Dear Ms. Joseph:
The Public Works Department did receive a copy of your protest letter on December 3,1992. Regarding
the protests of annexation of your property into the City and the Hosking Sewer Assessment District, .both
protest hearings have already been held by the City Council with both the Annexation and Assessment
District approved. Concerning the Maintenance District, the protest hearing is set for December 9,1992
and we will include your letter as a protest for the formation of the district. Enclosed are copies of the
Resolution of Intention to establish Maintenance District No. 3, Division 6 and the Public Works Directors
Report for your review. These documents will explain the City's intention to establish the Maintenance
District. Please note that the budget for the 1992-93 fiscal year is zero.
Your letter also referenced a request to remove garbage pick up from your property tax bill. The City is
unable to send you a separate garbage bill for the other property you mentioned because the fee is
collected only through your property taxes. However if you are a senior citizen 65 years or older and
satisfy the requirements you may qualify for a refuse refund, Please contact the Sanitation Department

Public Works staff has made an analysis of the impacts the South
.Beltway would have on this district. The following are the results
of that analysis:
A map showing the preferred alignment for the South Beltway is
attached. .The effect of this alignment on the proposed Maintenance
District would be negligible. There is approximately 20 acres of
land which would be affected by the beltway, this would eliminate
an~estimated 60 Equivalent Dwel-ling Units ~EDU} along with 1500
square feet of median landscaping and approximately 42,000 s ware
q
feet. of parkway landscaping. The net .effect would be a decrease of
approximately $4.00 per parcel for the district. In summary, the
estimated~cost,per EDU at full development of landscaped areas
prior to the be~.tway is $125.00 and the esti-mated cost ~ after the
beltway is $121.00. This estimated cost is for maintenance of the
build-out landscaping within`a major- portion of Section 26,
T.30 S., R.27 E. including parks, median and parkway landscaping
and is based on 1992 dollars.

SUBJECT: MAINTENANCE DISTRICT N0. 3, DIVISION 6
(BERKSHIRE)
In anticipation of any protests with respect to small landowners or
owners of properties which have not been subdivided, it is
recommended that the above referenced maintenance district utilize
an assessment spread methodology for street landscaping based on
development.
The proposal would result in assessing those subdivisions which
have a requirement for providing street landscaping improvements.
As a subdivision develops and landscaping is required and
constructed, only the subdivision will be assessed for the
maintenance of landscaping. As additional subdivisions develop and
construct landscaping, these properties would also share the
maintenance cost for street landscaping within the district. This
is also consistent with Council policy which was established for
this type of situation on prior districts adjacent to Panama Lane.
The individual property owners (-properties which have not been
subdivided} would not be assessed for street landscaping until
their. property develops and/or has ~a requirement for street
landscaping., but all properties within the district will be
assessed for maintenance of a park at such time when a park is
constructed. A park is shown on the master plan for this area.
Attached is a copy of a map indicating the proposed district
boundaries, the existing Tracts and the Tentative Tracts. As
indicated in the above example, all maintenance and operating costs
associated with the Tract requirements to provide ~ street
landscaping in this District would be spread to the developed
Tracts equally.
It is anticipated that the cost to maintain landscaping constructed
by Tract 5389 and Tract 5432 would be approximately $12 per lot.
The maximum cost per Equivalent Dwelling Unit, including park
maintenance, would be about $125, based on full build out of the
District and 1992 dollars.
