Dale Hawley, appointed Engineer of Work for CITY OF BAKERS- FIELD ASSESSMENT DISTRICT N0. 82--1 (STOCKDALE SEVER .TRUNKLINE) , hereinafter referred to as the "Assessment District", pursuant to the provisions of the Municipal Improvement Act of 1913, being Division 12 of the Streets and Highways Code of the State of California and Section 10204 of said Code and in accordance with RESOLUTION OF INTENTION N0. 955, A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD TO ACQUIRE IMPROVEMENTS, ASSESSMENT DISTRICT N0. 82-1 STOCKDALE SEWER TRUNKLINE, herewith submit the. Engineer's Report for the Assessment District consisting of five (5 ) parts described as follows PART 1: PLANS AND .SPECIFICATIONS/ACQUISITIONS The plans and specifications for the acquisitions consist of the following: a) Those certain construction .plans and specifications as approved by the City Engineer, together. with all City Engineer approved change orders to said construction plans on file with the City Department of Public Works, far those certain sanitary sewage pipeline works, appliances and appurtenant facilities already installed and generally referred to as the STOCKDALE SEWER TRUNKLINE (hereinafter referred to as the "Trunkline"). "On March 16, 1983, the Assessment District Engineer of Work filed a statement with the City Clerk, certifying said Trunkline facilities a.s complete and acceptable for. City acquisition and connection to existing City sanitary sewage facilities. Said approved .plans and specf ica~ions for completed Trunkline facilities are incorporated herein by reference as though set forth irl full. b) A general description of all other existing works, appliances, property~or appurtenances necessary or convenient for the operation of Trunkline improvements to be acquired by the City, all of which are more particularly described in Part 2 hereof . PART 2: GENERAL DESCRIPTIOr~ 0~' ACQUISITIONS A general description of Trunkline works, appliances .and appurt- enances already installed and any other works, appliances, -1- property, or capacity rights necessary or convenient for the opera- tion of the Trunkline, are set forth in Part 2 of this Engineer's Report, and made a part hereof. PART 3: ESTIMATE OF ACQUISITION COSTS A breakdown of the estimated cost for the acquisition of Trunkline improvements, together with the incidental expense for completion of said Assessment District is presented in Part 3 of this Engi- neer's Report and is on file with the City Director of Public ti3orks. Said estimated costs include the costs associated with all City Engineer approved Trunkline change orders. PART 4: PROPOSED ACQUISITION ASSESSMENT A proposed assessment of the total amount. of the costs and expenses of ,the Trunkline acquisition upon the several lots, pieces, parcels or portions thereof or subdivisions of land within the Assessment District in proportion to the estimated benefits to be received by such lots, pieces, parcels or sub- divisions from said Trunkline, is set forth upon the assessment roll filed ,herewith and made a part hereof. PART 5: ASSESSMENT DIAGRAM A diagram showing the assessment district, the boundaries and the dimensions of the subdivisions of land within said assessment district, as the same existed at the time of the passage of the Resolution of Intention, is filed herewith and made a part hereof and a part of the assessment. Da1.e Hawley Superintendent f Streets City of Bakersfield _2_ 1 FINAL ENGINEER'S REPORT CITY OF BAKERSFIELD ASSESSMENT DISTRICT N0. 82-1 (STOCKDALE SEWER TRUNKLINE~ PART 2 GENERAL DESCRIPTION OF ACQUISITIONS The general description of City Assessment District acquisitions consists of those certain sanitary sewage pipeline works, appli- ances and appurtenant facilities already installed and certified complete by the City Engineer and generally referred to as the STOCKDALE SEWER TRUNKLINE (Trunkline), together with those other works, appliances, property, capacity rights and incidental expenses. necessary or convenient for operation of said Trunkline facilities by the City. The Trunkline has been constructed by Tenneco Realty Development Corporation (hereinafter referred to as "Tenneco") as partial fulfillment of conditions of approval for those certain subdivisions of real property within City boundaries, known as Tentative Tracts No. 4472, 4482, 4489, 4494, 4544., 4561, 4562 , 4563 , 4576 , 4593 , .45.94 , 46.00 , 4601, 46.02 , 4608 , 4610, 4611, 4612, 4613, 4619, 4620, 4625, 426 and Tentative Parcel Maps No. 6547, 6722,.6787, 6.846 and 6847. The eligible items of acquisition are all those Trunkline works, appliances, appurtenant facilities, properties, capacity rights and incidental expenses which meet the acquisition eligibility" criteria set forth in that certain City Agreement No. 82-105, by and between the City and Tenneco, dated duly 7, 198.2. Agreement No. 82-105 identifies the eligible items of acquisition as those Trunkline improvements shown