Ire its continuing effort to beautif~- and upgradE -the iniagc of the city, the City of Lakcrsfi~ld
proposing to landscape the medians in Stockdale Highway and Coffee Road within the areas shown on the
enclosed maps. Improvements will include trees, shrubs, ground cover and an automatic irrigation system in
addition to the decorative stamped colored concrete being constructed with the current median project. The
initial cost of construction of these improvements will be borne by the City:
Maintenance of the landscaping would be through Landscape Maintenance Districts. Many
.Maintenance Districts have been formed within the .City to provide a means of paying the maintenance cost
of local landscape improvements. The City is proposing to, form two new Maintenance Districts to pay for
the Est of maintaini.ngthesefmprovements. This cost will be fairly apportioned to all property owners within
the boundaries of the proposed districts. The estimated maintenance cost for a single family home in these
districts is $12.00 per year. The estimated cost for apartments is $7.00 per unit. The estimated cost for non
residential properties is $50 per acre per year.. If these districts are formed this cost will be added to yow
propert~~ tax bill.
.Enclosed are copies of a typical plan and. maps showing the boundaries of the proposed Maintenance
Districts. Also enclosed is a self addressed post card on which you may indicate your support of or opposition
to he proposed Maintenance Districts. Please check-one of the boxes and return the-card to the City by
March 25, 1994. Once all cards have been received,. you will be advised of the next steps regarding this

SUBJECT: STOCKDALE HIGHWAY, COFFEE/GOSFORD ROAD
LANDSCAPE MAINTENANCE DISTRICT
Dear Property Owner:
As a result of a survey taken last March and a public information meeting, held in June, the City is
proceeding with its plans to form a Maintenance District for the maintenance of landscaping to be placed in
your neighborhood. The landscaping to be maintained will include the medians in Stockdale Hi hwa from

the fire station just east of El Rio Drive to the west boundary of the CSUB campus and in Coffee Road
between Truxtun Avenue and Stockdale Highway. As stated in an earlier .letter the cost of installing the
landscaping will be borne by the City. The .maintenance district is being formed to ,pay. for the annual
maintenance of the landscaping. The enclosed. notice, as required by -law, is to inform you of .two hearings
on the formation of the district. The first hearing is for public testimony on the proposed district and will be
held February 8, 'I995, at 7:00 PM, in the Council Chambers. The second hearing is the protest .hearing where
you nlay protest the formation of the district. This hearing will be held on March 22, -1995, at~ 7:Q0 PM, in
the Coun~:il Chambers.
In the original letter sent out last March proposing this district, we stated that the annual assessment
for a single family dwelling would be $12 per year.. Since then, however, the City Council a roved the

Consolidated Maintenance District on June 29, 1994.. This combines all :previous districts: into one large
district where all parcels receiving a ,similar benefit will pay the same amount. The Citv's rocedure is' that

all new districts formed d~-~ng the fiscal year will be merged into the Consolidated Maintenance District at
the end of each fiscal year. If this district is formed, there would be no assessment for the current ear (I994-

95}. The asse,rnent for fiscal year 1995-96 would be $12 per single family dwelling ($7 per dwelling unit -for
multifamily}. ~n f cal y€~ar 1996-97, and thereafter, each parcel would be assessed the same as other arcels

represent a large group of .property owners from both: Stockdale Estates
and ~ua~lwood neighborhoods. who are VEHEMNTLY OPPaSED to the
formation of the proposed Landscape Maintenance Distric# No. 2-15
(interim) Stockdale Hwy & Coffee/Gosford (Ward 4> (see attachments).
Our group ~s growing by the hour as we have just learned via a letter
mailed to all property owners from our Public Works Department received
January 28, 1995 aboufi City.. Staff's infent to proceed with the
establishment of the proposed Landscape Maintenance District involving
our neighborhoods see attachment).
It is imperative thaf you be informed and/or reminded that the
"Adminisfirative Report" -dated .~anuary 20, 1995 from our Public Works
Direcfior to yourselves is absolutely. inaccurate as is stated, "Property
owners in this area have indicated their support to establish a

