AN ORDINANCE AMENDING SECTION 17.06.020 (ZONING MAP NOS. 101-02, 101-03, 101-04, 101-10 AND 101-11) OF TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE ZONING OF CERTAIN PROPERTIES WITHIN THE ROSEDALE RANCH DEVELOPMENT AREA, FROM C-2/P.C.D. (REGIONAL COMMERCIAL! PLANNED COMMERCIAL DEVELOPMENT) ZONE TO 01 ZONE AT TWO LOCATIONS OF 5.01 ACRES AND 5.00 ACRES FOR A TOTAL OF 10.01 ACRES; FROM R-1/P.U.D. (ONE-FAMILY DWELLING IPLANNED UNIT DEVELOPMENT) ZONE TO 01 ZONE ON 5.0 ACRES; FROM R-1 (ONE-FAMILY DWELLING) TO 01 ZONE ON 5.01 ACRES; AND FROM M-1 (LIGHT MANUFACTURING) ZONE TO 01 ZONE ON 5.0 ACRES, FOR A TOTAL PROPOSED ZONE CHANGE REQUEST ACREAGE OF 25.02 ACRES, GENERALLY LOCATED ON THE NORTHWEST CORNER OF OLIVE DRIVE AND RENFRO ROAD, SOUTH OF SEVENTH STANDARD ROAD, EAST OF SANTA FE WAY (FILE # 07-0898) WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield at 5 locations within Rosedale Ranch development area located on the northwest corner of Olive Drive and Renfro Road, south of Seventh Standard Road, east of Santa Fe Way; and WHEREAS, by Resolution No. 34-08 on February 21, 2008 the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Municipal Code to approve Zone Change 07-0898 as delineated on attached Zoning Map Nos. 101-02, 101-03, 101-04,101-10 AND 101-11 marked Exhibit "3", by this Council and this Council has fully considered the recommendations made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted changes in zoning of the subject property from C-2/P.C.D. (Regional Commerciall Planned Commercial Development) zone to 01 zone of 5.01 acres and 5.00 acres for a total of 10.01 acres; from R-1/P.U.D. (One-Family Dwelling IPlanned Unit Development) zone to 01 zone on 5.0 acres; from R-1 (One-Family Dwelling) zone to 01 zone on 5.01 acres; and from M-1 (Light Manufacturing) zone to 01 zone on 5.0 acres. Total acreage of proposed zone change request is 25.02 acres and the Council has considered said findings and all appear to be true and correct; and WHEREAS, the law and regulations relating to the preparation and certification of Environmental Impact Reports (EIR), as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff, Planning Commission and this Council; and WHEREAS, said map was an associated project of GPAlZone Change 04-0671 (Rosedale Ranch EIR) approved by the City Council on November 16,2005; and WHEREAS, the laws and regulations relating to CEQA and the City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff, the Planning Commission and the City Council; and 1 ~ Q"f>.,K~-? o ~ >- ~ 5 6 ORIGINAL WHEREAS, the Rosedale Ranch Environmental Impact Report, certified by City Council on November 16, 2005, and incorporated by reference for this project, documents that this subdivision is a later project that will not have a significant effect. Based upon an initial environmental assessment, staff has determined the proposed project will not significantly effect the environment, and utilization of the referenced for this project is adequate. (CEQA Guidelines Section 15153(c) and Section 15182) WHEREAS, there have been no substantial changes to the project or circumstances under which it will be undertaken; and WHEREAS, no new environmental impacts have been identified; and findings: WHEREAS, the City Council has considered and hereby makes the following 1. All required public notices have been civen. Hearing notices regarding the proposed project were mailed to property owners within 300 feet of the project area and published in a local newspaper of general circulation at least 10 days prior to the hearing. 2. The Environmental Impact Report (EIR)) certified on November 16. 2005 for the oricinal proiect (Rosedale Ranch EIR) is applicable to and appropriate for this proiect. 3. The provisions of CEQA and City of Bakersfield CEQA Implementation Procedures have been followed as described: a. In accordance with CEQA Guidelines Section 15162(a){1), there is no new significant environmental effects or a substantial increase in the severity of previously identified significant effects associated with the revised project, therefore, no major revisions to the previous Environmental Impact Report are required. The EIR prepared for the project in November 2005 examined potential environmental impacts of the Rosedale Ranch development area in 14 substantive categories; 8 categories would have a less than significant effect on the environment, 3 categories would have an insignificant effect on the environment and a Statement of Overriding Considerations was adopted for 3 categories. The project will not significantly impact the physical environment, because