on the approved plans and specf -- cations on file in the of f ise of the City Director of Public Works, which Trunkline improvements have been certified as complete by the Engineer of ~Tork for said Assessment District prior to the .adoption of the Resolution of Intention to acquire said Trunkline improvements. The eligible items. of acquisition include the actual cost of the improvement incurred by Tenneco for materials, labor, engineering, construction inspection, construction survey- ing, inspection fees, sewer fees, assessment engineering fees, interest paid on funds advanced for construction work and all costs incidental to the construction of said Trunkline improve- ments. Trunkline items eligible for Assessment District Acquisition are generally described as follows: A. GOSFaRD ROAD TRUNK SEWER Includes sanitary sewer pipeline improvements complete with manholes and appurtenances as .shown on CITY approved "Plans For The Construction of Gosford Road Trunk Sewer" and including CITY -3- approved change orders to said plans. Gosford Road Trunk Sewer is located in the following described streets or easements, as shown on said City approved plans. a. In an easement located south of and running parallel with McCutchen Road right of way from the point of connection to the existing 48-inch diameter CITY interceptor sewer at Gosford Road Trunk Sewer Manhole No.1, Station 10+46.02, westerly a distance of 4,266.70 feet, more or less, to Manhole No. 8, Station 53+12.7 (EQ}. b. In Gosford Road from Manhole No. 8 , .Station 52+34 (EQ) , northerly a distance of 11,333.32 feet more or less, to 1~2anhole No. 29 , Station 164+97.32 , the point of connection with the 24-inch diameter pressure discharge line from the Gosford. Road Lift Station. Manhole No. 29 is located 2.60 feet more or less, southerly from the centerline of proposed District Boulevard. B. GOSFORD ROAD LIFT STATION The Gosford Road Lift Station includes a complete sanitary sewage lift station and appurtenances, as shown on CITY approved "Plans For The Construction Of Gosford Road Lift Station" and including CITY approved change orders to said plans. Said lift station is located 80 feet southerly, more or less, of the centerline of proposed District Boulevard and 80 feet easterly, more or 1~ss, of the Gosford Road centerline. C . CAMPUS PARK TRUNK SEWER The Campus Park. Trunk Sewer includes sanitary sewer pipeline improvements complete with manholes, pipeline stubouts providing for the future connection of tract sewers and appurtenances as shown on CITY approved construction plans for the "Campus Fark Trunk Sewer" and including CITY approved change orders. The Campus Park Trunk Sewer is located in the following described streets or easements as shown on the aforementioned Tentative Tract and Parcel Maps: u. From the point of connection to the Gosford Road Lift Station, northwesterly 124.60 feet, more or less, to Campus Park .Trunk Sewer Manhole No. 1, Station O+OO, located near the intersection of Gosford Road and proposed District Boulevard. b. Northerly in .Gosford Road from Manhole No. 1, 20 felt more or less, to connect .with existing Drop Manhole No. l8. c. ~aesterly in proposed District Boulevard from Campus Park Trunk Sewer Manhole No. 1, Station 0+00, a distance of 1,960.69 feet, more or less, to Manhole No. 5, Station 19+60.69, located in the intersection of proposed District and Pin Oak Boulevards. -4- d. Northerly in proposed Pin Oak Boulevard from Manhole No. 5 a distance of 6.87 feet, more or less, to Manhole No. 7, Station 26+47.69, located at the intersection of proposed Pin Oak Boulevard and proposed "A" Street. e. Westerly in proposed "A" Street from Manhole No. 7, a dis- tance of 1,298.53 feet, more or less, to Manhole No. 10, located at the intersection of proposed "A" Street and pro- posed Park View Drive. f. Northerly in proposed Park View Drive from Manhole No. 10 a distance of 1,696 feet, more or less, to Manhole No. 14, Station 56+46.22, located at the intersection of proposed Park View Drive and proposed Campus Park Drive. g. ~~esterly in proposed Campus Park Drive from Manhole No. 14 a distance of 1,219.43 feet, more or less, to Manhole No. 17, Station 68+65.65, located in the intersection of proposed Campus Park Drive and proposed Old River Road. Manhole No. 17 being the western terminus of the Campus Park Trunk Sewer and the southern terminus of the Old River Road Trunk Sewer. D. OLD RIVER ROAD TRUNK SEWER The Old River Road Trunk Sewer includes sanitary sewer pipeline improvements complete with manholes, pipeline stubouts providing for the future connection of tract sewers and appurtenances as shown on CITY approved "Sewer Plans, Old River Road Trunk Sewer (Between Ming Avenue and Campus Park Drive}" and including CITY approved change orders. The ~1d River Road Trunk Sewer is located in the following listed existing streets or proposed streets as shown on the aforementioned Tentative Tract and Parcel