SUBJECT: STOCKDALE HIGHWAY, COFFEE/GOSFORD ROAD
LANDSCAPE. MAINTENANCE DISTRICT
Dear Property Owner:
In its continuing effort to beautify and upgrade the image of the city, the City of Bakersfield is
proposing to landscape the medians in Stockdale Highway and Coffee Road within the- area shown on the
enclosed map. Improvements will include trees, shrubs, ground cover and an automatic irrigation system in
addition to the decorative stamped colored concrete being constructed with the current median project.. The
initial cost of construction of these improvements will be borne by the City.
Maintenance of the landscaping- would be through a Landscape Maintenance District. Many
Maintenance Districts have been formed within the City to provide a means of paying the maintenance cost
of local landscape improvements. The City is proposing to form a new. Maintenance District to pay for the
cost of maintaining these improvements. This cost will be fairly apportioned to all property owners within the
boundaries of the proposed district. The estimated maintenance cost for non residentialproperties is $80.00
per acre per year. The estimated cast for multi-family properties is $9 per unit per year. If a district is
formed this cost will be added to your property tax bill. An alternate district is being proposed for the
properties fronting on Coffee Road should the larger district not receive the necessary support.
Enclosed are copies of a typical plan and maps showing the boundary of the proposed Maintenance
District and the alternate District. Also enclosed is a self addressed post card on which you .may indicate your
support of or opposition to the proposed~Maintenance District. Please check one of the .boxes and return the
card to the .City by March 25,1994. Once all cards have been received, you will be advised of the next steps
.regarding this project. Should you have any question or need additional information on this project, please

SUBJECT: STOCKDALE HIGHWAY, COFFEE/GOSFORD ROAD
LANDSCAPE MAINTENANCE DISTRICT
Dear Property Owner;
As a result of a survey taken last March and a public information meeting held in June, the City is
proceeding with its plans to form a Maintenance District for the maintenance of landscaping to be placed in
your neighborhood. The landscaping to be maintained will include the medians in Stockdale Highway from
.the fire station just east of El Rio Drive to the west boundary of the CSUB campus and in Coffee Road
between Truxtun Avenue and Stockdale Highway. As stated in an earlier letter the cost of installing the
landscaping will be borne by the City. The maintenance district is being formed to pay .for the annual
maintenance of the landscaping. The enclosed notice, as required by law, is to inform you of two hearings
on the formation of the district. The first hearing is for public testimony on the proposed district and will be
held February 8,1995, at 7:00 PM, in the Council Chambers. The second hearing is the protest hearing where
you may protest the formation of the district. This hearing will be held on March 22, 1995, at 7:00 PM, in
the Council Chambers.
In the original letter sent out last March proposing this district, we stated that the annual assessment
for a single family dwelling would be $12 per year. Since then, however, the City Council approved the
Consolidated Maintenance District. on June 29, 1994. This combines all previous districts into one. large
district where all parcels .receiving a similar benefit will pay the same amount. The City's procedure is that
all new districts formed during the fiscal~year will be merged into the Consolidated Maintenance District at
the end of each fiscal year. If this district is formed, there would be no assessment for the current year (1994-
95).. The assessment for fiscal year 1995-96 would be $12 per single family dwelling ($7 per dwelling unit for
multi-family). In fiscal year 1996-97, and thereafter, each parcel would be assessed the same as other parcels
receiving the same benefit. In 1994-95 each parcel with landscaping similar to what is being proposed for this
district paid an assessment of $32.
Should the district not be formed the spaces in the medians will be paved over with asphalt.

