A RESOLUTION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD GRANTING
SETTLEMENT AUTHORITY OF THE CITY
ATTORNEY, NOT TO EXCEED $25,000.
WHEREAS, California Government Code Section 935.4 provides that a public entity
may authorize its employees to allow, compromise or settle liability claims against the
entity in amounts not to exceed Fifty Thousand Dollars ($50,000) per claim; and
WHEREAS, department heads for the City of Bakersfield may execute contracts,
by ordinance, up to Twenty-Five Thousand Dollars ($25,000) without submitting said
contracts to the City Council for approval; and
WHEREAS, the settlement authority for the City Attorney has not been adjusted
since May 17, 1989; and
WHEREAS, the office of Risk Management for the City of Bakersfield handles
liability claims against the City prior to the service of a summons and complaint; and
WHEREAS, the effective administration of a self-insurance program necessitates
the reliance upon the office of the C ty Attorney and the office of Risk Management for
disposition of liability claims, and potential claims, against the City.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. Prior to the service of a summons and complaint, the office of Risk
Management is hereby authorized to settle liability claims in an amount not to exceed Ten
Thousand Dollars ($10,000).
2. The office of the City Attorney is hereby authorized to settle liability claims,
and potential claims, in an amount not to exceed Twenty-Five Thousand Dollars ($25,000).
3. Any liability claim, or potential claim, which exceeds Twenty-Five Thousand
Dollars ($25,000) may only be settled after receiving authorization from the City Council
of the City of Bakersfield.