Maps: a. In proposed Old River Road from Manhole No. 1, Station a+QO (the point of discharge of the Old. River Road Trunk Sewer to the Campus Park Trunk Sewer), northerly a distance of 8,164.49 feet, more or less, to the point of connection with the Ming Avenue Trunk Sewer. E . I~iINC AVENUE TRUTJK SEWER The Ming Avenue Trunk .Sewer includes sanitary sewer pipeline improvements complete with manholes, pipeline stubouts providing for the future connection of tract sewers, a canal undercrossing, connections to existing sewage pipelines and system appurtenances as shown on CITY approved "piing Avenue Trunk Sewer Plans (Between Gosford Road and Old River Road" and including CITY approved change orders. The Ming Avenue Trunk Sewer is located in the following listed existing streets or proposed streets as shown on the aforementioned Tentative Tract and Parcel Maps: - 5 - a. Ming Avenue from Manhole No. 1, Station 1+00, (located in Ming Avenue a distance of 120 feet, more or less, from the centerline of Gosford Roads westerly in Ming Avenue a dis- tance of 6,452.18 feet, more or less, to Manhole No. 14 located in the intersection of Ming Avenue and proposed Old River Road. b. In the proposed Old River Road from Manhole No. 14 southerly 80 feet, more or less, to the poin of connection with the Old River Road Trunk Sewer. The acquisition costs of eligible Trunkline items shall include the actual contract prices for construction of the Trunkline as paid to contractors by TENNECO, including allowances for cost increases or decreases resulting from CITY approved contract change orders. Additional eligible costs shall include the costs for acquisition of the Gosford Road Lift Station site property, costs for materials, labor, design engineering, soils testing, computer analysis, construction inspection and surveys, inspec- ton fees, interest on funds advanced for construction work, assessment engineering, bond. counsel and. attorneys' fees, mun~- cipal financing consulting fees, CITY assessment administration charges and other charges associated with the -doing of all incidents) work and payment of expenses therefore, as necessary or convenient to accomplish any of the foregoing and making all acquisitions auxiliary to any of the foregoing which may be necessary or convenient to complete the same in accordance with the requirements of the CITY, the County of: Kern, any agency of the State of California ar of the Federal Government, any special district of local government, or ,regulated public utility company. The acquisition of easements, including. construction easementsr or capacity rights necessary by reason of the foregoing described work. -6- FINAL ENGINEER'S REPORT CITY OF BAKERSFIELD ASSESSMENT DISTRICT N0. 8 2-1 (STOCKDALE SEWER TRUNKLINE) PART 3 ESTIMATE OF TOTAL ASSESSMENT DISTRICT COSTS 1. The Stockdale Sewer Trunkline System consists of four (4) sections of gravity sewer pipeline and one sewage lift station. These five Trunkline sections are listed below and a statement of the acquisition assessment costs for each section is presented in the following Tables 3-1 through 3-5. A. WHEREAS, said Resolution of Intention did refer said proposed acquisition to the Engineer of Work for said Assessment District No. 82-1 and did direct, said .Engineer to make. and file with the City clerk of said City, a report in writing, presenting the following: a. A proposed assessment of the total amount of the. costs and expenses of the proposed acquisition of improvements upon the several subdivisions of land in the district in propor- tion to the estimated benefits to be received by such subdivisions, respectively, from said improvements, and of the expenses incidental thereto. Dale Hawley, Engineer of Work of .said Assess- ment District No. 82-1, pursuant to the provisions of the Municipal Improvement Act of 1913 and said Resolution of Intention, do hereby submit the following: 1) Pursuant to the provisions of said Act. and of said Resolution of Intention, I have assessed the total amount of the costs and expenses of the proposed acquisition of improvements and of the expenses incidental thereto upon. the several subdivi- sions of land in the district in proportion to the estimated benefits to be received by such subdivisions, respectively, from said improvements all as is more particularly set forth in the Assessment Roll as contained herein. The numbers on said Assessment, Roll correspond with the assigned numbers upon the Assessment Diagram filed herewith. Superintendent of ruts City of Bakersfield State of California -63- FINAL ENGINEER'S REPORT CITY OF BAKERSFIELD ASSESSMENT DISTRICT N0. 