This letter is in response to the March 7, 1994 mailing directed to property owners ~in the area of
Stockdale Hwy, and Gosford Road. We are adamantly opposed to the formation of these two (2}
Landscape Maintenance Districts. First, the property owners were not .asked about the ex ansion

of the road which will. increase the traffic in the area.. Secondly, the funds expended on the
documentation provided in the mailing must have cost a substantial amount. That ex enditure

could have been used to maintain the landscaping if the City decided to go forward with the. plans.
Thirdly, there is no definite cost being provided, to the property owners. An "estimate" does not
make us comfortable with .what the city may eventually decide :to .tax us. Fourth, accordin to the

maps provided; we would. be providing maintenance .for the landscaping for numerous areas not
included in these districts. The areas delineated in the maps include Quailwood and a onion of

Stockdale Estates but exclude Old :Stockdale, ,Cal State University, Bakersfield, Mercy

LANDSCAPE MAINTENANCE DISTRICTS
in its continuing effort to beautify and upg~-auc the image of the city, the Ciiy of Bakers~iel~i is
proposing to landscape the medians in Stockdale Highway and Coffee Road within the areas shown on the
enclosed maps. Improvementswill -include trees, shrubs, ground cover and an automatic irrigation system in
addition to the decorative stamped colored~~ooncrete being constructed with the current median project. The
initial cost of construction of these improvements will be borne by the City.
Maintenance of the landscaping would be through Landscape Maintenance Districts. .Many
Maintenance Districts have been farmed within the City to .provide a means of paying .the maintenance cost
of local landscape improvements. The City is proposing to form two new Maintenance Districts to pay for
the cost of maintainingthesefmprovements. This cost will be fairly apportioned to all property owners within
the boundaries of the proposed districts. The estimated maintenance cost for a single family home in these
districts is $12.00 per year. The estimated cost for apartments is $7.00 per unit. The estimated cost for non
residential properties is $50 per acre per year. If these districts .are formed this cost will be added.., to your
property tax bill.
Enclosed are copies of a typical plan and maps showing the boundaries of the proposed Maintenance
Districts. Also enclosed is a self addressed post card on which you may indicate your support of or opposition
to the proposed Maintenance Districts. Please check one of the boxes and return the card to the City by
March 25, 1994. Once all cards have been received, you will be advised of the next steps regarding this

Public Meeting
A public meeting was held at the Dor6 Theatre on the Cal State University Bakersfield campus, at 7:00 P.M.
on Thursday, June 16,1994. A letter was sent to all of the residents in the proposed district on June 9,1994
(copy attached) informing them of the time, place and purpose of the meeting.
Back in March, a letter was sent these same residents asking for their comments in favor or opposition to the
formation of the maintenance district. The results were ambivalent • although an overall majority of approx.
53.7% were in favor of the formation of the .district, only 49.3 % of the residents north of Stockdale Hwy. were
in favor of forming the district while 60.4% of the residents south of Stockdale Hwy. were in favor of foaming
the district. A total of 566 cards out of 1055 were returned to the Public Works Department.
Approximately twenty-dive residents attended the meeting. Also in attendance was Councilwoman Conni
8runni. The meeting was. conducted by the Public Works Department with the help of Frank Fabbri, Parks
Superintendent (a copy of the meeting format is attached). Comment cards were handed out at the meeting
for the residents to express their opinion on whether or not a maintenance district should be established
During the, meeting, the audience was told of the possibility of maintenance district consolidation and its effect
on this district's maintenance costs. This had the unfortunate effect of widening the discussion beyond the
intent of the meeting, but as you know, the residents had to be informed of the possibility of the consolidation.
Most of the most vocal members of the audience were in opposition to the formation of the district. The
comments were similar to the ones usually received at meetings of thissort - taxation is already too high; this
will just open the door to unlimited assessments since there is no cap; there is too much bureawrracy already;
etc.. Other comments received included
I have friends on .Renfro who drive down Stockdale Highway; I want them to pay for the
maintenance also.
I don't want to have to pay for any landscape maintenance down on Union with all the graffiti
and running over trees.
Why can't the maintenance of this median be done by a private company • we wouldn't have
to pay as much-then.
Landscaping Stockdale Hwy. will not inaease my property value - I live in Quailwood
This landscapingwill benefit the whole city • it should be paid for out of the general fund or
gas tact or some other source.
Interestingly, the majority of the response cards returned from the meeting were in favor of the formation of
the district.