mitigation measures relating to aesthetics, agricultural resources, air quality, cultural resources, hazardous materials, hydrology/water, land use, public services/utilities, recreation, and traffic will be the same as under the original project. b. In accordance with CEQA Guidelines Section 15162(a) (2), there are no substantial changes with respect to circumstances under which the project is undertaken which will require major revision of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. There are no changes in circumstances, substantial or otherwise, under which the project is being undertaken that would required major revisions in the EIR previously approved for the project. c. In accordance with CEQA Guidelines Section 15162(a)(3), no new information of substantial importance shows: (i) new significant effects not previously discussed, (ii) a substantial increase in severity of previous discussed impacts, (iii) mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce significant effects, or (iv) mitigation measures or alternatives which are considerably different from those analyzed in the previous EIR that would substantially reduce significant effects. The revised project does not result in any impacts that were not previously discussed in the EIR, found to be less than significant or mitigated to a level of less than significant. ~ ~AK~1> o ~ 2 ~ m - r- o D ORIGINAL d. None of the requirements for a subsequent or supplemental EIR or negative declaration pursuant to CEQA Section 21166 or CEQA Guidelines Section 15162 and 15163 are present. e. There are no significant impacts which are peculiar to this project which were not considered in the Rosedale Ranch EIR. f. There are no potentially significant off-site impacts and cumulative impacts which were not discussed in the EIR prepared for the Rosedale Ranch development area. h. None of the requirements for a subsequent EIR or negative declaration pursuant to CEQA Section 21166 or CEQA Guidelines Sections 15162 and 15163 are present. No major revisions are necessary to the previously adopted Rosedale Ranch EIR. All mitigation measures adopted for the previously approved Project will apply to this subdivision. No subsequent or supplemental EIR or negative declaration is necessary. 4. The public necessity, general welfare and good zoning practice justify the requested change of zone from the existing zoning district to DI zone. 5. The overall design of the project, as conditioned, is consistent with the goals and policies of all elements of the general plan. 6. The conditions of approval, attached hereto as Exhibit "1" are needed to provide for orderly development, and the public health, welfare and safety. SECTION 1. as follows: NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield 1. That the above recitals, incorporated herein, are true and correct. 2. That these zone changes pertains to the Rosedale Ranch Environmental Impact Report certified by City Council on November 16, 2005. 3. That the Rosedale Ranch Environmental Impact Report is appropriate for this project. 4. That Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be amended by changing the land use zoning on Zone Maps No. 101-02, 101-03, 101-04, 101-10 and 101-11 attached hereto as Exhibit "3" of that certain property in said City of Bakersfield as herein before described. 5. That the following zone changes as shown in Exhibit "4" are recommended: Areas "A" and "C" change from C-1/P.C.D. zone to 01 zone; Area "B" change from R-1 zone to 01 zone; Area "0" change from R-1/P.U.D. zone to 01 zone; and Area "E" change from M-1 zone to 01 zone. 6. In consideration by the City of Bakersfield for land use entitlements, including but not limited to related environmental approvals related to or arising from this project, the applicant, and/or property owner and/or subdivider ("Applicant" herein) agrees to indemnify, defend, and hold harmless the City of Bakersfield, its officers, agents, employees, departments, commissioners or boards ("City" herein) against any and all liability, claims, actions, causes of action or demands whatsoever against them, or any of them, before administrative or judicial tribunals of any kind whatsoever, in any way arising from, the terms and provisions of this application, including without limitation any CEQA approval or any related development approvals or conditions whether imposed by the City, or not, except for CITY's sole active negligence or willful misconduct. This indemnification condition does not prevent the Applicant from challenging any decision by the City related to this project and the