82-1 (STOCKDALE SEWER TRUNKLINE) ASSESSMENT PROCEDURE A specific procedure or formula must be developed for every assessment district, for the purpose of apportioning the total cost of the assessment district to the individual properties that will benefit from the district improvements. State statutes require that the cost of the assessment be apportioned to the individual parcels .according to the benefit that each parcel can be expected to receive from the improvements covered by the assessment. It has been established through the years that the benefit to a parcel from a particular improvement should be determined on the basis of the highest and best use expected for a property. The current land use of an area to be benefited by a new mprove- ment will, therefore, not necessarily be used as the basis for determining the full extent of the benefit and the resulting assessment share for the. property. This is especially true with regard to improvements that will provide urban utility services to properties that are not presently developed~to an urban land use. The availability of these utility improvements will increase the potential and use options for these undeveloped properties. These undeveloped properties should therefore be assessed on the basis of their new potential for future development. An assessment proceeding can provide for the complete construction of the desired improvement, or for the acquisition of improvements already constructed. The Stockdale Sewer Trunkline consists of sanitary sewage pipeline and appurtenant facilities already con- structed as a condition of development for several tentative subdivision tracts located within the City of Bakersfield. These tracts are identified in Part 2 of this engineer's report. Assessment proceedings were undertaken by the City of Bakersfield to forts City Assessment District No. 82-1 (hereafter "the District"), for the pureose of acquiring the Stockdale Sewer Trunkline (hereafter "Trunkline"~ from the present owner. Acqui- sition of the Trunkline by City assessment proceeding will make Trunkline sewage transport capacity available to all properties located within the Benefit .Area. of the Trunkline system. Figure 1 of this engineer's report shows the boundaries of both the Benefit and Assessment Areas of the Trunkline. The Total Assessment For Improvement Acquisition, as presented in Table 3, Part 3 of this engineer's report, has been assessed upon the several subdivisions of land in the District in proportion to - 64 - the estimated benefit to be received by each such subdivision. A description of the procedure used to apportion the assessment among the subdivisions of land in the District is presented in the following section. Assessment Procedure The boundaries of the Trunkline Benefit and Assessment Areas are illustrated in Figure 1 of this engineer's report. A review of the referenced Figure will show that the Trunkline Benefit Area exceeds the Trunkline Assessment Area. The Trunkline Benefit Area represents that specific land area which, if developed to urban land uses, will discharge sanitary sewage waste flows generated within the area to the Trunkline system. The Trunkline system will transport the sewage waste flows discharged from the Benefit Area to the City of Bakersfield Treatment Plant No. 3, for treatment and effluent disposal. The Trunkline Benefit Area exceeds the Trunkline assessment Area, because several owners of the properties located in the Benefit Area requested that their properties be withdrawn from the District. These withdrawal requests and their potential impact on assessments for properties that would remain in the District were reviewed with District land owners. The remaining District land owners agreed to absorb the additional costs that would be assessed to their properties as a direct result of the requested property withdrawals. Proceedings were then undertaken by the City to form the District and levy the TOTAL ASSESSMENT FQR IT~PROVEMENT ACQUISITION (see Table 3, Part 3~ against those properties left in the District. The referenced Figure 1 illustrates the area to be assessed for the acquisition. This assessment proceeding was undertaken pursuant to that certain City Agreement No. 82-105, dated July 7, 1982, by and between the City and Tenneco Realty Development Corporation.. Under the terms and conditions set forth in that agreement, the City will charge a connection fee to all properties withdrawn from the assessment district that connect to the system at some future date. The terms and conditions of the Trunkline Connec- tion Fee are to be established by the City. In order to equitably accommodate this withdrawal of benefiting properties from the assessment, the procedure for computing individual parcel assessments has been divided into two parts. The first part of the assessment procedure is called the Baseline Assessment and the second part is called the Oversizing Assess- meat. The Baseline Assessment represents the total amount a property would have been assessed if all properties located within the Trunkline Benefit Area shown on Figure 1 had been included in this assessment district. The Oversizing Assessment represents that portion of the Total Assessment for improvement