In March, you were sent a letter describing landscaping improvements the City has proposed
for the Stockdale Highway and Coffee Road street medians in your area. You were also asked for
your input on whether or not you would support a landscape maintenance district in your area to
pay for the maintenance of these improvements.
We would like to thank those of you who took the time to respond to our survey. The result
of this survey indicate that 53% of the property owners in the .proposed district are in favor of the
formation of a maintenance district. Although the majority opinion indicates that the maintenance
district should be formed,. the City wishes to obtain more feedback from the property owners before
proceeding.
During the course of the survey, many of you asked for more information regarding costs,
operations, and administrative procedures. In order to present same of this information to you as
well as to provide you with the change to ask questions directly of our City staff, the City would like.
to invite you to a Public Information Meeting. This meeting will be held on Thursday, June lb,1y94
from 7:40 to 5:30 P.M. at the Dore Theatre on the Cal State University Bakersfield campus.
Unmetered parking will be.available in Parking Lots B and C (please see the attached map). Please
note that parking in another location may result in a parking ticket. .
Your participation in this meeting will help the City of Bakersfield in determining whether
or not to proceed with the formation of a maintenance district and .the installation of median
landscaping. You will be given the opportunity to express your support or opposition to this project
should you wish to change from the~view you expressed during. our earlier survey. We look forward

Dear Mr. Sempell:
Thank'you for your letter of February 13,1995, concerning the proposed Maintenance District for
your neighborhood. The following are the responses to the questions you asked:
1 and 2. When the Coffee Road bridge at the Kern River was completed in 1993, there was
approximately $100,000.00 in construction money .left over. This money was earmarked for
construction of median landscaping in Coffee Road .from the Kern River to Stockdale ,Highway,
where. the property owners had expressed an interest in forming a maintenance district. At
approximately the same time, Stockdale Highway was to scheduled to be resurfaced.. However,
resurfacing the street this time .would have brought the street surface nearly up to the -top of the
existing median curb. Also, the street needed to be increased from 4 lanes to 6 lanes. Therefore,
it was .decided to remove the existing medians and construct new medians at a narrower width to
allow for the additional lanes. The Public Works Department opted to leave this section of the
median unpaved so that, should a maintenance district be established in the area, landscaping could
be installed with that scheduled for Coffee Road.
. 3. The cost of the median removal and reconstruction was $93.,308. No electrical or
plumbing work has been done in the medians for landscaping. .
4. The amount budgeted to install the landscaping is $65,000.
5. Money for the installation of the landscaping has .been budgeted and is available. If this
money is not expended on this project, it will be transferred to other road projects as directed by
the City Council.
6. All of the expenditures for medians and landscaping were approved by the City Council
through the Budget process.
7. City policy is to extend the boundary of a maintenance district to approximately 1/2 mile
from the landscaping or to a collector street or other natural boundary. Kroll Way is a collector just
under 1/2 mile from Stockdale Highway.
8. The landscaping in the median on Ming Avenue between Ashe Road and Gosford Road
was constructed prior to 1981 and is paid for entirely by the general fund, in accordance with the
then-existing City policy. After 1981, City policy was revised so .that alI new median landscaping
must be supported by a maintenance district. Some 21,000 assessment notices are sent out each year
under that policy.
9. Costs for the landscaping in Ming Avenue are not tracked separately since they are not
within a landscape maintenance district.
10. There are no plans to form a maintenance district for the medians in Ming Avenue
between New Stine Road and Gosford Road.
11. In the initial study to determine the limits of the proposed district the area between
Ashe Road and California Avenue was considered. However, since the 114 mile section of Stockdale
Highway west of Ashe Road is in the county it was decided to end the district at the dire station.
12. Property owners. of single family lots west of Gosford Road between Stockdale Highway
and Ming Avenue paid a maintenance district assessment of $16.11 last year, and will pay
approximately $32.00 this year..
13. Maintenance District No.1 Division 10 (Quailwood) and No. 2 Division 14 (Stockdale
Estates} were originally 2 separate districts under the old method. CSUB was not included in
Maintenance District No. 2 Division 14. Under the Consolidated Maintenance District all 3 areas
were proposed to be combined into one district.