obligations of this condition apply regardless of whether any other permits or entitlements are issued. The City will promptly notify Applicant of any such claim, action or proceeding, falling under this condition within thirty (30) days of actually receiving such claim. The City, in its sole discretion, shall be allowed to choose the attorney or outside law firm to defend the City at the sole cost and expense of the Applicant and the City is not obligated to use any law firm or attorney chosen by another entity or party. PLANNING MITIGATION MEASURES FROM GPA/ZC 04-0671 Bioloaical Resources 2. Prior to any ground-disturbing activities, a qualified biologist shall conduct surveys for nesting birds, including raptors. The surveys shall occur at a minimum of 3 days prior to the clearing, removal, or trimming of any vegetation. Surveys shall include areas within 200 feet of the edge of the proposed project boundary and the entire proposed project site. If active nests are found, a 50-foot (minimum) fence barrier shall be erected around the nest site. A 200-foot barrier shall be required for any raptor-nesting sites, including Swainson's hawk. No habitat removal or any other work shall be allowed to occur within the fenced nest zone until a qualified biologist confirms that the young have fledged and have left the nest. If archaeological sites are discovered on site during construction, and an archaeologist is contacted to determine the significance of the find, the developer shall provide written evidence to the City Planning Department that a qualified archaeologist has been retained, shall be present at the pre-grading conference, shall establish procedures for archaeological resource surveillance, and shall establish in cooperation with the project developer procedures for temporarily halting or redirecting work to permit the sampling, identification, and evaluation of the artifacts as appropriate. If human remains of Native American origin are discovered during project construction, it is necessary to comply with state laws relating to the disposition of Native American burials, which fall within the jurisdiction of the Native American Heritage Commission (Pub. Res. Code Sec. 5097). If any human remains are discovered or recognized in any location other than a dedicated cemetery, there will be no further excavation or disturbance of the site or any nearby area reasonably suspected to overlie adjacent human remains until: a. . the coroner of Kern County has been informed and has determined that no investigation of the cause of death is required, and b. . if the remains are of Native American origin, i. the Native American Heritage Commission was unable to identify a descendant or the descendant failed to make a recommendation within 24 hours after being notified by the commission, or ii. the descendants of the deceased Native Americans have made a recommendation to the landowner or the person responsible for the excavation work for means of treating or disposing of, with appropriate dignity, the human remains and any associated grave goods as provided in Public Resources Code Section 5097.98. According to California Health and Safety Code, six or more human burials at one location constitute a cemetery (Section 8100) and disturbance of Native American cemeteries is a felony (Section 7052). Section 7050.5 requires that construction or excavation be stopped in the vicinity of discovered human remains until the coroner can determine whether the remains are those of a Native American. If the remains are determined to be Native American, the coroner must contact the California Native American Heritage Commission. (GPA/ZC 04-0671 Condition 12) Noise 5. Commercial and industrial uses shall be designed such that noise from operations does not exceed City noise standards for non-transportation sources. The project applicant shall retain a qualified acoustical consultant to design treatments for commercial and industrial uses such that residences located adjacent to these uses will not be exposed to noise exceeding City standards for non-transportation uses. Treatments may include methods such as: . limits on hours of operations . use of enclosures or localized barriers around equipment noise sources . placement of barriers between the residences and commercial and industrial uses . use of mufflers on equipment exhaust The acoustical consultant will prepare and submit to the City a report detailing the acoustical treatments to be used for compliance with this performance standard. The report must be reviewed and approved by the City before a building permit will be issued.