Acquisition shown in Table 3, Part 3 of this engineer's. report that would have been apportioned to those properties which have been with- drawn from the District at owner request. - 65 - The details of the District Assessment Procedure are presented as follows: 1. Basis of Trunkline Cost Apportionment The Baseline and Oversizing assessment costs have been apportioned to individual properties in the District in direct proportion to the Trunkline capacity allocated to a property. Trunkline capacity has been allocated to individual properties throughout the Trunkline Benefit and Assessment Areas on the basis of the estimated total number of Equivalent Residential Dwelling Units (EDU) that may be developed on a property. Approved general plan land use designations, in combination with land owner site plans, were used where available to compute the EDU allocations for properties within the District. All other areas were assigned an assumed Village land use designation, carrying a maximum density of 5.0 EDU/gross acre. Figure 2 of this engineer's report illustrates .the general location of the five (5~ sections of the Trunkline system to be acquired by this assessment proceeding. Each section is described further in Part 2 of this engineer's report, titled General Description of Acquisitions. The Total Assessment for Improvement Acquisition for the entire Trunkline system is presented in Table 3 of Part 3 of this engineer's report, while Tables 3-1 through 3-5 of part 3 present the share of the total acquisition assess- merit for each. of the five Trunkline sections. Each property in the District has been assessed a pro rata share for acquisition of only those Trunkline sections which will actually serve the property. .The first step in the process of apportioning these Trunkline section assessments, was to compute a unit assessment factor per EDU for each Trunkline section. These factors were ,developed by dividing the estimated total number of EDU's to be served by each Trunkline section into the amount shown in Part 3 as the Total Assessment For Improvement Acquisition far the Trunkline section being considered. An individual property assessment for a Trunkline section could then be computed by taking the product of the section unit assessment factor and the estimated total number of EDU's for the parcel. The total amount assessed to a property in the district is computed by adding the amounts apportioned to the. property for each section of the Trunkline, as computed under the previously described procedure. 2. Baseline Assessment As previously stated, the Baseline Assessment represents the total amount that would have been assessed to a property located within .the Trunkline Benefit Area shown in the referenced Figure 1, if all properties located within the Benefit Area had been included in this assessment proceeding. Therefore, the - 66 - Baseline Unit Assessment represents the costs per EDU that would have been assessed to all those properties withdrawn from the District at owner request. Consequently, the Baseline Unit Assessment is used in the procedure for computing the amount to be apportioned to the Oversizing assessment. It will also be available as a benchmark value, for use by the City in computing connection fees to be charged to non-assessed properties that may be connected to the Trunkline at some future date. The total Base line Assessment fora property was computed as the product of the total estimated number of property EDU's, multiplied by the sum of the Baseline Unit Assessments for each Trunkline section that will serve the property. 3. Oversizing Assessment The Oversizing Assessment represents that portion of the Trunkline Total Assessment For Improvement Acquisition that would have been apportioned to Trunkline Benefit Area properties withdrawn from the District at owner request. See Figure 1 for an illustration of the Benefit Area excluded from the District. The share of the total assessment that would have been paid by .these withdrawn properties must be assessed to the properties left in the District. The Oversizing part of the assessment will therefore be an amount that is in addition to the Baseline Assessment apportioned to each property in the District. The total amount of the Oversizing Assessment was computed as the product of the estimated total EDU's fo-r the properties withdrawn from the District, multiplied by the sum of the Baseline Unit Assessment Factors for each Trunkline section that will serve those withdrawn properties. The total amount of the Oversizing Assessment is to be apportioned, at land owner request, to a limited number of the properties in the District. Figure 2 of this engineer's report illustrates that portion of the District which will be assessed the total amount of the Oversizing Assessment. The specific properties that are to be assessed for Trunkline Oversizing are listed as follows by their Assessor's Parcel Numbers (APN~.