Public Meeting
A public meeting was held at the Dori Theatre on the Cal State University Bakersfield campus, at 7:00 P.M.
on Thursday, June 16,1994. A letter was sent to all of the residents in the proposed district on June 9,1994
(copy attached) informing them of the time, place and purpose of the meeting.
Back in March, a letter was sent these same residents asking for their continents in favor or opposition to the
formation of the maintenance district. The results were ambivalent -although an overall majority of approx.
53.?% were in favor of the formation of the district, only 49.3 % of the residents north of Stockdale Hwy. were
infavor of forming the district while 60.4% of the residents south of Stockdale Hwy. were in favor of forming
the district. A total of 56b cards out of 1055 were returned to the Public Works Department.
Approximately twenty-five residents attended the meeting. Also in attendance was Councilwoman Conni
Brunei. The meeting was conducted by the Public Works Department with the help of Frank Fabbri, Parks
Superintendent (a copy of the meeting format is attached}. Comment cards were handed out at the meeting
for the residents to express their opinion on whether or not a maintenance district should be established.
During the meeting, the audience was told of the possibility of maintenance district consolidation and its effect
on this district's maintenance costs. This had the unfortunate effect of widening the lion beyond the
intent of the meeting, but as you know, the residents had to be informed of the possibility of the consolidation.
Most of the most vocal members of the audience were in opposition to the formation of the district. The
comments were ~ to the ones usually received at meetings of thissort - taxation is already too high; this
will just open the door to unlimited assessments since there is no cap; there is too much bureaucracy already;
etc. ether comments received included
I have friends on Renfro who drive down Stockdale Highway; I want them to pay for the
maintenance also.
I don't want to have to pay for any landscape maintenance down on Union with all the graffiti
and running over trees.
Why can't the maintenance of this median bedone by aprivatecompany - we wouldn't have
to pay as much then.
Landscaping Stockdale Hwy. will not increase my propert~r value - I live in Quailwood.
This landscapingwill benefit the whole city • it should be paid for out of the general fund or
gas tax or some other source.
Interestingly, the majority of the response cards returned from the meetingwere in favor of the formation of
the district.

We have tallied all of the responses received to date, including the comment cards received at the public
meeting. Nineteen responses were received at the meeting, along with two letters and two phone calls; l3 of
theses had responded previously and were not counted except for the two responses which changed their
opinion from "for" to "opposed" (A copy of the memo outlining the results received prior to the meeting is
attached; also attached is a memo outlining the results after the meeting). The results are as follows:

As you can see, the results of the meeting failed to clarify the issue. There is a majority of the respondents
who desire to have median landscaping on Stockdale .Highway and who are willing to form a maintenance
district. However, the north and south sides of Stockdale Highway are still split with the Stockdale area in
favor and the Quailwood area opposed.

of this survey indicate that 53%n of the property owners in the proposed district are in favor of the
formation of a maintenance district. Although the majority opinion indicates that the maintenance
district should be formed, the City wishes to obtain more feedback from the property owners before
proceeding.
During the course of the survey, many of you asked for more information re ardin costs,

The recently constructed landscaped median on Stockdale Highway,
between the Arvin Edison Canal .and Don Hart Drive West, totals
13, 075 square feet .
It is my understanding that Cal State will pay the annual
maintenance costs for ane .half of the landscaped median which
fronts their campus. I have based the annual maintenance cost
estimates far the 1996-97 FY at $Q.35 per square foot.
~.3, 075 square feet / 2 = 6, 537.5 square feet .
6,537.5 square feet x $.0.35 per square foot= $2,288.13
Based on the above Cal State should pay $2, 288.1.3 for the- 1996-97
FY.