property owners up-front with truthfulness and full disclosure from the
initial efforts of this proposed district formation. I am confident that none
of us here tonight as well as the people of our All-American City wish to
appear deceitful or misleading in our public efforts to represent!
As a result, our still organizing & uniting neighborhood efforts of Stockdale
Estates and 6Zuailwood respectfully request that the City IMMEDIATELY
DISCONTINUE any further effort at establishing this proposed maintenance
district!
We believe all of the People of Bakersfield have suffered enough with the
°eyesore" of this unnecessarily prolonged and delayed project to
complete the unpaved median on Stockdale Highway. We recall- in our
initial. letter from the Department of Public Works dated March 7, 1994, " In
its continuing effort to beautify and upgrade the image of the city,. the
City of Bakersfield is proposing to landscape the medians of Stockdale
Highway and Coffee Road within the areas shown on .the enclosed maps.
Improvements will include trees, shrubs, ground cover and an automatic
irrigation. system in addition to the decorative stamped. colored concrete
`being .constructed with. the current median project. The .initial cost of
construction of these improvements will be borne by the City.."
If the City. is still prepared to bear the costs of the initial construction,
maybe there are alternative improvements that do not require the
establishment of a maintenance district?? For example, is it logical to
consider that the City use the funds apparently allocated for the " .initial
cost of the construction of these improvements" be used to complete. the.
median with the already constructed decorative stamped color
concrete? Which, by the way, has never been proposed as an alternative
. to the property owners. Or does that alleged fund even currently exist??

NO-CAP assessment tax. This circumstance already occurs when
Homeowner's Association Fees are seemingly high!
You see, our concern of course centers around our .neighborhoods.
today, but this issue effects all other property owners in the City of
Bakersfield who will also be subject to assessments of a similar nature. In
fact, we already have had calls from other property owners outside of our
neighborhoods both in Maintenance Districts already (and UNAWARE of
their soon to be discovered membership in the Consolidated District} as
well as property owners not yet "inducted"!
Finally, before others with me here tonite have there own additional
concerns and experiences to share, , tet me repeat what has clearly
been echoed by our people at the local ,state and federal levels - No
new taxes! or "assessment fees° as they .are now. termed for purposes of
"creative financing" UNLESS Cleary desired by the: majority 2/3,'s of the
people! Smaller government not larger! And let's learn to live within the
limits of existing funding! In our case in 6Zuailwood & Stockdale Estates,
THE PEOPLE HAVE Al.RfADY SPOKEN!

In response to a recent letter from the Public Works Department of
the City of Bakersfield concerning the formation of Maintenance
District No. 2-15, I would like to express my strong opposition to
this proposal. The letter mentions a survey conducted in March,
1994. This was, as indicated, a survey -- not a vote of the
affected property owners.
As a result of the survey, which indicated only 53 percent of the
respondents were in favor of forming such a District, there was a
Public Information Meeting (specially requested by Conni Brunni
}
held June 16, 1994, at Cal-State. Nearly all of the attendees at
this meeting voiced .strong opposition to the formation of such a
.District.. Some of the opposition came from those who did not want
the District under any circumstances, and some from those who were
concerned about lack of safeguards to control escalation of costs.
The question of costs and the passibility of rising costs .was
brought up many times to the persons representing the Public Works
.Department, but-.was met with evasive answers. When I asked Frank
~`abbri, .Parks Superintendent, if there was any historical data to at
least give an idea as to the rates of increases suffered by other
Maintenance Districts, he stated that increases were enerall

"small" --.a statement that was later refuted. at a regular meetin

of the City Council.
At the June 29, 1994, meeting of the Counci 1, you posed the question
of why costs of maintaining landscaping within Maintenance Districts
had risen so much faster than the cost outside of Maintenance
Districts. At that meeting, there was much discussion about
consolidatian of the many districts into one Large district. At
that time you questioned .the propriety of such a move, stating that
you did not believe the projected savings of approximately $20,000
warranted the move. You also suggested to the Council that if such
a move was approved that increases in assessments should be no more
than 10 percent of what the assessment would have been without such
consolidation. This concept was passed as an amended motion at-the
June 29, 1994, Council meeting.

During the Public Information Meeting mentioned earlier, the
proposed assessment for each single family residence was $12 per
year, with apartments being assessed $7 per unit.and nonresidential
properties to be $50 per acre. The most recent letter concerning
these assessments places these costs at $32 per residence, afar cry
fram the aforementioned 10 percent, The latest letter also suggests
that if a Maintenance District is not formed, the spaces in the
median will be paved. SO BE IT!!!. The City Engineer admitted that
the project was undertaken, along with another project, with
insufficient funds available to complete either of them, These
people came to us asking that we bai 1 them out of a probl em they had
created, and we said no.
This latest letter also states that. "the cost of installing the
landscaping would be borne by the City", with the cost of
maintenance to come from the funds derived from the proposed
Maintenance District. Where in the world do these people think the
money to install the landscaping came fram in the -first place? They
do not seem to recognize that it is not their money, but belongs to
the taxpayers, who must, ultimately decide how it is to be spent.
I feel that this latest attempt by the City to glean more money from
property owners to provide something that was never requested, with
no means of limiting the rates assessed, is an affront to ali
property owners within the proposed district- and should be squelched
as: soon as possible. Please continue to question the propriety of
forming such a district, and urge your fellow Councilmembers to vote
"NO" on the formation of Maintenance District No. 2-15.

