefor have been filed raith and approved by the City Engineer. The improvements generally include parks, signs and sign posts, walls,fences, street and parkwaylandscaping which incline, but are not limited to, plant forms, kiosk, drainage facilities, irrigation system pipes, conduits, water mains and/or sprinkler systems and ornamental planting, including turf, lawns, shrubs, hedges, ground covers and trees now existing or . hereafter to be constructed, laid or planted in and for said maintenance district, and of special benefit to the territory within the district, and or a public nature including the cost of necessary repairs, replacements, water, r MD17.P1 ~'~' fuel, power, gas, electric current, care, supervision and any and all other ' essa for the ro r maintenance and operation thereof, and all additions, items nec ry p pe ' rovements and enlargements thereto which may hereafter be made. There may be other improvements of the general nature designated above to be maintained and operated by the district. In most of the City, street landscaping and parks are maintained through the Community Services Department's budget expenditures. After Proposition l3, funds available for street landscaping, parks and other maintenance were substantially reduced. At present, the department's budget will not acccxrnnodate maintenance of new improvements of the type described above and proposed for newly develo d areas within the. City. Thus, absent funds for maintenance costs from a source, other than general tax revenues, the City will not accept or permit parks or ' they landsca in or si s or walls to be placed in the City-owned median strips or o p g ~ in the area .included within this proposed maintenance district. The funds lands r ted as the result of the establishment of the proposed district will be gene a utilized strictly for the purposes of and applied to the maintenance and upkeep of i rovements within the district. Such funds will not supplant any City general fund expenditures, either present or future. The assessment for a single family residence for 1993-94 would have increased from $70.33 to $73.15, an increase of $2.82 or 4 % . As a condition of approval for the zone change Castle and Cooke agreed to continue assessing this parcel based on the current R-3 zoning. Therefore, we will not change the EDU count for this parcel. The current EDU's are based on R-3 zoning.