Dear City Leaders:
As you know, f represent a large group of homeowners from the from
Stockdale Estates and 6Zucilwood neighborhoods who have publicly
expressed opposition to .the formation of this proposed Landscape
Maintenance District as was demonstrated at our recent X2/8/95) City
Council Meeting. Our group of homeowners are intending to meet again
prior to the March 22nd Protest Hearing to be heard in front of our City
Council. In order to improve the communication and rapport between
our group and the City Staff and Council more. information is needed.
Since our Council Representative, Mr. McDermott, encouraged "Staff" to
pwork with the citizens" at the 2/8/95 Public Hearing, I thought I would
request some public information thct I believe will defuse the negative
sentiment that has developed among our group of homeowners. The
answers to these questions I am confident will help immensely to clarify

some of our concerns. This information will help all of us come together
and as a community move forward in a positive and constructive manner.
We request this information so that we may oll participate in making an
informed, thoughtful and responsible decision on this issue.
The questions we have ore respectfully submitted as follows:
1) With whom or what .body did the idea of landscaping the median
at Stockdale Hwy./Coffee-Gosford originate?
2) Why were the medians removed when the road was repaved?
3) How much has this proposed project cost thus far? Specifically,,
please show the breakdown and where funding for each has
come from.

Staff costs accrued thus far on this proposed project
4) Actual Dollar amount originally budgeted to "install. the

Ave. between Ashe and Gosford paid for?
9) Has this stretch of landscaping (item 8 above) ever been costed
out? If so, what is the current (or latest figures) annual
maintenance cost?
10) Is there any intent or plan to propose, or has it been discussed
to develop a similar Landscape Maintenance District for the
median on Ming Ave. between New Stine and Gosford (in part
or whole)?
1.1) Is there any intent or plan to propose , or has it been discussed
to landscape the medion on Stockdale Highway from Ashe Rd.
east to So. Real Rd. (in port or whole)?
12) Is it true that only the property owners to the west of Gosford
currently pay for the median landscape mointenance of
Gosford between Stockdale Hwy. and Ming eve.? Please
explain the logic why east of Gosford (Stockdale Estates) has
not been assessed in this district?

13) What happened to Maintenance District No. 1 Division 10 and
No. 2 Division 14 and when were they altered? Was CSUB
originally included in District No. 2 Division 14?

Repave the median of Stockdale Hwy. with black asphalt. 2) Complete
the median with stamped brick (similar to what has already been
installed). 3) Landscape at "Tier I" costs and 4) Landscape at "Tier IV"
costs. Would you also please be so kind to forward those estimates to us
when conveniently available but before the March 22nd Protest Hearing?
Again, let me assure you we are interested in your responses to the above
questions in order for our group of homeowners to move forward in
`working cooperatively and with good faith with both the City Council and
the City Staff. Your expediency in responding (in writing) will be greatly
respected and appreciated as we feel there; needs to be full disclosure in
order for the individual homeowner to make there best informed decision
whether or nat to endorse ANY landscape proposal or upgraded median
improvement.

results you cooperatively provide me.
Afferwards, we may wish to meet. with City Stcff and/or our Council
member to see if we can mutually understand and agree on the

We feel firmly that should the City Council and Staff decide to discontinue
efforts toward the proposed Landscape Maintenance District, we will. be
very pleased with black asphalt (not painted green or any other color)
which has existed prior as well as currently exists east on Stockdale Hwy.
from Ashe Rd. to So. Real Rd. However, depending on the one time cost
estimate of the Red Stamped Brick alternative as has already been
constructed in the existing median upgrade, there is some interest in this
option. Please let us know as soon as possible but within 10 working days
so we have enough time to review and possibly meet with you prior. to the
next Protest Hearing.