We are against the groposed Stockdale Highway, Gosford Road
Landscape Maintenance District proposed by your Public Works
Department. It appears to us that your plans included this
landscaping even before any of those chosen to pay for it
were informed. We are not against trees but there are
several reasons we oppose the formation of this District.
1) A few property owners will be forced to pay for a
project that will benefit the thousands of motorists
that travel Stockdale Highway.
2) In our opinion, the formation of this district is
taxation without representation unless a two-thirds
majority approve in our opinion.
3) The cost estimates are suspect. First it was $12.00 a
year, then it jumped to $32.00 a year with na cap. We
were misled with the first correspondence and survey
with a $12.00 number.
4) The most recent letter states "The cost of installing
the .landscaping will be borne by the City". What does
this mean? Are we to assume this cost is free? The
nonrecurring cost should be included in the
correspondence so that taxpayers can see the actual cost
of this proposed project.
5) According to the representative from Cal-State, the
University would provide their share of funds as
necessary to complete this project and that the
University was for the project. There is nothing stated
on the letter we receive about any assessment other than
home dwellers. What will Cal-State's assessment be?
How about the Shopping Center, will it be assessed and
how much?
6) A speaker at the Council meeting on February 8, 1995,
noted that about 1100 homes would spend about $32,000.00
a year to maintain this median and pay for the water.

I will be out of town the evening of February 8th and cannot
attend the meeting to be held-concerning this matter. However, ?
wish to voice support for the .proposed district and will watc h
with interest as the project moves forward.
Even though I will not be attending the meeting I wish to
contribute the fallowing thoughts to the committee: In planning
the landscaping I sincerely hope serious consideration will be
given to the site. Please choose low water requirement trees and
shrubs, and do not plant high maintenance cost turf, weed growth
on the bare ground that will evQntually be covered by the shrubs
can be controlled with simple and safe pre-emergence herbicides,
and/or the use of mulch made from the city's mulch. trimmings or
Christmas tree mulch. To control the water run off, which is
wasteful and in time destroys the adjoining road beds, the so it
level must be 4-6" below the curb. This will allow the water, as
applied by bubbler emitters, to collect in the basin formed by
the curbing, and finally percolate into the soil profile. Exam-
p 1 es of what not to do are the Gassf o rd-Gof f ee strips which are
"crowned" and allow the sprinkler water to flow onto the. street
wasting water and damaging the street surf ace. It is also impor-
taut. that the median planting areas be ripped to a depth of 18-
24" to open the soil and allow water and root penetration through
the compacted media strips.'
Bakersfield-must have trees and shrubs, not asphalt, at this.
important entrance to our "A11 American City". .The dirt piles
now standing have been very depressing sights, and hopefully the
view will change soon. Please continue to keep all of us in-
formed about the progress of this work.

~ Unfortunately, I was unable to attend the Public Information Meeting
at CSUB last Thursday evening, June loth. However, I would like to
voice my opinion (once again) regarding the subject maintenance district.
I am opposed to the creation.of a maintenance district for the highway.

ation of grass, shrubbery and trees obviously requires installation of
a water line, continuous watering and associated maintenance costs, as
opposed to none for~the red tile. Furthermore, the fast traffic on
Stockdale Highway from dense housing in the southwest and from CSUB,~ .; ,
during times of the day, is such that anything rising above ground level
in the median will create an unsafe visual hazard for such traffic.
Also, as far as my wife and I are concerned, the creation of another main-
tenance district is just a means of violating the precepts involved with
Proposition 13. We are retired Senior Citizens living on a pension and
we cannot afford to be inundated with property taxes emanating from a
procession of taxing districts designed deliberately to circumvent the
provisions of Proposition 13.
We would Like to see the money that would be spent for median landscaping
be utilized to install traffic signals at the intersection of Stockdale
Highway and Via Riata. There has been several bad accidents at this
intersection and there are times when it is virtuously impossible to enter
o.r cross Stockdale Highway safely due to the speeding traffic.~from both
directions along the highway. .

