In 1990 the owners of our property (William and Rita Judge) along with the owners of over 60% of the y property. in your area signed a petition to have the City form an assessment district for the purpose of constructing sewer trunklines to serve the area along Hosking Avenue as shown on the attached ma .The etition was accepted by the City Council on September 11,1991. Notices P P were sent to all affected property owners and a hearing was held. An assessment district was then formed under the authority of the Streets and Highways Code, Section 10000 et seq. Each parcel within the district was assessed its share of the cost of the trunkline based on its land use designation. Your parcel was assessed based on single family residential land use designation. On October 1, 1992, assessments (liens) were recorded for each property within the district. Bondswere then sold and the sewertrunkline-was constructed. These liens run with the property, and therefore the assessments are due and payable each year by- the current owner. Assessments are paid annually through property tax bills and will be paid off with the 2006-2007 tax year. Notice of this assessment, or lien, should have appeared ~n your title report as Assessment District 91-1 (Hosking Trunk Sewer} when you bought the property. Greg suggested showing the old APN's as well as the Assessment District Parcel number so that someone could tie the information to the Final Engineer's Report. With this same view in mind, I have used (instead of the area information from. the Assessor's records) the net area used in the preparation of the Final .Engineer's report. Councilman Mark Salvaggio has requested information regarding the Hosking Sewer Trunk Line Assessment District (AD 91-1 }. A constituent of his - a Mrs. Gibbs -called with some concerns about her assessment and- how it compared to her neighbors, and also how to "get out" of paying the assessment. Once an assessment district is in place, the only way to "get out" of paying the assessment is to pay it off completely. Otherwise, the annual assessment is placed upon the property tax to pay the debt service for the bonds. When the district was formed, the property owners were given the opportunity to pay off the assessment before a lien was placed on the property. This payoff is calculated before the additional bonding costs are added and .can be substantially lower the amount of the lien. In this case, the property owners at that time (William J. & Rita J. Judge} chose not to pay off the assessment, and a lien in the approximate amount of $41,604.85 was placed on the property. The annual assessment for this property, now owned by Mrs. Gibbs, is about $4,015.00. If Mrs. Gibbs wishes to pay off her assessment, the amount due would be $15, 032.80. The neighboring property that she is concerned about would be lots 18,19 and 21 as shown on the attached map.