Attached, please find copies of prior correspondence regarding the above named issue. Please
be advised that our position on this proposed district has not changed and we feel even more
adamantly that the entire issue is completely out of line. According to the 1-2b-95 letter we
recently received from the Public Works Department, the survey last summer resulted in the
City going forward with plans for this proposed district. We attended the hearing last June at
which public input was requested. The city staff, after the meeting, told our then City
Councilperson, Connie Brunni, that the results of the "vote" were that those present wanted the
project to go forward. We were speaking with Ms. Brunni at that time. We informed her as
we are informing you now, NO vote was taken at that meeting and the city staff obviously
collected only the responses from those present who were in favor of the project. One of the
"gentlemen" even articulated that I, Terry Livengood, could not voice an opinion at the
meeting! After informing me that only my husband was allowed a voice, I did enlighten him
to the fact that women were given the right to vote- years ago! At the meeting, any of us who
had voiced objections to the project were told that the cards to state an opinion were only if we
wanted to change our original position. Those who were in favor of -the project were told to
bo ahead and document that opinion on the cards handed out that evening. In no way did that
constitute a "vote" for the hearing.
after the Council voted on the issue in June 1994, we again contacted Connie Brunni and were
informed that the measure had failed and that we need not be concerned, the maintenance
district would NOT go forward. Now, seven (7) months later we are notified that City Staff
has :not accepted the response of the ,public and the vote of the Council but are progressing
forward with. yet another attempt to put the maintenance district in place.. Our original
concerns are being proven to be accurate, the assessment is not to continue at the estimated
$12.00 per year fee-that Staff had informed the residents. Now we are looking at something
more in the neighborhood of $32.00 per year.. The Staff informed us in the last public he<~rin

that additional employees would need to be hired, private contracts could very easily reduce
the expenditures for the maintenance districts, but no options other than City control and

Dear Property Owner:
As a result of a survey taken last March and a public information meeting held in June, the City is
proceeding with its plans to form a Maintenance District for the maintenance of landscaping to be placed in
your aeighborhood. The landscaping to be maintained will include the medians in Stockdale Highway from
the fire station just east of El Rio Drive to the west boundary of the CSUB campus and in Coffee Road
between Truxtun Aveaue and Stockdale Highway... As stated in an earlier letter the cost of installing the
landscaping wiU be borne by the City. The maintenance district is being ,formed to pay for the annual
maintenance of the landscaping. The enclosed notice, as required by law, is to inform you of two hearings
oa the formatioa of the district. The first hearing is for public testimony on the proposed district and will be
held February 8,1995, at 7:00 PM, in the Council Chambers. The second hearing is the protest hearing where
you may protest the formation of the district. This hearing will be held on March '2, 1995, at ?:00 PM, in
the Council Chambers.
In the original letter sent out last March proposing this district, we stated that the annual assessment
for a single family dwelling would be $12 per. year. Since then, however, the City Council approved the
Consolidated Mainteaance District on June 29, 1994. This combines aU previous districts into one large
district ~ where all parcels receiving a similar benefit will pay the same amount.. The City's procedure is .that
all new districts formed during the fiscal year will be merged into the Consolidated Maintenance District at
the end of each final year. If this district is formed, there would be no assessment for the current year (1994-
95). The assessment for fiscal year 1995.9fi would be $12 per single family dwelling ($7 per dwelling unit for
multi-fanvly). In fiscal year 1996-97, and thereafter, each parcel would be assessed the same as other parcels
receiving the same benefit. In 1994-95 each parcel with landscaping similar to what is being proposed for,. this
district paid an assessment of $32.
Should the district not be formed the. spaces in the medians will be pavCd over with aspualt.

At the meeting, we were informed that the response to the March curve was a roximatel

50 % of the property owners ie the area. According to City staff, the result was 53 % in favor
to 47 % opposed. This would represent only 27 % of the property owners responded
affirmatively. one issue which was not clarified last night was how these percentages were
estimated. We were informed that the businesses in the area had been approached before
beginning this project and businesses such as Town and Country Shopping Center had agr~d
to fund the maintenance district prior to approaching the home owners. Were the businesses
included in the totals of respondents and did these business votes represent more than one vote
per parcel? Additionally, we were informed last night that the only two (2) such maintenance
districts in the City already in operation are funded exclusively by business areas. This is the
first venture into residential areas. The attitude of the residents at the meeting last night
certainly seemed to us not to be in .favor of the proposal. The concept of landsca in the Ci

was not disputed, the major objection was with the establishment of yet another government
bureaucracy. The City staff acknowledged that additional personnel will be necessary to

This letter is in response to the March 7,1994 mailing directed to property owners in the area of
Stockdale Hwy. and Gosford Road. We are adamantly opposed to the formation of these two ~2)
Landscape Maintenance Districts. First, the property owners were not asked about the expansion
of the road which will increase the traffic in the area. Secondly, the funds expended on the
documentation provided in the mailing must have cost a substantial amount. That expenditure
could have been used to maintain the landscaping if the City decided to go forward with the plans.
Thirdly, there is no definite cost being provided to the property owners. An "estimate" does not
make us comfortable with what the city may eventually decide to tax us. Fourth, according to the
maps provided, we would be providing maintenance for the landscaping for numerous areas not
included in these districts. The areas delineated in the maps include Quailwood and a portion of
Stockdale Estates but exclude Old Stockdale, Cal State University, Bakersfield, Mercy
Southwest, The Shores, and The Edgewater Apartments. Additionally, as far as we know, these
roads are not for the exclusive use of the property owners in the specified maintenance districts.
Stockdale Hwy. is a major thoroughfare with one of the primary functions being access to Cal
State- University, Bakersfield. For a selective few to be maintaining the City property for this area
is unequivocally unfair.
We do NOT authorize the City to increase our taxes to maintain this project and assume that the
City will re-thiink this entire issue. ~Ve anticipate hearing the results of this survey in the near

In .response to a recent letter from the Public Works Department of
the City of Bakersfield concerning the formation of Maintenance
District No. 2-15, I would like to express my strong opposition to
this proposal. The letter mentions a survey conducted in March,
1994. This was, as indicated, a survey -- not a vote of the
affected property owners.
As a result of the survey, which indicated only 53 percent of the
respondents were in favor of forming such a District, there was a
Public Information Meeting {specially requested by Conni 8runni}
held June 16, 1994, at Cal-State. Nearly all of .the attendees at
this meeting voiced strong opposition to the formation of such a
District. Some of the opposition came from those who did not want
the District under .any circumstances., and some from those who were.
concerned about lack of safeguards to control escalation of costs.
The question of costs and the possibility of rising costs was
brought up many times to the persons .representing the Public Works
Department, but was met with evasive answers.. When I asked Frank
Fabbri, Parks Superintendent, if there was any historical data to at
least give an idea as to the rates of increases suffered by other
Maintenance Districts, he stated that increases were generally
"small" -- a statement that was later refuted at a regular meeting
of the .City Council.
At the June 29, 1994, meeting of the Council , you posed the question
of why costs of maintaining landscaping within Maintenance Districts
had risen so much faster than the -cost outside of Maintenance
Districts. At that meeting, there was much discussion about
consolidation of the many districts into one large district. At
that time you questioned the propriety o~f such a move, stating ,that
you did not believe. the projected savings of approximately $20,000
warranted the. move. You also suggested to the Council that if such
a move was approved that increases in assessments should be no more
than l0:percent of what the assessment would have been without such
consolidation. This concept was passed as an amended motion at the
June 29, 1994, Council meeting.

My name is Florence Hiett. My husband and I have lived at 201 Montalvo Dr. since December 1971. We were one of the
property owners who responded to the initial inquiry concerning the landscaping of Stockdale Highway. Our response was a
negative one based mainly on the fact that we did not want an increase of our property taxes. During the 24 years we have
lived in our home Stockdale Highway has grown from a two lane road to the main artery it is today. I do not feel in anyway
that the lack of landscaping has decreased the value of our property nor do I feel it will greatly improve it. The esthetic view
of driving down Gosford is one of beaufiyr when it is freshly mowed and the trees are green, but many of us would also be
quick to comment on the waste of water running down the streets .from misgauged sprinklers that never seem to get adjusted,
or of seeing three city works trucks with six personnel standing around while ONE indi~~idual replaces a sprinkler head.
Many of us would rather see pot-holes and cracks, repaired or increased up-keep on existing parks.
Aber reading the coverage in the Bakersfield Californian on page two in Tuesday's edition I decided to call my neighbors to
see how they felt about the proposed tax levy. I spent two hours on the phone and finished with a very different view than
the one you expressed in the Californian. Many of the residents I personally talked with said that they no longer were in
favor of the project. This would greatly effect the numbers you have quoted. They also expressed several important questions
such as.
1. VUHY are we who live north of Kroll being singled out to pay for this?
2. WHO pays for Oosford maintenance?
3. 't~HO pays for Ming maintenance?
4. Safety hazzards... such as view of traffic and maintenance worker's safety
5. V4'HY is there NO legal cap?
6. ~, since this will be an increase in taxation, is this not going to be an
issue that we will be allowed to vote upon
